Legal Pundits and the Washington Post Line Up To Mock Durham’s “Zombie Investigation” in Stark Contrast to The Same Mueller Charges

In Washington, there is no greater indication of wrongdoing than the number of people denouncing efforts to investigate it. The “nothing to see here” crowd went into hyperventilation this week when Special Counsel John Durham indicted a former Clinton campaign lawyer, Michael Sussmann. Legal experts who spent years validating every possible criminal charge against Trump and his associates are now insisting that Durham needs to end his investigation. The Washington Post heaped ridicule on Durham despite an indictment detailing an effort to hide the connection to the Clinton campaign and a concerted effort to push false Russian collusion claims.

Keep in mind that Durham was ordered to investigate the origins of the Russian investigation, including claims that those origins were unlawfully concealed or knowingly false. The Sussmann indictment involves both issues after he allegedly pushed a false allegation of collusion and then hid the fact that he was working for the Clinton campaign.

I have been writing about the expected push back to end the investigation of John Durham and particularly oppose the release of his report. Right on cue, the Post responded with a bizarre editorial from the Washington Post that suggested that Durham should just stop immediately.

Durham has been praised as an apolitical career prosecutor by both Democrats and Republicans. Nevertheless, Democrats have long denounced the investigation, even as they demanded full support for Mueller’s investigation into the claims.

It is the methodical reputation of Durham that makes him so dangerous. He is known for dogged pursuit of wrongdoing without political or personal bias. I have referred to his investigation as an “eephus,” a slow pitch, due to the impact of the pandemic and his decision not to move publicly before the election.

Ironically, before the election, Democrats demanded that Durham slow down or stop any action. Mueller top aide, Andrew Weissmann, even called on prosecutors and investigators to refuse to assist Durham before the election.  In reality, Durham decided that he would not act before the election even though it further delayed his investigation.  Now the Washington Post and others are chastising him for waiting so long.

Take Randall Eliason who is quoted by the Post in another piece as dismissing such an indictment as “all Durham’s got” and adding “there are a lot of cases that could be brought but aren’t because they are so trivial.” During the Trump Administration, Eliason pushed legal interpretations barred by Supreme Court case law  and offered strikingly different takes on Mueller’s work. When Mueller brought unrelated charges, Eliason assured Post readers that Mueller was clearly establishing the long-sought Russian collusion claims — which he ultimately failed to do. Nevertheless, Eliason told people to be patient and not get concerned with the “side show” of the indictments because Mueller was finally proving Russian collusion.

For its part, the Post editors ran a mocking editorial entitled “John Durham’s zombie Russia investigation produces an iffy indictment. Is this all there is?”  The editorial focused on the fact that Sussmann is charged with just one count of lying to federal investigators under 18 U.S.C. 1001. That provision is the classic charge for Washington scandals. It is rarely the original scandal but the cover up that gets people into trouble in Washington. What makes the indictment so significant is not the charge but the narrative — the very point that Mueller supporters noted when he brought the same charge against Trump figures.

However, the editors only refer to Sussmann allegedly lying to conceal his “associations.” It does not discuss the details of how he allegedly lied to conceal the role of the Clinton campaign in spreading these false rumors and getting FBI insiders to push for an investigation. Another partner of Sussmann at the firm of Perkins Coie was accused by the media of lying to conceal the Clinton campaign’s funding of the Steele dossier.

Even by D.C. standards, the contrast is astonishing. In 2018, the Post slapped back on those who were demanding that Mueller wrap up his investigation and questioning the lack of charges linked to the original Russian collusion allegations.  (Ultimately Mueller found no proof of such collusion). At the time, the Post demanded that we “should make clear that he will be given such time as he needs to complete his investigation.”

Now in 2021, the Post is mocking Durham for taking so long despite earlier demands that he slow down for the election. The Post states conclusorily that this is not as serious as the charge against Michael Flynn because Flynn lied about his connections to the Russians which was central to the Mueller investigation. It then states that “the consequences of Mr. Sussmann’s alleged lie are minimal by comparison.” The Post ignores that, just as Mueller was looking into the Russian connections, Durham is looking into the origins of the false allegations of Russian collusion. Sussmann is accused of hiding those connections in the very same way with the very same charge as Flynn.

