President Biden Announces New “Red Flag” Rule Fit For Hunter Biden

President Joe Biden has announced unilateral gun control measures as part of his pledge to crackdown on gun violence like the recent attacks in Boulder and Atlanta.  The measures are unlikely to have a significant impact on such massacres, which is a long-standing problem with claims of politicians on curbing gun violence. What is notable however is the inclusion of a provision that relates directly to the allegations raised against Hunter Biden — allegations of a possible federal felony that have been virtually blacked out in recent media coverage and interviews.

The fact is that the range of possible reforms is very limited and are unlikely to produce transformational change on gun violence from what Biden calls a “public health crisis.” That does not mean that regulating “ghost guns” (home constructed weapons without serial numbers) is not a good idea.  However, such regulation would not have altered past mass shootings. Often individuals engaged in such killings acquire their guns legally. Likewise, the changing of the status of stabilizing braces (allowing a pistol to fire like a rifle) will not impact many such cases. A stabilizing brace was used in Boulder but the absence of such a brace would not have likely made a major difference in such a close quarters shooting.

However, it is the “red flag” provision that stands out on this list. Biden is giving the Justice Department sixty-day period to develop model “red flag” legislation that would allow friends and family members to identify an individual as a potential danger, thereby temporarily preventing the person from accessing a firearm.

That could well be called the Hunter Biden Act. As discussed earlier, Hunter Biden acquired a handgun despite his long-standing drug and alcohol abuse as well as a history of depression. In 2018, the gun was tossed into a trash bin in Wilmington by Hallie Biden, widow of the deceased brother of Hunter. After the death of his brother Beau, Hunter began a sexual relationship with Hallie and she apparently became concerned about what he might do with the gun. That is precisely the concern for the Red Flag law.  In many ways, her action reflected the need for such laws. In desperation, she threw the gun away but unfortunately chose a garbage bin not far from a school.

To get the revolver back, Biden answered “no” on the firearms transaction record that asked whether he was an “unlawful user of, or addicted to” a narcotic drug or any other controlled substance. Lying on that federal form can lead to prosecution under several provisions. The United States code makes it a crime punishable by up to 10 years in prison to “make any false or fictitious oral or written statement” to obtain firearms. Although prosecutions are rare, this should be a major story or at warrant media scrutiny. After all, the son of the president may have committed a federal felony and his father has been calling for greater expansion and enforcement of gun permitting laws.  Now, the issue of unstable gun owners is one of core areas of President Biden’s new reforms.

The question is not whether this proposal would change the conduct of gun owners but whether it will change the focus of the media. President Biden is now seeking a federal law to address precisely the situation that arose with his son. Even that might not make Hunter’s alleged violation newsworthy in today’s media environment. After imposing a virtual blackout on the Hunter Biden laptop story before the election, the media has published false accounts or barely addressed the controversy in a wide range of interviews on Hunter Biden’s new book “Beautiful Things.” When it came to the alleged gun violation, the media avoided any direct questions about the denial of a drug addiction that, according to Biden’s interview and book account, continued until his father’s 2020 presidential campaign.

It is an all-too-familiar pattern. Hunter admitted that he was a crack addict even during period when he was receiving massive payments from foreign companies due to his unexplained “expertise” on energy and other issues. Whether it is a gun felony or influence peddling, the blackout has turned into a media dimming with the book.  Biden is asked cursory questions that resulted in largely identical answers about his lack of memory from his long addiction. He simply cannot remember the laptop, its contents, or even fathering a child with a woman. It does not matter that he can remember details going back to his first drink at age 8. Reporters raised these issues and then quickly move on to other issues.

The new approved narrative was breathlessly described by CNN’s host Brian Stelter who declared it to be an “extraordinary” account of a “real human being.” Stelter gushed that the book’s depiction of “how many times Hunter Biden could have died, the president’s son, it’s breathtaking.”  It is not the book of a deadbeat dad, influence peddler, or the privileged political elite. Biden is instead a hero for our times – a modern Odysseus who overcame every challenge.

