TRUMP ACCUSES THE OBAMA ADMINISTRATION OF USING FISA TO WIRETAP TRUMP TOWER

donald_trump_president-elect_portrait_croppedPresident Donald Trump has again triggered a tsunami with a series of tweets.  Trump went to his favorite device to accuse his predecessor, Barack Obama, of wiretapping Trump Tower.  “Terrible! Just found out that Obama had my “wires tapped” in Trump Tower just before the victory.  Various news outlets have noted that Breitbart just ran a story on the use or attempted use of Foreign Intelligence Surveillance Act (FISA) to investigate connections to Russian banks.  The story was covering allegations voiced by radio host Mark Levin.

The first tweet stated “Nothing found. This is McCarthyism!” Trump threatened that  “I’d bet a good lawyer could make a great case out of the fact that President Obama was tapping my phones in October, just prior to Election!”

“Terrible!” Trump tweeted. “Just found out that Obama had my ‘wires tapped’ in Trump Tower before the victory. Nothing found. This is McCarthyism!”

I have previously stated that Trump’s use of twitter is not as shocking as many have suggested given the long-standing effort of presidents to use new technology to speak directly to the American people.  However, such communications should not take on the character of stream of conscious thoughts or issues that should be first fully examined by aides or counsel. It is also problematic for a president to discuss FISA targets which are highly classified.  Thus, it is a rather odd for a president to opine  “Is it legal for a sitting President to be “wire tapping” a race for president prior to an election? Turned down by court earlier. A NEW LOW!”

The President has access not just to Breitbart but classified evidence including any and all FISA applications.  (For full disclosure, I had occasion to go to the FISA court when I was an intern with the NSA and later became a critic of the court).  The problem with the President’s question is that the standards for FISA are so low and easily satisfied (with little judicial review) that it is difficult to establish any illegality under the law.

Passed in 1978 as a compromise with the Nixon Administration, FISA allows for “foreign intelligence” surveillance and was designed to evade the fourth amendment protections governing the use of warrants.  FISA surveillance is permitted based on a finding of probable cause that the surveillance target is a foreign power or an agent of a foreign power. That is manifestly different from probable cause to believe someone has committed a crime.   It is true that, if the target is a “U.S. person,” there must be probable cause to believe that the U.S. person’s activities may involve espionage or other similar conduct in violation of the criminal statutes of the United States.  However, citizens can be collateral to the primary target under FISA.

In 1994 Congress extended FISA further to allow for covert physical entries in connection with “security” investigations, and then in 1998, it was amended to permit pen/trap orders. It has been used to gather business records.

There is provisions stating that a U.S. person cannot be surveilled  “solely upon the basis of activities protected by the first amendment to the Constitution of the United States.” Thus, if Trump aides were targeted for political reasons, the surveillance would be unlawful even under the dubious protections of FISA.  There are also minimization provisions designed to excise collateral or protected communications.

Notably, the tweet is likely to take over this news cycle just as the Administration was about to release the long-delayed Executive Order on immigration.  As I previously discussed,  a senior aide is being quoted as saying that it will be delayed again to guarantee that the order “has its own moment.”  Of course, an executive order is not like some debutante that longs for its own moment like a coming out party at Mardi Gras.  It is intended to protect national security and the “moment” (according to the government’s own filing) has already passed.  However, whatever moment was being waited for, it may not come with this latest controversy.

I do consider the allegation of the prior Administration taping Trump Tower to be a matter of great concern but it depends on who was the target.  Watergate after all involved an illegal break in and completely unlawful use of surveillance targeting political opponents. If true, this was done through a legal process.  That does not make it right of course.  Trump is correct that, if true, this should be a matter for investigation.  The government should show considerable restraint in targeting political opponents. The Trump Tower was well-known to be the nerve center of the Trump campaign.  However, we still do not know how the surveillance was tailored, if it was requested or granted.

    How do you know Trump wasn’t wiretapped? Basically, we know from whistleblowers, that everyone is under surveillance. Wikileaks points out numerous instances of Obama tapping both foreign and domestic world leaders. Obama has tapped the phone lines of friends and family of reporters whom he also had tapped. Obama tapped and had killed via drone at least 3 US citizens. This it what it means to live under a surveillance state.

    As to a deep state attack. Many people have laid out very good evidence of this occurring, including Greenwald and others. The deep state is not so much attacking Trump as it is attacking our democracy. How can you not be concerned?

Documents leaked from the govt. by wikileaks and Snowden are original sources. Surely you have read at least some of them. I’m sorry their content does not concern you as a citizen because mass surveillance should concern everyone who values our Constitution.

        1. Mass surveillance has been a fact of life for a long time.

          Nothing new there. Start with cell radioi iphones especially those with GPS. They can be turned on by an exterior signal UNLESS the battery is out and if there is a camera it’s all open to copying. Locatioin and time at location etc. all available . funny thing is when the embedded microchip was proposed the uproar was tremendous but then everyone did it voluntarily and buy their own .

          The rules on broad cast or through the air is covered by a law in effect since the 1930’s That type of communication has been open to monitoring since those days and interfering with the signals audio or video etc. banned since then. Which means the neat little NASA (a company in England) device blocks all cell radio transmissions and reception in a 25 to 50 radius. ILLEGAL in the USA. No warrants are needed.

          Communication by wire or fiber optic does require warrant of some type. However very few converations can be made without being transmitted tower to tower or using satellites.AND no warrant is required if the signal originates in, transits, or ends having crossed an internatinal border incuding the legal altitude.

          There are warrants out that are used to sift for certain words and word combinations but even if they cheat which the new complex in Utah can do without detection it’s a case of getting the information and then not saying how it was acquired.

          Given the monumntal disinterest by the public you’ll have an easier time reinstating the Bill of Rights and civil rights or electing a Democrat than getting more than a ho hum on mass surveillance. Just don’t use words like bomb, explosives, assassination etc. etc.

          which brings me to the internet. Wide open. Very few wire to twire installations in existence.

          What helps is turning items off when not in use.For cell radio phones that means removing the battery just and using tracphones for starters and when you are done leave it on and toss it on an interstate truck or bus. . For most it’s not worth the effort. Since the other end of the conversation can be monitored.

          No need to be paranoid. You are being surveilled

  2. Wow. It must be freewheeling conspiracy night. Everyone needs to get a grip. Nobody bugged Trump. Therefore, there is no evidence to discover. He is not under attack by the “Deep State” or the Trilateral Commission or even the Knights of Columbus. He may be looking under his bed every night, but from the comments I’ve read, so are half the people on this thread.

    I don’t know whether this Presidency will survive an entire term, but if it doesn’t, Mr. Trump will have only himself to blame. In the meantime, I don’t plan on losing any sleep over it.

      Where’s the meat? Starting with that first line…..My computer routinely communicates with sources all over the world on daily financial information. So?

      1. There is no conspiracy and the world trade towers were not blown up by internal explosives HOWEVER there is valid doubt on the veracity of the Warren report based on factual evidence.

        To what end is unknown but no one can take an off the self POS Carcano bolt action and shoot three rounds in that time frame with that much accuracy. Therefore three rounds weren’t fired and one was an echo perhaps (conjecture) or three were fired but not by one shooter (conjecture) and certainly not by one who barely qualified at the lowest level required – marksman. That alone and the refusal to accept information for consideratin puts doubt on the Warren Report.

        i raise that just as a well known example of how important facts, thinking, and reason are including the Trade Tower situation.

        And all three examples at the level of who won the election. Last I looked it was 55% Trump 45% Clinton electoral vote count. NOTHING else matters. Everything else since is based on an inability to face reality.

            Barely qualifying in the Marine Corps didn’t make him a likely candidate for puliing off a mechanical/hand eye coordination miracle.

            The commission itself left too many stones unturned

            A lot of the rest such as coincidence of death of witnesses I don’t give much credence too. But tteir were a huge amount of coincidences.

            I’ll stick to facts of personal knowledge and testing.

    1. I always thought Obama politicized the DOJ. In so doing, he made the illegal investigation of James Rosen possible. Now we have the allegation that Obama’s DOJ requested surveillance on Trump. It shouldn’t be dismissed out of hand as some here have suggested. Let’s investigate it and I bet Lynch and Obama are at the bottom of it. Sadly James Comey might be a casualty of this political war.

    The media is rushing forward with all sorts of careful lawyerly denials of wiretapping from Obama’s people. The biggest one comes from James Clapper.

    Former Director of National Intelligence James Clapper on Sunday denied any suggestion that Trump Tower communications were wiretapped before the election.

    For the part of the national security apparatus that he oversaw, “there was no such wiretap activity mounted against the president, the president-elect at the time, or as a candidate, or against his campaign,” Clapper told Chuck Todd in an exclusive interview on Sunday’s “Meet The Press.”

    This carefully leaves out wiretaps of his associates. It also emphasizes Trump in the political sphere rather than the business or personal one.

    When Todd asked him whether he could confirm or deny if a FISA (Foreign Intelligence Surveillance Court Act) order for this existed, Clapper declared, “I can deny it.”

    Asked again whether there was a FISA Court order to monitor Trump Tower, Clapper said, “Not to my knowledge.”

    Clapper said that if any wiretap like that occurred, he would “certainly hope” that he would be aware of it.

    “I can’t speak for other authorized entities in the government or a state or local entity,” he added.

    So this is a very careful denial/non-denial. But here, as Andrew McCarthy laid out, is the key point about this. It was a request, not an order.

