I have previously criticized President Donald Trump for his relentless attacks on the media and his mantra of labeling such publications as the Washington Post and New York Times as “the enemy of the people.” He has also routinely called a couple dozen people and organizations “traitors,” as recently listed by Axios. This weekend Trump continued the attacks on the New York Times for a story that revealed attacks on Russia’s electric power grid. Trump declared that the publication of the article was a “virtual act of treason” — an act on a classic example of investigatory reporting. Trump’s continued attacks on the free press are not just highly embarrassing but highly disturbing from a President of the United States. With free speech, the free press is the very touchstone of liberty in our nation.
Ironically, the story contradicted the common Democratic narrative that Trump is soft or even controlled by Russia. Here was a case where U.S. intelligence was allegedly shooting across the bow of Russia to show that it better stop probing our own electrical grid in a deterrent action. Trump however immediately wiped out that view by angrily denying the story as “fake news” and “treason.”

As Trump was denying the story, other coverage said that U.S. intelligence officials are hesitant to share the details of their operations from Trump. According to David E. Sanger and Nicole Periroth:
Two administration officials said they believed Mr. Trump had not been briefed in any detail about the steps to place “implants”—software code that can be used for surveillance or attack—inside the Russian grid.
Pentagon and intelligence officials described broad hesitation to go into detail with Mr. Trump about operations against Russia for concern over his reaction—and the possibility that he might countermand it or discuss it with foreign officials, as he did in 2017 when he mentioned a sensitive operation in Syria to the Russian foreign minister.
Obviously, there is no need to defend the New York Times for such a piece of investigatory reporting. Nor is there a need to defend our commitment to the free press as on of the virtual pillars of democratic government and freedom. It is simply disheartening to hear an American President voice such attacks previously reserved to the world’s most authoritarian figures.
The New York Times spoke for many concerned citizens and journalists on Sunday that “Accusing the press of treason is dangerous.” It added that it followed a cautious and responsible course in vetting the story with the Trump Administration: “As our story notes, President Trump’s own national security officials said there were no concerns.”
What is most disturbing here is the claim that the IC is essentially operating on their own.
Regardless of all the other twists to this, our constitution vests the executive power of the united states in the president. There is no power given the CIA or FBI in the constitution.
Just as the military is subordinate to the civilian leadership of the president – so is the rest of the govenrment.
It is far less dangerous to have a president who makes poor choices, than to have an unelevted shadow govenment that gets to decide on its own in secret without any oversight what is good for the rest of us.
Even if they might be right 9 times out of 10. The tenth is an unfixable form of tryany.

I am sure many of them disagreed. But they listened.
Many of us might disagree. But the constitution gives the final decision to the president, and if we do not like his choices we get to vote him out of office or impeach him.
What we do not want is random maybe even well meaning people in government disregarding our elections, and our elected president and running the country as they see fit.
One can only guess as to why the President wanted this covert cyber-op to remain secret. I’m guessing that the President knows that cyberwarfare remain a huge vulnerability for the US. The US Cyber Command has spent tens of billions, and hasn’t achieved anything remotely approaching security in cyber….you could argue that the threat has only increased the past 10 years. I think the President should worry about the blowback if the US suffers a major cyber attack on his watch.
As for the NYT, their position would be more defensible if they had an official source, or in the case of an unauthorized leak, they talked to DoD about the consequences of going public.
We should all support an absolutely free press.
But that is not to say the president must stand and take it. When the free press refuses to abide by its own ethical standards, those under attack can and should fight back. The free press is subservient to the truth, and even Mr. Turley must acknowledge the reporting by the free media has becom not only slovenly, but downright untrue with greater and greater frequency.
Trump, should hit back hard and call the media to account for its actions.

The FBI relied on CrowdStrike’s “conclusion” to blame Russia for hacking DNC servers, though the private firm never produced a final report and the FBI never asked them to, as Ray McGovern explains.