Biden life is a tragedy to be sure. Most of us feel great sympathy for his loss of his mother and sister as well as his brother. His addiction is hardly surprising given the painful chapters of his life. If this book and these interviews were fully honest and open, the book would be as breathtaking as Stelter claims. However, at every critical point where Hunter could be held accountable for criminal or unethical acts, he recedes into the claimed dark recesses of his memory. For example, he claims not to have any memory of fathering a child with former GW student, 29-year-old Lunden Alexis Roberts. However, he is not asked about fighting Roberts in her seeking basic parental support after being found to be the father after a DNA test. The court ultimately ordered such payments as “long due” and Roberts’ court filings described Biden as having “no involvement in the child’s life since the child’s birth, never interacted with the child, never parented the child,” and “could not identify the child out of a photo lineup.”

None of those “red flags” for the media have generated the slightest interest from reporters in interviews with Biden. Now, President Biden is pushing a law to address precisely the danger presented by Hunter Biden in 2018. The Red Flag law will be the next test for the media and whether it will confront or continue to evade the unauthorized Hunter Biden story.

    The World Trade Center event was not a mass shooting – but it was certainly a mass killing.

    Do you count Ruby Ridge or Waco amoung Mass shootings ? Or isn’t is a mass shooting when the government kills people without proper cause ?

    Regardless a “mass killing” is an event where the perpitrators goal is a large body count.

    Drive by shootings are NOT mass killings. Family anihilations are NOT mass killings.
    Armed robberies gone wrong are NOT mass killings.

    Now you can in oerwellian fashion manufacture whatever defintions you wish.

    But when you do as you are currently doing – you are actively engaged in deliberate deception.

    Drive buy shootings are a regular event in Chicago and LA. They have gotten WORSE because of YOUR stupid actions.

    Many people have pointed out to you that existing “red flag” laws are not enforced. Laws that make it a crime for a convicted felon to possess a firearm. This despite the fact that nearly all gun murders are committed by previously convicted felons.

    And yet – in just the past 9 months cities like DC, NYC, and Chicago have all reduced their efforts to identify, arrest and prosecute felons in possession of guns.

    You want people to beleive you are rational, following common sense, Reason. While at the same time your party, your people have actively weakened the most effective laws that exist to reduce violent crime.

    It is not Republicans who have weakened Gun laws – Person’s not to possess laws are common place throughout the country.
    They are very effective where enforced.
    They are not enforced in the very places where violence is worst.

    Actual mass Killings are rare – on average about 20/year over the past 5 decades.

        In state after state – we still have not reconciled the number of people who voted against the number of ballots counted – there remains in the swing states just under a 400K discrepancy between the total ballots counted and the total voters known to have voted.

        I honestly do not know the extent of Election fraud in 2020 – and anyone who claims to know left or right is full of Schiff.
        What I do know is that the election was conducted lawlessly – and contra your claims Ben – even several courts have now concluded that.

        But we have no means at the moment of correcting that.

        There is no fear that an election official who does not follow the law will be prosecuted. In fact atleast one has been promoted to the Biden administration.

        I have been lobbying for election integrity since just after the 2000 Bush Gore election.

        It has been self evident for 20 years that we have a huge problem in US elections.
        We are seeing more and more races won by razor thin margins. This is not a new problem – it has been true for 20 years atleast.
        WE have had 3 presidential elections in 20 years that turned on less than 100,000 votes across the country – one that turned on a few hundred. We have had house elections turn on as little as 6 votes – out of more than 100,000.

        If you are unable to grasp that is a recipe for disaster – you are an idiot.

        In the last election we spent $15B on the election. That is $100 for every single vote. The PV undercover video found that Ballots harvestors in Rep. Omar’s district were being paid $300 for each vote.

        It should be self evident that it is far easier to buy votes than to buy advertising to try to get votes.

        The incentives for election fraud – large and small are enormous.

        Yet those on the left have their head in the sand.

        You keep saying that Biden is respected internationally – you can not seem to grasp that questions about the integrity of the election completely undermine the government.

        If our media is censored – how is it we are to know we have the truth ?

        Regardless, if you are going to spend $15B on an election – then your party can afford to help its voters get ID’s.
        Democrats especially have a long history of transporting voters to polls. Why can’t they get the two voters in each state without ID through the process of getting ID ?

        The vigorousness with which democrats fight popular measures to improve election integrity draws one to the natural conclusion that democrats are protecting their own fraud.

