New Emails Show Unsuccessful and Unrelenting Pressure on Barr and Rosen from Trump to Intervene in the Election

Newly released emails show the pressure brought by the White House on both former Attorney General Bill Barr and his brief successor, acting Attorney General Jeffrey Rosen, to intervene in the 2020 election.  Both Barr and Rosen refused to intervene and pushed aside numerous efforts to arrange meetings with Trump counsel and to file federal complaints.  What is astonishing is the degree to which these pressures continued in the brief period in which Rosen served as acting Attorney General in the final days of the Administration.

The emails given to the House Oversight Committee show how Barr refused to give credence to the electoral fraud claims of individuals like Rudy Giuliani before Trump forced him out in the waning days of the Trump Administration. The pressure was then brought on Rosen to do what Barr refused to do including filing a complaint drafted by the Trump legal team. The pressure was highly inappropriate and Rosen continued the position of Barr in refusing special efforts.

When Barr was pushed out by Trump after public attacks, it appeared entirely gratuitous and unnecessary.  After all, there were only a few days left to the Administration. However, it now appears that Trump counsel used the substitution to resume the pressure for an intervention. Many of the emails reference the theory that Dominion Voting Systems were used to change votes and the more recently discussed theory that Italy was using satellites and military technology to change votes.

The pressure on Rosen came from a number of sources, including Trump’s chief of staff, Mark Meadows, who asked about investigating the Italian satellite allegations.  When Meadows’ email was forwarded by Rosen to Rich Donoghue, the acting deputy attorney general, Donoghue wrote back that it was “pure insanity.” Rosen responded that he was pressed to arrange a meeting between the FBI and a Giuliani associate, but refused. He told them to use the FBI tip line — a suggestion that Rosen recounted was viewed as “insulting” by Giuliani.  It was a clear message that there would be no back channel to the DOJ.

What is troubling is that the pressure on Rosen started as soon as Barr announced his resignation for later that month.  This included the sending of a draft complaint for the Justice Department to file to “declare that the Electoral College votes cast” in the six battleground states that Trump lost “cannot be counted.”  The draft was reportedly sent to Acting Solicitor General Jeffrey Wall and is highly unusual and, in my view, highly improper.  One email leaves no question of where the pressure is coming from, stating “As I said on our call, the President of the United States has seen this complaint, and he directed me last night to brief AG Rosen in person today and discuss bringing this action,” he wrote in one email. “I have been instructed to report back to the President this afternoon after this meeting.”

Not only do the emails further vindicate Barr in this protection of the integrity of the Department but the disclosures follow Attorney General Merrick Garland adopting some of the Barr positions previously denounced as raw political abuses by legal experts on networks like CNN and MSNBC.

                  A federal judge has approved a $25 million settlement deal between President Trump and students who paid for Trump University real estate seminars, bringing lengthy litigation to a close.

                  The deal, which calls for Trump to reimburse the students who say they were defrauded, was struck in November but needed approval from U.S. District Judge Gonzalo Curiel. He signed off on the settlement Friday in San Diego.

                  Trump doesn’t admit any wrongdoing under the terms of the settlement.

                  The settlement applies to three separate lawsuits — two class-actions and a fraud case. The $25 million deal includes payouts to more than 6,000 Trump U students who paid thousands of dollars for courses they describe as worthless.

                  One student had pushed against the deal, as The Associated Press reports:

                  “The only holdup appeared to be a Florida woman’s claim that she should be allowed to opt out of the settlement and sue the president on her own — a move that would likely scuttle the entire agreement.

                  “Attorneys for former customers said that their clients would get at least 90 percent of their money back under the deal, based on the roughly 3,730 claims submitted. …

                  “Curiel said the high payments weighed in favor of approval and he noted that only two of about 7,000 eligible class-action members objected to the terms.”

                  You may recall that on the campaign trail, Trump accused Curiel of being biased because he is “Mexican.” That claim was false — Curiel was born in Indiana — and even House Speaker Paul Ryan acknowledged that it was “sort of like the textbook definition of racism.”

                  Trump doubled down on the comments before saying he wouldn’t talk about Curiel any more.

                  Curiel had urged both sides to settle.

                  And what about the fraud allegations that underpin these lawsuits?

                  NPR’s Ina Jaffe reported last year that students paid $1,500 to $35,000 for courses on “real estate investment secrets” ostensibly taught by instructors handpicked by Trump.

                  “They claim that the promised Donald Trump investment techniques were mostly stuff that you could find on the Internet, some of which was illegal in some of the states where the seminars took place,” she said. “They say that the promised mentoring was worthless or nonexistent, that the instructors were unqualified and that they were definitely not handpicked by Donald Trump, as he claimed.

                  “And transcripts of Donald Trump’s deposition … confirm that he was relatively unengaged with what went on in Trump University.”

                  Trump’s lawyers said the allegations are false.

                  NPR’s Jim Zarroli spoke with an unhappy Trump University customer who said he paid $35,000 for “secrets” such as the fact that he could go to the IRS website to learn about federal tax deductions.

                  “The more and more I got involved in Trump University, the more and more I found out that I had truly been scammed,” Bob Guillo, 76, told NPR.

                  “At first it was embarrassing,” Guillo said. “Then I became very, very angry that the man that scammed me out of all that money had the audacity to run for president. And I’m still angry.”

                      Long ago I was sued by an employee for all sorts of discrimination (the employee was a white male).

                      I was still paying his family health insurance at the time of the lawsuit – because I knew his wife had health problems and I did not want her to be uninsured.

                      The ALJ presiding over the case asked if we would settle for $2500 – I jumped at that. Just continuing the case until we won would cost more than that in legal fees.

                      Settlement is common.

Case rates in sweden declined long before there was a vaccine – further we are again in summer and C19 does poorly in high temps and humidity. There is alot of data analysis that will be needed to know the actual effect of vaccines – we may not know for sure until next fall.

                      We were up to 1.4M doses/day by the day before Biden’s inaugural. US Deaths per day peaked on Jan 15. and were in rapid decline through March and slow decline since. The rapid decline starting in mid January is one of the reasons that the decline may have little to do with the vaccine – the rate of decline was too fast too early for the vaccine to be a factor.

                      Regardless it was predictable by inauguration day that deaths would be way down by July.
                      It was KNOWN with certainty that they were ALREADY way down by late march.

Moreover, Mayor Trantalis’ eagerness to jump to unfounded and inflammatory conclusions intended to stoke distrust and hatred among American citizens demonstrates that he lacks the judgment and temperament needed to hold office. Mayor Trantalis should resign immediately.

          The MSM never said Russia stole the election from Hilary. They said only that Russia interfered with the election. No one can know if the interference affected the results. It didn’t help to be sure and should not be tolerated in the future.

  17. Turley et al misnomers the claim of “intervention”. Trump never wanted them to change votes, or effect fraud; he always only wanted a clean election, his “pressure” was only ever to counter the clear and present fraud that was taking place before everyones eyes.
