Ohio Northern University Denies Republican Group “Back the Blue” Apparel

There is another free speech fight brewing at Ohio Northern University. According to the site College Reform, Ohio Northern College Republicans were denied approval of apparel featuring “Back the Blue” on the sleeve and a Thin Blue Line flag printed on the back. Even though the shirts did not include references to ONU, the university still barred the design due to other schools being forced “to retract and apologize” for such designs. It is another variation of the “heckler’s veto” where (in this case private) schools intervene to stop lectures or expressive activities due to the objections of others.

“Back the Blue” is obviously an expression loaded with political and social meaning in support for police officers. The denial of such expression is content-based censorship.

College Republicans president Madeline Markwood noted that the student handbook does not require such pre-approval but that the group wanted to work with the university in good faith. In emails obtained by Campus Reform, ONU associate director of Communications and Marketing Sheila Baumgartner wrote to Markwood on September 17 to emphasize the “sensitivity” of the design and the need to discuss the request with the Diversity, Equity and Inclusion board and the Office of Multicultural Development office.

Baumgartner then stated  “[t]hey then discussed as a group and would recommend not moving forward with this project. There are several schools who allowed Blue Lives initiatives who have had to retract and apologize.”

He cited such incidents as Emerson College apologizing for displaying the Thin Blue Line flag.  Notably, the controversy at Emerson was the use of a Blue Lives Matter flag on as an office computer screensaver.  This is the denial of the use of such symbols by students.

ONU then suggested a meeting with the Office of Multicultural Development and Interim Director of Multicultural Development Albertina Walker agreed to meet to discuss “thin blue line flag and its complicated place right now in American culture.”  The meeting appeared to get derailed when Walker said that the office needs to “understand what it means for your organization to ‘support the Police Union’ by selling its paraphernalia” so that she can “understand [Markwood’s] perspective.”

Markwood said (correctly) that the students should not need to explain their support for police or justify it.

Ohio Northern University is a private institution, not a state school. It is not the government shutting down the speech in the classic heckler’s veto but the effect is the same with officials barring expression by citing the opposition of others. Imagine if the school barred “Black Lives Matter” displays or other such causes. It is discriminating on the basis of the content of the messages on the basis that some are too “controversial.”  It invites bias and selective regulation.

Ohio Northern University should reverse this course and remove such objections in the interests of free speech.

  1. Take heart. The speech police on the college campuses are losing bigly in the courts. The are not only having to pay the litigants against them but they are paying their lawyers $1300 dollars per hour. https://www.realclearinvestigations.com/articles/2021/10/07/colleges_learning_costly_woke_math_in_the_courtroom_school_of_hard_knocks_797604.html. Obviously they are not among the brightest and the best. With emphasis on “the best”. More litigation to the tune of millions of dollars is coming their way. They’re asking for more money from the states to cover their cost. It’s all about the Benjamin’s baby. Your vote against these woke storm troopers will stop them in their tracks.

  2. “[Private property is] that dominion which one man claims and exercises over the external things of the world, in exclusion of every other individual.”

    – James Madison
    ______________

The right to private property is not qualified by the Constitution and is, therefore, absolute.

The right to private property is absolute or the right to private property does not exist.

By establishing the right to private property, the Constitution proves that the absolute right to private property exists.

Private property is not, and is distinct and separate from, public property.

Congress has no power to “claim or exercise” dominion over private property.

The right to private property of the owners of Ohio Northern University is superior to the freedom of speech of students.

Students are not compelled or bound to enter or occupy the private property of Ohio Northern University, and students are free to enjoy their freedom of speech in other locations.

  3. Except for the fact, police support not controversial. Any issues raised are nothing but a tactic to shut down discussion.

If you don’t support police you can’t support the Democrat Party. Democrats have run the cities and those city police departments for generations. The policing as it exists, is exactly what the Democrats have built and developed. Its not the police to blame, but those in charge of the police. Elected Democrats.

  4. Jonathan: I don’t suppose any time soon you will discuss the continuing problem of racism in schools around the country. But you should. Here is a case worthy of discussion. A white teacher at the Winterville Charter Academy in Winterville, NC has resigned over overt racist remarks she made in her classroom. Kanisha Tillman, who taught 8th grade at Charter, told her Black students that if not for the Constitution, they would be her “field slaves”. When a Black student called a fellow white student a “cracker” for endorsing the teacher’s remarks Tillman responded by threatening to write up the Black student for disciplinary action.