        The Times article on the election was incredibly damning. It detailed much of the organized effort of the democratic party to win this election. It openly admitted a vast well organized “conspiracy” to subvert by any means necescary state election laws and state constitutions – particularly in the 6 key swing states.

        The openly admitted plan was one that made election fraud trivial. It was also rife with racist assumptions.

        There is nothing wrong with a campaign doing everything in its power to legally win an election.
        But the more that the ends justifies the means, the more that “legally” means – going arround the law – disregarding the law,
        the more that it is not the campaigns that are doing whatever it takes to win the election – but those withing government – the greater the danger of fraud.

        It is one thing for DNC lawyers to be arguing in court for favorable election law changes – it is another thing entirely for those – of either party, inside government to be seeking to change the law – without going through the legislature.

        And where there is this lawlessness – fraud is not likely far behind.

        I would note that though MOST of my fighting for election integrity has been against democrats – it did not start that way.

        My initial conflict was with Bush and the Helping America Vote Act. This foist on us nationwide millions of black box unauditable voting machines and counting machines. It has taken two decades to MOSTLY get rid of those opaque black boxes.

        WE can not have machines in any part of an election where there is not an automatic audit. PERIOD.

        Both parties have been complaining for two decades about mysterious vote flips by machines. Is this error ? Is this fraud ? Is it even real ?

        We do not know – and without audits we can not know.

        Personally I would entirely eliminate all voting machines. Manually counting 150M ballots in one day is perfectly feasable.

        Elections in france are hand counted paper ballots with results the same day.

        Buit it is possible to use machines – but not without automatic audits that are independent of the machines.

    At the end of Trump’s term the total C19 deaths were a bit over 300K
    US deaths are now 561K.
    Trump averaged less that 1000 C19 deaths per day in 2020.
    The death rate under Biden has been about tripple that – and is currently rising – even with alot of the country vaccinated – a Gift from Trump.

    Total 2020 deaths are consistent with a trend going back atleast 5 years – probably further.
    There are no actual excess 2020 deaths unless you presume that the number of deaths per year must be constant – despite the fact that population and total deaths have both been increasing for decades.

    Further life expectancy INCREASED in 2020. Put simply the overall number of life years lost in 2020 was LESS that previous years.

    But lets for a second Assume you are magically correct.

    What exactly was Trump to do ? If you presume that Trump has the ability to preclude those deaths. Then you must know how he could have stopped them.

    We are 80 days into the Biden presidency
    19% of the population is fully vaccinated, 34% has received one dose.
    And yet the deaths per day are higher than trump and rising.
    If Government has the means to reduce C19 deaths – why hasn’t that happened ?

    Todate the actual evidence is that Biden has done much WORSE than Trump on C19.

    As to the economic consequences – no it is not worse than a recession. It is weird, we have had nothing like it ever before.
    The closest we ever had was the 1921 depression which was very severe and 18months start to full recovery.

    The massive money pumped out had nothing at all to do with economic production.
    Free markets figuring out how to adapt to the pandemic did – as they always do.

    No recession is good. The recession caused by the collapse of the housing bubble was again the result of bad government – like nearly all recessions – bad monetary policy. – interest rates too low for too long. ‘

    Interest rates control the level of risk that investors will take. High interest rests result in very risk averse investing, while lower rates increase the amount of risk investors will accept.

    Regardless, I have no desire to defend Bush – he was an awful president – almost as bad as Obama.
    But he did not specifically cause the “great recession”.

    That said – while Obama did not cause it either, he is responsible for its duration. Reagan inherited a far worse recession – a misery index over 30 – we have never seen that. The Reagan recession was also deliberately cause by the Fed – that was what was necescary to purge stagflation from the economy. And we may see that again if inflation predictions are correct.
    But the reagan recession was short – recovery was fast.

    In fact historically – protracted recessions ALWAYS occur when government attempts to interveine, and short recessions occur when governments excercise fiscal restraint – again see the 1921 depression, and the 1980 recession vs, the great depression and the great recession.

    The wharton economic model is currently predicting that the Biden “stimulus” will produce atleast a 3 decade reduciton in growth of about 0.89% – that will bring the US below European levels of growth.

    This BTW is fully consistent with half a centruy of economic data that demonstrates that ever 10% of GDP that government spends reduces growth by about 1%/year. This is why growth rates in europe are lower than the US. This is why the standard of living in europe is about 30% lower than the US depending on the country.

