Gun In Charlotte Shooting Reportedly Was Stolen and Scott Had A Violent History

gun-use_20160924224445060_6155669_ver1-0_1280_720 The controversy over the death of Keith Lamont Scott continues to get more complicated. While the family insisted that Scott was unarmed, that now appears false. Not only was a gun found at the scene but it reportedly had his DNA and fingerprints on it. Now, reports now indicate that Scott’s gun was stolen and bought illegally from the thief. In the meantime, however, protesters are now calling for the resignation of the mayor and the police chief in Charlotte.

After the family was confronted with the pictures of the gun, they insisted that Scott did not own a gun.

imagesThe gun was stolen in a burglary and the thief reportedly said that he sold the gun to Scott.

Moreover, it is now being reported that Scott was convicted of aggravated assault with a deadly weapon in 2005. He shot and injured a man in San Antonio, Texas after firing more than 10 rounds from a 9-millimeter pistol. In addition, in October 2015, Scott’s wife, Rakeyia, filed for a restraining order against him and stated in her petition that he was a threat he carried a 9-millimeter gun. He also reportedly threatened to kill the family.
As I have indicated in past coverage, the police have a strong presumption in their favor given the existing facts. If Scott was armed and clearly refused to comply with police orders, he could be seen as a sufficient threat for the use of lethal force under Tennessee v. Garner. The contradictions over Scott’s owning a weapon and his possession of the gun at the shooting strengthen the case for the police and, assuming these facts remain uncontroverted, would weaken any potential criminal prosecution.

  1. OK so the cops had a few days to get their lies together, what else is new. I guess all these black guys have just started resisting and the cops have just started killing them for doing so, what a joke. However, some of you morons will believe this is so, why don’t you have a make-up artist make you up as a black guy for a day and see what happens.Go ahead vote for Trump and see what happens, he is for rich whites not for you poor white slobs your dumb ass is in the same boat with everyone else.

  2. James Brock, a thirty-year-old, UNARMED volunteer firefighter was able to take down the school shooter at Townville Elementary School yesterday with no one being further injured.
    Smoke that.

  3. Po- Since you and some others already “know” what happened in this case, I won’t bother following the results of the investigations of the Charlotte shooting.
    C. one week after this shooting, your own “objective investigation” has done away with the need for any further review of this case.

    1. Tom, by your taking sides on this issue, based on unclear evidence or non-supported evidence, you, friend, are claiming to know what happened.
      Do you?

  4. I won’t try to emulate Po the Parrot by reposting it in boldface type, but the comment by Darren Smith toward the beginning of this thread ( Sept .28, 3:06 AM) is worth re-reading.

    1. Po the parrot…nice I like it!

I agree with you, Tom, and with Darren, the cops should have ascertained the facts before murdering a man guilty of absolutely nothing, which obviously leads to, and it should, unrest!

  5. Just to make sure we don’t miss phillyT’s insightful comment, let me repost it:
Some of yous ought to shut up and meditate on it a lil bit!
Meanwhile, when it is your turn to go through the wringing, and trust me, it starts with the weakest members of society but ALWAYS affects everyone, ultimately, don’;t come crying to us.

“Just do what they say and you won’t get hurt” is something you say to a hostage.

Not a free citizen in the USA.

Show me the video where he points the gun at one of the cops and I’ll make a public apology. Until then, it’s just more cops out of control and living in a perpetual state of terror.

Not every one has the temperament to be a cop. If you’re that afraid all the time, go be a mall security guard.

    1. No, PO, it was NOT an insightful comment. It was a stupid, dumb emotion-filled statement that has no basis in Reality. Which is pretty common for PhilaT.

Assume for a moment, that you are a gun owner. You are sitting in your recliner, watching Al Jazeera, with your AK-47 beside you. Several homes in your neighborhood have recently been invaded and the residents therein shot. A man breaks into your home, brandishing “The Judge.” Which is a big pistol that has shotgun bullets in it, I think.