But you prefer to defend the College Republicans at Ohio Northern University who wanted to print a shirt emblazed with “Back to Blue” and a “Thin Blue Line” flag. Such language can obviously be interpreted as support for police racist practices in the treatment of Black people. That, in your view, is a “free speech” issue that requires defending. But when a school teacher uses overt racist language toward her Black students and threatens to discipline a Black student for objecting? Not a peep out of you. Why the double standard?

    1. She resigned, as should every teacher pumping racist ideology into our children. You’d think she had said, if you don’t support my teaching, you ain’t black. Or, without our constitution, they’ll put you back in chains.

But do keep on with the double-standard complaint. 🤣

    2. This is a legal blog, there are no legal issues raised by that incident. A ridiculous attack

    3. print a shirt emblazed with “Back to Blue” and a “Thin Blue Line” flag. Such language can obviously be interpreted as support for police racist practices

The flag could also be interpreted to endorse Leprechauns riding unicorns, As long as you are going to make stuff up.

told her Black students that if not for the Constitution, they would be her “field slaves”

So teaching false CRT premises is oky doky, but teaching the Constitution is racist? But for the constitution, blacks would still be slaves. They are not, because a super majority of Whites amended the Constitution.

Generally refereed to as the Reconstruction Amendments

The Thirteenth Amendment abolished slavery. The Fourteenth Amendment addresses citizenship rights and equal protection of the laws for all persons. The Fifteenth Amendment prohibits discrimination in voting rights of citizens on the basis of “race, color, or previous condition of servitude

If you don’t understand that, you self identify as a student that did not get taught the basics of our government, and have since, lacked the intellectual curiosity to be self taught.

Your commentary is up to its usual standard – sloppy. Kanisha Tillman, who is black (as if her name wasn’t a pretty big clue), was the one PARENT quoted as saying she was “hurt and disgusted” by the words of the unnamed teacher. Wonder why we don’t pay you much heed? Wonder no more.

Oh and I’ll pass your apologies on to Ms. Tillman.

      1. The problem with this scenario is that in 1790 (1795, 1798, 1802 – four iterations), the American Founders who ratified the Constitution one year previously, passed the Naturalization Act which required citizens to be “…free white person(s)…” and the final Naturalization Act of 1802 was in full force and effect upon the issuance of the illicit Emancipation Proclamation in 1863, in turn requiring the immediate deportation of non-white slaves freed by that document, lest they be considered a hostile foreign invasion force which America would be compelled to repulse.

The aforementioned affected blacks must not be in America by law. As I recall, America is a society of laws. It appears as though laws were called on for protection in the paragraph above. The long arm of the law (~ 158 years) can be a terrible thing…and a big surprise.

    5. ” . . . the continuing problem of racism in schools around the country.”

It’s called affirmative action and CRT.

P.S. If you want to spread the vicious slander that America is an evil country, at least get the details of your story right.

  5. Glad to see these students support the brave police who fought off the terrorists storming the Capitol on 1/6.

    1. OMG!

If the big bad “terrorists” were “fought off” in the Capitol, what they heck is America going to do against the whole Chinese Air Force, Navy, Marine Corps and Army when China commences hostilities against America’s former friend, Taiwan?

I know, we can all throw our purses at them.

That will strike fear in the hearts of men!

  6. Here’s the problem: “Office of Multicultural Development and Interim Director of Multicultural Development.”

Abolish one and fire the other.

  7. By taking such actions, universities convince us that the lives of cops don’t matter to them.

There is something rotten in society when a simple statement that the lives of police officers are important is considered controversial.

Justice is when allegations of police misconduct are investigated in good faith, and only acted upon when warranted.

Injustice is claiming all law enforcement are racist, or harassing those who say their lives matter.

    People’s lives matter. Justice matters.

We are now seeing the Left encourage assaults on police officers. Resisting arrest is no longer prosecuted in deep blue counties of CA.

Propaganda portrayed law enforcement as an evil enemy. It encouraged defunding police. Many police departments had to scale back, and lose entire divisions. Response times increased. Cops became hesitant to do their jobs. Criminal mayhem ensued.