The Post was not so skeptical or mocking in heralding similar charges against figures like attorney Alex van der Zwaan and adviser George Papadopoulos.  They also were charged with single counts under 18 U.S.C. 1001.

I questioned many of the false statement charges brought by Mueller as unrelated to Russian collusion or, in the case of Flynn, the abusive elements of the case.  I also failed to see the consistency in the handling of false statement cases. However, I still supported the continuation of the Mueller investigation.

One line also stands out: “The danger of special counsel investigations is that, given unlimited time and resources, they often find some bad action tangentially related to their original inquiry that may have had little or no substantial negative impact.”

The objection is almost comical given the Post’s editorials supporting Mueller who never found that the Trump campaign colluded with the Russians. Instead, virtually all of the charges were for lying to investigators or entirely unrelated charges. Papadopoulos spent of all 14 days in jail. Van der Zwaan spent 30 days.

There was no concern over “tangential” or entirely unrelated charges when Mueller nailed a California man who ran a website selling dummy bank accounts to eBay and Facebook, Richard Pinedo, for identity theft. Sam Patten pleaded guilty for failing to register as a foreign agent. Michael Cohen was charged with various financial crimes related to his taxi medallion business and other personal matters, as well as a campaign-finance violation related to a stripper’s alleged affair with Trump. None of those charges led the Post and others to object to a drifting investigation. Instead, experts praised Mueller for using such charges to pressure possible witnesses.

Judging from the alarm at the indictment, Durham has every reason to finish his work. While many of the actors are now beyond the reach of charges due to the statute of limitations, he is preparing a report that could answer many questions on how the Russian investigation began. Yet, like Trump’s demanding the end of the Mueller investigation, the calls to stop Durham only deepen suspicions. As I said in opposition to Trump’s attacks on Mueller, there is a point where you “doth protest too much.” Just as I supported the appointment of a Special Counsel on Russian collusion and his finishing his work, the same is true here. Even if there are no more indictments, Durham would at a minimum bring clarity about what happened . . . which is precisely why many want him to stop immediately.

    The indictment explains how Sussman and his collaborators, as consummate insiders, exploited their influence to gain an audience at the highest levels of the FBI. With the collusion of a prominent tech executive and university researchers (some of whom apparently had pangs of conscience) to abscond with private internet data. How do we know that these people are elite insiders and that the story has legs? Because the government and media are quiet as church mice. If they wanted us know, they would leak like a sieve as they did so many times under the Trump administration. But they don’t, so they’re quiet, doing their darndest to tamp down the story and hoping that this crisis dies down into the next news cycle like so many before it.

    Progressives are terrified. Terrified that we will learn the true story of collusion in the 2016 election and their corrupt schemes to destabilize a duly elected president. So terrified that they will do anything to keep their grip on power. Anything. Ask Mark Milley.

            b) Counting “apprehensions” is not the same as counting people, since a single person may be apprehended multiple times (in fact, your article says as much: “Many who were taken into custody have attempted to cross the border more than once”)
            c) Not all “apprehensions” correspond to “illegal immigrants,” since it is legal to arrive at the border and request asylum.

            I do not believe in open borders. We also don’t have open borders. It is not illegal for people to apply for asylum, and I do believe in taking in refugees, especially when our actions contribute to their difficulty remaining in their home countries (e.g., people who worked for the US as translators in Afghanistan, people fleeing drug violence fueled by US drug use). I also believe in work visas.

    Today’s New York Times reports that America’s election workers have a new and desperately needed friend:

    The Election Official Legal Defense Network, which made its public debut on Sept. 7, offers to represent more than just poll workers, of course. Formed to counter the waves of political pressure and public bullying that election workers have faced in the last year, the organization pledges free legal services to anyone involved in the voting process, from secretaries of state to local election officials and volunteers.

    The group already has received inquiries from several election officials, said David J. Becker, the executive director of the nonprofit Center for Election Innovation and Research, which oversees the project. Without getting into details, Mr. Becker said their queries were “related to issues like harassment and intimidation.”

