“Discrimination at the Hands of Their Government”: Another Federal Court Has Halted a Federal Relief Program As Racially Discriminatory

President Joe Biden is facing an embarrassing and growing problem as he continues to declare his focus on ending racial discrimination: another federal court appears close to ruling that his Administration is engaging in raw racial discrimination. Milwaukee District Judge William Griesbach issued a temporary restraining order in Wisconsin halting Biden’s controversial $4 billion race-based federal relief program for farmers.  The awarding of relief based on race immediately raised objections of racial discrimination. The ruling is based on the court’s view that the white farmers challenging the program are likely to prevail.

The order was made in favor of twelve plaintiffs from nine different states who sued the Secretary of Agriculture and the Administrator of the Farm Service Agency to enjoin the Biden Administration from implementing a loan-forgiveness program for farmers and ranchers under Section 1005 of the American Rescue Plan Act of 2021 (ARPA). The program pays up to 120% of direct or guaranteed farm loan balances for Black, American Indian, Hispanic, Asian American or Pacific Islander farmers.

As part of the ARPA, Congress appropriated “such sums as may be necessary” to pay for the cost of loan modifications and payments to “socially disadvantaged” farmers and ranchers. § 1005(a)(1). The term “socially disadvantaged farmer or rancher” is defined under 7 U.S.C. § 2279(a). § 1005(b)(3) as a farmer or rancher who is a member of a “socially disadvantaged group.” § 2279(a)(5).

“Socially disadvantaged group” is then defined as “a group whose members have been subjected to racial or ethnic prejudice because of their identity as members of a group without regard to their individual qualities.” § 2279(a)(6).

The Biden Administration defines “socially disadvantaged farmer or rancher” to include individuals “who are one or more of the following: Black/African American, American Indian, Alaskan native, Hispanic/Latino, Asian, or Pacific Islander.” American Rescue Plan Debt Payments, U.S. DEPARTMENT OF AGRICULTURE, available at https://www.farmers.gov /americanrescueplan (last visited June 7, 2021).

The lawsuit was previously criticized as baseless or, as NBC reported, part of a “war against equity” by Trump supporters.

The Court found that the program was unambiguously discriminatory since “the only consideration in determining whether a farmer or rancher’s loans should be completely forgiven is the person’s race or national origin.” As such, “Plaintiffs are excluded from the program based on their race and are thus experiencing discrimination at the hands of their government.”

The Court found on the required compelling interest that the Administration failed to state a case:

Here, Defendants lack a compelling interest for the racial classifications. Defendants assert that ‘Congress targeted the debt payments in Section 1005 to the minority groups that it determined had suffered discrimination in the USDA programs and that had been largely left out of recent agricultural funding and pandemic relief.’ Dkt. No. 17 at 17. But Defendants have not established that the loan-forgiveness program targets a specific episode of past or present discrimination. Defendants point to statistical and anecdotal evidence of a history of discrimination within the agricultural industry. Id. at 16–17. But Defendants cannot rely on a ‘generalized assertion that there has been past discrimination in an entire industry’ to establish a compelling interest. J.A. Croson Co., 488 U.S. at 498; see also Parents Involved, 551 U.S. at 731 (plurality opinion) (‘remedying past societal discrimination does not justify race-conscious government action’). Defendants’ evidence of more recent discrimination includes assertions that the vast majority of funding from more recent agriculture subsidies and pandemic relief efforts did not reach minority farmers and statistical disparities. Id. at 17.

Judge Griesbach further rejected the government’s arguments on the narrow tailoring prong:

Defendants have not established that the remedy is narrowly tailored. To do so, the government must show ‘serious, good faith consideration of workable race-neutral alternatives.’ Grutter v. Bollinger, 539 U.S. 306, 339 (2003). Defendants contend that Congress has unsuccessfully implemented race-neutral alternatives for decades, but they have not shown that Congress engaged ‘in a genuine effort to determine whether alternative policies could address the alleged harm’ here. Vitolo, 2021 WL 2172181, at *6. The obvious response to a government agency that claims it continues to discriminate against farmers because of their race or national origin is to direct it to stop: it is not to direct it to intentionally discriminate against others on the basis of their race and national origin.

