Second Circuit Rules In Favor Of Trump Administration On Sanctuary Cities

The Trump Administration won a major victory with decision by the 2nd US Circuit Court of Appeals in favor of its sanctions against “sanctuary cities” which refuse to cooperate with federal immigration enforcement. The decision in New York v. Department of Justice reversed a lower court ruling blocking the policy of withholding certain grants. Despite my disagreement with friends like Judge Napolitano, I previously stated that I thought the Administration would prevail ultimately on this challenge though there are good-faith arguments against government. The decision could have two immediate impacts. First, it will add pressure to cities in their opposition to the immigration policies. Second, it could create the type of split in the circuits that make a Supreme Court review more likely as these challenges move beyond the trial level.

The case originated with the decision in July 2017 by then-Attorney General Jeff Sessions limiting the availability to Edward Byrne Memorial Justice Assistance Grants on the basis for cooperation with the federal government. The move was challenged by the city of New York and various states, including a New York, Connecticut, New Jersey, Washington, Massachusetts, Virginia and Rhode Island. It is also a rejection of the analysis of United States District Court for the Southern District of New York Edgardo Ramos.

Judge Reena Raggi, writing on behalf of the unanimous 3-judge panel, such conditions on federal grants are legitimate tools to enforce national immigration laws and rejected the claim that they “intrude on powers reserved to the States.” 

The panel recognized the inherent authority of the Executive Branch in this case and stated that case being advanced by the Administration in a host of such cases:

As the Supreme Court has repeatedly observed, in the realm of immigration policy, it is the federal government that maintains “broad,” Arizona v. United States, 567 U.S. 387, 394 (2012), and “preeminent,” power, Toll v. Moreno, 458 U.S. 1, 10 (1982), which is codified in an “extensive and complex” statutory scheme, Arizona v. United States, 567 U.S. at 395. Thus at the same time that the Supreme Court has acknowledged States’ “understandable frustrations with the problems caused by illegal immigration,” it has made clear that a “State may not pursue policies that undermine federal law.” Id. at 416. As Chief Justice John Marshall wrote over 200 years ago, “the states have no power, by taxation or otherwise, to retard, impede, burden, or in any manner control, the operations of the constitutional laws enacted by congress to carry into execution the powers vested in the general government.” McCulloch v. Maryland, 17 U.S. 316, 436 (1819). This fundamental principle, a bedrock of our federalism, is no less applicable today. Indeed, it pertains with particular force when, as here, Congress acts pursuant to its power under the Spending Clause. See U.S. CONST. art. I, § 8.

    There Are Compelling Reasons

    The Corona Virus is a perfect example to illustrate the need for Sanctuary Cities.  If an epidemic spreads throughout the U.S., we want people seeking treatment immediately.

    We dont want Immigrants trying to tough out Corona in small apartments with family, friends and neighbors breathing the same air.  That’s a recipe for disaster!

    But you dont need Corona for a health emergency.  The measles, mumps and whooping cough are reasons enough to encourage trust in public health officials.  Sexual diseases are another; AID’s is still a threat.

    The same dynamics apply to a number of different issues.  Sex Trafficking is a prime example.  We dont women living as slaves on American soil.  Nor do we want children held in any bondage.  Immigrants must feel free to come forward when reporting serious crimes.

    Education is another example.  We dont want parents keeping children out of school because they fear enrollment paperwork.  We dont want tenants afraid of Building Inspectors.  Horrific fires could result if unscrupulous landlords take advantage of Immigrants.  

    We dont Farm Workers or Day Laborers being cheated out of wages by unscrupulous employers.  Or being subjected to hazardous conditions that leave them disabled.  Workers must be free to file complaints with Labor Officials.

    Animal Control Officers, DMV Employees, Water & Power Technicians, Coroners, Pharmacists and Food Inspectors are all professionals Immigrants must trust.  We cant have a segment of society living underground.

    Sanctuary Cities were created for a number of common sense reasons.  But Donald Trump has no common sense, nor has rightwing media.  They would have us believe Sanctuary Cities is just a flaky liberal concept hamstringing police.  In reality, the opposite is true.

