Schiff and Democratic Leaders Push For IG Investigation Of Bill Barr Over Comments

440px-William_BarrThere  is an interesting fight brewing on the Hill after House Intelligence Committee Chairman Adam Schiff and Judiciary Committee Chairman Jerrold Nadler called for the Justice Department inspector general to investigate Attorney General Bill Barr over his comments on the firing of the intelligence community watchdog, Intelligence Community Inspector General Michael Atkinson.  What is curious is that Barr justified the firing on the very basis that I previously raised in a blog column, While I was highly critical of the move, I noted that termination would have been justified if Atkinson continued to assert that he would not follow Justice Department interpretations of federal law.  However, President Donald Trump made clear that he fired Atkinson for the worst possible reason: the merits of the Ukrainian allegations reported to Congress.  So Schiff and Nadler are calling for an investigation into Barr over his arguing what would be legitimate grounds for a termination? It is not clear to me what the IG is supposed to do with such a request.  Sen. Dianne Feinstein, D-Calif., and Sen. Mark Warner, D-Va., have also requested a review of Barr’s comments. (For full disclosure, I testified in favor of Barr’s confirmation before the Senate Judiciary Committee).

I previously wrote that:

“Atkinson was wrong in his interpretation of the complaint failing within the statutory scheme for reporting to Congress. While the inspector general concluded that this allegation fell within the whistleblower law, the Justice Department has a good faith basis to reject his interpretation. That law is intended to address mismanagement, waste, abuse or a danger to public safety by intelligence officials. The president is the ultimate intelligence authority, and there is little support to argue that a discussion between world leaders should be viewed as a subject of this law. After all, any intelligence official could claim that a president undermined national interests in discussions with another world leader. Trump has been denounced, perhaps correctly, for disclosing classified information to foreign figures, but he has total authority to declassify information for a good reason, a bad reason, or no reason at all.

I believe that Atkinson should have yielded to the legal judgment of the Justice Department on the interpretation of this law.”

I still would not have fired Atkinson so long as he committed to following Justice Department interpretations in the future. I also criticized other terminations following the impeachment, though they were clearly within Trump’s authority.

Barr essentially made the same argument when asked why Atkinson warranted termination for ignoring the interpretation of the Department: “from the vantage point of the Department of Justice, [Atkinson] had interpreted his statute, which is a fairly narrow statute, that gave him jurisdiction over wrongdoing by intelligence people and tried to turn it into a commission to explore anything in the government and immediately reported to Congress without letting the Executive Branch look at it and determine whether there was any problem.”

For that reason, Barr thought that the termination was “the right thing” to do.

Yet, Schiff and Nadler have called upon Justice Department Inspector General Michael Horowitz and acting director of the Office of Professional Responsibility Jeffrey Ragsdale, to investigate Barr for “blatantly mischaracteriz[ing]” the basis for Atkinson’s firing.  They claim that “Mr. Barr’s misleading remarks appear to have been aimed at justifying the President’s retaliatory decision to fire Mr. Atkinson.”  That is the basis for an Inspector General’s investigation?  Why would an Attorney General opining on the legal basis for a termination be a violation of federal law or policy?

Barr is right that Atkinson’s termination would be justified on such a basis. He does not claim that this was the only or primary reason for Trump’s decision.  Yet, Feinstein and Warner believe that the IG should investigate an Attorney General if he is viewed as “misstating” facts behind a president’s motivation in firing an official.  Such a standard would allow the IG’s office to regulate all public comments by a president or cabinet member for their accuracy or veracity like a type of fact checking operation.

The call for this investigation undermines the credibility of the otherwise serious work to be done by the Committee. It shows a type of perpetual motion machine of investigations built by the Democrats.  I fail to see why this is a wise political strategy. It is designed to get a brief media hit but also dilutes the impact of real matters that warrant investigation.

    What the law actually says:

    “The Inspector General is authorized to receive and investigate, pursuant to subsection (h), complaints or information from any person concerning the existence of an activity within the authorities and responsibilities of the Director of National Intelligence constituting a violation of laws, rules, or regulations, or mismanagement, gross waste of funds, abuse of authority, or a substantial and specific danger to the public health and safety.”

    It does not say the person making the complaint must be in the intelligence community nor does it say say the “violation of laws, rules, or regulations, or mismanagement, gross waste of funds, abuse of authority, or a substantial and specific danger to the public health and safety” must be carried out by intelligence officials.

    This complaint concerns an “activity within the authorities and responsibilities of the Director of National Intelligence” because it involves intelligence officials reporting classified information and the subsequent investigation will require someone who
    can handle classified information to conduct it.

    The idea is to provide an avenue for reporting “violation of laws, rules, or regulations, or mismanagement, gross waste of funds, abuse of authority, or a substantial and specific danger to the public health and safety” without compromising classified or sensitive material.