      Do you:

      1. Say: “Drop the gun! Just do what I say, and you won’t get hurt!”

      2. Say: “Pardon me, Sir, but you are frightening me with your huge weapon.”

      3. Grab your “sweet sweeper” and blow the SOB away!

Regardless, of your choice, do you really think if you choose Option No. 1, that you have made the Home Invader into a hostage?

No platitudes, please. If I want platitudes, I will just read me some Kahlil Gibran.

      Thanks!

      1. Your example has nothing whatsoever to do with the situation. You just made up a little fantasy scenario to be as scary as you could come up with and with no solution except the one you want to prove your point.

There were multiple cops on the scene. All armed. All wearing vests. All supposedly highly trained (although in most states it takes more training to be a barber than a cop). This guy didn’t break into their home. There is no evidence he pointed a gun at anyone. He apparently didn’t fire a shot.

I just heard the police in Rancho Cordova CA just shot a man who was recording them with a cell phone from inside his own garage.

Because they feared for their lives.

Well Jesus H Christ, if you spend that much time in fear for your life, you have a giant problem and should never ever ever be in law enforcement.

Police in other countries don’t just go around murdering citizens.

      2. Squeek, I was about to point your fallacious equivalency, then noticed phillyT handled it better than i could, so here it is again:

  6. I doubt the actual facts will get much legs in the media.

What was it Winston Churchill said? “A lie will get halfway around the world before the truth even gets its pants on.”

The media perpetuated the story that it was a book. So a lot of people think it was a really, really nice guy shot while holding a book, which was probably a Bible, while he waited for his kids. And, sure the cop who shot him was black, but people will still think it was racist and won’t bother to investigate the facts for themselves. Even Hillary Clinton used this shooting a reason why she needs to “talk with white people”. That “this isn’t who we are.” Even though there were no white people involved.

If it doesn’t fit with the meme, it doesn’t get discussed.

I have been so frustrated with the extreme Left’s erosion of racial accord. They are fanning the flames of hatred against the police, convincing gullible people that it is the cops who are their biggest threat, when it’s really the criminals on the corner. Concerned moms beg the cops to actively police; crime goes down. Liberals (like HRC in her debate) call for reforming the police, they back down in places like Baltimore, and homicides go up 300%. They release prisoners early in CA, and auto thefts go up over 400% in some cities. Please, for the love of all things holy, Liberals stop helping us! The results are often disastrous to the parties they proclaim to help, but when people fail to research results, they are blissfully unaware of that fact, and keep voting for their own demise. Every once in a while, we get a story of legitimate police misconduct. But almost all of the cache popular crisis turn out to be completely untrue. (“Hands Up! Don’t Shoot!”, Trayvon Martin was just walking down the street with a bag of skittles when a bad man shot him while running away, etc.)

And, can someone please explain to people to comply with the police, and save their complaints for an IA later? No cop in the history of time ever decided not to arrest you because you spewed really creative curses or merely refused to comply. But it has become a badge of honor to show your machismo by fighting and cursing at cops. Even women and kids do it now. It’s like Jerry Springer out there.

  7. Gun In Charlotte Shooting Reportedly Was Stolen and Scott Had A Violent History

Have any witnesses, other than Charlotte PD, come forward and claimed to have seen a gun?

All video of this fatal encounter that has been released to the public is inconclusive.

There are innumerable instances where a suspect is in a fetal position prone on the ground surrounded by numerous police officers who are flailing away with batons, fists and feet while shouting — “stop resisting”.

Just because a police officer claims something does not make it so.

    https://www.youtube.com/watch?v=VbojhwStGq4

Many cops are trained to yell “stop resisting” as a pretext to justify using force and violence when arresting a suspect. In this video, a former police officer — now a California criminal defense attorney — explains. ~ Michael Scafiddi

Are police in Charlotte (etal) trained to shout “drop the gun” (even if there are no weapons present) as a pretext to justify the use of deadly force?

    1. J H Kunstler, an elitist liberal type nailed the answer Monday, and stated what I have said for a long time:

The police insist that Mr. Scott was holding a gun. Why is The New York Times bent on ambiguating this story? The officer who shot Mr. Scott was black. The Charlotte police chief is black. Does the Times mean to say that they are incompetent, dishonest, and reckless? Does the Times seek to reinforce a popular notion that police in general, including black police and their supervisors, are determined to oppress black Americans generally? Does the Times wish to sow even more distrust and animosity between black America and the police?

