Are Anti-Mask Masks Legal?

The anti-masks are made of thin material, mesh or even crochet and are advertised as having no protective qualities for Covid-19.  The question is whether they are legal.  They appear to be so.

A popular video shows a man wearing a mesh mask to a Tampa Walmart and saying “It was almost like not wearing a mask at all. Nobody cared. That’s because it’s not about safety. It’s all about compliance.”

Most laws like Alabama‘s only refer to a “covering” not a mask with protective qualities:

2. Facial coverings for individuals. Effective July 16, 2020 at 5:00 P.M., each person shall wear a mask or other facial covering that covers his or her nostrils and mouth at all times when within six feet of a person from another household in any of the following places: an indoor space open to the general public, a vehicle operated by a transportation service, or an outdoor public space where ten or more people.

Maryland requires masks:

“Facial coverings for individuals.

Effective July 16, 2020 at 5:00 P.M., each person shall wear a mask or other facial covering that covers his or her nostrils and mouth at all times when within six feet of a person from another household in any of the following places: an indoor space open to the general public, a vehicle operated by a transportation service, or an outdoor public space where ten or more people are gathered.”

Even that is subject to exceptions. However, consider the definition of face coverings:

“Face Covering” means a covering that fully covers a person’s nose and mouth, but is not a Medical-Grade Mask. The term “Face Covering” includes, without limitation, scarves and bandanas.”

A mesh mask does cover the fact and, since scarves can be used, there is no effort to indicate a threshold protective level or dimension.  There are vast differences between masks and stores are unlikely to want to police the sufficiency of masks, particularly if the states do not specify minimal standards.  Even creative work on the noun “cover” does not help much.  Oxford defines it as simply “a thing that is put over or on another thing.”  A permeable material still covers the mouth and nose. It just does little else.

Twitter is replete with such anti-masks with such disclaimers as “Stylish, breathable and don’t protect you from a darn thing! Masks required? No problem! Breath free while making a statement.”

It is a statement that most people would not want to make.  However, it is probably legal.  It can bring certain notoriety with a chance of lethal contraction.

However, with cities like Miami threatening $500 fines for failing to wear a mask, more people may choose to protest with these defiant masks — defeating the efforts to curtail the spread.

Given the recent incidents of people flipping out over masks, this is not likely to make things less confrontational. The latest example is some a person named Ruby Musso who filmed herself arguing with staff after she refused to wear a face mask. Multiple employees ask her to leave and she is called a “Karen.” She in turn calls them Nazis.

The anti-mask mask is likely to trigger new confrontations as stores or other customers object to failure to follow the “spirit” of these orders while others claim the right to comply in their own defiant way.

By the way, the anti-masks are not the only technical workaround pandemic rules.  New York bars are now reportedly serving “Cuomo Chips” for $1 to get around the ban on alcohol without food.  This is meant to satisfy the requirement that “all restaurants and bars statewide will be subject to new requirements that they must only serve alcohol to people who are ordering and eating food.”

  1. Better question: If the United States decided to become an overbearing Communist country in the spirit of Communist China, could it be any more idiotic and annoying abut it? Answer: No, it couldn’t. I’m not wearing a face diaper.

  2. Sure, people can do this, it’s probably legal and even if it wasn’t, it would be in practice hard to enforce people wearing masks with some protective qualities. This said, it’s about as smart as using condoms with the end cut off. They may be more comfortable, but what’s the point? I don’t think anybody ever proposed that as a way of making some statement about AIDS, but then, young people in my days were considered silly and stupid by our elders, but we were the voice of reason compared with young people today. And yeah, lots of people in my day objected to curtailing of their sexual freedoms, which isn’t even a thing one associates with condoms these days.

    So, to be consistent, people who refuse to wear masks should also refuse to use condoms, and now that we’re at it, why wear any clothes at all? It’s summer, and clothes are uncomfortable at these temperatures. Make a statement against oppressive and stupid laws, go naked! Oh sorry, nobody is trying to brainwash along those lines, so you didn’t think about it. You must prove your love of freedom by doing the same stupid thing as everyone else.

      If you are wearing a condom it means you are have sex with another person.

      Whereas, a mask does not have anything to do with having sex with another person.

      Then there’s the fact that Fauci clearly said that masks are useless just 3-1/2 months ago.

