Federal Court: New York Democrats Violated The Constitution By Cancelling The Presidential Primary

downloadDemocratic politicians like Sen. Chuck Schumer (D., N.Y.) have been railing against what they view as an undemocratic effort to suppress votes.  Former Vice President Joe Biden has even peddled a conspiracy theory that President Donald Trump was certain to halt the November election.  However, a New York judge has ruled that it is the Democratic party that violated the Constitution in cancelling the June 23rd presidential primary to effectively anoint Biden as the party nominee. What was particularly striking was the highly dubious argument presented in court by the Democratic Party.

U.S. District Judge Analisa Torres ruled that the Democratic Party violated the First and 14th Amendment rights of candidates like Sen. Bernie Sanders by cancelling the primary.  What was transparently opportunistic was the rationale.  The Democratic Party argued that they needed to cancel the primary because of the danger of the coronavirus. However, it was still planning to hold its congressional and state-level primaries on June 23.

Judge Torres wrote that

“If all but one of the presidential candidates are removed from the ballot and the primary is not held, Delegate Plaintiffs will be deprived of the opportunity to compete for delegate slots and shape the course of events at the Convention, and voters will lose the chance to express their support for delegates who share their views. The loss of these First Amendment rights is a heavy hardship . . . There is also a strong public interest in permitting the presidential primary to proceed with the full roster of qualified candidates.”

Sanders had petitioned New York to remain on the primary ballot.

The move by the New York Democrats was particularly resented by Sanders’ supporters after the Democratic National Committee effectively rigged the primary to guarantee the nomination of Hillary Clinton in 2016.  This year, the party establishment was equally active in working against Sanders. (and here) Hillary Clinton has actively opposed Sanders. The decision of the party only reenforced the view of many Sanders’ supporters that the party only believed in the democratic process when the results are acceptable to the party establishment. That view was stated repeatedly to me at the last major campaign rally of Sanders in Michigan.

The question for Biden will be whether the current controversy over the allegations of sexual assault will impact the voting in the primary.

The duty of the Supreme Court was only ever to declare void, all acts contrary to the manifest tenor of the Constitution. Imagine, Supreme Court justices are superior intellectuals but have no grasp of the “manifest tenor” or their basic duty. Communists (liberals, progressives, socialists, democrats, RINOs) have violated the Constitution by imposing the welfare state and the Supreme Court has upheld it.

    – Article 1, Section 8 prohibits any and all taxation for individual or specific welfare, charity or redistribution of wealth.

    – Article 1 Section 8 prohibits regulation beyond that of money, the flow of commerce and land and naval Forces.

    – The 5th Amendment provides the absolute right to private property and allows no claim or exercise of dominion by Congress.

    General Welfare – ALL PROGRESS WELL. The only constitutional taxation, other than for security, is for “…general Welfare…” such as roads, water, electricity, sewer, trash pick-up, post office, etc. General is defined as ALL, not one, a few or some.

    The entire American welfare state is one grand violation of the Constitution and Bill of Rights. Affirmative action, quotas, welfare, food stamps, rent control, social services, forced busing, minimum wage, utility subsidies, WIC, TANF, HAMP, HARP, TARP, Agriculture, Commerce, Education, Labor, Energy, Obamacare, Social Security, Social Security Disability, Social Security Supplemental Income, Medicare, Medicaid, “Fair Housing” laws, “Non-Discrimination” laws, etc., are all unconstitutional.

    First, this in not final ruling. That wasn’t on merits, but rather, for intermediate relief ( preliminary injunction).

    Second, most of the candidates, voluntarily, by their own initiative, had suspended or removed their candidacy, I quote from the ruling:

    ” Over the course of February, March, and April, however, ten out of the eleven presidential contenders ” publicly announced that they are no longer seeking the nomination for the office of president of the United states, or that they are terminating or suspending their campaign ”

    The judge indeed, asserted that, in many states, there is that fight against the Coronavirus, not only in NY, but, not to forget, that the fact is, that the rate of infections, is far greater in NY, so, had to be incorporated, within the discretion of balance of hardship made by the judge.

  5. Is Turley Really Concerned For Bernie,?

    Or Worried For Trump??

    The Professor has ignored stories pertaining to Trump’s reelection campaign; which by all accounts is in a state turmoil.

    Trump’s campaign had planned to use the slogan ‘Keep America Great’. But that motto may not work with 20% Unemployment. So what’s an incumbent to do? ..’Blame China’..? Why ‘yes’, of course, weeks of blaming China will convince Americans that Trump deserves 4 more years to start a civil war!

    But Trump realistically Trump knows he may not get 4 more years to start a civil war. So he may have to complete this mission by January. That may explain why Trump keeps threatening to prevent any federal rescue of the states. Trump wants us to think that such a rescue would ‘reward blue states for their fiscal irresponsibility’.