Is the Left going to be held accountable for the skyrocketing crime and murder rate? What worse policy outcome can there be than more murdered people? The Left has yet again caused more blight and crime in poor neighborhoods.

As shoplifting and crime escalate, businesses and jobs leave poor areas. This means there are less opportunities for financial advancement, and the neighborhoods are more dangerous than ever. This was a direct result of Leftist policies. This didn’t just happen like a piano falling out of the sky. This was the predictable result. But those who predicted this were branded racists.

Make the connection between policy and result, and grow wiser.

    1. Propaganda portrayed law enforcement as an evil enemy. It encouraged defunding police. Many police departments had to scale back, and lose entire divisions. Response times increased. Cops became hesitant to do their jobs. Criminal mayhem ensued. — Karen S

This appears to be the point of the left’s defund the police strategy… to federalize local police departments.

After hobbling local law enforcement with funding cuts, thus allowing street crime and chaos to rapidly rise and spread (with a little help from the left’s well financed mostly peaceful protestors), local officials then respond to citizen outrage by calling on the Feds to step in and “restore law and order”.

    2. Karen: your usual discipleship is showing here once more. There is no evil “Left” encouraging assaults on police officers. However, you have defended the Trump insurrectionists who attacked, beat and killed Capitol Police officers, beating them with flag poles and fire extinguishers. You downplayed this direct assault on our democracy as just a “couple of yahoos” who got out of line, ignoring the gallows and calls to “hang Pence”, all fomented by your hero. There is no evil “Left” causing crime or murder rates to “skyrocket”, either. Dumb Kayleigh McNiinny had to be corrected when she accused the Biden Administration of having the highest murder rate–she didn’t notice that the statistics she cited were during the Trump administration.

Karen claims: “make the connection between policy and result and grow wiser”. Wow! That coming from a disciple to a bloated narcissist dictator wannabe who told the faithful to “fight like hell or you’re not going to have a country any more”, and that he hoped “Pence would do the right thing”, which meant violate the law and steal votes for Biden. But, you’re all about law and order and respect for the rule of law.

    Biden’s Big Lies

Of all the lies told by the Biden administration — from Covid to Afghanistan to the Southern border — this has to be the biggest whopper:

That the $3.5 trillion “reconciliation” bill (aka boondoggle) is “going to cost nothing.”

Who knew? You can get something for nothing. What next — a perpetual motion machine?

Oh, that bill includes $2.1 trillion in new taxes — which I guess is not a “cost” to those forced to pay the taxes. And that “those” is everyone — directly or indirectly.

And the remaining $1.4 trillion? It will be paid with “magic” money, i.e., by inflation — which is also a cost to everyone.

P.S. If you think that Biden’s bill is *only* a tax on the wealthy, then you do not understand the first thing about the principle of secondary consequences. And if you think that the corporate taxes are *only* a tax on companies, then you do not grasp the first thing about the noxious consequences of a government consuming a company’s capital. (For more, read Hazlitt and Mises.)

    1. Biden’s tax reform calls for the uber wealthy corporations and individuals in this country, who pay NO income taxes, to start paying their fair share. That would more than compensate for the cost of the infrastructure package that is overwhelmingly popular with the American people. And, no, there’s no trickle down implications either. The wealth that these people and corporations accumulate due to paying no taxes is enormous.

      1. Biden’s tax reform calls for the uber wealthy corporations and individuals in this country, who pay NO income taxes, to start paying their fair share.

Did you sleep through Econ I on your way to your nursing and law degrees? When the corporate tax rate goes up, what do you suppose will happen to the price of the product or service they sell?

        1. Article 1, Section 8, Congress has the power to tax ONLY for “…general Welfare…,” omitting and, thereby, excluding any power to tax for individual welfare, specific welfare, redistribution of wealth or charity.

Congress cannot tax for any component of the American welfare state.

The IRS is extraneous and superfluous and its existence incoherent under the U.S. Constitution.
          ___________________________________________________________________________

Congress has no power to regulate anything other than money, commerce and land and naval Forces.

Congress has no power to tax for departments engaged in unconstitutional regulation.

        2. So when taxes go down the price of product and service should go down too, right? Or maybe you can show examples how the price of service and product went down when taxes were cut for corporations and board members.

          1. Citizens pay taxes.

            Corporations cannot pay taxes.

