White House Communications Director: Big Tech Should be “Accountable” for Vaccine “Misinformation”

There was an unnerving conversation between between Biden White House Communications Director Kate Bedingfield and MSNBC host Mika Brzezinski that shows how much ground has been lost on principles of free speech. In an exchange on Morning Joe, Brzezinski asks Bedingfield why Biden has not completed his promised review of Section 230 and create an avenue to held social media companies “accountable in a real way” for spreading “misinformation” about vaccines. Brzezinski ignores not only the constitutional implications of such a move but ignores how such an approach would eviscerate free speech and free press rights.  Equally chilling is the response. Bedingfield agrees and assured Brzezinski that the Biden Administration believes these companies should be held accountable for allowing others to voice doubts or dissenting opinions on such questions.

Bedingfield assures Brzezinski that they are “reviewing” Section 230 and that the Biden Administration does believe that the media companies need to be held “accountable.”

Vaccine “truth” has become the latest means for calling for more censorship from social media companies. It is better than the prior use of election misinformation because now advocates can claim that free speech is actually killing people.  Indeed, President Joe Biden recently declared publicly that Facebook is “killing people” by not censoring free speech.  He later walked back his comments.

Keep in mind that these companies already have the largest censorship system in our history. It is being managed by private corporations but directed to some extent by government officials. Just this week, the White House admitted it has been flagging “misinformation” for Facebook to censor. This outsourcing of censorship allows government officials to do indirectly what they cannot do directly. It creates the specter of a type of shared shadow state.

Facebook only recently announced that people on its platform may discuss the origins of COVID-19, after previously censoring such discussion — but it still bars opposing views on vaccinations and the pandemic. Other companies actively block wayward thoughts and views; last week, YouTube was fined by a German court for censoring videos of protests over COVID restrictions.

When Twitter’s CEO Jack Dorsey came before the Senate to apologize for blocking the Hunter Biden story before the election as a mistake, senators pressed him and other Big Tech executive for more censorship.

In that hearing, members like Sen. Mazie Hirono (D., HI) pressed witnesses like Mark Zuckerberg and Jack Dorsey for assurance that Trump would remain barred from speaking on their platforms: “What are both of you prepared to do regarding Donald Trump’s use of your platforms after he stops being president, will be still be deemed newsworthy and will he still be able to use your platforms to spread misinformation?”

Rather than addressing the dangers of such censoring of news accounts, Senator Chris Coons pressed Dorsey to expand the categories of censored material to prevent people from sharing any views that he considers “climate denialism.” Likewise, Senator Richard Blumenthal seemed to take the opposite meaning from Twitter, admitting that it was wrong to censor the Biden story. Blumenthal said that he was “concerned that both of your companies are, in fact, backsliding or retrenching, that you are failing to take action against dangerous disinformation.” Accordingly, he demanded an answer to this question:

“Will you commit to the same kind of robust content modification playbook in this coming election, including fact checking, labeling, reducing the spread of misinformation, and other steps, even for politicians in the runoff elections ahead?”

“Robust content modification” has a certain appeal, like a type of software upgrade. It is not content modification. It is censorship. If our representatives are going to crackdown on free speech, they should admit to being advocates for censorship.

The public however is not entirely sold on censorship on an expanding array of subjects from gender identification to election fraud to criticism of foreign governments. That is why the pandemic is the perfect vehicle for getting a free people to turn against free speech. You simply declare, as did Biden, that free speech kills. It can kill you. You then push companies to censor more under the threat of being held “accountable.”

The fact is that you generally cannot hold people legally “accountable” for saying things that politicians or media figures like Brzezinski do not like about vaccines or climate change or any other controversy. The regulation of companies can offer some regulatory avenues for inducing corporate censorship like threatening to take away immunity if they do not serve as surrogate censors. However, that can also raise constitutional issues both as a question of corporate speech or converting these companies into state actors.

The greatest danger is that these political and media figures are signaling that they want even greater levels of censorship and that these private companies will accommodate them. They already have. The result is the expansion of an already massive censorship system that controls much of our political discourse.

  1. Here’s my question for JT: Going back before the Internet and anyone-can-publish, if you wanted a voice in public affairs, you had to go through an editor, or in radio/TV, a producer. These gatekeepers exercised complete discretionary control over what got published via their platforms.     If Professor Turley, or any of the conservative regulars here, followed mainstream media, they would know that the Delta Varient is currently surging around the world. And here in the U.S. the virus is sweeping all those Red States where vaccination rates are lowest.

    Professor Turley seems to think America is rich enough to close-down again while everyone sits out the Delta Varient. But one should note that Mitch McConnell, of all people, issued a statement yesterday encouraging vaccinations.

                      We heard something similar from Al Gore in 2006. He said we had 10 years.

                      Over and over again, we hear devastating claims. The truth is these climate scientists know a lot less than people think they do. They even make things up and lie.

