Ah but there is no absolute right to privacy or marriage, unless we take Harry at his words and invent that right which we so dearly take to heart. 

I believe that unmarried/married/ people can have consensual whatever and still be protected I found this in my google search which is pretty fair in synopsis of the constitution and the right to privacy:
