An Educational Tonkin Gulf? The NSBA Apologies for the Letter that Triggered the Controversial Federal Operation

We recently discussed the controversy following the letter of the National School Boards Association (NSBA) asking the Justice Department to investigate parents causing disruptions or making threats at school board meetings. The letter included a reference to using the Patriot Act against possible domestic terrorism. Attorney General Merrick Garland responded a few days later with an order to the entire Department of Justice to monitor school board meetings around the country and coordinate a response with local officials. Now the NSBA has issued an apology.  The question is whether Garland will now rescind or amend his much criticized memo. It has the feel of an educational version of the Gulf of Tonkin incident. Should we reconsider our deployment in light of the false premise that triggered the escalation of hostilities?

The NSBA stated “On behalf of NSBA, we regret and apologize for the letter . . . there was no justification for some of the language included in the letter.”

Notably, recent coverage indicates that the NSBA coordinated the letter with the White House before it was issued.  A significant number of people at the organization (and likely some in the Administration) saw early drafts of this letter. Not one appears to have objected to the reckless and extreme language directed toward parents, citing a handful of cases.

For his part, Garland stated that none of these past disruptions would constitute domestic terrorism. However, as I discussed earlier, he further pledged that he will not use such laws against parents objecting to critical race theory or other issues at these meetings. However, those answers only begged the question of why the Justice Department has pledged this broad effort to monitor and respond to threats at these meetings. If these are not matters of domestic terrorism, why is the Justice Department implementing this effort? The letter does not cite any pattern of criminal threats or their interstate or federal profile.

This question was picked up in a letter to Garland from half of the eight members of the Commission on Civil Rights. They requested “specific examples” of “harassment, intimidation and threats of violence” which Garland claimed as evidence for the need for federal intervention in parent protests at schools.

Now even the NSBA agrees that its letter was over-the-top and extreme.

    Far more likely, you know the name, likeness, and occupation of the father in Loudoun County, Virginia who did what any reasonable father would do. Advocate for his daughter, by all reports the victim of a sexual assault in the bathroom of her school. Speak out for \the safety of the children in his local schools. The consequence? He was subject to literal, state sponsored violence. To public ridicule. To actual arrest. Why? Because he was a father who dared to speak out for his daughter. Because his words were politically inconvenient for his local school board. Because he had the courage to speak truth to power.

    Garcia and Slaven are the executives with the National School Board Association who authored the now infamous letter from the NSBA to President Biden. The letter calling for intervention by the DOJ, the FBI, and the Department of Homeland Security(!) in the face of American parents who dare to advocate for a voice in their children’s education. A letter with the audacity to conflate concerned parents with members of extremist hate organizations. An ideologically driven letter advancing a particular political agenda. If you have a few minutes, read their letter. It speaks for itself.

    Garcia and Slaven are powerful insiders with direct access to the Biden regime. If the press reports are correct, Garcia and Slaven even conspired with senior operatives in the Biden administration to draft that horrific letter. Yet, what in their background, politics and ideology led them and the organization they lead to stand mute in the face of shocking reports of violent sexual assaults against children in the Loudoun County schools? To stand mute while a concerned parent was ignored, ridiculed and arrested? To stand mute in the face of what appears to be an egregious failure of oversight by the Loudoun County School Board? To borrow a now popular political slogan, this is a case where silence actually was violence.

    Garcia and Slaven still have their jobs. If the sick twists of recent history are any guide, they’ll soon be in line for lucrative book deals as a reward for their fealty. How can that be? It is their actions that led to the humiliation of the NSBA board of directors and the retraction of their letter by that very same organization. An unprecedented crisis in our nation’s schools. And a direct assault on core principles of free speech.

    It is time for the NSBA to right the ship. To require Garcia and Slaven to answer for their actions. To explain whether the letter was their idea, or whether they succumbed to pressure by operatives in the Biden administration. To refocus the NSBA on education, not political indoctrination.

    These are the poster children for the crisis in our nation’s public schools. Not a poor Virginia father.

      There is no power provided by the Constitution to Congress with reference to education.

      Congress has no power to tax for education.

      The Dept. of Education, the NSBA, the NEA and respective state organizations must be irrevocably abrogated and eliminated with extreme prejudice.

      Teachers should not fear the communist czars of “state directorates of education,” they should be concerned with the opinions of parents – they should perform on the local level.

      Actual higher education and advanced-degree institutions must be private, and “fake” communist state colleges and universities must be privatized and forced to compete.

      American taxpayers are forced to pay real money for “fake” and impracticable degrees which are not necessary for the largest part of corporate requisites and performance.