            Corporations have no money.

Corporations get their money from consumers.

            Consumers are citizens.

            Citizens pay taxes.

          2. “. . . how the price of service and product went down when taxes were cut . . .”

There are countless such examples. Here’s just one: Gas price went from about $3.80/gl in 2014 to about $2.80/gl in 2018.

It sure would be a better country if people understood the basics of free market economics. Corporations use their capital to create new products, to improve products, and to increase the number of units they produce — which, in turn, lowers prices. (See, for example, the history of the computer industry.)

When government loots a corporation’s seed corn, quality and supply suffer, and prices rise. If you think supply and prices were bad during the pandemic, just wait until Biden starts spending more of your money.

        3. . . . what do you suppose will happen to the price of the product or service they sell?”

And to their capital for R&D, expansion, job creation, raises, dividends . . .?

        4. What would happen to the price of products and services? Maybe nothing, or prices may even go down if there’s free and fair competition, especially if Medicare is allowed to negotiate prescription drug prices. Anyway, with the average American doing better, the economy will improve. What should happen is less profits to the ultra-wealthy.

          1. Maybe nothing? Your wish-casting defies all available economic studies that describe how corporate tax increases will negatively impact the economy. It’s a tactical exercise that will fail strategically. The next tactical move will be (you hinted at it) is price controls. These actions effectively chop off the invisible hand that would normally lead to free and fair competition. It’s nonsense to think attacking the profits of the ultra-wealthy (whatever that means) will only impact the ultra-wealthy. First of all, they are ultra-wealthy for a reason. It doesn’t matter if it’s new money or old, legally amassed or by criminal activity. Even the most philanthropic among them will not ever be forced to eat Top Ramen for dinner or have their car repossessed. Zuckerberg lost $7 billion in one day last week, do you think he considered pawning his jewelry so he could keep his lights on? No. What the government needs to do is remove market barriers, not add them. Because the real harm they do is not felt by the ultra-wealthy, wealthy, moderately wealthy in the same life-altering way as those in the middle or low income brackets.

      2. Corporate tax in the year 2020 equaled $230.2 billion in 2020. Boom. There goes another Natacha masterpiece. Some large corporation did not pay taxes in 2020 but Natacha conveniently leaves out the word “some” to make it look like corporations pay no taxes. Disingenuous stinkin thinkin.

      3. Biden’s tax reform calls for the uber wealthy corporations

Wealthy corporations. That’s a hoot. Corporations have operating capital. Not wealth

A corporation is a piece of paper.

The only place to get $tax is from another Human

Yes Democrat Politicians always say they are going to tax the corporations, But its a shell game to fool rubes. And boy does it do that…in spades

      4. “. . . infrastructure package . . .”

Which is, of course, another con game. The $3.5 trillion boondoggle bill has virtually nothing to do with “infrastructure.”

If there were truth in titling, that bill would be called: “The Bernie Sanders Let’s Make America Venezuela” bill.

  9. The frequency of freedom of speech and liberty squashing occurrences in the USA cannot and should not be ignored any longer. There are signs in large cities and small rural towns all across our country that the USA is rapidly veering away from a being an human rights, individual freedom, constitution based, democratic republic and towards a country being completely dominated by propaganda, intimidating mob justice and social totalitarianism. Stop ignoring what’s staring you in the face.

Wake up people. Irrational social justice warriors that are currently dominating our society are a 21st century scourge, they’re destroying the fabric of our nation, our society and our culture and that’s exactly what they’re trying to do.

Once your rights become unenforceable because social totalitarians have b-a-s-t-a-r-d-i-z-e-d and morphed them into the quaint anecdotes of history, your rights will be gone.

    1. Steve,
I sense that people are waking up. Is it too late? Perhaps. However, I believe the rapid rise in the weaponization of the executive branch agencies against those opposing these totalitarian actions is a reflection of people waking up. Consider Biden’s cratering poll numbers. Even with a massive propaganda machine doing everything possible to put lipstick on his disastrous policies, >60% disapprove of what his administration is doing. The spin on that fact is they aren’t as bad as President Trump’s. Of course Trump’s ratings were driven by that same propaganda machine doing everything possible to tar his successful policies.