      1. MOCA is a test of basic mental competence. It is not an IQ test.

        Estimate of Trump’s IQ based on his success in multiple different endeavors strongly sugest an IQ significantly north of 135.

        The only real negative indicator for Trump is the way he uses language. But that is complex. He speaks with the vocabulary of a long shoreman, but his ability to debate is very high. He has jousted with the press for 4 years, and the left has to lie about what he said to find a problem.

        Further politicians are noted for carefully constructed speech patterns. Obama had to speak like a white lawyer to get elected. GWB had a reading list that was impressive, but drawled like a texas oilman – which he was not. It is near certain both practiced how they spoke – down to the errors.

        Trump speaks in the way that those whose votes he is getting would speak.

        1. Trump doesn’t speak to impress the faculty; he speaks to connect and carry his audience. Once that is recognized his performance is remarkable. He isn’t talking to the crowd he is having a glittering conversation with them; somehow it is two way and they love it for its impression of spontaneity. By comparison, Obama and most the rest are doses of Ambien that leave one yearning for a nice, fluffy pillow.

            He is speaking directly to ordinary people, in language they understand without being condescending.

      It is not a test of intelligence. It is a test of cognative impairment. A perfect score is 30, The average for unimpaired people is 27.4 – though how anyone gets 2 wrong is besides me.

      But if you have had a stroke of are in cognatice decline MOCA will catch it.

      My father suffered from Vascular demensia. He was also an architect – which should have helped him alot in the visual aspects of the test.

      After his first stroke he declined from 22 to 16 very rapidly.

      I am not surprised Trump “aced it” – it is not a difficult test – if you are not impaired.

      Honestly I hope Biden is not in cognative decline. But his mannerisms and behavior are changing slowly exactly the same as my father after his first stroke. And at close to the same rate.

      Wallace making a big deal out of MOCA is stupid.

      Trump made the mistake of claiming to have aced something that is trivial for anyone who is not impaired.

            It is not supposed to be either easy or hard.

            Each question is supposed to identify specific cognitive deficits.

            If you do not have that specific deficit the question is easy.
            If you have that deficit to a large degree the question is impossible.

            Many people who are not cognatively impaired are weaker in some areas.

            A perfect score is 30. The norm for an unimpaired person is 27.4 – so obviously most people get 2 wrong.

            To be considered impaired you have to get 8 wrong.

            So alot of people who are not impaired get as many as 7 wrong.

            So I would avoid the topic of cognitive decline, if I were a Biden supporter.

                Yet his handlers refuse to release the results of those tests.

                That’s because the tests clearly show that he has Dementia/Alzheimer’s.

                So the DNC is going to nominate a Presidential candidate with obvious Dementia.

                If that doesn’t concern you, then you should be tested for cognitive decline. Or maybe an IQ test, as well.

              Further Biden has always had a speaking style that is incoherent.

              Those problems make an assessment purely from his limited public appearances difficult.

              But it does appear that Biden’s problems are changing and worsening

              The rate of change is not consistent with alzheimers but something that moves faster.

              I would further note that Biden in his best days – is not someone you would want as president.

              1. I’ve been through the Dementia nightmare for 5+ years with my mother. So I have become an unwilling expert on Dementia and all of its stages. That was derived by witnessing it first hand, as well as countless hours of reading about the disease, plus meetings with her Doctors.

                As early as last Summer (2019) I started telling people that Biden had Dementia, but it was in its early stages. But by this past Winter it had already devolved to mid-stage Dementia.

                FYI- There is no specific “rate of change” from one person to another with Dementia or Alzheimer’s. With some people (like my mom) it happens very slowly, with others it can progress very rapidly.

                Biden obviously falls into the latter category.

                The DNC is fully aware that he has Dementia, but they don’t care. Which is extremely cruel.

                Yes, Biden has always been as dumb as dirt, and even more dishonest. But I don’t wish this on anyone, or their family.

                    That said he is still old enough there are lots of concerns. The life expectancy of people his age is barely to the end of his term.

                2. My father had vascular dementia, caused by lots of strokes, many very small.

                  It took 2 years from the first stroke to death. Two hellish years.

                  I have a friend whose wife developed early onset dementia.
                  Much slower, it took her 10 years to die.

                  But if anything that was worse.

                  I do not wish this on anyone.

                  Biden appears to be progressing pretty fast. Slower than my father, but not alot.
