Putting the Bars Back Into Bar Mitzvah: Rabbi Accused of Throwing Lavish Party in the Tombs

180px-Prison_cellThe New York prison system is dealing with a bizarre scandal after the media revealed taht an inmate at “the Tombs” in Manhattan was given an elaborate bar mitzvah party for 60 people with catered food, an Orthodox singer, and 60 guests. The party was thrown by Tuvia Stern, a bail jumper and scam artist who pleaded guilty to grand larceny after victims alleged he stole $1.7 million. The bar mitzvah was for his son.

Two Former West Palm Beach Officers Indicted After Beating Handcuffed Suspect

Two former West Palm Beach police officers have been arrested in the beating a handcuffed robbery suspect, Pablo Valenzuela, 43, as captured on this dash cam video from May 2008. Louis Joseph Schwartz, 30, and Kurt John Graham, 24, were fired last August and are now facing felony conspiracy to commit official misconduct and misdemeanor battery.

From Paine to Pappert: Citizen Arrested for Complaining Too Often to City Officials

200px-Thomas_PaineIn a bizarre case, Bridgeville Borough resident has been convicted for repeatedly writing and calling his elected officials to complain about their lack of effort to relieve a local nuisance. If you count copies sent to some officers, Marshall Pappert sent around 350 and was arrested for criminal harassment. It is a good thing that Bridgeville prosecutors and courts did not exist when Thomas Paine was doing his incessant complaining about his government.

Meaning of Empathy: Sotomayor Refused to Consider Appeal of Man Based on Technicality — Man Later Found Innocent Based on DNA

200px-Sonia_SotomayorCivil libertarians have been complaining that many liberals are ignoring that Judge Sonia Sotomayor has been viewed as hostile to core liberal values and has a fairly conservative voting record in many areas, including free speech, student rights, and criminal procedure. For a review of her cases, click here. Another case has come to light that shows little of the empathy cited by the White House. While Vice President Joe Biden has emphasized the Sotomayor “watches the back of police” in cases (which is supported in some of her more controversial rulings), she has shown little empathy for those challenging police or convictions. The case of Jeffrey Deskovic is being cited as one such case.

Indian Colleges to Expel Any Women Wearing Jeans or Shorts — In Order to Protect Them

190px-Denimjeans2Colleges in the Indian state of Uttar Pradesh have a novel way to protecting women from sexual harassment. Officials announced that any female students wearing jeans, shorts, minishirts, or tight blouses will be expelled because men are harassing them. This falls into the category of destroying a village to save it. Rather than expelled men who harass women, the schools are cracking down on the victims.

New York Times: Sotomayor Called Herself an “Affirmative Action Baby”

The comments have heightened criticism of her vote in the New Haven firefighters case where she supported the throwing out of promotion results because whites and Hispanics scored better than blacks.

The Meaning of Empathy: Biden Tells Police Organization that Sotomayor “Gets It” and “Has Your Back”

Bush and has voted against free speech, student rights, and other cases with important liberal causes. As I have discussed in my review of her cases and criticism of past commentary of this nomination, liberals will lose ground on the Court if Sotomayor votes as a justice the way she voted as a judge. One of those areas is police abuse where Sotomayor has been criticized for siding with police in cases with strong evidence of abuse. Now, Vice President Joe Biden has drawn attention to the later cases by assuring a police organization that Sotomayor is pro-police and will watch their back when cases come before the Supreme Court.

Fox News Reporter Chases Down Story in New York

When told that the driver was a reporter, Dooda joked that he must work for Fox News. He was right, though Broderick says that Dooba is a “vigilante.”

Professor Settles Lawsuit With City Over Arrest For Taking Pictures of Power Lines

pearlpUniversity of Washington Professor Shirley Scheier has settled the lawsuit over her arrest by the City of Snohomish for taking pictures of power lines. The American Civil Liberties Union represented her and settled for $8000. The settlement is disappointing and disturbing given the small damages and lack of deterrent effect for the city.