It sure seems that way. And what is The New York Times’s interest in dragging out the supposed ambiguity of the Scott case? I shall tell you why: because yielding to the obvious truth in the matter would not support the election campaign meme that Black America requires the protection of the Democratic Party against genocidal police forces across the nation.

I can’t link you to the story because of the WordPress filter, sooo google, “J H Kunstler Trauma Programming” for the rest of it. Very well-written piece.

  8. “the police have a strong presumption in their favor given the existing facts” I don’t buy that. The video clearly shows that Scott was not aiming at or threatening any officer. Openly carrying a gun is perfectly legal in North Carolina. How can something perfectly legal be construed as a threat? And, of course, the police knew nothing whatsoever of Scott’s history at the time of the incident, so let’s lay that red herring aside.

    1. Carry is legal, your right and so is “leave the vehicle and drop the gun”? I have to guess after numerous commands to “leave the vehicle and drop the gun” that your next move is going to show me the latest dance step? It’s real simple comply.

The police hard already seen him rolling “blunt” and ignored it, then came the gun, that’s when they took steps to take legal action. He would have alive today he just got out of the vehicle on the first command and drop the weapon. Real easy.

PS: Whats your legal position on riot and looting?

      1. Please excuse my misspell and words missing, I’m trying to write to fast, sorry.

      2. None of that constitutes a death sentence.

And my personal opinion is that all those Penn State idiots who burned a police car and tore up the town after the pedophile enabler Paterno got sacked? They should have all been jailed.

        1. after the pedophile enabler Paterno got sacked?

Paterno forwarded what McQueary told him to the athletic director and the director of the campus police department. These higher ups then dropped the ball. Not seeing how Paterno counts as a ‘pedophile enabler’ for that.

      1. I don’t see where it says the police on the scene had ESP. Not one of them knew those facts at the time.

        1. It wasn’t ESP. The cops saw the gun. They had previously seen the pot. Drugs+gun = Bad Stuff, and time to talk the dude. But he don’t want to drop the gun. The same gun that his lying-a$$ wife was telling cops he didn’t have. Even though she knew about the gun when she filed for the Restraining Order. Hmmm. I wonder if the pot was causing her short memory problems.

Just admit the truth. The cops got another piece of crap off the street.

        2. Oxa-
As you said, there is no evidence that
the police on the scene had ESP.
There is plenty of evidence that many who have commented here DO have ESP.
They know what is in the yet-to-be-released videos.
They know how many witnesses were in the area, they know how many statements were given by these witnesses, and they know the contents of those statements.
Read some of these comments if you’re looking for examples of ESP.

  9. Well, well where is phillyT and his buddies. I recall only Friday he was calling the police “steroid freaks, need trading, ex high school football players, ex military. One of you morons suggested that they were all “hunters and fisherman” hence they were preditors. If I recall Pietro suggested cops should be killed. Where are you phillyT playing your clarinet or is it flute?

These rioters and looters just use these events to go shopping, most of the time they don’t even know the guy’s name. Lets see what the main stream left wing lib news agencies have to say. Police need more trading what a joke, I have been in countless inner city homes where there are kids with different fathers and the mother whacked on her ass with booze or drugs.

As far as Hilly goes I concede that she gets more points on the debate. Donald could have knocked the hades out her but he missed so many great opportunities to reveal who and what she is. Hopefully he will do better at the next debate. This once great nation is breaking down at the hands of the democrats. Maybe for the next debate she will bring more of these criminals families as she did at the democrat convention.

    1. Really? You think HRC won? I am a Jill Stein supporter so no irons in this fire, but I thought he did well. Showed more restraint than I expected given all the material he has to work with – but then if he had gone after her too much all the feminazis would have whined. Trump got 13 mil in contributions after the debate and tens of thousands turned out to see him in Florida.

