Comedian Chelsea Handler Under Fire For Tweet On Arresting Racists

Handler tweeted “2 Chinese guys were arrested in Berlin for making nazi salutes,” Handler tweeted Sunday. “Wouldn’t it be nice 2 have laws here for people who think racism is funny?”

My first reaction was that it would be nice if we had one for people who think it is okay to use the number 2 rather than the word “to.” (Yes, even on Twitter)

My second response was that it was not clear if this was a joke. If so, Handler has not said it was meant as a joke.  If so, it was not very funny.  If it were not a joke, Handler is an example of how some are increasingly embracing the criminalization and regulation of speech.

We have previously discussed the alarming rollback on free speech rights in the West, particularly in France (here and here and here and here and here and here) and England (here and here and here and here and here and here and here and here and here and here and here). Much of this trend is tied to the expansion of hate speech and non-discrimination laws. Ironically, we have even seen comedians targeted with such court orders under this expanding and worrisome trend. (here and here).

What is also strange is that race is a common feature among comedians who often push the envelope of social commentary.  Bill Burr is a popular example.  Comedians have the most to lose from the trend of the criminalization of speech in the West.   Indeed, Mitchell and Webb made Nazis a common source of comedy, including a question censoring, a loving comedian might ask “are we the baddies”:

I’m impressed, adding that to my admiration for your even handed, sensible posts, clearly written, well reasoned, accessible and understandable, without a hint of dumbing things down, by lawyers and non lawyers alike. To my taste, Ms Handler is an excrescence one is better off not knowing. I get it that none of this is your point. But what’s life without the odd sidebar, even if very odd. 🙂

It has less to do with feminism than common sense and fairness. For millennia women in professions were looked down upon as pretend professionals becaus they weren’t men–who, of course, were the “real” professionals, so they devised words to make sure that everyone knew they whenn theynreferred to a woman they were not referring to a “real” professional. . It’s time people stopped denigrating women as “less than” the male standard. A doctor is a doctor, a lawyer is a lawyer, a comedian is a comedian.

  5. I wonder if a clear difference on the principle (not loopholes) could be established between a law banning the burning of the flag and a law banning racist speech? Why would one be OK and the other not? The answer would have to presuppose that both acts could be objectively determined for the only thing of interest would be, “the principle” of such a distinction, not legal gotchas or rhetoric too clever by half.

    1. Agreed. In principle, too. The law must define its terms in the narrowest manner possible. Such narrowly construed legal definitions cannot constrain ordinary vernacular speech without doing violence to The First Amendment. Conversely, ordinary vernacular usage of terms such as racism and hate cannot be inscribed in Law without putting the lion’s share of speech acts into legal jeopardy. Even such a relatively narrow definition of racism as “a belief in the superiority or supremacy of one race over another” would have to be connected to an underlying criminal act in order to avoid nullification of The First Amendment. Congress shall enact no laws respecting the policing of free thought.

  6. I watched her show a couple of times, but seemed to always being going downhill. And she did not appear to be sober. However, she should be the first to worry about speech codes. If you clean up her act, she will not have an act.

  7. JT mentions Bill Burr. I’ve been a fan for awhile. He is an intelligent, thought provoking, comedian. He pushes the envelope on many hot button issues. I saw him in concert last September in Madison. He talked some about the election, making it abundantly clear he liked neither of the mainstream candidates. But, Burr is no obsessed w/ politics like all the PC comics out there. Like all great comedians, the focus of his comedy is human nature and our struggles w/ it. Although Burr rarely mentions it, his wife, who helps him write his material, is black. And she obviously is not a PC person.

    I decided to focus my comment on a real comedian. Regarding the person highlighted in this post. I will take advantage of our 1st Amendment while it still exists and simply say she is an ignorant b!tch.

  10. I’ve never thought of Handler as a liberal. She is really an opportunist who will say just about anything to get attention. As to whether her suggestion is anti free speech, of course it is just like warning journalists to stop covering what the president says or jailing journalists or protesters. Free speech is the cornerstone of a democracy. The good thing about Handler is that she isn’t in government unlike say KellyAnne Conway, Donald Trump or some other anti free speech stars.

      1. Voltaire is still right; we ought to defend with our lives one another’s right to speak words that we’ve spent our whole lives opposing. There ought not to be any laws against hateful speech. The hate crime currently known as intimidation, formerly battery, involves an actual threat to do harm to someone. Intimidation is not ordinary, everyday distasteful speech. Criticism is the best and only permissible defense against hateful speech. Germany may be a special case, if the Nazi party is still outlawed there. Even so, they ought not to apply that law to foreign guests visiting Germany.