    Over the past 50 years the US has absorbed more than 45M immigrants legal and otherwise mostly at the bottom of the economy and still ended up with a 30% higher standard of living than europe.

    Well keep this up and you can kiss that goodbye.

    Regardless, I will be happy to criticize Trump for his spending – as well as Biden.

    C19 is not even close to the spanish flu.

    It is more comparable to the 1967 Flu that occured during Woodstock. One in which we did nothing,

    But C19 is also unique in that nearly all those who die from it are in the last months of their lives.
    While most virus’s have higher mortality with age – C19’s age curve is dramatic.
    The deaths under 20 are miniscule – those under 40 much less than the Flu – even deaths under 60 are less than the flu.
    But if you are over 80 and get C19 you have a 1:3 chance of dying.

    As I noted before – US life expectance ROSE during the pandemic. HOW ? Because, there is a radical difference between the number of people who died and the number of life years lost. C19 had negligable impact on total 2020 deaths and even loss on life years lost.

    To a large extent C19 replaced Pheumonia as the cause of death for people who were dying of something else.

    You keep trying to make C19 into a huge deal it is only a huge deal if you are terrified of things that are inconsequential.

    BTW No court decided the election was “fair and square” – they decided things like Trump did not have standing, or it was too late, or as SCOTUS did that the issue was moot because congress certified the election.

    Atleast 4 different states have been found by courts to have conducted their election in violation of their own election laws.

    I already noted that the very limited random sample of signature verification that was done in Cobb county GA if true in Fulton county – which was near certain far worse than Cobb – would have flipped the election.

    GA courts have since found that GA was required to do signature matching by law – which they did not do.

    There remain substantial legal challenges to the election that are moving forward – these are near universally going bad for democrats.

    Please look into the history of election fraud in the US. The US has a long long history of election fraud.
    It was horrible in the 19th century – that resulted in 28 states passing constitutional amendments requiring secret ballots.

    No mailin election can EVER meet the requirements of a secret ballot. Regardless, without secret ballots buying and selling votes was common place. As was prefilling out ballots for people and giving them to them, or even delivering them for them.

    Today we call that ballot harvesting – which is illegal in most of the country and most of the world – but was rampant in 2020.

    It is likely that Kenedy won the 1960 presidential election was a result of large scale election fraud in Illinios.
    It is well known that Lyndon johnson won his TX senate seat with over 80,000 fraudulent votes.

    Regardless, election fraud is far easier and more commonplace in cities – and nearly all cities in the country are controlled by democrats.

    I do not think Republicans are especially more honest than democrats – but they normally have less opeortunity for effective election fraud.

    But mailin elections open the flood gates.

    As I told you before – give me $1M – that is chicken feed in an election where $15B was spent – and I can flip all size “swing states”.

    One of the huge problems – just ONE of many with government programs like this – is that they have no clue about the real economy.

    There are only so many civil engineers as an example. It takes 4+ years to increase their numbers, Decades to do so significantly.
    And no one will go to school to become a civil engineer to get a high paying job that will go away when the infrastructure program ends.

    Regardless if government does something that requiress more civil engineers – that will result in OTHER things not happening – other projects not being built. that will have little effect on civil engineers – but it will have dramatic effects on those who depend on civil engineers doing their job.

    This is quite litterally why the soviet union failed – and why ALL top down central planning fails.
    And we have more than a century of data that proves that.

    It is not possible for those at the top to allocate resources such to meet ALL the demands of a complex economy.

    There is only one resource allocation method that actually works – and that is the bottom up nature of free markets.

    In a free market – resources will always be allocated based on the wants and needs of the people AND the value they place on each of those wants and needs.

    Government – any kind of top down planning can not accomplish that.

    That is also why in a working economy, small businesses start grow, and eventually some become large business and then fail.

    Large businesses have significant economy of scale advantages over small businesses, but they are more fragile and less agile.

    There is only one company in the Fortune top 10 when I was a child that is still there.

    Many on the right are worried about the Amazon’s and FaceBooks, and Googles – I am not. They will adapt or be replaced.
    I do not know what the future brings – but i do know that big businesses rarely survive long without government propping them up.

    BTW everything tru of big business is even more true of govenrment.

