A Nasty Drag in Niceville: Electronic Cigarette Reportedly Explodes In Mouth Of Florida Man

There is an interesting product liability case in the making in Niceville, Florida where Tom Holloway, 57, reportedly had his teeth blown out when his electronic cigarette exploded. He also lost part of his tongue and suffered burns on this face. It is not known which brand was allegedly informed in the explosion.

If these accounts are true, a products liability action would seem likely, though it is not clear whether this is a manufacturing defect or a design defect. Certainly this would be more dangerous than the expectation of the ordinary consumer under the Restatement Second test (402A). Most people do not expect to have their teeth blown out with a smoke. However, with an estimated 2.5 million people now use electronic cigarettes, one would have expected to hear about any common side effect involving human combustion. That would suggest a manufacturing defect.

Whatever the claim, the comments of officials are not helping this company. Joseph Parker, division chief for the North Bay Fire Department, volunteered “[t]he best analogy is like it was trying to hold a bottle rocket in your mouth when it went off. The battery flew out of the tube and set the closet on fire.”

E-cigarettes heat liquid nicotine rather than using tobacco and are billed as healthier alternatives for smokers. That is, healthier up to the point that your teeth are allegedly blown out.

  1. Since the public became aware about the dangers of smoking a couple of decades back, many individuals have found stopping the tobacco practice hard. Brands have actually been innovating and manufacturing smoking cessation products for many years now. From nicotine patches to gum, nicotine abusers have actually been utilizing them to quit their practice.Electronic cigarettes (additionally known as e-cigarettes and electric cigarettes) are the newest product on the marketplace. They are made to look and feel like real cigarettes, even to giving off synthetic smoke nonetheless they do not actually include any tobacco. Users inhale nicotine vapor which looks like smoke without any of the carcinogens found in tobacco smoke which are unsafe to the smoker and others around him.’

  2. This is the suitable blog for anybody who wants to search out out about this topic. You realize a lot its virtually exhausting to argue with you (not that I actually would needHaHa). You positively put a brand new spin on a topic thats been written about for years. Nice stuff, simply great!

  3. @Artiewhitefox Is this really one of the craziest things you have ever read? Wow! Well let me tell you that one of the craziest things I’ve ever read is your random comments about “how zoosexuals (animal sexual abusers) are gods gift to earth” Call me crazy if you will but for me that’s the craziest shit I have heard in my life.

  4. Unfortunately, the man was using a LEA electronic smoking device with a modified battery so he would have more power going to the atomizer, thus creating more e smoke. It’s too bad an incident like this overshadows the good effects for millions who have switched to e cigarettes and quit smoking tobacco.

  5. I have heard of them…I think I even puffed on one once. I have since quit smoking.

  6. I just saw “The Tourist” and Johnny Depp’s character had one of those. Before that, I never knew such a thing existed.

  7. I came a hairs breathe to becoming a smoker myself when I was about 11. Out of curiosity i took one drag. After a time I asked for a second, and he said no. After that day, I never saw him again.
I am glad I pleased you with what I wrote =^_^=

  8. Holy Cow! That was one hot cigarette! I guess if you think that a cigarette with a battery in it is any better than lighting a leaf on fire and putting it in your mouth, maybe there is some contributory negligence afoot.

  9. There are many reason why this may have happened, so I don’t think people should just jump to conclusions and say ‘Oh e-cigs are rubbish, smoking is obviously safer’. As far as I am aware, this has not happened before, this would therefore suggest that one specific brand has made a product not suitable for use, NOT that all e-cigs are potentially lethal.

Although there is no guarantee that it is the manufacturers fault either….I mean had the product been tampered with or altered in any way by the user? Has anyone stopped to ask this question yet? Messing with the current and flow of an electronic device isn’t a wise thing to do unless you’re an expert in the technicalities of it all, and I know from seeing Forums on e-cigs that many users do tamper and ‘develop’ the products they purchase.

See? We don’t have the answers yet and so we shouldn’t assume and brandish unsubstantiated allegations against a whole industry.

I do agree this is a sad situation, and I do feel bad for the guy, however until he is stable, able to answer questions, and the report released, there is no point just mouthing off.

    That’s my point of view!

  10. No sympathy from this corner, though I was once a nicotine junkie myself. Darn few smokers were forced to do it, and unless they lived in a cave, can now claim ignorance of the dangers.
And “Fire In The Hole?” Ironically hilarious.

  11. Smoke em if ya gottem. So sayeth John Wayne, who was paid by the tobacco companies to do so, to his platoon in the jungles of Vietnam after their hike. Of course the Viet Cong smelled the smoke and came and shot them up. John Wayne died of lung related smoking illnesses.

  12. Tort deform…..Two word….. Corporation Profits….Shareholder Equity…..Consumer Screwed….

  13. O.O. This is one of the most insanely crazy things I have ever heard of. It makes you think that smoking is not so bad after all. I have to conclude that the ones who made that contraption owes him a set of teeth. What else am I to think?
And to think no one said, FIRE IN THE HOLE.