Burn Baby (Be-Bop) Burn: Christian Group Files to Seek Right to Burn Book

n26785The Christian Civil Liberties Union (CCLU) has selected a curious place to put together an old-fashioned book burning: a court. In West Bend, Wisconsin, Christians are upset over a book called Baby Be-Bop and other books contained in the “Young Adult” material that they say are sexually explicit and inappropriate. In a 9-0 vote, the library trustees refused their demands to remove or restrict the material at the West Bend Community Memorial Library.

Benjmain violated the constitution by sitting on a case involving the major donor in his campaign, A.T. Massey’s chief executive, Don Blankenship.

Defense Shocked: Court Rules Police Can Use Taser to Collect DNA Sample

180px-Taser-x26In New York, Niagara County Court Judge Sara Sheldon Sperrazza has issued a controversial ruling that police can taser a suspect who refuses to voluntarily submit a DNA sample. In this case, Ryan S. Smith sought to suppress DNA evidence that linked him to two crimes because of the use of the force against him. When told of a court order to obtain a second sample for DNA testing, Smith reportedly stated “You are gonna have to Taser me if you want my DNA.” That apparently sounded like a pretty good idea to the officers in the room.

Justice Department Found to Have (Again) Withheld Evidence and Invalidating Convictions Through Prosecutorial Misconduct

kott-dskohring-dsThe Justice Department has again conceded to acts of prosecutorial misconduct that will result in the release of two politicians from jail in Alaska. In a case with obvious similarities to the botched case of former Sen. Ted. Stevens of Alaska, former Representatives Pete Kott and Vic Kohring will likely be released soon after the Justice Department admitted that it withheld evidence that should have been turned over to the defense. What is most striking is that the same prosecutors were involved in both the cases of Stevens and these state legislators.

Live Free or Die: New Hampshire Becomes Sixth State To Recognize Same-Sex Marriages

The New Hampshire legislature has voted to recognize same-sex marriage joining five other states with such recognition in a continuing and encouraging trend among the states. Gov. John Lynch signed the bill soon after it was passed by the legislature. The question now is whether religious conservatives will try to stop states from determining their own matrimonial laws by passing a federal constitutional amendment.

Texas Police Officer Tasers 72-Year-Old Grandmother Who Refused to Sign a Speeding Ticket

RichardMcCainConstable Richard McCain insists that a grandmother deserved to be tasered in a recent roadside incident to protect himself from a violent attack. The suspect was Kathryn Winkfein, a 72-year-old grandmother, who had refused to sign a traffic ticket. Deputy Chris Bieze tasered Winkfein after she allegedly became belligerent.

Federal Judge Tosses Out Unlawful Surveillance Cases

gavel2The Obama Administration succeeded yesterday in getting three dozen public interest lawsuits dismissed against telecommunication companies. President Obama voted for the bill that gave the companies immunity and sought to prevent a court from declaring the warrantless surveillance program illegal. U.S. District Court Judge Vaughn Walker also ordered investigations in Maine, New Jersey, Connecticut, Vermont and Missouri to be halted. However, he retained the issue of whether to sanction the Justice Department for its conduct in the case.

J.D. Salinger Files To Block Publication of Sequel to Catcher in the Rye

200px-Rye_catcherThe reclusive author J.D. Salinger (a personal favorite) was seen this week — at least in court papers. Salinger broke from his self-imposed seclusion to file an interesting lawsuit to block a novel based on Holden Caulfield, the hero from “The Catcher in the Rye.” The book, entitled “60 Years Later: Coming Through the Rye,” is written by an author calling himself J.D. California and published by a Swedish company. It features Caulfield as an old man. The defendants include Swedish publisher Nicotext; its offshoot, Windupbird Publishing Ltd.; and California-based SCB Distributors as defendants.

Marine Recuiter Accused of Pimping 14-Year-Old Girl With Two Potential Recruits

150px-USMC_logo.svgPolice in Hemet, California are dealing with a bizarre criminal case after a Marine recruiter was charged with pimping a 14-year-old girl with potential recruits. Staff Sgt. Bryan Damone Cunningham was allegedly caught in a car with two such prospective recruits and police are investigating whether he used the girl as part of his recruitment efforts.

