I am not sure how my testimony went over with the Senators, but I am claiming the support of one familiar face. I found George waiting for me outside of the Dirksen Senate Office Building after the hearing. As a GW professor, this can only be viewed as a good omen. He no doubt wanted to remind the Congress that GW (as opposed to that other local institution) is the only school that was founded on a charter paid for by our first president. George made no comment on the Administrative State but his appearance (in my view) spoke volumes. Sure, Bernie Sanders has that bird that landed on the podium, but I had the ultimate Founding Father appear after testifying on the need to remain faithful to their original constitutional design.
By the way, he leaned away when I whispered that I was a Cubs fan. However, his response was still far better than that of Mr. Lincoln on an earlier encounter.
I am not sure if George felt compelled to appear because of my call for nonpartisan reform or my warning about the dangerous rise of a fourth branch in our tripartite system. However, I submit that the message could not be more clear (whatever that message might be). I can only feel sympathy for my friends on the Duke faculty (who can only hope for a chaining smoking James Duke) or the Stanford faculty (who must wait for their railroading Leland Stanford) to appear as moral support. We have our first president and his namesake university, by George.
Are you thinking bernies bird had a brain? One was happenstance another a human in a costume. Plus “cubs” is a deep breath word….if any ‘bad breath’ came of that – you should go to the doctor to make sure you don’t have a lung infection. You’re the one looking for signs …so go deeper. All “kidding” you aside. You might not make our currency….but your role today probably matters. Some days i see you on cspan and think to my self….ok i confess i say it outloud….”he looks like he hasn’t slept in a week”. While most ppl do bread and ciruses you at least look like you care. My American political idols are Reconstruction Era Republicans who pushed for the 13th, 14th and 15th Amendments. The “original Framers” back in the days of George Washington was mostly slave owners and all accepted the notion and political acceptance of slavery. Sorry George– you are not on my list.

President Washington shared some clairvoyant insight concerning political parties during his farewell address: reading in pertinent part:
“… The disorders and miseries which result gradually incline the minds of men to seek security and repose in the absolute power of an individual; and sooner or later the chief of some prevailing faction, more able or more fortunate than his competitors, turns this disposition to the purposes of his own elevation, on the ruins of public liberty.
Without looking forward to an extremity of this kind (which nevertheless ought not to be entirely out of sight), the common and continual mischiefs of the spirit of party are sufficient to make it the interest and duty of a wise people to discourage and restrain it.
It serves always to distract the public councils and enfeeble the public administration. It agitates the community with ill-founded jealousies and false alarms, kindles the animosity of one part against another, foments occasionally riot and insurrection. It opens the door to foreign influence and corruption, which finds a facilitated access to the government itself through the channels of party passions. Thus the policy and the will of one country are subjected to the policy and will of another.”
On a related note. I recommend that any student who wishes to be a lawyer consider the various law schools in Washington DC. You get the neighborhood of the nation’s capital and all the smart folks who teach in those schools. You can go to oral arguments in the Supreme Court after your Con Law Class lets out in the morning.
I liked the address to Congress by JT, printed in the previous article, and hope that Congress can put some limits on the executive agency powers. Although the Framers conceived a three part system this Fourth Branch is indeed independent of the President and his Cabinet and each department exudes its own strength.
My complaint about the current state of affairs is: too much Fourth Branch legislation and secondly, lame duck Legislative Branch. Congress is like a Missouri Mule crippled and reliant on three hoofs not four. Sometimes Congress sits on its ass. No mule pun intended.

LOL! The hapless Brewers started the racing mascots w/ the sausages. in case you are not a baseball fan, The Washington Nationals MLB team has the racing Presidents. The Pirates the racing pierogi. One of the first times the Brewers brought out the racing sausages it was in their old ballpark and the Yanks were in town. My son and I were sitting down near the photographer well. The sausages came out of the gate in left field and were lining up to race. A photographer from the NY Post looked @ me w/ wonderment. I explained the different types of sausages and that they were going to race in a moment. He started shooting and laughing his butt off as he did.