    The network is the creation of two powerhouses in Republican and Democratic legal circles, Benjamin L. Ginsberg and Bob Bauer. In a Washington Post opinion piece this month, the two — Mr. Ginsberg was a premier G.O.P. lawyer for 38 years and Mr. Bauer was both a Democratic Party lawyer and White House counsel in the Obama administration — wrote that such attacks on people “overseeing the counting and casting of ballots on an independent, nonpartisan basis are destructive to our democracy.”

    Because of Trump’s election lies, and the pressure he has put on Election Officials nationwide, there is now a genuine need for Legal Defense Network for all state employees and volunteers involved in elections. What a sad development!

When Alinsky leaked word that large numbers of poor people were going to tie up the washrooms of O’Hare Airport, Chicago city authorities quickly agreed to act on a longstanding commitment to a ghetto organization. They imagined the mayhem as thousands of passengers poured off airplanes to discover every washroom occupied. Then they imagined the international embarrassment and the damage to the city’s reputation.

    Rule 10: The price of a successful attack is a constructive alternative. Avoid being trapped by an opponent or an interviewer who says, “Okay, what would you do?”

    Rule 11: Pick the target, freeze it, personalize it, polarize it. Don’t try to attack abstract corporations or bureaucracies. Identify a responsible individual. Ignore attempts to shift or spread the blame.

  8. The Seditious act(s) cast on President Trump and his administration has not been addressed until now. What will come from this second indictment is really the question. If the investigation only yields two indictments on a now proven seditious plot to over throw the elected Presidency, then we can be assured that the Constitution and law there under are meaningless in the swamp we call Washington DC

The neglect by Justice during both Sessions and Barr’s supervision and now Garland, makes one wonder if they too are complicit in the plot to overthrow the Trump presidency and what seems to be a continued denial of existing evidence of wrong doing.

    3. Trump had dementia. Made up. Trump never showed signs of dementia, such as Biden is exhibiting. Trump took a cognitive assessment test, and directed his doctor to share the results, as well as his medical history and general health, with the public.

    4. Trump was going to hide his actions from the world. Fabricated. Trump gave access to the press, and he answered questions from journalists where the hate was mutual. He argued and quarreled with journalists, but he still held press conferences and took the arrows. It’s actually Biden who refuses to answer questions, walks off the podium. When he does answer questions, he only calls on reporters from a list whoever is really in charge gave him, and then he often reads the answers.

    5. Trump called white supremacists “very fine people”. Fabricated. Trump said there were very fine people on both sides of the protest, those in favor of removing statues, and those in favor of keeping them. He expressly said, “and I’m not talking about the white supremacist or Neo Nazis, who should be condemned totally.” It can also be inferred that he wasn’t calling Antifa “very fine people”, either.

    6. Trump was so unstable he would cause nuclear war, and should never have the nuclear launch codes. False. We went 4 years without any new wars. Trump was actually more interested in peace. He negotiated 4 Middle East peace deals, which John Kerry had claimed were impossible. We can thank Trump for the Abraham Accords, which Biden’s Admin is currently celebrating.

    7. There was a threat that Trump was going to nuke China. See above. Trump was interested in peace. Holding China accountable for engineering and accidentally releasing Covid-19 never involved nuclear war. Totally fabricated.

    8. Trump engaged in a quid pro quo with Ukraine. Aid to Ukraine was indeed delayed, but it was released by the planned deadline. It was Joe Biden who explicitly told Ukraine that if they did not fire the prosecutor, who happened to be investigating Hunter Biden’s company, by the time Joe left on the plane within 6 hours, then they would not get any US aid money. That’s a quid pro quo. Activists keep relying on what they claim Trump really meant, or implied, or what he could have been thinking. Joe Biden engaged in an explicit quid pro quo. Donald Trump was impeached for inquiring about Joe Biden’s quid pro quo. Biden is the Democrat ruling elite class. Australia balked at the price, plus the limitations in capability, so it asked the US for proposals. The submarines we have available for sale are better and cost less, and so Australia went with the US submarines. France somehow thinks the US owes it to either increase the price to compete with their higher price, or give them a second or third shot at getting this sale. Now, what, exactly, did Biden do that was wrong here? To whom does he owe loyalty–US submarine manufacturers or France? France had an inferior product that cost more and the Australians didn’t want their submarines.

            It is extremely rare that either party or their candidates have actual majority support – either for their candidates or their policies.