This is the latest opinion finding that the Biden Administration is engaging in presumptive racial discrimination. As discussed previously, in Texas, Judge Reed O’Connor found that the Biden administration engaged in systemic gender and race discrimination to implement COVID-19 relief for American restaurants.

In Oregon, however, a challenge was rejected over racially dependent benefits. A state COVID-19 program for black businesses, called the Oregon Cares Fund, was challenged by a Mexican-American café owner and others under the Equal Protection Clause. While legislative counsel and some legal experts raised concerns over the constitutionality of the law, a trial court rejected the challenge.

Even if such categories pass constitutional muster, there is the question of selecting groups for favored treatment. In the case of Oregon’s fund, Latino owners were excluded. Under the American Rescue Plan, anyone can qualify for preferential treatment if they claim to be part of a group that has “been subjected to racial or ethnic prejudice or cultural bias within American society.” It is the legislative version of the special graduation held at the University of Portland for “QTBIPOC (LGBTQIA and/or BIPOC).” Once the inclusions were defined, the only major exclusion was straight white males.

These challenges could find a receptive majority on the Supreme Court. In a 2007 case, Chief Justice John Roberts stated that position most succinctly by declaring that the “way to stop discriminating on the basis of race is to stop discriminating on the basis of race.”

Notably, Judge Griesbach rejected the call of the Biden Administration for a limited injunction” “To ensure that Plaintiffs receive complete relief and that similarly-situated nonparties are protected, a universal temporary restraining order in this case is proper.”

While white and people of color farmers have been given the short end of the stick for years, trumpian troglodytes seen nothing wrong with the trump bailout of farms that he had a direct hand, with his trade policies. Small farmers need relief no matter what color they are. Biden trying to bring stability to black farms is at least a start. But to a trump supporter Ammon Bundy is a real farmer who lives with the entitlement of not paying his bills because he slings a AR-15 on his shoulder.

        1. Seth – don’t knock the goats. A lot of people in rural areas keep goats to help with the cost of hay as well as taxes in general. CA keeps jacking up the cost of property taxes, water, electricity, gas, transportation. Hay costs over $26 a bale now, plus taxes. But if you keep livestock like goats, you can get a tax break on buying that hay.

          This is also why so many politicians and rock stars have their wineries, or their small farms on property.

          Without the farmland program, sure, Trump would pay more taxes, but the land would have been developed. No more open space. It’s getting impossible to maintain horse property in CA, and the East Coast. The property taxes are outrageous. As soon as a long time landowner sells a parcel, the property taxes are assessed so high that you’d have to be rich to buy it. You can’t make any money with a horse business anymore or even break even. Little by little, horse and farmland gets developed until it’s all gone.

          This reminds me of when a languishing city provides a tax incentive for a big business to expand there to bring jobs, and then within a couple of years activists start yelling they aren’t paying their fair share.

          Taxes are a form of punishment. And everyone wants to reduce that punishment.

            In NYC, they blamed Trump for a tax abatement given to all builders. NYC was in a hole and wasn’t moving. That tax abatement permitted him to refurbish a building. That was the first of many which brought NYC out of the hole. If Trump and some other bold guys didn’t do what they did, NYC would have been wiped off the map.

      2. I remember the era of claimed Pigford discrimination. Federal agencies were desperate to lend to black farmers and black businessmen and were under pressure from Washington to ‘improve’ their rates of lending.

        As usual, standards collapsed and a lot of bad loans were made. They failed. To not get a loan if you were black at that time your creditworthiness and experience and history had to be really terrible., sort of like not being able to get into Harvard these days.

        There is nothing unethical or immoral in anyone, including Donald Trump, keeping goats on their property for whatever reason they want.         This is what everyone does – try to make money, and try to keep as much money they make as possible.

