In past cases involving shootings, police have argued that some people use the police to end their lives in so-called “suicide by cop” cases. Now, a defendant is claiming that another man wanted to be shot when he tried to engage in gay sex — what his defense attorney called “suicide by rape.” Eric Miller is accused of shooting and killing Jamie Brucker, 29, after Brucker allegedly came on to him. This follows the prior novel defense to a gay hate crime where one of the defendants claimed that he was also gay and thus could not have committed the hate crime.