BTW, immigration has not bothered schools since the 1970s (I think) since I taught a lot of illegal aliens and they were not afraid to come to school. The biggest problem we had was that they were illiterate in two languages, Spanish and English, We taught them English, they learned Spanglish at home.

      When you realize what Sanctuary Cities are really about, get back to me.

For example, your laundry list of compelling reasons is evidence of unintended consequences of the systematic enabling of illegal immigration. So logically you conclude violators of our laws should not suffer the consequences of their illegality, on the basis of successfully maneuvering around the law.           When law and morality contradict each other, the citizen has the cruel alternative of either losing his moral sense or losing his respect for the law. These two evils are of equal consequence, and it would be difficult for a person to choose between them.

          What message is being communicated to the American taxpaying citizen if they are forced to subsidize violators of our immigration laws?

          What message is being communicated to foreigners regarding the benefits of illegally residing in the United States?

I knew Turley would jump on this court ruling story, because it appears to make Trump look good, instead of the story about Trump’s total failures in regard to disease prevention readiness and the lies about coronavirus. Trump dismantled the disease preparedness portions of the CDC, Homeland Security and other agencies, so we are behind. Yesterday, the CDC was warned Americans that it is anticipated that the coronavirus will spread and if it become a crisis, thought should be given to avoiding large meetings, schools should be prepared to have e-learning, and companies should consider ways workers could work from home. Meanwhile, Trump’s main economic advisor is claiming that the virus is totally contained, which is a lie. Then, Trump lied by claiming that it would be gone by April, as temperatures warm. There are no facts to support such a claim.

    Also, Rush Limbaugh claimed that coronavirus is nothing but the common cold, and that Democrats ginned up fears about a pandemic to panic the stock market and make Trump look bad.

    Stephanie Ruhle of MSNBC summed up the reason the market is dropping: no one believes anything that Trump says because he is a chronic, habitual liar, so when he has one of his syncophants say that the disease is completely contained in the US, “almost airtight” while the CDC says make plans in case of a pandemic, no one believes Trump. Trump also demanded that 45 Americans who tested positive for the virus be allowed to fly back to the US, over the objections of the CDC, then claimed to be incensed about it, after receiving massive criticism about what a stupid move this was.

    Prediction: Trump will command staff at the CDC to lie about the number of new cases, or not disclose the truth, and if they won’t tell the lies he demands, he’ll fire them. That’s what really scares people. It’s really sad when you can’t believe the leader of your own country to tell the truth about something as important as the risk of a communicable disease. Then, again, he lied about the predicted path of a hurricane, so no one would put this past him. Anything, literally anything, to make him look good.

      Not surprising that Natacha touts MSNBS News. The fact is that, irrespective of what Trump says, that the market have become overvalued after a spectacular runup over the last decade.
      It is especially vulnerable, given lofty valuations,.to any uncertainty.
      And especially in sectors like the airlines, hotels restaurants……any area rated to travel, tourism, public outings in crowded places….there’s going to be concern about how this Coronavirus will play out.
      Whether Trump glosses over the potential impact of this virus, or if he says “we’re all DOOMED”, the market is going to react to the inherent uncertainty of the impact of how this virus will run its course.
      And it’ll react independently of whatever Trump tweets or says.

      I differ from Rush however in that I believe the situation with coronavirus is dangerous and even if containment has worked so far– and the experts say it is working so far, and fair enough evidence that it is– that does not mean that it will work forever, and that serious preparations for an outbreak should not be made.

      generally i would support more funding for the CDC not less. I think that was probably a bad idea to cut their budgets. i would cut about a thousand other budgets first, before theirs. but you know budget recommendations get put together mostly by a big staff of flunkies and the big guy just takes his staff’s recommendations. it’s been seen many times that a POTUS makes stupid recommendations where the budget is concerned, that is a bipartisan failing in our process.

      Trump should just bite leather and reverse himself on this point, and double down with twice as much funding, say 5 instead of 2.5. this is the time to spend it, if ever

        I agree that cuts to the CDC’s pandemic response budget is wrong, and needs a course correction. Much as I hate to add on to the spiraling debt, I’m with you on this one.