    US Real GDP 2008 – 2016 15.6T-17.7 – that is a gain of 2.1T in 8 years in REAL GDP.
    2016-2020 17.7-19.2 – that is almost 2T gain in Real GDP in 4 years.

    Further Obama started at the depths of a Recession – he should have seen 2-4 years of 5% growth.
    Trump started at the end of one of the weakest recoveries of all time, and ended with a pandemic that breifly destroy 35% of the economy.
    And still managed almost 2T in REAL GDP growth.

    Inarguably Trump did Better than Obama economically.

    Humanitarian – if you wish to engage in charity – go ahead. I do personally.
    But Charity is NOT the business of govenrment. There is little if any humanitarian role for government.

    But since we are comparing – Biden has a humanitarian disaster at the US boarder one of his own making.
    In only 80 days he has managed to go from very little illegal crossings, very little in the way of unaccompanied minors.
    No “kids in cages” – to the worst situation in 30 years. To people dropping toddlers over fences. To 5 year olds wondering arround in the desert alone. To more unaccompanied minors than the entire Trump administration.

    80 days in and Biden is a total humanitarian disaster.

    And we have Biden and the Biden administration on TV telling these people “please do not come” – and thinking they will listen.
    They are coming wearing Biden T shirts.

    You have this weird idea that empty words matter – that telling illegal immigrants to wait – will do anything when you have thrown open the doors.

    Biden’s head of DHS is saying that Wall construction never stopped – and that it is going to continue, and that it must continue.

    This is not what Biden promised, it is not what he said on Day one.

    I do not even know if it is true.

    But what we all know is that this is a MASSIVE FAIL.

    Strength is not the result of a word here or there. It is a result of consistent action everywhere.

    I did not vote for Trump in 2020, or 2016.

    The 2020 election was still lawless. You can hold your breath till you are blue in the face – you can not change that.
    The election was certainly fraudulent too.
    Was there enough fraud to change the results – likely.

    I might eventually find out – because I am actually paying attention.
    It is clear at this point that GA was wrongly decided.
    It may become even more clear in the future.

    AZ is the next major area of inquiry. It is near certain that eventually the Senate indepent audit will take place.

    That will be a big deal.

    We already know than thousands of ballots were shredded since the election.

    Things to look for in the audit when it happens.
    Do the total ballots still in existance match the number of voters who voted.
    Is there evidence of forged ballots.
    Do the ballot counts match those reported and certified.
    Then we can go into – are the voters who are reported to have voted – actual eligable voters.
    Do the signatures and ID of the mailin ballots match.

    The likelyhood of not finding more than enough error to flip AZ is small.

    One of the problems the left has is that actual voter fraud – in a normal election – even an inperson election is more than enough to question an election that was this close.
    While know typical fraud in mailin elections is 20-200 times inperson fraud. \

    Another problem specific to the 2020 election and one of the reasons that recounts usually do not change things is that
    While FRAUD is lopsided, Errors tend to balance.

    We already know that the found discrepancies in counting have favored Trump by about 90:10.

    If the descrepancies were due to error – they would split about 50:50, The odds are unintential errors match the vote results.
    When ever there is a error pattern that is dramatically different fromt he vote itself – it is near certain you have fraud.

    In state after state all audits, recanvasses etc. have resulted in significant trump gains.
    Not enough to flip the election – but more than enough to prove Fraud.
    As an example as I recall the GA “faux recount” had Trump pick up about 6500 votes and Biden gain about 400.
    That is more than 10:1 That is not error, that is fraud. When there is fraud one place it is going to be others.

        You are concurrently right and wrong. All of what is being done is NOT the same. All is not the same quality. All does not start at the same level.

        We are increasingly seeing the tools for the low skilled manufacture of increasingly complete and high quality weapons.

        I would also note that many of the people participating in this are NOT low skill – nor are they paying more to get less.
        With small increases in skill level and equipment capability, comes the ability to get more, better, more highly customized for less.

        I would further note – this is a trend that goes beyond guns.

        We are seeing alot of custom manufacturing returning to the US – where factories full of CNC equipment produces products often one at a time that are highly customizable and highly automated.

        The US ability to do this is moving SOME manufacturing from China.

