There is another free speech fight brewing at Ohio Northern University. According to the site College Reform, Ohio Northern College Republicans were denied approval of apparel featuring “Back the Blue” on the sleeve and a Thin Blue Line flag printed on the back. Even though the shirts did not include references to ONU, the university still barred the design due to other schools being forced “to retract and apologize” for such designs. It is another variation of the “heckler’s veto” where (in this case private) schools intervene to stop lectures or expressive activities due to the objections of others.
“Back the Blue” is obviously an expression loaded with political and social meaning in support for police officers. The denial of such expression is content-based censorship.
College Republicans president Madeline Markwood noted that the student handbook does not require such pre-approval but that the group wanted to work with the university in good faith. In emails obtained by Campus Reform, ONU associate director of Communications and Marketing Sheila Baumgartner wrote to Markwood on September 17 to emphasize the “sensitivity” of the design and the need to discuss the request with the Diversity, Equity and Inclusion board and the Office of Multicultural Development office.
Baumgartner then stated “[t]hey then discussed as a group and would recommend not moving forward with this project. There are several schools who allowed Blue Lives initiatives who have had to retract and apologize.”
He cited such incidents as Emerson College apologizing for displaying the Thin Blue Line flag. Notably, the controversy at Emerson was the use of a Blue Lives Matter flag on as an office computer screensaver. This is the denial of the use of such symbols by students.
ONU then suggested a meeting with the Office of Multicultural Development and Interim Director of Multicultural Development Albertina Walker agreed to meet to discuss “thin blue line flag and its complicated place right now in American culture.” The meeting appeared to get derailed when Walker said that the office needs to “understand what it means for your organization to ‘support the Police Union’ by selling its paraphernalia” so that she can “understand [Markwood’s] perspective.”
Markwood said (correctly) that the students should not need to explain their support for police or justify it.
Ohio Northern University is a private institution, not a state school. It is not the government shutting down the speech in the classic heckler’s veto but the effect is the same with officials barring expression by citing the opposition of others. Imagine if the school barred “Black Lives Matter” displays or other such causes. It is discriminating on the basis of the content of the messages on the basis that some are too “controversial.” It invites bias and selective regulation.
Ohio Northern University should reverse this course and remove such objections in the interests of free speech.

I graduated from this college (ONU) in 1969 and they were “woke” then, especially in regards to Muslims.

The problem with this scenario is that in 1790 (1795, 1798, 1802 – four iterations), the American Founders who ratified the Constitution one year previously, passed the Naturalization Act which required citizens to be “…free white person(s)…” and the final Naturalization Act of 1802 was in full force and effect upon the issuance of the illicit Emancipation Proclamation in 1863, in turn requiring the immediate deportation of non-white slaves freed by that document, lest they be considered a hostile foreign invasion force which America would be compelled to repulse.
The aforementioned affected blacks must not be in America by law. As I recall, America is a society of laws. It appears as though laws were called on for protection in the paragraph above. The long arm of the law (~ 158 years) can be a terrible thing…and a big surprise.

Today’s university student body is less driven, less socially engaged, emotionally stunted, and anxious/depressed. University colleagues / practitioners that are charged with the mental health of university students are overwhelmed with how unprepared university students are today. They often reference Dr Jean Twenge and Dr Jonathan Haidt for scholarly data on how fragile these kids are.

I reflect on Americans 19th and 20th Century, particularly veterans of various wars, who returned from wars in their 20s, got married, had jobs, raised children, many went to school, and were undeniably fit adults. Today, the contrast is stark. Kids today can’t even leave their parents homes by their 20s. It is embarrassing to see the kids on campus today: males dressed like slobs, inarticulate, haven’t a clue on classical works, women who lack self-esteem, insecure, easily 90% avoiding each other, opting instead to have their faces in their electronic devices while walking, sitting in university common space or in the library….apart from others.
Intellectually, emotionally and physically, our younger generation are developmentally stunted. The blame goes to their parents who lacked interpersonal skills to sustain marriages, families, careers and personal care. Looking across America’s plains, I grimace at the size, shape, debauched physique of Americans, knowing the medical complications therein. A nation can not survive when the people are not fit physically, emotionally, psychologically or developmentally. How far we have fallen from 1776 indeed.

Just an hour ago Jones had Pastor Arthur Pawlowski on again, about being in Canada, preaching in his church & was arrested for that & gathering at church because of Canada’s Govt ongoing move into full blown Commie/Nazi type authoritarianism.

I agree Oky1. JT’s blog is one of many sources I use as well. HIs presentation of these 1st amendment issues is like he’s walking into a dark room everyday with a flashlight and spotting one cockroach. I agree with him. I recall him being asked during a debate what one book would he would recommend every American to read. His answer was The Law, by Frederic Bastiat. His recommendation was spot on.

I’ve followed this blog since 2007, when I met Prof Turley when he spoke to a group of students I was working with. It used to be a place to read the good prof’s occasionally contrarian, often insightful views on legal issues. About halfway through Obama’s first term though, Turley pivoted to almost exclusively posting articles about executive overreach and how Congress needed to reclaim its historical place. After 6 years of hammering this message daily he stopped the moment Trump was elected and never mentioned the topic again. Now he posts these sad “look-at-what-those-wacky-academics-are-doing-now” blogs because he knows it’s the only way he can get engagement from his dwindling audience. There’s nothing ad hominem about addressing this blog’s obvious shortcomings. The audacity for a renowned constitutional scholar to fixate on a presidents abuse of power and a congress unwilling to check it. Then, he fixates on congresses abuse of power when a different president is acting within his constitutional authority.