    You see if Trump can convince his base that blue states want a rescue at the ‘expense’ of red states, that could possibly stoke just enough anger to start a civil war. Keep in mind that most are on their way to bankruptcy due to the pandemic. So now is the ideal time for Trump, and senate Republicans, to make a rescue of the states the most contentious issue possible.

  7. If Democrats cancelled all primaries and events around that time frame, they could have truthfully said they were obeying social distancing laws. Since they didn’t, this is yet another underhanded trick against Bernie Sanders.

    I do not support Bernie Sanders. That doesn’t matter. The rules need to apply equally to everyone. If the Democrat Party wants the right to decline certain candidates running as Democrats, then they need to encode that in the rules, and tell them no at the beginning. Instead, they allowed Bernie Sanders to run, spend all that money, and then keep doing dirty tricks to keep him out.

    The country does need to develop a way to function during a pandemic. While I have made clear that I do not want quarantine lifted until there are N95s aplenty, and an approved treatment, I am in a high risk group. I have asthma. I have a kid and I certainly don’t want him exposed to any disease associated with lung and heart damage. My husband is healthy but I don’t want him sick, either. If anyone in my family comes down with Covid-19, I’ll take care of them. With my asthma, I doubt I’d make it. I want to keep this disease away from my entire family.

    However, it is not Ebola, with its 50% mortality rate. It’s not Smallpox. But it could be. There are still samples of smallpox kept in two labs that I know of. One of them is in Russia. There is no way there are only two. These are the days of genetic engineering. There will be more plagues, and our global connectivity will guarantee they will spread rapidly.

    I was disappointed to see Congress continuing to operate in person. The press gaggle still crowded around. Eventually, they started putting empty chairs around them, but they are still clustered together in halls and breathing the same air.

    As terrible as Covid-19 has been for us and other countries, it is practice for bigger and worse on the event horizon.

    We have got to learn from this experience. Grocery stores have got to be able to smoothly transition to no contact delivery, shipping, and curbside pickup. They have to be able to get groceries to customers without requiring in person shopping. Our government and court system must figure out how to keep running during epidemics, without requiring people show up in person. Prisons have long been disease dispersement systems with MRSA a long standing problem. Here in CA, they have repeatedly emptied jails over the years, most lately due to Covid-19. Crime is getting rampant. Police don’t even respond to a lot of shop lifting, as the felony threshold is now $950. That recent Turley post about the guy arrested thrice in a day is not even that unheard of.

    Most of all, our economy has to adapt to survive during shutdowns. That means that employers who can, need to develop work at home alternatives ahead of time. The food supply chain must be able to transition from restaurant sizing to individual consumer packaging. No more potato and milk dumping when people need groceries. Crowded worker conditions in food plants are sources of contagion. I foresee more automation and job losses in future, sadly.

    1. I have BernieBros in my family. Their dispositions are such that it would be a challenge to move any of them into the Republican column. I’d like that, but it would require some incremental adjustments in the Republican stance that would need time to percolate through the culture. Some of them also need to stop confusing irritations and disappointments that are embedded in the human condition (which they imagine aren’t based on a potted idea of life in Sweden) with actual injuries done to people.

      I’d also like to see incremental erosion in the Democratic lock on the black vote. The way forward in that realm I think would be a cultural shift wherein rank-and-file blacks understand society and history in light of their mundane lives and not in light of social propaganda. The last flip of the political ecosystem in the black population occurred very rapidly – really over the period running from 1960 to 1964. Just returning to the situation ex ante (wherein Republicans got 30% of the black vote rather than 10%) would be beneficial to all concerned in this environment.

You did not attempt to touch me or my children. Forget the hand, she was taught the throat. My old lab that I crawled out on the ice to pull out when he would not give up “his duck” and use his teeth to grab a hold. Well below zero but I always carried emergency rations, blankets etc. in my truck. I wrapped him up and turned the heater on high, unloaded and went home. I never hunted ducks again.   14. I recall a sermon by a minister relating to marriage when he said ‘what does love have to do with it’ meaning you learn the meaning of real love over time in a marriage. But, in this situation the federal and state legislators frequently ignore the constitution. One of our members told their state legislator when she met with him ‘you know this bill goes against the Tennessee constitution’ and he had that deer in the headlights look. Any and all human beings who touch proposed legislation should be ‘mandated’ to have read and passed a test on the state and U.S. Constitution. So, again, what does the constitution have to do with it?

        I see your point as it relates to Senator Sanders and no I’m not suggesting his name should have been removed from the ballot. However, I am suggesting it would have been helpful to readers to provide a brief overview of previous primaries cancelled in various states by both parties.

        1. Why would that be helpful? Were the other primaries and other parties included in the suit? How far back would you need JT go for you to have your personal needs met?
