Diss Barr? Trump Returns To Attacking The Justice Department

Despite a public condemnation by Attorney General Bill Barr, President Donald Trump is back tweeting and atacking a wide range of Justice Department attorneys and investigations. That includes the recently resigned prosecutors in the case of Trump associate Roger Stone. These irresponsible tweets continue undermine Barr and magnify the problems for the Administration with both the courts and Congress.

President Trump lashed out this morning in the tweet series below.

In the tweets, he not only insists that the “Everything having to do with this fraudulent investigation is badly tainted and, in my opinion, should be thrown out” but adds that he may sue everyone involved.

Once again, it is difficult to comprehend the meaning, let along the purpose, of such tweets. Nothing can be “thrown out” in the Mueller investigation in that the report is complete and no conviction was based on its findings. Any convictions were the result of separate trials that were based on grand jury and other information made part of those records. As for suing everyone, such lawsuit could be technically filed but would be quickly rejected as frivolous.

Some of us agree with the criticism of the Russian investigation, a criticism that has been reinforced by findings that there was no probable cause for the renewal of the FISA surveillance and there was no collusion with Russia. In addition, the investigations by the Inspector General found considerable and raw bias by key players in the investigation.

That brings us back to the purpose. This is obviously putting Barr in an impossible position, as he stated publicly. Indeed, Barr stated just two days ago, that “I think it’s time to stop the tweeting about Department of Justice criminal cases. I’m not going to be bullied or influenced by anybody … whether it’s Congress, a newspaper editorial board, or the president.” He added “I cannot do my job here at the department with a constant background commentary that undercuts me.”

It would seem like Trump is fully aware that the tweets could be viewed as calling Barr’s bluff, if he thinks it was a bluff. It would seem obvious that this would create pressure on Barr to either resign from his office or resign himself to Trump’s tirades. That would be a huge mistake for Trump, but Trump may still be angry over being publicly criticized. Whatever his intent, the tweets further paint Barr into a corner either by default or design.

  1. I have a technical question for attorneys or other observers who are conversant with federal sentencing and judicial disqualification:

    In this case, possibly for very good reason, the trial court declined to rule on the pending motion for new trial before identifying the sentence, explaining why it is sound, and staying it pending a decision on the new trial motion.

    The pending motion can lead to a new trial.Ordinarily, once a trial court grants a motion for new trial or does so on its own motion, the same trial judge hears the subsequent trial. Here however, the trial judge has made findings quite adverse to Stone, some of which are based on the jury verdict, but others of which appear to be based on the court’s reactions to threats Stone allegedly made about the court itself.

    If the court grants the motion for new trial, it seems impossible for this defendant to get a fair trial from this judge, who has already stated that Stone is both guilty of the criminal charges as found by a jury, and is subject to a gag order, based at least in part upon his alleged threatening communications concerning her.

    Is there any way that this judge could fairly hear the retrial if the motion for new trial is granted or a new trial is ordered by the CA?

    1. John, no way could this judge preside over a second trial. That is why I believe that she will rule that the “bad” juror did not sufficiently taint the verdict to warrant a new trial. On the other hand, that ruling will be appealed and could be overturned.

  3. Jonathan: William Barr’s faux public criticism of Trump is much ado about nothing. It was an simply attempt by Barr to blunt massive criticism of his unwarranted intervention in the Roger Stone sentencing recommendation. If Barr really believed the DOJ should be free of political manipulation he would have shown some cajones and resigned. Barr didn’t do this and says he has no plans to resign, He will continue to do Trump’s bidding. If there was any question about who actually runs the DOJ Trump put that to rest yesterday when he pardoned or commuted the sentences of 11 people including Edward DeBartolo, Michael Milken and former Illinois Gov. Rod Blagojevich–the wealthy or politically well connected. In his statement exercising his pardon power Trump said he didn’t consult with the DOJ in advance which is the normal process but because he didn’t need to– HE is the “chief law enforcement officer”. Barr apparently didn’t get the memo. In the case of Blagojevich he is the poster child for political corruption in Illinois. In 2011 Blagojevich was convicted of wire fraud, extortion, soliciting and accepting bribes and was sentenced to 14 years in federal prison. Trump has sent a clear message that if you are wealthy or have friends in high places he will give you a get out of jail free card. This also sends another important message. If you are a federal prosecutor working hard to root out government political corruption you better first consult with the real boss–and it’s not William Barr! So Trump has called Barr’s “bluff” and who backed down? What else did you expect, Jonathan?

    1. If Barr/Durham don’t start spitting out some fruitful results, it won’t be just Trump welcoming Barr’s resignation.

    The intent (for the last 3 years) of the tweets against Mueller has always been to disguise and obscure the fact that the Mueller investigation was the Trump administration investigating the Trump administration. By calling it a witch hunt and a coup attempt Trump successfully convinced the gullible rubes on both the right and the left that Mueller was investigating something real.

    The Mueller investigation was Kayfabe from start to finish.
