A Golden Calf Lawsuit? Controversy Erupts Over Doctored Photo of Republicans Praying At Trump Statue

A picture has been circulating on the Internet among Democratic and liberal posters that purportedly showed Republicans praying at a gold-colored statue of former President Donald Trump at the 2021 Conservative Political Action Convention (CPAC). The statue was mocked by critics as “the Golden Calf.” Figures like Joel Stein, who wrote for the Los Angeles Times, proclaimed that “the fall of Rome was this embarrassing.” Former Democratic congressional candidate Adam Christensen circulated the photo as did others with similar mocking notations. Another poster Mo Bella wrote Caption “this photo taken today of CPAC’s evangelical leaders. Yes, they are praying to a golden statue of their holy insurrectionist.” The problem is that the photo was fake. The question is whether those depicted could sue for false light in such a depiction.

The original photo was taken with the “Evangelicals for Trump” group dated Jan. 3, 2021 and included evangelical figures like Pastor Paula White-Cain. The posts were later flagged as part of Facebook’s efforts to combat false news and misinformation on its News Feed.

Stein acknowledged his re-posting of a fake picture and promised to take it down but stressed the the statue itself was real — evading the obvious point that he was ridiculing these (also real) people as worshipping Trump in the literal sense. Instead, he simply noted “The statue is real. It is difficult but important to stick to facts amid the insanity of American politics.”

Even that degree of recognition seemed beyond the ability of figures like Christensen who admitted later that the photo was fake but insisted that the “intent” in the photo was “clear.” He then attacked Trump supporters again: “White Evangelical support is near an all time high going into CPAC and after the event rolling this idol into the conference it’s clear that their ‘support’ is close to going to the next level.” That sounds a lot like “sure it was a fake but it is really true, right?” There is a great deal of difference, particularly for religious people, between praying with Trump and praying to his golden idol.

Many of those re-posting this image are the same people pushing to ban others from social media for spreading “fake news” or “disinformation.”  Christensen showed how easy such hypocrisy can be addressed. He insisted that the photo was a “visual representation of what I see in Conservative media circles as well as those that I grew up with.”

The problem however is that while the picture was fake the people in the picture were not.  The photo suggests that these individual religious leaders prayed to a golden image of Trump — a clear reference to the Golden Calf in the Old Testament. As discussed in Exodus, Israelites had a change of heart after Moses went to Mount Sinai to receive the Ten Commandments. In direct defiance of God, they built a “molten calf” and they declared: “‘This is thy god, O Israel, which brought thee up out of the land of Egypt” (Exodus 32:1–4). They “offered burnt-offerings  and other gifts. Moses pleaded with God to spare them for such sin.

It is a defining passage for many religious people — the line between faith and sin; between worship and idolatry. To show not just religious persons but religious leaders praying to a Golden Calf is the ultimate insult and defamation.

In many states, any lawsuit would be framed as defamation. They are not named in the photo but they are all widely recognized public figures.  As such, they would fall under on Gertz v. Robert Welch, Inc., 418 U.S. 323, 352 (1974) and its progeny of cases.  The Supreme Court has held that public figure status applies when  someone “thrust[s] himself into the vortex of [the] public issue [and] engage[s] the public’s attention in an attempt to influence its outcome.” A limited-purpose public figure status applies if someone voluntarily “draw[s] attention to himself” or allows himself to become part of a controversy “as a fulcrum to create public discussion.” Wolston v. Reader’s Digest Association, 443 U.S. 157, 168 (1979).

The Supreme Court mandated a higher standard to protect freedom of speech and the free press. The standard for defamation for public figures and officials in the United States is the product of a decision decades ago in New York Times v. Sullivan. The Supreme Court ruled that tort law could not be used to overcome First Amendment protections for free speech or the free press. The Court sought to create “breathing space” for the media by articulating that standard that now applies to both public officials and public figures. In order to prevail, they just must show either actual knowledge of its falsity or a reckless disregard of the truth.

However, a more direct claim (if recognized in a given state) would false light. That tort requires a publication that puts a person before the public in a false light that is highly offensive to a reasonable person. It also requires a showing that the poster or publisher knew of or acted in reckless disregard as to the falsity of the publicized matter.

