If I were the prosecutor looking into this matter, I'd still go after these school officials for destroying evidence in a criminal investigation. Even school officials, like the the CIA interrogators, know, it is a CRIME to torture people! Which is why they destroyed the tapes in the first place. It was done specifically to AVOID criminal prosecution. I think they should be prosecuted anyway.