      1. Olly, it’s true more people are awakening to the disastrous consequences of Leftist policies.

If the Biden Administration does pass this multi trillion dollar spending bill, that’s when the middle class and the poor will really feel the effects. Already, it is estimated that the current inflation, running at a 30 year high, combined with supply shortages are already costing the average American $175 a month.

If Biden gets the job killing spending package passed, that’s going to really hit Americans hard. The claim that it won’t cost Americans earning $400,000 a single dollar is ludicrous. At least the Administration has stopped claiming it can spend trillions of dollars “for free.”

“However, a study from the Joint Committee on Taxation — a non-partisan congressional tax scorekeeper — found that the cost of corporate tax increase would be passed on to lower and middle-class consumers, “Within 10 years of a corporate tax increase from 21 percent to 25 percent, 66.3 percent of the corporate tax burden would be borne by lower- and middle-income taxpayers with income well below $500,000.”

“This statistic becomes only more striking in absolute number of taxpayers. Of the more than 172 million taxpayers who would bear the burden of the increased corporate tax rate, 98.4 percent, or about 169 million, have incomes under $500,000,” the study added.

Additionally, it found that in 2023 “taxpayers of every income level will see [a] meaningful tax increase.””

        https://ijr.com/psaki-bidens-spending-not-cost-americans-earning-less-400k-a-dollar/

Not only would they end up having to raise middle class taxes to pay for this whopping pork spending bill, there are also connections between consumers and manufacturers and corporations that spread costs. When the cost of doing business goes up, prices go up. Employees get laid off. Some businesses offshore or close entirely.

Everything will cost less and fewer people will be working.

The typical Leftist response to such a scenario would be to force wages to rise, which will exacerbate the problem, causing more layoffs and closures.

How low will we be brought before voters stop falling for the something for nothing schtick? Everyone wants free money. It’s appealing to many to tax “the other guy”, some abstract company or wealthy fat cat. It always ends up affecting them in the end. Will we sink as low as Venezuela before people think, gee, these policies might sound nice, but they never work out.

        1. Everyone wants free money. It’s appealing to many to tax “the other guy”, some abstract company or wealthy fat cat. It always ends up affecting them in the end.

This goes back to what I commented about last week after Gen. Milley called the Afghanistan withdrawal an So you have a strategic failure while you simultaneously have an operational and tactical success, Democrats govern tactically without a care in the world about the consequences strategically. The only other option is the Democrats are thinking strategically and their vision is to collapse the entire system leaving them with total power. For some Democrats, it is likely the former, but for those at the top, it’s likely the latter.

    2. “Irrational social justice warriors that are currently dominating our society…”

This is the narrative pushed, from different directions, by all major media, both “left” and “right”. You have swallowed it whole and been molded into a tool to keep Americans divided and distrustful of each other. Sad.

      1. This is the narrative pushed, from different directions, by all major media, both “left” and “right”.

Which part is being pushed? That they are irrational, or that SJW’s exist, or that they are dominating our society?

        Asking for a friend.

      2. Uh-huh. “the request’s “sensitivity” caused the office to discuss the request with the Diversity, Equity and Inclusion board and the Office of Multicultural Development office.”

Appears that irrational sjws are dominating NOU society. They even have two separate entities through whom requests to wear a flag symbol need to be vetted, apparently “or else.”.
I wonder if the ask was for a rainbow flag, if it would have been accepted – maybe not if they ran it by the fictitious “right”-wing boards on campus.

        Come on.

      3. Brad wrote, “You have swallowed it whole and been molded into a tool to keep Americans divided and distrustful of each other.”

That indirectly implies that what has been “swallowed” is not actual truth and my reply to that is BALDERDASH!!!

I live in a “progressive” (progressive is an oxymoron when talking about modern “progressives”) bubble that’s full of irrational social justice warrior activists and I actually see their irrational behaviors daily, plus I see the same irrational behaviors being reported from all over the USA. This story is another in the trash heap of irrational social justice warrior behaviors destroying the fabric of our nation.

It’s apparent to me that you’re the one that’s swallowed the totalitarians propaganda whole.

Take the time to read the link I provided, comment there if you like.