      Even with one sided press – it was ludicrous to buy that there were domestic terror groups targeting School Boards.

      The only violence associated with this has been targeting parents advocating for their children

      Smith confronted the administration and school board – and they LIED. Then he was attacked by a Trans activist claiming he was just spreading transphobia.

      We can debate Trans issues all you like people with penis’s do not belong in girls bathrooms.
      It is irrelevant if every single MTF Trans person on the planet would never commit a violent sexual act.
      Make it possible for Sexual predators to gain easy access to their prey and they will feast.

      I do not know if the perpatrator here has actual gender issues – nor do I care. He is a violent serial rapist.
      And the school district is complicit for making it easier for him and for covering it up – Twice.

      This is no different from the conduct of the Boy Scouts and Church that have lead to repeated sexual assaults,
      and the same punishment should be meted out. Those in running the school district should pay with their money and their jobs.

      But aside from the painfully obvious first impressions of this story – IT GETS WORSE.

      It now appears that the Garland memo was driven completely by the Biden whitehouse.
      The Whitehouse solicited the National School Board association to write their letter.
      The Whitehouse then crafted Garlands response.

      Whether that is illegal or not, it is inherently immoral.

      The war on parents came directly from the Biden whitehouse.

      Only parts of this were known when Garland testified before congress – and frankly he did badly.
      Yet still much was being hidden at the time.

      Myriads of people have noted over time how much better at “messaging” democrats are compared to Republicans.

      What happened to the democratic party ? Did every political consultant with a witt of sense Die ?

      What politician in their right minds would provoke a war on parents deliberately ?

      But this is far from the first instance in which democrats today have been completely clueless.

      Look arround – what have democrats done right in the past 10 months ?

      Worse still, there are no signs that either the problems or the stupidity that caused them is going away any time soon.

      Many like myself do not really beleive Biden is running things. I can have some sympathy for Joe Biden – he is not in control of himself much less the country.

      But how are those actually running the show doing any better than a demented person ?

      Biden’s incapacity is NOT an excuse – these failures are party wide.

    4. Just when you thought it couldn’t get any worse for the Loudoun County School Board and the NSBA.

      Reports are surfacing that Scott Zeigler, the Superintendent of the Loudoun Public Schools, informed the School Board that a young woman was sexually assaulted by a male in the high school bathroom. Oddly, Zeigler’s email fails to mention that the alleged assailant was a boy wearing a skirt lurking in the girls’ room. A presence that was apparently condoned, if not actively encouraged, by the school. And news reports say that the sexual assault was actually a rape. Worse yet, Zeigler’s email seems more focused on attacking the victim’s father. Apparently, only certain kinds of victims are worthy of progressive compassion.

      It gets even worse. To whom did the school offer counseling? If you guessed the victim or her father, you would be wrong. If you guessed other students that were traumatized by alleged sexual violence in their school, you would also be wrong. The school offered counseling to students who saw the victim’s father. A father who succeeded in causing the sheriff to open a criminal investigation into the alleged rape of his daughter.

      Loudoun County School Board Chair Brenda Sheridan, former board member Beth Barts (seemingly, students don’t need protection from the occasional sexual assault, as long as it’s not a regular thing), and Superintendent Zeigler all have some serious explaining to do. Not to mention the loss of their positions. And if there is any sense of cosmic justice, personal liability.

      The evolving situation presents a second, even more serious test of the NSBA’s mettle. Will they condemn the sexual violence in the Loudoun County schools? Will they join the calls for a full investigation of the circumstances that created such a terrible crisis, that those responsible be held accountable, and that the root causes be corrected? Or will they stand mute, confident in the knowledge that they will remain secure in their exalted positions while the Loudoun controversy fades into the next news cycle?

If the next election is manipulated like the last you can bet there’s going to be a great deal of anger from Republicans, Independents and yes Democrats. Not this group who are hiding behind the old Democrat party name, God knows who these people are?

    1. Not “if”…..it is in the works. Fairfax County already tweeted out a message to expect late, delayed reporting of election results. Which is code for “we need to know how many votes we need to come up with before we call the final result for Macaulffe.”

      The way the 2020 election was conducted – it is trivial for even a single person with limited resources to commit election fraud on a large scale.

      56% of the country not beleives it is likely the 2020 election was stolen.

      That lack of trust – can result in violence – as you note.
      It can also result in even more fraud. Democrats beleived without evidence that Paul Manafort colluded with Russians to rigg the 2016 election what do you think republicans – like manafort will do if they beleive democrats rigged 2020 and are going to rig 2022.