            Sometimes one party or the other can get majority support for some political concept – it is ALWAYS trivial to get majority support for reform of healthcare – as healthcare is ALWAYS messed up. But that does not mean majority support for specific policies.

            If we required – as we should true majority support for specific policies – government would have done very little in the past century.

            Regardless, of course Trump did not, nor does he now have the “support” of the majority of people.

            We have few measures for actually support – as opposed to polls and voting results which do not measure support they measure how we would pick given only two choices.

            Possobly the best measures of actual support we have are the numbers of people who will actually show up at political events.

            In fact part of the evidence for fraud in 2020 is that there was pretty much no one on the planet enthusiastically supporting Biden.
            Almost no one came to the few campaign events he had. Few participated in his virtual events. By nearly every measure of support aside from polls Biden was going to get Trounced.

            There is no doubt that many voters voted Against Trump rather than for Biden. But it is a real reach to expect that Biden won with almost no support and tens of millions of “i hate trump” votes – especially given that Trump added 10M votes to his 2016 total in the midst of a pandemic.

            As to your claims regarding the election.

            50 State Sec. States did NOT certify Biden as the winner.
            Biden purportedly won 24 States – not 50.

            There is no election lawsuit that found anything regarding election Fraud.
            There is not any court that permitted any investigation of election fraud prior to the inauguration.

            There is plenty of evidence of “wide spread” election fraud.

            Depending on the extent to which the evidence of errors in Maricopa county overlap – somewhere between 200,000 and 850,000 ballots have problems in Maricopa county.

            With a few exceptions that are with near certainty fraud – and clearly “wide spread” if that means sufficient to alter the election outcome, most of these errors could be fraud or they could just be incompetence on the part of those running the election.

            Regardless, they are all reasons to doubt the accuracy of the results.

            Maricopa county had more than 200K more ballots counted that voters who voted. Is that fraud ? or just incompetence on the part of those running the election ? After the fact it is nearly impossible to tell.

            Maricopa county had nearly 40,000 duplicate ballots – in some instances the same person voted more than 4 times.
            In over 17,000 instances the same person voted atleast twice. Fraud ? There are possible but not probable explanations for this that are not fraud, though even without fraud this is still a serious problem that could alter the election outcome – because these duplicat ballots were counted.

            Regardless the most likely explanation is fraud not error/incompetence. Worse still there are multiple possible forms of fraud that could produce this result.

            It is possible that 17,000 individual voters asked for and submitted mailing ballots multiple times or that they voted by mail and in person.
            It is possible for that to occur without Fraud – the election was confusing. But whether fraud or not – the duplicates counted and were more than enough to throw the election.

            But there is an alternate possibility. In the CA recall we found many republicans showing up at the polls finding that a vote was already cast for them.

            One form of fraud that likely occured – in CA, in AZ and many other places is systemic fraud – political operators submitted ballots for people on voter registration lists that were unlikely to vote. This is an easy and difficult to catch form of fraud when mailin elections are conducted laxly.

            If I select 100,000 voters from a voter registration list that are not likely to vote and I submit votes for them, a small portion of my list might actually vote – resulting in duplicates. In a well run election the duplicates will not be counted, nbut my mailed in nallots for the rest of the unlikely voters will be counted.

            Given what we know about the AZ election – that type of large scale systemic fraud is not merely possible by likely occured.

            Regardless the standard for a legitimate trustworthy election is NOT

            CAN YOU PROVE FRAUD ?

            It is

            WAS THE ELECTION CONDUCTED SUCH THAT WIDESPREAD FRAUD IS NOT POSSIBLE.

            The Maricopa audit demonstrated that the conduct of the AZ election was sufficiently poor at fraud prevention that it is possible that there were nearly half a million fraudulent votes.

            The audit did not prove that fraud did take places.
            It did not prove that it did not.

            But it did prove that large scale fraud was possible and would not be caught.

            Regardless – if you want people – ALL people, to trust election results – conduct elections in a manner that fraud is not possible.
            We have the ability to do that. Many states do that.

            And if you do not conduct elections uch that they can be trusted – expect that Jan 6 is just the tip of the ice berg.

        UnConstitutional Wars (Global War On Terror … a noun!?), Wars of Aggression, War Crimes and War Criminals (Nuremberg Principles) go on unabated.