    3. Steve,
I thought you might like this article.

Since Smith penned his Wealth of Nations in 1776, the wealth of the average Westerner has increased a hundredfold. Intractable complexity and its twin, pervasive ignorance, are both cause and consequence of that enrichment. Though Enlightenment thinkers envisioned Man liberated by the light of his own understanding, the philosophes could not comprehend reason’s shadow. It is not greater awareness, but deeper unconsciousness, that characterizes the modern mind. This may be the fundamental irony of our times.

We moderns find ourselves in the position of a man who wakes up alone aboard a strange ship, surrounded by unfamiliar machinery. Blinking lights and sterile floors are the only face of a vast mechanism that entombs him above the cold waves. The reluctant sailor cannot even name any of the machines that hum around him. All he sees are ‘things.’ There are black things and green things, red things and white things, and not a single thing makes a bit of sense.

Though the ship is mysterious, it is clear that it’s not floating through empty space – icebergs loom out of the mist on all sides. What’s more, a trail of oil stains the sea black in the vessel’s wake. Yet there is no apparent way to determine how to fix the leak without wrecking any of the ‘things’ that keep the ship afloat.

The civilization that puts bread in our mouths is far more complex than any sailing ship – too intricate for anyone to model, let alone steer. If its advance only increases our ignorance, we should grow more reticent to change as time passes. Yet there is no reason to expect human beings to grow in humility as they gain power over the natural world and one another. This is why tragedy, whether in the form of Greek drama or the economist’s irony, remains an enduring human experience.

Excellent piece, Olly. Thanks for sharing.

Today’s university student body is less driven, less socially engaged, emotionally stunted, and anxious/depressed. University colleagues / practitioners that are charged with the mental health of university students are overwhelmed with how unprepared university students are today. They often reference Dr Jean Twenge and Dr Jonathan Haidt for scholarly data on how fragile these kids are.

        Dr Jean Twene:

The Coddling of the American Mind by Haidt is an excellent book.

I reflect on Americans 19th and 20th Century, particularly veterans of various wars, who returned from wars in their 20s, got married, had jobs, raised children, many went to school, and were undeniably fit adults. Today, the contrast is stark. Kids today can’t even leave their parents homes by their 20s. It is embarrassing to see the kids on campus today: males dressed like slobs, inarticulate, haven’t a clue on classical works, women who lack self-esteem, insecure, easily 90% avoiding each other, opting instead to have their faces in their electronic devices while walking, sitting in university common space or in the library….apart from others.

Intellectually, emotionally and physically, our younger generation are developmentally stunted. The blame goes to their parents who lacked interpersonal skills to sustain marriages, families, careers and personal care. Looking across America’s plains, I grimace at the size, shape, debauched physique of Americans, knowing the medical complications therein. A nation can not survive when the people are not fit physically, emotionally, psychologically or developmentally. How far we have fallen from 1776 indeed.

  11. Jonathan Turley is a very important and relevant legal scholar you can tell by the way his posts deal not with the salient legal issues of the day but with opaque decisions made at obscure colleges no one has ever heard of.

    1. The irony of your statement is apparently lost on you. The erosion of free speech is as salient a legal issue as anything happening in our country today. By shining a bright light on stories like opaque decisions made at obscure colleges no one has ever heard of, JT is fighting against the forces that would like nothing more than to make other salient legal issues something no one can ever hear about.

      Try again.

      1. I’m not sure how/why JT is handling himself on these many issues, but it seems weak to me.

Infowars/TheGatePundit/The Liberty Daily/Naturalnews/Project Veritas & many more are far deeper on many of these important issues & facts.

(Project Veritas, talk about Home Run Hitters, one after the next)

Just an hour ago Jones had Pastor Arthur Pawlowski on again, about being in Canada, preaching in his church & was arrested for that & gathering at church because of Canada’s Govt ongoing move into full blown Commie/Nazi type authoritarianism.

Next Wednesday he goes back to court & is looking at up to 4 years in prison for the above.

Pawlowski grew up in a communist nation in Eastern Europe, so knows what that crap looks like.

He & others (I think maybe JT is leaning this way) are pointing out it’s coming here now.

Just look at the EU/UK/Aussie they’ve already went Commie/Nazi Nutz.

We can see in those places the govts there got rid of the good police, military, firemen, docs, nurses mayors, etc., & kept only the rotten ones.

It’s a known Commie operating move to take over govt & turn us all over to the Globalist/UN control if they don’t kill us with their Fauci/Gates Bio-Weapons.