      Aside from the 2020 Presidential election – there is plenty of evidence that there was fraud in the Newsome recall, far far too many voters showed up at the polls are were told they had already voted. but there was no blowback over the recall – because Newsome got more than enough votes that it is unlikely that fraud – even large scale fraud made a difference.

      All eyes are on VA right now. if observers are thrown out, if tens of thousands of magical votes show up at the least minute – there will be a great deal of anger from voters.

  3. I just saw on Thursday Night Football that the NFL is in favor of men in skirts being allowed in women’s bathrooms. Soon you will hear of a 320 pound ex football player wearing a skirt using the women’s restroom. What could possibly go wrong? If you are the one who tries to stop it you will be the one who goes to jail so just take your picture and move along. If you decide to act your cell mate will be the father who protested that the rape of his daughter was being covered up by the “woke” administrators committee.     1. It doesn’t matter how someone dresses, how they wear their hair, or whether they behave in a masculine or feminine way. Those are all performative behaviors, not biology.

      There should be a no male genitalia rule in women’s spaces, such as changing rooms and showers, and no biological men in women’s sports. That would take care of safety and fairness issues.

      That would prevent a recurrence of the rape of girls in the bathroom, and men exposing themselves to little girls at spas.

      When a black woman complained that there was a man exposing himself to little girls at the Wi Spa, she was denigrated as transphobic. The woke mob told the black woman to be quiet. Stop complaining and take it.

      It turns out that the man was a registered sex offender with a history of such behavior. CA law forced the spa to allow any biological male who claimed he was female access to women’s changing areas and showers. The negligence and risk in this law is appalling. This is the same law that allowed a man, dressed as a man, to walk into the girls bathroom at my son’s soccer field years ago, angrily telling mothers there was nothing they could do about it. He had a camera around his neck. The park staff said there was nothing they could do. The girls said he was taking pictures. He’d already disappeared by the time a crowd of angry fathers arrived to deal with it. When police finally located him, the memory card from his camera was gone.

      Far left states have a trend of enabling criminal activity, at the expense of the law abiding.

      Then there was the boy who wore a skirt in order to enter a girls bathroom at a high school, and raped a girl. The school board lied to parents worried about boys allowed access to girls bathrooms and locker rooms, saying there were no reports of any assaults in girls bathrooms.

      1. Who would have expected that if you passed laws requiring people to allow men in skirts into womens spaces – that sexual preditors would wear skirts ?

        That would have been completely impossible for anyone to foresee.

    2. Right wing groups at Board of Ed meetings are not just protesting. They are threatening violence and some times engaging in it. Yes, it has happened. No Gulf of Tonkin ….why the NSBA decided to run away from the facts is beyond me.

      WhenBoard of Ed members fear going to meetings because of threats of violence, I say that the actions of those who engage in the threats and in the violent behavior to influence policy is terrorism. The same behavior is being engaged in at meetings of Boards of Health amd else where. That’s domestic terrorism and we should all be concerned.

        They make great media fodder,though, while the media ignores all the other issues parents might be upset about.

        People are mostly ticked about mask mandates in my neck of the woods. They need to get more concerned about data mining of students, excess standardized testing, and the excess focus on creating “worker bees” rather than well-educated American citizens.

        1. You are right, especially about the worker bees and way more perceptive than many parents who don’t even realize their children are being educated to be good obedient slaves.
          What other role is open to American children who are basically illiterate compared to those of other countries and have zero skills and qualifications that will enable them to compete with the highly educated children globally.
          Knowledge is power and it’s obvious by now the educational system has failed our children and even more obvious it is being done on purpose. There was a reason there were laws against teaching slaves to read and write long ago. The same principle still exists and given the resurgence of the efforts by the left to bring back their beloved slavery again, is being recycled in a fairly brilliant, stealthier, more palatable manner to disguise it’s true purpose.

        The person arrested at the LCSB meeting was a father whose daughter was violented raped by a boy who claimed to be gender fluid in the girls bathroom – and the administration publicly denied to his face that happened.
        And then a trans activist physically confronted him.

        I do not think that constitutes domestic terrorism – unless you are talking about by the school district.

        The LSCD is now under investigation for failure to report child abuse – they are a mandatory reporter and failing to do so is a crime.
        It appears they have failed to report several rapes and sexual assaults over the past 2 years.

        It is not just CRT that parents are increasingly angry about.

        One of the board members facing recall has resigned – it turns out that SHE was making threats and using her power as a government official to punish those who criticised her.

        Regardless, if you have actual examples of this so called violence and threats of violence by parents – provide it.