Seventh Circuit, Sotomayor, and the Second Amendment: Conservative Icons Easterbrook and Posner Support Sotomayor’s View of Right to Bear Arms

easterbrook200px-Sonia_SotomayorposnerThe United States Court of Appeals for the Seventh Circuit has handed down a decision that could play a role in the Sotomayor confirmation process. In National Rifle Association v. Chicago, the Seventh Circuit upheld a Chicago ordinance banning handguns and automatic weapons within city limits. In so doing, it held that the individual right to bear arms is not a fundamental right applicable to the states. It is precisely the hypothetical that some of us discussed in the wake of the Supreme Court’s decision in District of Columbia v. Heller, which recognized an individual right to bear arms in the Second Amendment. It also supports the view of Judge Sonia Sotomayor, who has been criticized for two opinions (including one after the Heller decision) that rejected the right to bear arms as a fundamental right. Sotomayor received indirect support from two unlikely sources: conservative icons Frank Easterbrook and Richard Posner.

Former Connecticut Lawyer Elizabeth Zembko Arrested For Shoplifting and Burglary

250px-Hinged_Handcuffs_Rear_Back_To_BackFormer Connecticut lawyer Elizabeth Zembko, 48, achieved notoriety a few years ago when she was convicted of stealing half a million dollars from her former law firm and elderly clients to pay for shopping sprees. It appears that the shopping bug is not quite out of her system. After serving 15 months, she was re-arrested for shoplifting and burglary in two different incidents.

Judge Kent Resigns On Eve of Impeachment Hearing — Effective One Year From Now

Kent has decided to turn in this resignation to President Barack Obama. His lawyer Dick DeGuerin says that the hearings are now unnecessary and Judge Kent will not participate. Cheney: Gays Should Be Able To Marry

North Carolina Judge Reprimanded for Facebook “Friend” and Googling Information on Litigant

gavel2There is an interesting case of judicial ethics out of North Carolina where District Court Judge B. Carlton Terry Jr. was given a public reprimand for becoming “friends” on Facebook with the attorney for the defendant, Charles A. Shieck, in a child custody disputes. Terry was also reprimanded for not just posting statements about the case but googling the plaintiff in the case (and referencing what he had found).

British High Court: Pringles are Potato Chips

Police Arrest Alleged Killer of Dr. George Tiller

George_Tiller_croppedA Kansas man, Scott Roeder, has been arrested for the murder of Dr. George Tiller (left), 67, who was shot while serving as an usher at his Wichita church Sunday morning. Tiller was one of the few U.S. doctors performing late-term abortions in the country and had previously survived a 1993 shooting outside of his clinic when he was shot in both arms. I discussed this case on this segment of Rachel Maddow Show.

Golden Child Goes Grunge

osel01There is another “gilded cage” story out of Tibet. This week, many people are talking about a Malaysian princess who fled a seemingly story tale life with a Royal family after alleged torture and abuse. Now, ,Tibetans are dealing with the flight of a man once worshiped as a God. Osel Hita Torres, 23, was selected by monks at five month old as the reincarnation of the recently deceased Lama Yeshe. At 14 months, he was taken from his parents and declared Lama Tenzin Osel Rinpoche. He fled and is now a film student in Spain who has denounced his treatment and stolen childhood. He can now be seen in his fully human glory in baggy pants, long hair, and loving life.

Gilded Cage: Malaysian Royal Family Accused of Drugging and Torturing Princess

100px-KelantanWith the world still talking about UAE Crown Prince Sheik Issa bin Zayed al Nahyan and is torture videos, another royal family has been accused of torture and abuses. Teenage model Manohara Odelia Pinot was only 16 when she was married to Tengku Temenggong Muhammad Fakhry, a prince of Malaysia’s Kelantan State. While in Singapore, she was able to escape with the help of police and tell an incredible story of being drugged, tortured, and confined by the family.
