Alabama Woman Mistakenly Shoots Husband In Head During Road Rage Incident

190708140002-erica-cole-alabama-road-rage-exlarge-169Erica Cole just may have the worst criminal defense other than a confession.  She shot her husband Nicholas Cole in the head but insisted that she was really trying to shoot someone else in a road rage incident. It is not much an improvement.  She is charged with attempted murder, second-degree assault and reckless endangerment.

The road rage incident reportedly occurred on the highway near Dodge City, Alabama.  The cars then continued the confrontation at a home on a local road. 
The “I meant to shoot the other guy in the head” claim will not take you very far at trial. Nicholas Cole is still recovering in the hospital.

  1. I hope some clever attorney encourages the lady shooter in this incident to plead insanity (Alabama is a M’Naghten Rule state). That would give a forensic psychiatrist or psychologist a chance to place her in the growing pool of prohibited persons who may never legally possess a firearm under the Gun Control Act of 1968.

      if you count the total number of misusers of firearms in the US and divide that number by the population of the United States, you get a tiny fraction.

      Certainly not enough to show even superficially that guns are more dangerous than, say cars – misused cars are deadlier than misused guns. Both of which seem to have been misused in this incident.

Good friends of mine have been in immediate peril (during the Denver/Aurora theater shooting), but we live where we live, and laws are unlikely to change anything about that.

          The likelihood of ever successfully confiscating every weapon from every American is probably an even smaller number. No one’s ever made a serious study of that project that I’m aware. The civilians who retain possession of firearms illegally are going to be criminals of some stripe or other.

          The guns these criminals will own in defiance of the laws you want will be sold deadlier weapons than those confiscated from them and kill even more people in less time, because the Chinese regard sales of military weapons to civilian criminals in the rest of the world as a profitable market.

          China sells the highly toxic and potent fentanyl and carfentanil to drug dealers all over North America now, fuelling our opioid crisis, because our laws are a matter of serene indifference to them.

          But sure, let’s restrict the freedom of roughly 280 million law-abiding, qualified firearms owners because two thousand madmen have abused firearms in mass shootings over nine years. We can then copy the British and crack down on sharp-edged tools and other objects in the wrong hands.

            We have systemic problems that aren’t going to be resolved or eliminated by taking away the guns of the law-abiding. (Did I say anything about “restrict(ing) the freeeom of” anyone? No, I didn’t.)

  2. She’s got some anger management issues, right there. Since her husband survived, I hope the bullet only grazed him and he’ll recover.

    Road rage is entitled behavior, and puts everyone else on the road in peril. The misuse of a firearm was reprehensible. Perhaps they got to the point where the other guy was trying to drive her off the road, but it’s still no defense. She should have pulled over, and only defended herself if a life threatening situation ensued. Totally irresponsible.