        The NSBA letter had an apendix which identified the incidents to support the letter.
        The apendix was damning – the NSBA appears to think that disagreeing with them over educating children is threatening and violent.

        There are very specific requirements for a criminal threat.

        “I will sue you” – is not a criminal threat.
        “I will see that you are recalled” – is not a criminal threat.
        “I hope you rot in hell” – is not a criminal threat.
        Even “I hope something bad happens to you” – is not a criminal threat.

        I would further note – that actual criminal threats – of which I have seen no evidence, do not constitute domestic terrorism.
        They are local law enforcement matters. They are outside the jurisdiction fo the FBI.

        The fact that you choose to be afraid – does not make those you are afraid of terrorists.

        Are you aware of a single act of violence against a school board member anywhere in the country by a parent who was angry about the education of their children ?

        I am not aware of ONE. There must be one somewhere. At the same time, I think right now if there was a single one – it would make national news.

          I think there is a difference between Classical liberals, Liberals, and Leftists. Democrats can be divided into all three groups. Those who could still be described as Classical liberals appear to be few and far between (most seem to be Independents, some small-l libertarians, and a certain sort of Republican–not all Republicans are Classical liberals either). There are still a few old-school Democrats who would fall into either that category or Liberals (I’d put Maher and Bret Weinstein and Heather Heying and Naomi Wolf in the Liberal category with some classical overtones). Then there’s the Leftists who are a rather noisy bunch.

          Due to propaganda, I’m not really sure what percentage I’d put on the last two categories (Liberal and Leftist), at least for regular people. Probably depends on what part of the country you’re in. Democrats in CA (and very blue big cities) might be mostly in the Leftist category (I am a bit cynical). However, away from some of the big cities or college towns, Democrats might be closer to Liberal, maybe. Depends a bit on their personality, I suspect. Then there are some folks who might consider themselves very far Left (nigh on anarchist) who celebrate radical individuality such that they still support individual’s right to be heard.

          Propaganda is thick. Ideological possession can take quite a strong hold of people; however, even the madness of crowds wanes. People did eventually stop feverishly buying tulips.

      In east Germany – the people just decided to quit listening to a tyranical govenment – and that government ceased to exist.

      Those on the left do not appear to grasp that the rest of us will get what we want – one way or the other.

  5. NSBA is being coy here by apologizing only for the use of inflammatory language in the original,letter.

    Under that theory enlisting the DOJ and FBI and who knows what other 3 letter agencies to chill (at best) parents’ participation would be fine as long as only temperate language was used in the letter.

    I believe this “apology’ letter is what Nixon would have called a “modified limited hangout”.

    Wonder what NSBA will have to say when the inevitable FOIA requests and IG investigations reveal the full extent and timing of the communications between NSBA and various federal officials and bureaucrats >

  6. At this point, it would be refreshing to see this “apology” play out in the resignation of the Attorney General. This was such an open attempt at using the power of the federal government to intimidate into silence. The disgrace os that the so called legal scholar occupying the seat of Attorney General, sprung into immediate action, releasing an action memo in just five days.
    Merrick Garland conspired with the enemies of free speech to unlawfully suppress dissent. His time is up and he should do the right thing or face removal on conviction at trial for impeachment.

    Nothing less will serve to curb the authoritarian wave sweeping across this great and once free land.

  8. I’m a little more cynical. There has been significant blow back in NJ and VA against the Democratic governstorial candidates over these issues. I think the WH wants to cut this discussion short and coordinated this apology to do so

  9. It was national outrage that made the NSBA rethink their position.

    The NSBA has successfully induced the AG Merrick Garland to deploy the DOJ against parents upset with the hard left turn in the public education system. Unless we parents and concerned citizens and residents of the US continue to voice our displeasure, and be willing to remove our children from public schools, then we’ll be targeted by our own government in a fascist abuse of power.

    Keep the pressure on.

    I still don’t think the Teachers Unions understand they work at our pleasure. They’ve bought and paid for politicians for far too long to understand their role relies upon a willingness of parents to send their children to public school.

    I am very much interested how the Teachers Union will play their hand. They’ve gone after charter schools and have publicly opposed homeschooling. Will they overplay their hand and try to abolish homeschooling, preventing parents from having any recourse? Will they try to defang the threat of removing children from the system? They may very much want to, but parents homeschooled their children in droves during Covid, far better than the thrown together “distance learning” of many public schools. Will the Teachers Unions overplay their hands and move too quickly against homeschooling, or will they wait a few years until the public forgets about the benefits of having that option?