      3. Here’s the problem: we don’t know what we don’t know about COVID-19. There is a confirmed case in rural California of someone who has not traveled abroad, hasn’t been in contact with anyone who has traveled abroad, who hasn’t had contact with anyone known to be infected, and this person hasn’t had a lot of contact with people because s/he lives in a rural area. How long is the prodromal period? Can you spread the infection before you are symptomatic? What are all of the means of getting the disease? Why is it that children don’t seem to get the disease at the same rate as adults? Is there something in the vaccines that children nowadays routinely receive that provides some form of protection? Do children get the disease, but it is only very mild, so they don’t get sick enough to see a doctor, but still pass it along to others? Who knows for sure the answers to any of these questions? If we had the rapid response team in place that Trump eliminated, they would have been on top of this infection when it first happened, gathering data that would provide insight and answers to these tough questions. We are behind, and it is Trump’s fault. Since no one believes anything he says, people will never have confidence in anything his administration says about containing the disease. All Trump cares about is making himself look good, and stopping the market from free falling.

      You might not be aware, but the CDC was wasting considerable money. One example was a study on HIV in prostitutes in China. While it should trim waste, I would agree that critical funding should not be removed, as in pandemics.

      Trump cannot lie about Covid-19 cases, because this is not communist China or a socialist dictatorship. A hospital would not refuse to verify a corona outbreak if Trump told them to. This is not a socialist dictatorship yet.

      While I agree that pandemic response requires sufficient funding, we have so far done an excellent job quarantining our Covid-19 patients after we got them home. What I vigorously disagreed with was the Diamond Princess being forced to stay in Japan’s harbor until most of the passengers were infected. It was an unsuitable quarantine facility. Passengers mixed. Infected staff could spread the illness from room to room. Based on the timeline of patients testing positive, infections were occurring after the ship was supposedly put into quarantine. We should have retrieved our people immediately.

      As for Covid-19’s spread, there is little to stop it. In order to make the virus go extinct, it would require strict quarantine, the stoppage of all international travel by air, boat, vehicle, or foot, by all affected countries. China lied about the outbreak long enough for quite a few people to churn through Wuhan. We still don’t have verification if it was zoonotic or not.

      It would be devastating for the world economy for the planet to shut off travel. Since it is not Ebola, governments have not quarantined countries. Therefor, the virus will spread. Those who get a mild version will visit or return to the US and cough and hack at Disneyland, the movies, the mall, and schools. Even if Trump shut down all travel into the country from all other countries, the virus will continue to spread globally. Unless the US permanently stopped all international travel until or unless the virus was declared functionally extinct, no matter when the border was reopened, the virus would arrive. Even if every person who came down with cold and flu symptoms took the test kit, and was immediately quarantined, new infectious patients would arrive for the reasons stated above. I do not believe that the world considers covid-19 a sufficient threat to quarantine entire countries and go thermonuclear on stopping it. Short of that, it might join the rounds of seasonal illnesses. Perhaps it will have less virulent strains in future seasons.

      Aside from increasing funding to the CDC, what do you propose President Trump do?

      1. I don’t know what bubble you live in, but Trump lied about COVID-19 just last evening. He stood in the presence of CDC physicians and claimed there were 15 cases, when there are actually 60, he claimed we’d have a vaccine “very soon”, when it will take at least 12 to 18 months, he contradicted the doctor who said more cases are “inevitable”, he said there would soon be “0” cases, and that the infections will end by April, based on absolutely no evidence. The biggest whopper of all was to blame the stock market drops of Monday and Tuesday on the Democratic debate that happened Tuesday evening, which didn’t happen until after both markets had dropped.

        Trump is a chronic, habitual liar, and so no one has any confidence in anything he says. He fires people who tell the truth, like Joseph Magure, who reported, as required by law, Russia’s new interference in our elections, trying to help Trump cheat, again. Trump never gave Barak Obama credit for the booming economy he inherited, and he’s trying to blame the market losses on Democrats and the media. He knows that so long as this crisis continues, the market will keep dropping, although maybe not as much as this week, so he has even more incentive to lie. There can be no doubt he’ll fire any CDC spokesperson who contradicts the false, rosy picture of the “airtight containment” message he’s trying to create. The US wouldn’t be behind except for his cuts to the rapid response team members at the NIH, CDC, DHS, and other agencies. We don’t even have the capacity to test for COVID-19 except in 4 cities, one of which is NOT New York.