CrowdStrike, the controversial cybersecurity firm that the Democratic National Committee chose over the FBI in 2016 to examine its compromised computer servers, never produced an un-redacted or final forensic report for the government because the FBI never required it to, the Justice Department has admitted.
The revelation came in a court filing by the government in the pre-trial phase of Roger Stone, a long-time Republican operative who had an unofficial role in the campaign of candidate Donald Trump. Stone has been charged with misleading Congress, obstructing justice and intimidating a witness.
The filing was in response to a motion by Stone’s lawyers asking for “unredacted reports” from CrowdStrike in an effort to get the government to prove that Russia hacked the DNC server. “The government … does not possess the information the defandant seeks,” the filing says.
In his motion, Stone’s lawyers said he had only been given three redacted drafts. In a startling footnote in the government’s response, the DOJ admits the drafts are all that exist. “Although the reports produced to the defendant are marked ‘draft,’ counsel for the DNC and DCCC informed the government that they are the last version of the report produced,” the footnote says.
In other words CrowdStrike, upon which the FBI relied to conclude that Russia hacked the DNC, never completed a final report and only turned over three redacted drafts to the government.

These drafts were “voluntarily” given to the FBI by DNC lawyers, the filing says. “No redacted information concerned the attribution of the attack to Russian actors,” the filing quotes DNC lawyers as saying.
In Stone’s motion his lawyers argued: “If the Russian state did not hack the DNC, DCCC, or [Clinton campaign chairman John] Podesta’s servers, then Roger Stone was prosecuted for obstructing a congressional investigation into an unproven Russian state hacking conspiracy … The issue of whether or not the DNC was hacked is central to the Defendant’s defense.”
The DOJ responded: “The government does not need to prove at the defendant’s trial that the Russians hacked the DNC in order to prove the defendant made false statements, tampered with a witness, and obstructed justice into a congressional investigation regarding election interference.”
Thousands of emails from the DNC server were published by WikiLeaks in July 2016 revealing that the DNC interfered in the Democratic primary process to favor former Secretary of State Hillary Clinton over Senator Bernie Sanders for the party’s presidential nomination. The U.S. indicted 12 Russian military intelligence agents in 2018 for allegedly hacking the DNC server and giving the emails to WikiLeaks.
Comey Can’t Say Why
At a time of high tension in the 2016 presidential campaign, when the late Sen. John McCain and others were calling Russian “hacking” an “act of war,” the FBI settled for three redacted “draft reports” from CrowdStrike rather than investigate the alleged hacking itself, the court document shows.
Then FBI Director James Comey admitted in congressional testimony that he chose not to take control of the DNC’s “hacked” computers, and did not dispatch FBI computer experts to inspect them, but has had trouble explaining why.
In his testimony, he conceded that “best practices” would have dictated that forensic experts gain physical access to the computers. Nevertheless, the FBI decided to rely on forensics performed by a firm being paid for by the DNC.

Kurtz, Jury selection played a big part and that is probably why the defense moved for a change in venue. However, there were 12 jurors so I think the prosecutorial errors made contributed to the not guilty verdict. LONDON (Thomson Reuters Foundation) – China is murdering members of the Falun Gong spiritual group and harvesting their organs for transplant, a panel of lawyers and experts said on Monday as they invited further investigations into a potential genocide.
Members said they had heard clear evidence forced organ harvesting had taken place over at least 20 years in a final judgement from the China Tribunal, an independent panel set up by a campaign group to examine the issue.
Beijing has repeatedly denied accusations by human rights researchers and scholars that it forcibly takes organs from prisoners of conscience and said it stopped using organs from executed prisoners in 2015.
But the panel said it was “satisfied” that the practice was still taking place, with imprisoned Falun Gong members “probably the principal source” of organs for forced harvesting.
Falun Gong is a spiritual group based around meditation that China banned 20 years ago after 10,000 members appeared at the central leadership compound in Beijing in silent protest. Thousands of members have since been jailed.
It was less clear if the Uighur Muslim minority had been victims, the tribunal found, thought it said they were vulnerable to “being used as a bank of organs”.
“The conclusion shows that very many people have died indescribably hideous deaths for no reason,” said the tribunal chairman Sir Geoffrey Nice in the judgement.
Chinese government regulations say human organ donation must be voluntary and without payment, said a spokesman for the Chinese Embassy in London.
“We hope that the British people will not be misled by rumors,” said a spokesman in an emailed statement sent before the tribunal’s final judgement was released.
The China Tribunal was set up by the International Coalition to End Transplant Abuse in China, a campaign group, charged with examining whether crimes had been committed as a result of China’s transplant practices.