        Here in CA, the Teachers Union induced their bought and paid for politicians to cap charter school enrollment at Feb 2020 levels, before the pandemic was declared. They wanted to step the flight of students from their schools. Many charter schools already had perfected independent study, online, and homeschool programs, while public schools had to hastily throw together “distance learning” home study. My son, for example, didn’t learn anything at all distance learning those last few months of the 2019-2020 school year.

        The Teachers Union is pretty bold in Deep Blue CA. They’re pretty open about wanting to destroy charter schools and homeschooling.

        1. Same in NYC. In NY and NJ they have teachers that have raped or physically abused students still on the payroll. One NJ union executive was proud to say that they helped keep a teacher teaching who raped a student. That is on video (project Veritas).

          In NYC parents voted with their feet to get their kids into the charter schools, but the politicians and teachers have held the charter school enrollment numbers back. These are mostly poor minority children. I think 50,000 at last count lost the lottery and that only represents the families that applied.

            1. Karen, to right this ship, we need to be more vocal here and outside of the blog. I am known to be very polite, but I will respond bluntly and truthfully when faced with repeated deceit and lying. We need to tell the liars what they are and let everyone else know they are liars. Being polite to ruthless people only leaves us in the gutter, robbed of our most valuable possessions. They go with the satisfaction of being dominant, just like a misogynist can be dominant against the weaker female. That is what we see from one on this blog.

              My involvement was peaceful, so I stayed away from these people because they always looked for violence, and I saw plenty of it.

          I can not think of a time when the country has gone so fast from the wind at its back to to fighting gail force headwinds.

        3. Teachers unions have been kneecapping charter schools for decades.

          Almost 2 decades ago my wife and I pulled our daughter from public school – because after 5 years of excelent teachers she got the team of teachers from hell, we tried to work with the teachers we tried to work with the administration, but they politely made it clear they were going to make my daughter miserable in school and that she would fail as a result and that of course would be her fault.

          My daughter is smart, but she also has severe learning disabilities – as a result of 2 years in a chinese orphanage.

          Anyway we looked at everything, Waldorf, New School. We finally picked a cyber charter – what could go wrong ? The sales pitch was good, and the worst that could happen was that she would lose a year.

          Turns out the cyber charter was corrupt, the head was pocketing lots of money. They were investigated, lots of people quietly disappeared.

          But as I told my wife – WHO CARES ? Our daughter is thriving. She is doing well. Ultimately we changed to a better cyber charter.

          But the only reason I would not highly recommend the original corrupt cyber charter we went with – is that there are even better ones.

          But through a decade of cyber charters, nearly every year the state at the behest of teachers unions imposed new rules.

          We went from learn at your own pace and move to the next unit only when you master the current one – a model that was really great for my daughter, to rigid schedules and a manditory pace.

          Regardless, at the start of the pandemic – there were cyber charters all over the country who were EXPERTS at educating kids online.

          And again we did everything we could to kneecap those who knew what they were doing and subject millions of students to a piss poor education by amateurs.

          BTW I am not surprised CA has handcuffed cyber charters.

          DeSantis won Florida because Gilliam vowed to choke FL’s cyber charters – and 300,000 minority single women with kids in cyber charters voted for DeSantis.

          Charter schools are poison for democrats. They are one of many reasons that the poor minorities and blue colar workers are moving right.

The school board then sent the “boy in a skirt” to another district where he raped again.

    School admin people lied and young girls got raped and yet there is no outcry from the METOO partisans because they don’t want to argue against having BOYS IN SKIRTS being allowed in bathrooms and locker rooms.

          I was educated 40 years ago. I would bet I know more about slavery lynching, civil rights – all that history that you think teachers are forced to lie about than you do. I know about Tuskegee – both the airmen, and the experiments, and the college, and Washington Carver.
          And I have been there. I can quote from Mark Twains war prayer. And I was educated in a deeply red county that Jerry Falwell called the buckle on the bible belt.
          I would bet I am far more knowledgeable about the evil things this country has done – to blacks, to indians, to the irish, the chinese, or to other countries. I am white – but I was bulled and called the N word – alot growing up.

          But I also likely know much more about the goof this country has done.

          And all that from an education 40 years ago – before Critical Race theory existed.

          In fact in pretty much every way – that education of 40 years ago was superior – by every measure. It cost 1/4 what education costs today. Students scored better, and they were more likely to graduate knowing how to read.

          But my 40 year old education should NOT be superior to that today.
          We are supposed to improve over time.

          I would ask you why in specific areas – like education that government dominates – we are doing worse – not better.
          But the question answers itself.