BTW: Infowars premiers a new documentary tonight: Covidland

        1. Mark Levin has been all over the topic also about this Markist/Authortrian crap creeping in.

        2. I’m not sure how/why JT is handling himself on these many issues, but it seems weak to me.

I agree Oky1. JT’s blog is one of many sources I use as well. HIs presentation of these 1st amendment issues is like he’s walking into a dark room everyday with a flashlight and spotting one cockroach. It’s high time he turns on the light and starts talking about where and why this country is infested with cockroaches. The same goes for every other “legal” controversy he decides to write about. At some point JT needs to zoom out of the room so he can see the elephant in it. I would ask him the same question I asked a Linkedin group about 9 years ago. This question came to mind as our group addressed one controversy after another. So I asked them: We have many problems with many causes, but is there one root cause? After one year and 1,000 responses, we concluded not one, but three equally important root causes:
          – Voter ignorance of government
          – Voter apathy towards government
          – Voter dependence on government

          1. (( After one year and 1,000 responses, we concluded not one, but three equally important root causes:

That seems an accurate conclusion to me. Ret. Congressmen Dr Ron Paul wrote/spoke many times on dealing with aftermath of these issues could likely only be solved by slowly backing out the US society off all these Free Govt Cheese types programs.

Politicians were able to get all these different groups, Farmers/Truckers/Doctors/Cops/etc., there own special lil govt freebies program so it’ll be a tough sell getting them to give those programs up.

Pensions & Healthcare, etc. those retirees are vested & no longer have their youth to change. That’s likely the motivations of the billionaires to whack us now to get out of paying what’s owed & flood the US with all the 3rd world slaves they can.

Skipping ahead the people of the US better get their heads out of their backside.

Those in billionaire class have already decided to take over this country & elsewhere.

“Build Back Better” slogan means bulldoze & remove all the old & replace everything with their authoritarianism.

One of their public spokesman, Kluas Schwab, comes out & basically says so.

We need to tell him & his friends, Gates/Fauci/etc., to go to hell, we are the “StakeHolders” not them!

“” Capture of democratic structures and institutions

Schwab as publisher of the World Economic Forum’s 2010 “Global Redesign” report postulates that a globalized world is best managed by a coalition of multinational corporations, governments (including through the UN system) and select civil society organizations (CSOs).[29] It argues that governments no longer are “the overwhelmingly dominant actors on the world stage” and that “the time has come for a new stakeholder paradigm of international governance”. The WEF’s vision includes a “public-private” UN, in which certain specialized agencies would operate under joint State and non-State governance systems.[30]

According to the Transnational Institute (TNI), the Forum is hence planning to replace a recognised democratic model with a model where a self-selected group of “stakeholders” make decisions on behalf of the people.[31] The think tank summarises that we are increasingly entering a world where gatherings such as Davos are “a silent global coup d’etat” to capture governance.[32] “”

I agree with him. I recall him being asked during a debate what one book would he would recommend every American to read. His answer was The Law, by Frederic Bastiat. His recommendation was spot on.

      2. Olly, Dirt sounds like one of the recent departed. Same lack of intellect. I think I am going to turn on a basketball game.

    2. Dirt McGirt wrote, “Jonathan Turley is a very important and relevant legal scholar you can tell by the way his posts deal not with the salient legal issues of the day but with opaque decisions made at obscure colleges no one has ever heard of.”

Nothing whatsoever in that comment about the actual content of Turley’s blog post which makes it a pure unadulterated ad hominem deflection.

      1. You haven’t been around these parts very long so perhaps the context of my statement was lost on you. I’ve followed this blog since 2007, when I met Prof Turley when he spoke to a group of students I was working with. It used to be a place to read the good prof’s occasionally contrarian, often insightful views on legal issues. About halfway through Obama’s first term though, Turley pivoted to almost exclusively posting articles about executive overreach and how Congress needed to reclaim its historical place. After 6 years of hammering this message daily he stopped the moment Trump was elected and never mentioned the topic again. Now he posts these sad “look-at-what-those-wacky-academics-are-doing-now” blogs because he knows it’s the only way he can get engagement from his dwindling audience. There’s nothing ad hominem about addressing this blog’s obvious shortcomings. An ad hominem attack would be if I said something like “Steve Witherspoon’s profile pic makes him look like Undecided Ken Bone’s less attractive older brother.” THAT would be ad hominem.