    Besides all that. the ICIG reports his findings to the Director of National Intelligence. It was the DNI that gave the complaint to Congress.

The most revealing thing in this blog since Trump has come power has been Turley’s constant framing of his most egregious misdeeds with “both-side”isms and minor show of displeasure. Contrast that with the acerbic tone with which even the minor actions of democrats – especially female democrats – are treated with. And people of color deserve a special corner in all this – just check how he handles the goat’s accomplice Bill Barr with Eric Holder.

    Mayor Bill de Blasio’s critics let him know how they really felt about him ordering New Yorkers to snitch on each other for violating social-distancing rules — by flooding his new tip line with crank complaints including “dick pics” and people flipping the bird, The Post has learned.

    Photos of extended middle fingers, the mayor dropping the Staten Island groundhog and news coverage of him going to the gym have all been texted to a special tip line that de Blasio announced Saturday, according to screenshots posted on Twitter.

    One user sent the message “We will fight this tyrannical overreach!” to the service and got an automated message that in part said, “Hello, and thank you for texting NYC311.”

    “F–k you!” replied @MorganLSchmidt1, along with a meme showing Adolf Hitler and the words “TO THOSE TURNING IN YOUR NEIGHBORS AND LOCAL BUSINESSES — YOU DID THE REICH THING.”

    “Start flooding their reporting text numbers with this pics!” the tweet added.

    Other profane messages included a photo of a bowl of gummy candies in the shape of male genitalia and a sign saying “EAT A BAG OF D–KS.”

    It was not immediately clear whether any of the posters actually lived in New York City.

    A Twitter post comparing Mayor de Blasio to Hitler in response to his call for New Yorkers to report social distancing violations.

    An NYPD source said that “dick pic” photos of real penises have also been texted to 311, and a caller phoned in a tip that de Blasio was seen performing oral sex on someone “in an alleyway behind a 7-11” early Sunday.

    “He looked at me…and coofed in my direction,” the caller said, according to a photo of the 311 operator’s computer screen provided to The Post.

    “Coof” is a newly coined term for coughing while infected with the coronavirus, according to the Urban Dictionary website.

    The inundation of off-color texts was so large the city had to temporarily shut down the service.

    “The city has begun vetting everything before dispersing the information to precincts,” the NYPD source said.

            1. Young – I haven’t been that deep in a mine, but I have fought a grassfire.

              1. Paul– I haven’t done a grassfire, just tall timber, but it is probably the same, ax, shovel, pulaski and lots of sweat and hard work, sleeping in the open. Good times when you are young.

                Some guys liked underground but I didn’t care for it, but I was in the same mine that killed my uncle. After I left there was a major loss, 91 men in a single day. Greg Olson wrote a very good account of the disaster in The Deep Dark. You will probably recognize the culture, pretty much the same as Butte.

                  1. Paul, if you look down the shaft you can see nothing, just dark and you realize you can drop three Empire State buildings down there before you will see the top of one. Then you go down. It is very humid and hot and in places difficult to get a breath if you exert yourself. And sometimes dangerous. From 3,700 there was another shaft that went down more than another 1,000 feet. The two guys who survived the first day of the disaster found safety huddled down there. I think everyone on the 3,700 who did not get out immediately died.

                    1. I knew some of them and I have wondered if any of the guys I worked with were among them, but I don’t remember their names. The names of the dead are on the memorial at the bottom of Big Creek Gulch where the mine is.

  18. I don’t think the President is required to give any reason for firing anyone who serves at his pleasure.

    I think Obama fired every U.S. Attorney in the country without explanation and the political establishment didn’t raise a peep.

    The perpetual investigation machine of the Democrats is not intended to discover facts. It is to try to wound this President in any way possible.

    Given their history, does anyone truly doubt that they will resort to voter fraud in the next election?

    An incomplete list would include: Claiming he was not elected because he did not receive a majority of the popular vote. Claiming the votes were miscounted and demanding recounts (which resulted in more votes for Trump). Pleading to the electors to illegally not vote for Trump despite the electoral votes the President won. Spying on his campaign. Spying on his Presidency. Illegally leaking confidential information. Pursuing a fraudulent investigation that spent millions of dollars and wasted millions of hours only to come up with nothing. Initiating a completely fraudulent impeachment that was supported lock-step by only one party and never had a chance in the Senate. This was bad because it was one more distraction when the Wuhan virus was coming our way. Blood on Democrat hands for that one. Beginning more frivolous investigations. All that! Yes, I think they want to engage in voter fraud and are pursuing mail-in-voting and vote harvesting and opposing voter ID to achieve that goal.

    The DNC makes the mafia look like straight-up, honorable guys.

    2. Young. US Attorneys are routinely replaced by new administrations. They are political appointees. Hard to imagine you’re a lawyer and don;t know this. IGs on the other hand are not routinely replaced and are intended to be as independent as possible within the executive branch.
