It is not clear what is worse for Kenneth Simmons, 26 — being arrested for an array of serious crimes or helpfully dropping his pay stub during a police chase to guarantee his identification regardless of whether he escaped.
Police were looking for a suspect in a stabbing in Syracuse when a helicopter spotted a possible match going into a corner store. Officers asked Simmons to come over to speak with him and he took off. During the subsequent chase, police saw him reach into his waistband and throw a silver semi-automatic Raven Arms .25-caliber handgun. When it was recovered, it was found to be loaded with the safety off. Simmons then dropped the pay stub with his name on it near the handgun.
He is now charged with criminal possession of a firearm, second and third-degree criminal possession of a weapon, and unlawful possession of marijuana . . . and being really really dumb.

The gun aficionados I communicate with in fora like this say the definition of a semi-automatic is that it requires a pull of the trigger for each shot. What’s automated is the loading.

In New York, the use of grand juries is bog standard and it’s modal to issue an indictment for the moon and then for every lesser-included-offense. This will be bargained down. I recall a case in a town 40 miles outside Syracuse where the defendant got slapped with a 13 or 14 count indictment for a car accident in which four people were killed (three counts for each death +DUI + reckless endangerment). It was bargained down to a single count of criminally negligent homicide.

The law refers to this as Thaumatological Imitative Reduxion. There is probably a law review article on this somewhere.