                      We have chicken little over here who knows next to nothing about climate science and just about everything else. I don’t know enough about climate science to draw a definitive timeline. I do know (like I knew 20 years ago) that if we face catastrophic climate change, there is nothing we are doing today that will reverse it. If it is a slow change, we will adjust to it and develop technologies to meet our needs.

                      You are right, of course. There is too much money and too many opportunities for social control in climate science for it to be taken at face value.

                      You probably remember the big Copenhagen climate meeting between world leaders than Obama sort of attended. Much of the climate science then, and now, was coming from the Hadley Climate Research Unit in East Anglia headed by, I believe, Phil Jones. Though in England, it was linked with climatologists throughout the world.

                      Just as the Copenhagen meeting was getting set to begin somebody connected with the Climate Research Unit dumped a lot of very damaging emails and documents onto the web. One of the directed recipients was the website Watts Up With That https://wattsupwiththat.com/. The email dump became known as Climategate and it slammed a torpedo into the Copenhagen conference.

                      One of the things I recall was an email exchange saying that they had to find some way to hide the Medieval Warm Period, a time when temperatures were at least as high as they are now. There have been several periods like that, the Roman warm period for one, and weather changes that had nothing to do with SUVs likely weakened the Akkadian Empire and, if memory serves, there was a cold snap about 8,000 before the present that put a dent in the progress of the Neolithic.

                      In any event, it seemed they wanted to hide the Medieval Warm Period so that our current warming would look more alarming. In another email Phil Jones, the director, admitted that he didn’t really know how to use Excel. A comment made by a programmer in some of the software was along the lines of, “I don’t know what this does and nobody else has any idea.”

                      It is no wonder that their predictions have been so disastrously wrong in almost every instance.                       Predictions that end up like that, supposed warm weather that turns out to be nastily cold are said to be subject to The Gore Effect.

It’s illegal for Congress to pass a law censoring Freedom of Speech, Freedom of the Press, Freedom to Associate and Freedom to Petition the government (just read the First Amendment).

    Hollywood attorneys knew that censorship violated the First Amendment so they made a deal with the federal government. Hollywood had no legal requirement to do anything – they were already acting legally. Hollywood’s plan was to give “parents” the censoring authority since government has no such authority in the USA.

    Hollywood would voluntarily label their shows and parents (not government officials) would have the censoring authority. Facebook and other social media could easily create a “self-labeling” system. Before you hit the “Post” button, you choose the rating (Violent Content, Nudity, etc). Parents could easily set viewing filters for their children. Facebook and other companies are already shielded from legal liability as long as they don’t assume the role of “editor” like a newspaper.

    Today, in 2021, many decades old movies are already censored before you see them. You probably couldn’t see an unedited version of Animal House, some Clint Eastwood movies, shows about the Bible or other shows today in 2021 unless you subscribe to HBO or some other service. Censorship never works longterm.

They concocted a false narrative out of thin air about Gov. Ron DeSantis and Publix pharmacies when they needed to make a successful Republican leader look bad.

    They’ve downplayed the border crisis, framed as an “accident” the story of car-jacking teenagers who murdered a Pakistani immigrant in broad daylight, said Antifa doesn’t exist, and lied about conflict in the Middle East, with the New York Times even ginning up fake maps of Palestine. They called Republicans who voted for Trump a “credulous boomer rube demo” and said the GOP needs to be de-programmed.

    They giddily ushered in a sham impeachment — and then a second sham impeachment. They claimed there was no way the National Security Agency was spying on Tucker Carlson. They lied about Russian bounties and downplayed Fauci’s emails.

  19. What blows the minds of Trump supporters is that accountability is a reasonable solution to a problem. They are more into, alternative realities.

    1. The irony here is that it was conservatives who demanded social media be held accountable for censorship by removing liability protections. But doing that also exposes them to lawsuits allowing misinformation to spread. The only solution for these platforms would be to increase censorship of both. The CAN censor anything that they deem a violation of their policies.

      1. Yeah, you have to wonder why, all of a sudden, Fox (other than Carlson and Ingraham) did a 180 on the vaccine. Could it be that because the more lethal and virulent Delta strain is taking such a huge toll amongst their target audience, coupled with the fact that the stock market is reacting to the surge in cases, so that even their own portfolios are taking a hit? If COVID isn’t brought under control, then masks, social distancing, working from home again and maybe online learning will be necessary in the near future. Restaurants, bars, sports venues and concerts may have to cut back capacity, and manufacturing will again slow down, worsening inflation because the supply chain still hasn’t caught up. You can’t get a new sofa or chair right now because the companies manufacturing foam rubber are way behind in production due to the pandemic. The same is true for auto parts. You’d really have to be blissfully blind not to see the fallout caused by disseminating fear and distrust of the vaccine, not just in human terms, but for the economy. Plus, there’s the liability issue–real people are really getting very sick and some are dying, not that Fox cares unless it causes them to get sued.