        We are also seeing more and more semi automated home production of all kinds of goods. While it is not quite affordable at home yet – we have equipment that is capable of produce just about any drug by molecular assembly – and every few years the price drops exponentially.

        We are essentially at a point where we have equivalents to Star Trek Replicators – atleast at a primative level.

        And whatever we can do today – we will be able to do more and cheaper and better tomorow.

        It will become increasingly difficult for government to stop people from having whatever they want.

        As I noted before – there is todate no reported instance I am aware of, where a “ghost gun” was used in a crime.

        There are major problems with these EO’s.
        The president has no unilateral law making power.
        An executive order is a directive by the president regarding either the internal administration of government,
        OR directing the executive with respect to implimenting powers that the executive already has – either by law or constitution.

        Trump’s immigration EO’s implimented powers given to the president by the constitution.
        But to Build the wall – he had to find funding in the existing budget.

        These Biden EO’s are subject to challenge and have a high probability of failure.
        I am not aware of any existing Federal Law that this could credibly fall under – even using the ludicrously broad nonsense that the courts allow today.

It is my understanding that the BATF form 4473 is filled out during the background check for the purchase of a gun, not to retrieve one from a dumpster. None of the stories I have read about this have indicated that Hunter had to do anything to get the gun back beyond asking for it. Please be kind enough to enlighten me if I do not correctly understand either the law or the facts in this case. Reporting (and the date on the pdf of the form) indicates Hunter filled out the 4473 on October 12, 2018 and Hallie threw the revolver in the dumpster October 23, 2018. The form is dated before the gun was dumped and retrieved.

    I share both your belief that a “red flag” law to remove guns from a dangerous situation (like from a drug addict in a household with children to put a fine point on it) is a good thing but that the due process issues are profound.

    Naming legislation to expand background checks the “Hunter Biden, drug addicts, criminals and crazies impediment act” would seem appropriate. However, if there are no consequences for lying on the form, expanding background checks will not do much other than inconvenience law abiding purchasers. Crazy people tend to acquire legally sold guns while criminals have their own illicit distribution channels for often times stolen guns.

    FWIW 3 days seems plenty of time for the FBI to get off its butt and complete the very small number of background checks that are not promptly decided. Give the Bureau more time and it will exceed that too.

        Interesting chap: 50% superstar, 50% screwup.

        Losing his mom in a car crash that might have given him brain damage could have something to do with it.

        And being Irish probably has something to do with it.

        I’ve been to Ireland.

        A lovely place full of lovely people but also the mental illness capitol of the world from what I saw: From bipolar disease to alcoholism.

        That’s not intended to be insulting to the Irish, it’s just the truth.

        I’ve always suspected climate had something to do with bipolar disease and alcoholism and mental illness.

        Modern humans have learned how to conquer climate but for centuries we just had to deal with it/suffer from it:

        The depressing gloom of winter and the ecstatic highs of summer = set up a bipolar wave in the human brain that is still undulating.

        He’s not a dumb guy at all, but he’s clearly a troubled guy.

        Looks like America is willing to give him a break, but enough of the naked photos please.

        Actually Johnathan Turley isn’t focused on Hunter other than the fact that Hunter has broken the laws and there is an ongoing federal investigation into him. So he’s no Baron Trump by any means.

        JT’s blog post is also timely in that Meat Puppet Joe is trying to enact laws while not even willing to enforce the laws on the books.
        Hunter Biden broke the law when he purchased the gun. He lied when answering no to two of the questions.

        So before we create these laws to harass gun owners… why not enforce the law and charge Hunter? Let him plead guilty to the felony and no jail time.

      You bring up an excellent point.
      Yes you are correct about the BATF form to purchase.
      Hunter lied to two of the questions. That’s a felony purchase.

      Hunter should have been charged and potentially gone to jail. (Although rarely prosecuted.)
      [He should be flagged in the system]

      To your point too about Red Flag laws.
      Its a legal nightmare.

      And here’s where you run into issues.
      Suppose you get that former Yale psychiatrist who kept saying Trump was crazy and not mentally fit for office… to now file complaints against anyone who owned a gun because she doesn’t like guns.

      Think of the ramifications and costs caused by this. Suppose its your child’s pediatrician who asked Lefty jr. if daddy had a gun at home.
      And he red flags you?

      Not good.