      1. Autumn – I think Trump is one of those people you are afraid to say you are for, so you say you are for Hillary. However, his crowds are huge. Hillary’s are small. Milo keeps saying his crowds are 5x the size of Hillary’s and he does colleges. I think the difference is greater than the polls are showing.

        1. That’s an indicator that his supporters are more enthusiastic than hers, which may have some implication for turnout. The survey research still has it too close to call generally. Rothenberg has it that her position at the state level is deteriorating, but she’s still got 285 electoral votes. Given the slim difference nationally, that advantage could conceivably melt away with very small shifts in opinion.

Another interesting item: the Republicans have a terrible calendar this year, but the Democrats are still no better than 50-50 to take the Senate.

      2. I’m an Independent and I will vote for him, I just think he missed great opportunities. Hilly is vulnerable in so many areas. When hacking emails was the topic he could have reminded what Hilly did with 30,000 emails. When she talked about his father giving him money to start a business, he should have asked what businesses has she ever started. When she said he stiffed people, he should have said you’ve stiffed the American public for 25 years.

He has to stop opening his answers with how beautiful his properties are. He has to keep banging away at her.

      3. Me too, Autumn, a Jill Stein supporter, felt Trump stamped himself presidential that day. In this circus, he was the top ringmaster, controlled everything, including himself.

      4. I don’t think that Clinton trounced Trump in the debate.
I think she did a little bit better, and won by a technicality, but I thought he did reasonably well.
I think in fact that he didn’t take advantage of 1/2 of the things he could have raised there — I think that came about from his not practicing or rehearsing ahead of time as Hillary did.
I suspect he will correct these errors in the next two debates coming.
fyi, I am a Gary Johnson supporter, so I am not a Trump supporter either.

    2. I’m right here. Waiting for the video that shows they didn’t plant the gun, wipe his hands all over it and call it a day.

Besides, as far as I know, that’s an open carry state, so they had no cause to shoot to kill except that they are all scared, make that terrified.

If I’m wrong, I’ll say so. Unlike you Trump thugs who can’t help but double down.

Hillary cleaned his clock but good. She was prepared and he thought he could wing it. 51 interruptions in 90 minutes. Wrong! Wrong! Wrong! SNIFF!
Cocaine or amphetamines? I’ve heard it could be either, given his history.

I hear he wants to go after her for her husbands infidelity. That should be rich, considering he cheated on wife number one with wife number two. Cheated on number two with number three. Announced his se ins divorce in a news conference before he told his wife or children. Yes, he’s such a class act–five children by three wives.

She knows just how to rule up his thin-skinned narcissism and she’s going to kick his lard ass so bad next time I’d take even money he doesn’t show up at the last debate.

As for your vague insinuations about musical instruments, not sure what you’re getting at, but show up at my house and see what happens.

The cops should always be drug and alcohol tested, and their cars searched randomly for throw down weapons and other plant-able contraband. Until they are ALL on film ALL the time, I won’t take their word for anything.

I have nothing against good cops. I just don’t like the ones who get away with murder.

      1. I have nothing against good cops. I just don’t like the ones who get away with murder.

It’s blatantly obvious you loathe police officers, a juvenile and self-aggrandizing luxury available to people who will never be tested by serious disorder.

        1. It may be obvious to you, but you live in some kind of imaginary world in your head, so I’m not concerned about that.
I get along very well with the police. I have a good friend who’s retired FBI.

You can take me at my word, or insist on knowing what I think, who I am, what I REALLY MEAN, like so many of your deranged right wing comrades on the board. It just makes you look pathetic.

          1. phillyt Your argument always come down to name calling and labeling your like a broken record. Somewhere I think you wrote you worked in a physco ward or was that you were a resident in a physco ward?

            1. What name did I call you?

Why don’t you start by explaining your comment “Where are you phillyT playing your clarinet or is it flute?”

Tell me that wasn’t supposed to be an insult.

If you can’t take it, then stop trying to dish it out.

And the word is “psych” not physco, by the way.

      2. You obviously don’t understand the meaning of “open carry” vs brandishing or in NC “terrorizing”. For a very quick simple run down, you could read Andrew Branca’s recent explanation.
