The comments of President Joe Biden on Friday left many of us surprised, if not stunned, when he appeared to announce a finding to the ongoing investigation into allegations that mounted Border patrol officers whipped or “strapped” Haitian migrants trying to enter the country. During the Trump Administration, many of us correctly chastised the President for crossing the line in discussing ongoing Justice Department investigations and calling for particular resolutions. The response to this inappropriate statement is more muted from the media but it should be no less concerning. Biden’s statements are clearly prejudicial to the investigation of the incident and should be corrected in the interests of a fair process for all involved.
If agents whipped migrants, they could not only lose their jobs but face criminal charges.
Many in the media, including on National Public Radio, have already reported as fact that the Border patrol agents were “whipping” migrants in the now familiar pictures. However, critics and agents have objected that the media is using still pictures and not the video that shows agents using their long reins to control the horses who were jittery near the water’s edge with people around them. The photographer himself says that the still photos are misleading and that he did not see any agent whipping any migrant.
Nevertheless, the call for an investigation was the right move particularly after Democratic leaders and Vice President Kamala Harris objected to the images as reminiscent the abuse of slavery.
Biden however announced both findings as well as the intended punishment before the investigation reached any conclusions:
“To see people treated like they did, horses barely running over, people being strapped – it’s outrageous. I promise you, those people will pay. There will be an investigation underway now and there will be consequences. There will be consequences.”
Presidents long resisted pressure to get them to comment on pending cases or investigations to avoid charges of undue influence or bias in the results. This is one such case. It was wrong for Biden to say what he did in promising punishment for agents before any investigation is complete. It sends a message to investigators about the expected conclusions of their work. It also suggests that a finding of no whipping or wrongdoing would contradict the President and would not be supported by the White House. That could present serious career issues for investigators. It is unfair to the agents. It is unfair to the investigators and it undermines the integrity of the investigation.
It seems to me that there are two separate issues here. The most discussed is whether migrants were in fact whipped or “strapped.” Biden stated that they were indeed strapped, but many are now saying that that was not in fact true. The investigation will hopefully establish the truth, but now investigators may be concerns about embarrassing the President with any contrary finding.
The second issue is whether it is wise or appropriate to use mounted officers to block migrants. Most cities use mounted units to control crowds. People are more reluctant to confront a horse in comparison to an officer on foot. Police insist that the benefits of mounted units have been proven repeatedly and most countries deploy them to bar entry or control crowds.
Moreover, border agents maintain that horses are still the best way to traverse parts of the difficult terrain of the Southern border. Yet, they also can create dangerous moments like this one on the water’s edge for tired and unstable individuals seeking to enter. That is why the investigation is a useful step.
You cannot promise agents a fair and unbiased investigation when the President has already declared that they strapped migrants and will be punished. That is why Biden’s comments were clearly inappropriate and he should publicly withdraw them in the interests of preserving a fair process for all involved in this controversy.
With all the illegalities from the Biden Administration, and in specific the illegalities of the FBI, are we still a free nation?

I had an interesting thought: The Minnesota Supreme Court overturned Mohamed Noor’s third degree murder conviction but left intact his manslaughter conviction.

I am not sure I agree with that conclusion, it sounds peculiar, but I haven’t reviewed the decision and I am not going to review it.
What has occurred to me is that the court may be preparing the public battle space for overturning convictions in Officer Chauvin’s case. The justices can’t help but know that the trial was grossly unfair and that unless they cower before the mob–as the trial judge seemed to me to be doing–they will have to overturn at least part of the judgment.
Now they can say that “Well we did something just like this with Mohamed Noor who is black.” That’s the kind of racial balancing we seem to need to do these days.

When I viewed the video, I watched the horses. One or more of the horses appeared to be agitated. When a horse is upset, agitated, nervous, insecure, it may stomp or rear up, throwing its rider and/or stomping on an individual on the ground while trying to get away. I don’t really know horses, but they are animals, who cannot speak and tell people to get away. I do have horses. Horses used in law enforcement undergo significant desensitization training. You can’t just grab any horse and subject them to hostile crowds.
The horses on the border looked like Quarter Horses. They were being used to block people from getting past them, kind of like a cutting horse at a ranch sorting. I never say any photos or video of any horses in the Border Patrol horse unit rearing or trampling anyone. I really wish people would stop conjecturing, out of fairness to the riders and their horses.
Cutting horses are some of the most independent thinkers in equine sports. The rider indicates the calf to cut out, and then it’s all up to the horse. The rider just has to stay balanced.
Here is an example of what a cutting horse can do. Around 1:06 is when the horse locks on to the calf the rider wants. The rider sits deep, puts his rein hand down and quiet, and lets the horse work. That horse’s chest will hit the dirt before he lets that calf past.
Joe Biden will not control the border. He’s created a humanitarian nightmare. It might be up to the states to make the border impenetrable. I don’t flatter myself to suppose Turley reads my comments except those which Darren may bring to his attention which is likely zilch. Turley cannot regret my posting here because he is an ardent Free Speech advocate. He wouldn’t dream of banning my speech though he finds it unpleasant or embarrassing. The sad fact is that he cannot be held accountable for his silence and his advocacy journalism because he will not admit that he has read my questions.

I watch 3 hours of its prime time schedule daily. Curiously, Turley has not made an appearance on the prime time shows for months now. Either he has nothing to add which would support their biased narratives, or he is quietly on the way out the door.

Meanwhile, another preposterous legal aberration is charging an electric utility with manslaughter (i.e. Shasta County prosecutor) when an Act of God is to blame, and when property owners should be responsible and liable for their property, including their trees. Are federal and state governments responsible for automobile accidents on the highways they provided?
Interestingly in Commufornia, extreme winds, as an Act of God, caused limbs of trees to extend far beyond usual spans causing limbs to collide with transformers, installed by law by the local electric utility to accomplish its mission to provide electricity 24/7/365, which, in turn, caused sparks which, in turn, caused a fire resulting in casualties and property damage.
Who is to blame for an Act of God? The deep-pocketed electric utility, of course. What kind of insurance company would assign blame to a blameless party fulfilling a legal obligation, in this case, to provide electricity? What kind of residents and homeowners would not insure their homes and lives for fire, and would not be responsible for their trees which deleteriously impact the electric utility’s equipment?