    In June, the Obama Justice Department submitted an application that apparently “named” Trump in addition to some of his associates. As I have stressed, it is unclear whether “named” in this context indicates that Trump himself was cited as a person the Justice Department was alleging was a Russian agent whom it wanted to surveil. It could instead mean that Trump’s name was merely mentioned in an application that sought to conduct surveillance on other alleged Russian agents. …

    In any event, the FISA court reportedly turned down the Obama Justice Department’s request, which is notable: The FISA court is notoriously solicitous of government requests to conduct national-security surveillance (although, as I’ve noted over the years, the claim by many that it is a rubber-stamp is overblown).

    Not taking no for an answer, the Obama Justice Department evidently returned to the FISA court in October 2016, the critical final weeks of the presidential campaign. This time, the Justice Department submitted a narrowly tailored application that did not mention Trump. The court apparently granted it, authorizing surveillance of some Trump associates.

    This was out there in mainstream media reporting.

    Clapper denies the order, but he doesn’t deny that a request was made. These are the same word games that we were getting from the Hillary campaign.

  6. I would not be one bit surprised if the Tower was bugged. I would also bet that Hillary Clinton and her Evil Minions had copies of Trump’s tax returns courtesy of their operatives in the government. Why would anyone ever doubt that all the spying and privacy rule-skirting is widespread?

          Mr. Dean lived it, in 1972-74. I remember the congressional impeachment hearings against Nixon. Nixon’s resignation came not from the impeachment hearings, but from the leaked documents of his tax returns of 1969 and 1970.

          FISA was the outcome of Nixon’s tyrannical behaviors during Watergate, as POTUS.

          If all you have are ad hominem attacks on me, Mr. Dean, and you believe the drivel pouring out of 45’s twitter feed then all I can say is – good grief.

Dean has contended for decades that he begged off knowing anything about Gordon Liddy’s activities at the beginning of 1972 and that he was guilty only of obstruction of justice re activities which occurred after 19 June 1972 (when he returned from a vacation abroad). Gordon Liddy, Gordon Strachan, and Jeb Magruder have all contradicted this contention. Liddy in particular has said they burgled the Watergate complex to garner information that Dean (and no other party) had specifically requested be located.

    1. John Dean was the counsel to the president from 1970 to 1973. Prior to that he was a third echelon official of the Department of Justice, reporting to Richard Kleindienst. Prior to that he was one of the minority staff counsel on the House Judiciary Committee. Prior to that, he was an associate at a communications law firm in Washington, a position from which he was fired for cause in February 1966, about a year after he’d been admitted to the bar. He had the most undistinguished legal career of anyone who has held the position of counsel to the president in the last 40-odd years, had by age 34 been dismissed from two jobs for misconduct, and has (per Gordon LIddy) been lying for 40 years about his precise role in the Watergate scandal (a contention re there is some evidence from other sources). He’s never worked in public relations at all, has no background whatsoever in electoral politics, and has never said much that was perspicacious. Exactly why is this of interest.

    2. As a former client of Prof. Turley in a lawsuit brought by a number of forcibly ‘retired” pilots, I have to admit that I am quite disappointed in the direction he has taken with this blog. I rather liked the old days here when real legal matters were the main point, and there were a lot of well informed, and reasoned guest writers. Most of those are gone now, and this is just a rightwing nut site. He doesn’t even clarify the ramifications of Trump’s accusations and only mentions the FISA courts and their lax standards. He even gives some credence to Trump’s accusation DESPITE the FACT that Trump has a long history of making such false statements. That means that Obama violated the law by ordering the DoJ to bug Trump’s phones, a criminal act by the way. That also means that Comey followed those orders which he knew to be illegal. Then it also means that if a warrant was granted, that the FBI had reason to think Trump and/or his staff were breaking US law. Yet nothing from the good Prof on all of these implications. Now we are finding out that this was just Trump being his normal lying self and we should move on! Incredible.

Well, Trump is now causing not only a vast bleed of taxpayer dollars to fund his weekend jaunts to Palm Beach with him now surpassing what Obama spent in ONE YEAR, he is also causing collateral damage with aviation schools and airports in the surrounding areas. They are now shut down completely because of the TFR during their most busy period on the weekends. At least there is some rough justice or karma since many if not most of those folks voted for our liar in chief. They got what they wished for! Too bad they did not think before they voted. I guess that all of our conservative folks here will help out their cause and their President by voting to upgrade Air Force One to make it more suitable for Trump by installing gold fixtures on board to make it equal to what his personal plane has. I also remember that when Obama took office, ALL of conservatives were blasting him for going to a Broadway show in NYC! Of course, spending more than Obama did in one year on such trips is perfectly OK for our LEADER of the FREE WORLD! Once again such silence shows the depths of their own corruption and lack of principle.

            1. Mayor Daley? He was a practitioner of conventional patron-client politics. He wasn’t much of a public speaker. James Michael Curley was given to a certain amount of ethnic demagogy. Daley’s approach to politics was attuned to the worldview and modes of association that urban wage-earners tended to have, so was ‘populist’ in that vague sense.