        1. You can try to put lipstick on a pig all you want Dirt McGirt but it doesn’t change actual facts.

Ad Hominem: (of an argument or reaction) directed against a person rather than the position they are maintaining.

Your sarcastic nonsense was in fact directed against Jonathan Turley rather than the position he was maintaining, own it.

I couldn’t help but notice that you didn’t try to contradict my other point that it was a deflection.

          Your comment was also petty.

          Nice chat Dirt McGirt.

        2. “An ad hominem attack would be if I said something like “Steve Witherspoon’s profile pic makes him look like Undecided Ken Bone’s less attractive older brother.” THAT would be ad hominem.”
          *************************
No that would be stupid and small. An ad hominen attack would be “Steve Witherspoon’s profile pic makes him look like Undecided Ken Bone’s less attractive older brother” and therefore he shouldn’t be believed.

          1. mespo727272 wrote, “No that would be stupid and small.”

            You’re incorrect.

Dirt McGirt is correct that “Steve Witherspoon’s profile pic makes him look like Undecided Ken Bone’s less attractive older brother” would be an ad hominem but it would certainly also be stupid and small, aka sophomoric, aka juvenile, aka foolish, aka It’s better to remain silent and be thought a fool than to speak and to remove all doubt.

mespo727272 wrote, “…and therefore he shouldn’t be believed.”

This is rarely ever stated or written in an ad hominem but it’s usually implied; however, it’s not a condition of being an ad hominem.

        3. About halfway through Obama’s first term though, Turley pivoted to almost exclusively posting articles about executive overreach and how Congress needed to reclaim its historical place. After 6 years of hammering this message daily he stopped the moment Trump was elected and never mentioned the topic again.

I’ve followed this blog for roughly the same amount of time. Crazy huh. The audacity for a renowned constitutional scholar to fixate on a presidents abuse of power and a congress unwilling to check it. Then, he fixates on congresses abuse of power when a different president is acting within his constitutional authority. Now, this same scholar is fixating on the attack against the 1st amendment that has been going on during both administrations. Perhaps this scholar is raising the alarm because when this right is gone, his scholarly criticism will be silenced as well. Yeah, crazy.

          1. Now you can grasp why the Founders required presidents to be “natural born citizens” per the definition, which they employed, in the Law of Nations, Book 1, Ch 19, Sec 212. The issue was and remains “foreign influences” and allegiances. Obama continues to be engaged in the Obama Coup D’etat in America which has culminated in illicit deposing of President Trump and the forward deployment to Del Rio, Texas, and all points throughout the United States, of the Obama First African Expeditionary Invasion Force, with more divisions staging for deployment, as Obama continues his Coup D’etat in America and his obsession to continue “…fundamentally transforming the United States of America…,” destroying it and restructuring it into a communist state subsumed by and with allegiances to the burgeoning, global, communist hegemon, China. Ditto the eminently ineligible Kamala Harris.

  12. What’s next for these anti-free speech colleges — re-education centers to purify the thoughts of these “confused” conservatives?

  13. I like the term, “the heckler’s veto”. That is what the left lives off of. Ignorance.

  14. Does this private school permit students to wear any attire with political, social or cultural messages on them?

    1. Olly,

I don’t know but I suspect Che Shirts would be celebrated. Mao too. Suddenly ‘freedom of speech ” would be ‘a thing’ again.

      1. I suspect these students are more Republican than conservative in their beliefs. A true conservative wouldn’t ask permission to exercise their 1st amendment right.

        1. Olly,

I think that is true. I wouldn’t ask permission nor would I deal with their internal Stasi as if it were anything but an oozing sore. These people need pushback of the type they favor–make them live by their rules and actual law, assuming there is any law left.

  15. Petty tyrants imposing their points of view on everyone else.

Listen to them squeal when Texas imposed its abortion law.

But Lefty views are good while conservative views are evil.

    Hard to respect that mindset.

  16. More of the famous leftist tolerance we hear so much about. And I am waiting for some s@@tlib to explain in painstaking detail why this ban is a good and necessary thing. No free speech for ‘fascists’, right?

    I want a divorce!

  17. Ah the Methodists – trying so hard to maintain relevancy.