Obviously, the person who created this image knew it was false.  That person may have meant the picture as satire and made the meaning clear (Note there can still be appropriation of a person’s image or likeness for commercial purposes). It is not clear where this image originated.

The use of such a picture is a common peril in the age of social media. Many people knowingly post false stories or picture knowing that they will be replicated and reposted. As more people post an image, the more it appears genuine.  For others, there is little desire to confirm whether it is true or not if it fits a narrative. There is an old expression in the media that there are certain “facts too good to check.”

I have written about such mythologies in the law that are repeated for years without question.

It seems unlikely that a lawsuit would emerge against these posters, but the controversy does show how the campaign to bar individuals for disinformation is often selective and biased in its applications. That was the subject of my recent testimony in the House on efforts to curtail cable access and mandate other forms of media censorship.

    Yes, there is, but it is absurd to even suggest the second option, unless one is being sarcastic or indulging in ridicule and strereotypy.
    Christians (not just Southern Baptists) voted for Trump because he supported policies that they wanted implemented. They had no reason to vote for candidates who advocated policies contrary to their values and beliefs. They knew who and what Trump was, but they chose to support his policies, not to endorse his character.
    Christians also pray for sinners and welcome back the prodigal and the wayward, so there is a third option regarding prayer, which is a plea, not a vote — that they prayed for Trump, not so much to save his soul as to save the country and themselves from Hillary and Joe, whose policies were, and are, antithetical to many traditional Christian beliefs and values.
    There is no need to agree with those with whom we disagree, but it is important we make an effort to understand them.
    It is not possible to reconcile Christian beliefs with those held by neo-liberals because they belong to different belief systems derived from different assumptions about human nature and reality in general, but it is essential to tolerate the beliefs of those with whom we disagree, whether convinced neo-liberal activists or devout Christians. The alternative is intolerance — a refusal to tolerate “error” and an obsessive desire to suppress it.
    Tolerance protects free speech and other freedoms which we all value. Intolerance invites a secular revival of the religious wars of the Reformation, which Europeans ended only by finding ways to live with one another, despite their profound religious differences.

Not only did he cheat to get out of military service, he threatened his namesake with disownment when he expressed an interest in the military. He mocked John McCain, a genuine American war hero, and he called those who volunteered for the military “suckers”. And, you think this person should be Commander in Chief?

      Trump doesn’t have any “policies”–he was a Democrat for decades until he decided that that massive ego of his needed greater affirmation and attention, so he said what he had to say to reel in his disciples. He pandered to their fears of losing their perceived white privilege to college educated blacks and women, of America being unable to compete with China, and fears of brown people from south of the border taking over lower paying jobs. He harkened back to days when coal was king, when there were good–paying factory and mining jobs and when women and minorities knew their assigned place in society. Those days are gone. So, he cheated his way into the people’s White House with help from Russia. Fox and other non main stream media lie about the results of the Mueller investigation, but even Trump’s own head of intelligence, Dan Coats, confirmed that Russia did help Trump cheat in 2016. He got fired for telling that truth. The truth is dangerous to Trump–he also fired Chris Krebs and Bill Barr for refusing to confirm the Big Lie. Trump lost the most-secure election in US history. Every Secretary of State confirmed the accuracy of votes after allowing recounts, signature match validations and investigating complaints of fraud, which were unfounded. Sixty+ courts listened to what Trump’s lawyers said was evidence of fraud and dismissed the claims because the few glitches and irregularities they came up with were not sufficient to overcome Biden’s 7 million vote advantage. The lie about the Dominion machines being manipulated or capable of being manipulated have been disproven. These are facts. Nevertheless, he continued lying and went on a vainglory “Stop the Steal” tour, encouraging the faithful to fight Congress for him, to overcome the will of the American people, most of whom: 1. didn’t vote for him in 2016 or 2020; and 2. never approved of him–he never reached a 50% approval rating in 4 years’ time. Then, there’s the economy, botching and lying about the pandemic and record unemployment. Yet, you believe that the majority of Americans wanted him back for 4 years? Polls predicted he would lose, and he did, but yet, his disciples believe his “landslide victory” was stolen from him. He incited a riot that left 5 people dead, and watched it on TV, relishing the proof that he was loved and powerful. Thousands of people have died to due his incompetence and deceit.         Your post is so full of misinformation, disinformation, propaganda, and distorted perceptions of reality that I would have to spend the next hour responding in detail. But I have better things to do with my time, so I will just say that the Mueller Report was discredited, Mueller himself appeared less than impressive when called on to testify, and there is no evidence that Russia helped Trump cheat his way into office in 2016. That was a myth crafted by Hillary’s campaign with the help of some people at the FBI.
        As for Christians knowing ‘who’ Trump was, please review the coverage after the election in 2017, which makes it quite clear that Christians voted for him because they hoped he would pursue policies which they supported, not because they approved of his lifestyle or admired his character. That is the point.
        As for Hillary and Joe, precisely what policies do they have that might appeal to the 74 million or so who voted for Trump this past election or those who voted for him in 2016? Mail-in voting? Hormone blockers for children? Abortion on demand? A renewal of low-level wars in the Middle East? Other? I would be curious to know. I do not know if Joe is more than a Sunday Catholic, but I do know that the Catholic Church does not condone abortion as a normal practice.
        Perhaps you need to read more broadly and make an effort to understand those whose views you find odious, beginning with a good primer on politics. I would recommend Michael Walzer’s essay on ‘dirty hands.’ It’s short, to the point, and you can find it in R. B. Brandt, et al., War and Moral Responsibility, assuming the book has not been cancelled for being written by white men.

