Flipping Flynn: The Real and Imagined Damage For A Mueller Deal

Since the appointment of the Special Counsel in the Russian investigation, former National Security Adviser Michael Flynn has been the most obvious target for not simply a criminal charge but a possible prosecutorial deal.  The news that Flynn is no longer sharing information under the prior joint defense agreement with Trump figures could prove significant . . . or not.  Such a change would occur even with a non-cooperation plea agreement.  Nevertheless, it could be an effort of Flynn to strike a deal on a deal for himself and his son in exchange for cooperation.

While it did not attract the same attention, another notable development was the cooperation agreement reached with Reza Zarrab, a Turkish businessman accused of violating U.S. sanctions on Iran.  His cooperation could have magnified the pressure on Flynn, whose greatest exposure appears to be his Turkish as opposed to his Russian dealings.

News that former National Security Adviser Michael Flynn is talking to special counsel Robert Mueller has Trump critics virtually hyperventilating with excitement. Indeed, the prospect of flipping Flynn has led some to all but declare the end of the Trump administration as we know it.

Former Obama administration ethics chief Norman Eisen declared on Twitter, “BAD NEWS FOR TRUMP. Flynn may or may not have dirt on the Prez, but he surely will roll over on Kush, who will flip like a pancake on daddy-in-law’s [obstruction]. They are gonna have to start frisking Jared for a wire in the Oval.” He ominously noted about Mueller, “When I was at State & he was at FBI we worked together on an investigation, & he loves surprises. Kushner, Donnie Jr. and the rest of the Trump crime family better keep their overnight bags handy. Pack shoes with no laces guys.”

While this case may be endlessly entertaining for some and Mueller may “love surprises,” these people, including Trump himself, are not props in some progressive fantasy production. Before Mueller has some major delicious “surprise,” he will need a crime other than those committed by Flynn himself. The effort to flip Flynn is the most predictable development in this investigation. First, he has clear allegations of criminal conduct in his work as a foreign agent. Second, his crimes are the type that prosecutors would have few qualms in trading away for good testimony. Third, he was in a high position that could allow him to produce “deliverables” on higher ranking individuals.

Finally, and most importantly, he has a kid in the mix: Michael Flynn Jr., who served as chief of staff to the Flynn Intel Group. As I previously discussed with regards to Trump himself, there is a danger in enlisting family in political work, and this is one of them. It makes you profoundly vulnerable when investigators come knocking. Mueller’s people have been circling “junior” and this withdrawal may indicate that he is the one price that Flynn is not willing to pay. Flynn’s son could now be the subject of a “third-party credit” in exchange for his father turning government witness.

It is important not to make any assumptions about the status of Flynn. Withdrawal is necessary even at the start of negotiations due to the conflict presented with other potential defendants. Any such deal could fall apart. Flynn is not some low hanging fruit. He is a major player and would be a trophy defendant for Mueller to add to his current indictment of former Trump campaign chair Paul Manafort. He has to produce something more valuable than himself for any real deal.

Nevertheless, Flynn could have counted on a potential presidential pardon if he remained loyal. Trump’s controversial pardon of former sheriff Joe Arpaio showed everyone that the president is willing to use this power despite overwhelming criticism. Becoming a cooperating witness could close off this avenue, and Flynn would have to believe that what Mueller is threatening is more significant than what Trump might offer.

Flynn could be facing serious claims of false statements to investigators under the U.S. Code and other laws. He is accused of misrepresenting meetings, including one with Russian Ambassador Sergei Kislyak that Flynn is accused of misrepresenting to Vice President Mike Pence and others. He also failed to register as a foreign agent. While only a handful of such cases have ever been prosecuted, Mueller charged Manafort under the Foreign Agents Registration Act, including allegations that he gave false information and sought to hide money derived from his work.

Flynn faces analogous alleged violations, including the cycling of payments through a Dutch firm, Inovo, that is owned by Ekim Alptekin, chairman of the Turkish American Business Council and close ally of President Erdoğan. Some of Flynn’s contacts with the Russians may have been captured by U.S. intelligence agencies, and he reportedly sought to gain access to damaging hacked emails on Hillary Clinton. Flynn could shed light on a June 2016 meeting with Russians to obtain disparaging information about Clinton as well as the influence of people like George Papadopoulos and Carter Page in establishing Russian ties.

Flynn also faces some more sensational claims, including alleged discussion of the effective kidnapping and delivery of Erdoğan critic Fethullah Gülen to Turkey for presumed torture and execution. At a meeting at the 21 Club in New York, Flynn was reportedly offered $15 million to arrange for Gülen to be taken on a private plane to a Turkish prison island. Flynn was also allegedly involved in a virtual propaganda film meant to discredit Gülen. The timing of these meetings is important because some communications occurred in December, when Flynn was assuming the role of acting national security adviser. If Flynn continued to be paid for such work in January, bribery charges could be alleged.

The most serious threat of flipping Flynn might be to Manafort, former CIA director James Woolsey, or Trump son-in-law Jared Kushner. Woolsey reportedly participated in the meeting on the kidnapping or “rendition” of Gulen and has been named as involved in some of these lucrative arrangements with foreign entities. Of course, there is always the possibility of damaging testimony involving President Trump. Such testimony would have heightened value to Mueller given Trump’s own statements. By trying to pressure Comey to “let Flynn go,” the president created his own damning narrative. With James Comey ready to testify that Trump’s overtures made him feel uncomfortable, leading to his famous memos, a witness on the other side could box in the president.

None of this means a perp walk down the White House driveway anytime soon. There is still no evidence of criminal conduct by Trump nor Kushner revealed in public court papers. Flynn is clearly a live torpedo in the water. However, while he has the range, it is not clear if he has the load to do serious damage to anyone in the White House. Rather, the concern should be that he and Mueller may be seeking a target of mutual interest, and if he hits, there will be nothing speculative or subtle about it.

    Bear in mind the experience of six years Senator and for years Sec State with the responsibility for ensuring the security systems were in good order and informing her superior the then President if found not to be in good order. While it’s used elsewhere the word ‘intent’ does not appear in the following and thus is not an element of any wrong doing.

    She knew what she was doing if you really want intent installed the equipment knowingly, used it knowingly, failed to secure the installation knowingly, and maintained it in a negligent manner knowingly.

    Her reason….personal convenience.

    But an experienced FBI Agent and Director of same could not come up with anything except a pass and go on collecting money in her ‘other’ activities nor felt it necessary to question the staff involved with and responsible for information security.

    This seems like yet another rehash – nothing new here. We were told that the special prosecutor was going to prove that President Trump colluded with Russians on God-knows-what. It hasn’t happened yet; not even close. All of these bad actors should have been prosecuted individually. All of this was known when Flynn worked for Obama. 20 election opponents of candidate Trump would have discovered damning collusion with Russia as “opposition research” during the 2016 election. And the preposterous kicker is that Mueller himself is as guilty and corrupt as Obama, Hillary et al. given that he was their FBI Director and “Keeper of the Secrets.” Look what happened to Vince Foster – keeper of the Clinton Arkansas secrets. The gatekeeper of the “swamp” is in a difficult position. It must have been unimaginably tense in the FBI, CIA, Mob, M/I Complex cabal that conducted the JFK assassination. We should probably pity the overburdened denizens of the “swamp.”

The worst thing that could happen to Trump is for Mueller to end his investigation of Russian money-laundering schemes in Latvia, Switzerland, Cyprus and Seychelles. For so long as Mueller and his crew are on the job, Trump cannot commit crimes against the United States through any of those Russian money-laundering networks. Think of Mueller as Trump’s MAGA-Condom, George.

Gorka’s new gig, adding to his Fox employment, is as a guest lecturer at the Heritage Foundation. While only a handful of failing to file as a foreign agent cases have ever been prosecuted, NONE of them have ever involved the National Security Advisor, the person entrusted to guard our nations top secrets. Turkey has over a half a million dollars invested in Flynn. His NSA salary was only $179,000. His loyalty is to his most generous benefactor which isn’t the United States, the country that fired him after a four decades long career. The only question is, how much of Flynn’s foreign agent activities Trump knew. Because if he knew anything at all, he knew everything. That’s how conspiracies are prosecuted. It’s also why even low level people get such harsh sentences in conspiracy cases. ANYONE that knew of criminal activity and looked the other way will be sitting in a prison cell for a long time.

    1. Allegedly, Flynn hawked the idea of an industry consortium to build nuclear reactors which included the U.S. and Russia. Trump’s judgement in choosing Flynn as national security advisor was appalling. If the appointment was part of a deal linked to financial benefit, no consequence is too great.

    2. A ringing indictment of and warning to anyone who ever staffed for Clinton. But Meuller can only cover for er so long and so far. Eventually and probably as a result of looking to get votes not lose votes the Comey slip up in citing a non existent element of the Hillary crimes will bear fruit. Why? Because she believed without checking and openly confessed based on false protection. Collusion is not a crime and INTENT is not an element of National Security crimes.

      That’s an interesting take on things. I knew Patty Hearst was kidnapped by the Symbionese Liberation Army almost immediately after it happened like millions of other Americans and I, like most Americans, did nothing about it. Should we all call our defense counsel and advise them that conspiracy charges for kidnap are in the offing?

    Turley, being Turley, (a.k.a. what Shakespeare called “a piece of work, Man”), prefers those people who can be made props in some moderate/centrist fantasy production. To wit, notice Turley’s naming of the name, James Woolsey. One wonders whether any of the old-timer, normie, blawg-hounds, here, have any insider knowledge of Turley’s apparent grudge against James Woolsey. Or would that be one of those “surprises” that Mueller supposedly loves?

    In the interest of disclosure, I couldn’t care less about Woolsey, one way or the other. If anything, Woolsey strikes me as the same sort of fence-straddling, moderate/centrist, now-he’s-D-now-he’s-R sort of “swamp creature” as our beloved host, or even Bobby Three-Sticks, for that matter. Why can’t these guys play nicely with one another? Because one of them gets hired while the other two don’t? It can’t be that base? Can it?

Here’s a synopsis: Woolsey’s role as an adviser to the Trump campaign and the Trump transition team were cover stories for Woolsey’s true role as an undercover agent for the FBI’s Counterintelligence Division. Woolsey infiltrated Team Trump and informed against Team Trump. Woolsey is not a target of Mueller’s investigation. Woolsey was and still is an agent of Mueller’s investigation.

  12. I think it’s quite interesting to hear Alan Dershowitz discuss the Mueller investigation. Anything but what it should be.

    1. Yes, I read that, too, Zambini. Dershowitz complains that politics in America has been criminalized; and that American politicans and their political parties are the ones whodunit. While Dershowitz may well have a valid point to make, I have an alternate theory that I call “Fighting FUBAR with FUBAR.”

      No. Seriously. Just as fire-jumpers fight fire with fire by making fire breaks that contain the spread of wildfires, so too do special counsels and their investigators–FUBAR-jumpers, if you will–fight FUBAR with FUBAR by making little investigative FUBAR breaks to contain the spread of unchecked, imbalanced Executive FUBAR.

      Please do not be alarmed. And don’t panic, either. Mueller and his crew are actually the very best thing that could possibly have been done for Trump. The special counsel’s investigation has made a system of FUBAR breaks to contain the Russian money-laundering networks in Latvia, Switzerland, Cyrprus and Seychelles that would otherwise have “fueled” a great FUBAR conflagration in the Trump administration. Thus, because of Mueller’s vigilant efforts, DJ Trump will most likely serve out the remainder of his one and only term of office as your President of the United States. And the rest of the country might pull through as well. Or not.

  13. Mueller, as FBI Chief, counseled Soweto bin Bama that Soweto may have the right to assassinate, with no judicial charge, American citizens on US soil. A real American patriot who honors his oath to enforce the US Constitution, that Mueller is.

    Soweto did in fact assassinate at least two Muslim American citizens on Soweto’s confidential so-called “Kill List,” father and minor son both named Anwar Al Awlaki, and both not on US soil. Soweto says the minor’s assassination was an “accident,” for which Soweto apologized (very tenderly, as always).

    Soweto, another great and wise Constitutional scholar/teacher, was just doing his due diligence with Mueller in case someone on Soweto’s Kill List required a drone missile in Miami or Scarsdale, ya know. All in a crime fighter’s normal day of making the world “safe for democracy,” a term coined by the Woodrow Wilson admin to justify US involvement in WW1 (a war in which Europe borrowed billions of dollars, then not only flipped the US off and ignored the debt, but mocked Yankees for being suckers to loan the money in the first place….no relationship to current NATO financing, no, not at all).

    I’m sure hundreds of thousands of previously moderate Muslims appreciate Soweto’s apology, and harbor no ill will toward Americans for minor Al Awlaki’s death. These previously moderate Muslims realize how much Soweto loves all the world’s chil’un. I feel so bad for Soweto’s heavy heart on this subject. You can tell it just eats him up.

  14. Mueller still seems to be making a case out of whole cloth. Personally, I could care less about Jared, but if they get Jared they have to go after Hillary who set him up. So, what is it going to be for Mueller? He is spending a lot of our money on non-Russian things.

    1. I’ve somehow missed how, Hillary set up Kushner, getting him involved in all the meetings with Russians, trying to create secret back channels and shady business deals. How?

  15. If Flynn cut a plea agreement with Mueller, it may be the mistake of his life. All he’ll be getting is a plea to lesser charges and a recommendation on sentencing. The judge doesn’t have to accept the plea. He can throw the book at Flynn. Thus he’s taking a big risk, as he could end up doing time. I would rather trust Trump to give me a full pardon if I kept my yap shut.

            For America’s sake, we can hope someone takes the initiative to bolster the U.S. image abroad.

I would say it is far more unprecedented and indecorous to have a recent former president keeping such a high profile traveling the world meeting with world leaders and undermining a sitting president during his first year in office. But the media will stay silent or spin it favorably for Obama, of course.

However, I do think that if both Hillary and Donald had their heads examined by an independent medical doctor, as I believe all presidential nominees should be required to do, the results would have been surprisingly negative for Hillary and surprisingly positive for Trump.

                      Hillary has a long history of fainting, falling, collapsing, and breaking bones, along with suffering from concussions, double-vision, violent outburts, throwing objects at people, over-drinking Chardonnay, pathological lying, cursing, cheating, threatening, exaggerating, exercising really bad judgment, and a decades long track record of making catastrophically bad decisions – as most recently evidenced by her poorly run billion-dollar presidential campaign. But sure, you go on believing that Trump is demented and psychotic and Hillary would have been a better choice to lead the country.

      Flynn will cut a deal to save his son. Any benefit to himself will be secondary. This scenario plays out regularly in other cases. Flynn will be reminded of Andy Fastow and his wife Lea in the Enron case. Andy was offered a plea deal which would have allowed Lea to walk. He rejected that deal, and both Andy and Lea ended up being convicted and sentenced to prison.

      And I concur with Issac that Flynn should not trust Trump to do anything except look out for Trump himself.

  16. I hope everyone here in the JT Community agree that Gen Flynn himself is in serious difficultly due to his oversights–for someone who called for HIllary’s impeachment, interesting how things can turn…..

It is interesting how things can turn, and you’re right about Flynn — though his troubles seem to have more to do with working for Turkish intermediaries than anything publicly known about his contact with Russian officials. That said, I can’t help but roll my eyes at the endless forecasting of the end of Trump; all they’re doing is turning this inquiry into a cheesy side-show.