        Every tax season, do the tax preparer commercials proclaim that they will help you pay as much as possible or else you’re a bad person? Why, no. They all say they will ensure you don’t pay a dime more than you owe. Tax attorneys, tax accountants, and estate planners all have a fiduciary duty to help you save as much money as possible. If they advise you to keep goats, and you choose to keep goats, then that means you own goats. Period. Nothing else.

        Plus, keeping goats means that you pay to buy the kids, doe, or buck, pay for their feed, pay for their veterinary care, though infrequently needed, pay for their enclosures, and pay for their keepers if you don’t care for them yourself. That means that in keeping goats, Donald Trump has employed someone to take care of them.

        Honestly, it boggles my mind how Democrats can ask their CPA or tax preparer to save them as much money as possible every April, yet condemn that very behavior as immoral if you make a lot of money. As if after a certain point you should be flinging it out the window.

        Compare how many people you employ, directly and through spending, and how many Donald Trump employs, and see who contributes more to the economy, and building roads and bridges, in the United States.

                      Normal Vitamin D levels are almost as effective at preventing C19 as the vaccine – and far safer.
                      That VD use reduces the severity of C19 dramatically if you get it.

                      That VD is one of the most effective actual treatments for C19 – though not OTC VD if you already have C19 as OTC C19 takes weeks to build up to normal in your body.

                      It also appears that MMR boosters are about 77% effective in preventing C19 – that is better than the flu vaccine and safer than the C19 vaccines.

                      Other treatments – like HCQ, Invarmectin etc – are less effective – but not ineffective.

                      Low doses of HCQ are many times more effctive than masks at preventing infection.

                      Both Invarmectin and HCQ significantly reduce the severity of C19 as well as the death rate.

                      But every single one should have been readily available to people if they wanted them.

Prescott Bush was a director of a bank (1 of 7) controlled by the Thyssen family. Thyssen initially supported Hitler feeling the Nazis were better than the communists. Bush was uninvolved in that effort. The shares of the bank were held by others. Bush had only one share (probably needed to hold as a director)

          Thyssen, in 1938 split from the Nazis in part because of the persecution of Jews and fled. He was arrested by the Nazis and jailed from 1941 to the end of the war.

          Compare that to Joe Kennedy, who was an open anti-Semite and supporter of the Nazi regime. Ask the British what they thought of Joe Kennedy Sr.

For over twenty years Black people couldn’t get VA loans as part of the G.I. Bill and for an overlapping thirty years also couldn’t get FHA loans due to redlining that the government invented. Poor white people became part of the middle-class and established generational wealth through housing. Black people got an income and wealth differential and paid more for services like insurance because of the neighborhoods they were forced to live in. Black people were harmed by the government. Does the government bear any responsibility for trying to address the problem they helped create?

            Whitey Cindy (me) attended a public High School, and although it was a wonderful school, most of the students were very wealthy.

            It does not say it is illegal and the article is more than 5 years old so it isn’t secret. I have a friend who does something similar with his estate north of La Jolla. The intention is to keep some land from being overdeveloped and it works.

            I bet you do your taxes lawfully but without choosing the most expensive arrangement when you have lawful ways of reducing your taxes. Why should you care if somebody else does the same?

            Biden inherited an economy spring loaded for rapid growth.

            And yet he has already seriously botched the start. Inflation is here NOW – it was not supposed to arrive for atleast 9 months.

            Employment is NOT rising rapidly – we were supposed to ALREADY have a 20% drop in unemployment. We have only had a few tenths of a percent – if any. Growth should be near double digits, It is barely reading better than during Obama.

            Only the left could botch a sure thing.

  19. Impeachment is necessary in order to stop all those unconstitutional policies of this new administration. It’s a disgrace to our democracy that this president is so incompetent and out of touch with reality. People believe he is not suited to represent the people. Him and his VP need to be both impeached before more damage is done. The border crisis alone is enough to start impeachment proceedings.