The DNI report specifically noted “This report includes an analytic assessment drafted and coordinated among The Central Intelligence Agency (CIA), The Federal Bureau of Investigation (FBI), and The National Security Agency (NSA), which draws on intelligence information collected and disseminated by those three agencies,” and some of the evidence they relied on was included in Annex A to the report.

          This is a great article by a liberal Democrat providing a post-2020 election analysis. Until I read this, the thought was Trump inspired a greater number of self-identified Republicans to turnout. This analysis however shows Trump actually moved traditionally Democratic voters in non-white demographics to vote Republican.

          What are the most important things you’ve learned about the 2020 election between the last time we spoke and today?

          What’s changed since November is that we now have individual-level vote-history data in a bunch of states. And we also have a lot more precinct-level data. And people have had more time to run surveys. So the picture has gotten clearer.

          One high-level takeaway is that the 2020 electorate had a very similar partisan composition to the 2016 electorate. When the polls turned out to be wrong — and Trump turned out to be much stronger than they predicted — a lot of people concluded that turnout models must have been off: Trump must have inspired higher Republican turnout than expected. But that looks wrong. It really seems like the electorate was slightly more Democratic than it had been in 2016, largely due to demographic change (because there’s such a large partisan gap between younger and older voters, every four years the electorate gets something like 0.4 percent more Democratic just through generational churn). So Trump didn’t exceed expectations by inspiring higher-than-anticipated Republican turnout. He exceeded them mostly through persuasion. A lot of voters changed their minds between 2016 and 2020.

          At the subgroup level, Democrats gained somewhere between half a percent to one percent among non-college whites and roughly 7 percent among white college graduates (which is kind of crazy). Our support among African Americans declined by something like one to 2 percent. And then Hispanic support dropped by 8 to 9 percent. The jury is still out on Asian Americans. We’re waiting on data from California before we say anything. But there’s evidence that there was something like a 5 percent decline in Asian American support for Democrats, likely with a lot of variance among subgroups. There were really big declines in Vietnamese areas, for example. Anyway, one implication of these shifts is that education polarization went up and racial polarization went down.

        Notice that the illegal acts were caught.

        No one is suggesting that there’s no fraud (unless they’re ignorant or dishonest). The issue is whether there’s widespread fraud that does’t get caught.

The past associations with Donald Trump by other cartoon characters is being scrutinized. Critics are calling for their blacklisting by the movie industry. Some say that Kermit is an example of green privilege, that Miss piggy is an illustration of pink privilege and Doctor Zeus may be guilty of hat privilege. Had Daumier and Goya been sued at the time for their depictions we may would never have been able to see their art in museums. That would be a big loss. You need to lighten up, Jonathan, and develop a thicker skin. As a big proponent of “free speech” you should welcome those who would try to portray Trump in an unflattering light–even if you don’t agree with them.