        Trump is incompetent. He lies. No one believes he can be counted on to tell the truth. People are getting hurt as a result. He should just resign.

        He put Pence in charge of organizing resources to combat COVID-19, based on what he claimed was a successful “Indiana model” for health care copied by other states. Pence’s record on health care in Indiana is dismal: he cut Medicaid and also refused to allow a needle exchange program in Scott County that had an outbreak of HIV due to dirty needles. His reason? His religious piety. He finally gave in, but at least 200 additional people got HIV due to his incompetence, and that will cost millions of dollars for treatment, probably from Medicaid. He also called Nancy Pelosi “incompetent” and said she doesn’t care about the welfare of Americans, but you don’t think these things cause people to lack confidence in him or believe that anything he ever says is for any reason other than self-adulation? He has to politicize everything and airs his grievances any time there’s a camera on him. He is driven by narcissism, and is incompetent.

        Trump DID de-fund positions at the NSA, HSA and CDC and other agencies involved in the rapid response team, primarily because this was a left-over from the Obama Administration.

        Anyone who believes what Trump says is a victim of “Trump Derangement Syndrome”, because you’d have to be crazy or delusional to think he has any leadership skills or cares about the welfare of America.

          And interestingly enough, election night ’16, party at Trump tower. Markets started to crash when reports showed Trump gaining an electoral college boost. Wall St. wanted HRC to win because she was *much* more predictable. But Trump supporter Carl Icahn (and others) left the party and dropped over a billion dollars in the overnight stock markets and prices kicked back up by morning in the States. Rare since American presidential elections usually shock the market into realignment no matter who wins. I happen to think the Icahn episode was one of the biggest instances of insider trading in American history.

              This gives a good snapshot of the stock market’s massive runup over the past decade.
              These kinds of extended, multi-year bull markets, without a significant correction ( pullback), are not common.
              That in itself, the “valuations part”, and the legitimate concerns about the ultimate impact of the Coronavirus, are primarily driving this market selloff.

Refusing to pay the cost to house, guard, and provide medical care for those who are incarcerated (and who have not committed any criminal offense, since seeking asylum is not a criminal offense) plus the cost to pay the salaries of people to keep records and notify ICE is not in any manner interfering with immigration laws. Rather, the feds are trying to interfere with local law enforcement.

Do you really think all of the hotel chains, restaurants, housekeeping services, lawn and garden care and nonunion construction don’t know they are hiring illegals?

        And, no, staying at a hotel that employs illegals, buying tacos from a truck that hires illegals, or using any other service that hires illegals isn’t the same as “employing” illegals. It’s so much easier to blame the illegals than those who hire them, plus it feeds into the racism and xenophobia that Trump encourages.

    2. Yes, but the Supreme Court has also held that the federal government may not withhold funds in order to compel a state government to enforce a federal statute. Prinz V United States, 521 US 898 (1997). Doing so violates the Tenth Amendment. How did the Second Circuit circumvent this?

      1. Probably because Prinz isn’t on point. Aiding and abetting illegal immigration into the United States is a distinct act from failing to enforce a Federal statute – it is a wilful violation of Federal law.

        If withholding Federal funds from sanctuary cities is inappropriate it’s because it doesn’t go far enough. Encouraging violators of Federal law to continue doing so is a crime, and those who commit that crime ought to stand criminal trial.

        But through the 1950s-1970s, Federal funds have been withheld from de facto segregated school systems, and Federal judges ordered US marshals and Federalized troops to help enforce integration of public schools when local authorities wouldn’t do so. Liberals had no issue with that, at the time.

    The judicial branch has no power to legislate or modify legislation.

    They’re judges not despots, tyrants and/or dictators.

    A nation of laws must vigorously impose law enforcement.
