According to the Associated Press, President Joe Biden today will support changing the filibuster rule for voting rights legislation — a move widely viewed as effectively killing the rule. The report says that Biden will portray the choice starkly as one between democracy and autocracy. The AP, however, does not reference the third option of hypocrisy by failing to note that Biden vehemently opposed such moves for decades. He previously denounced killing the rule as “disastrous” for our democracy but now will declare the rule itself to be an existential threat to democracy. It is the latest example of President Biden’s embrace of “whatever it takes politics.”
Biden will use a speech at Atlanta’s Ebenezer Baptist Church to complete his abandonment of his long-held position. AP quotes his expected address to include the following statement:
“The next few days, when these bills come to a vote, will mark a turning point in this nation. Will we choose democracy over autocracy, light over shadow, justice over injustice? I know where I stand. I will not yield. I will not flinch. I will defend your right to vote and our democracy against all enemies foreign and domestic. And so the question is where will the institution of United States Senate stand?”
Biden showed equal passion as a senator to denounce those who would find excuses for abandoning the filibuster rule. He called such efforts “disastrous” and proclaimed: “God save us from that fate … [it] would change this fundamental understanding and unbroken practice of what the Senate is all about.”
After six months of uncomfortable silence as president, Biden later said that, as president, he continued to support the rule. Putting aside certain factual and historical errors, Biden declared that killing the rule would “throw the entire Congress into chaos and nothing will get done. Nothing at all will get done. There’s a lot at stake. The most important one is the right to vote, that’s the single most important one.”
It appears now that, even if “God [might still] save us from that fate,” the President will not.
His colleagues, including then-Sen. Barack Obama (D-Ill.) and now-Majority Leader Chuck Schumer (D-N.Y.), gave equally full-throated endorsements of the rule being denounced today as a thoroughly racist relic. Schumer, who is now also pushing for the change, previously said to abandon the rule would be “doomsday for Democracy” and reduce the United States to a “banana Republic.”
While President Biden may have found his natural resting place in the conflict between politics and principle, the move against the filibuster rule will only aggravate our deep divisions.
The Democrats would force through a sweeping federalization of state election laws for the first time in our history. It would federally preempt the laws in dozens of states and declare that Congress, not state legislatures, will now dictate how people vote in states like Georgia. It is notable that Georgian politicians like Sen. Raphael Warnock will be standing next to Biden in Atlanta as the President calls for setting aside Georgia’s own laws. (Stacey Abrams who is running for governor will not attend the event). Previously, Biden was criticized for misrepresenting the provisions of the Georgia law.
What is most striking is the inherent conflict in this logic. President Biden is going to a state where representatives passed voting rules as part of their democratic process. He is effectively saying that they must protect democracy from itself and support Washington dictating the rules in Georgia.
While denouncing the “Big Lie” of those who questioned the last election, Democrats in the same breath are arguing that the next election might be illegitimate or might be stolen under current election laws. Democratic leaders have insisted that Trump began that Big Lie by seeding doubts months in advance of the 2020 election due to the laws in blue states. Now those leaders are seeding the same doubts about the laws in red states before the 2022 election. (Indeed, despite recent denials, some of these same leaders who denounced the Big Lie are the same people who previously called the Trump election “illegitimate” and some supported challenges to electoral votes in Congress).
It is also worth noting that federal laws already protect against rules that inhibit or curtail the votes of minority citizens. Other laws are subject to judicial review if they curtail the right to vote generally. Indeed, many of these laws are being challenged by Democrats in court. The federal legislation is needed because these laws have been upheld by the courts as constitutional and nondiscriminatory.
For some voters in these states, the federal takeover of their election laws is not likely to resonate as a victory of democracy. Election laws have largely been left to the states in our constitutional system. If those laws are constitutional, the view was that each state could follow its own approach to issues like voter identification rules. While Congress can condition the receipt of federal funds on improving election administration (and reinforce constitutional protections for minority voters through laws like the Voting Rights Act), this is an unprecedented federalization of election laws to dictate how elections are administered.
In abandoning his long-held position, President Biden is choosing divisive politics over principle. This will further deepen the anger and divisions in our country. It will fuel claims that these laws are somehow illegitimate or laying the foundation for autocracy.
I previously wrote why the filibuster rule was designed for times like this:
Pushing through such controversial measures with bare majorities and on straight party lines will only deepen the divisions and increase the rage in this country. So this is precisely a time when the filibuster can play a positive role, by forcing legislation to pass with a modest level of bipartisan support. It requires consensus and compromise at a time of growing, violent division.

The filibuster has gone through historic controversies through the centuries, from opposing Caesar to opposing civil rights. But as a consensus-forcing rule, its time may have arrived, to the chagrin of many.
This move may also be soon regretted.
It is not likely to succeed but would put virtually all of the Democratic senators on record for calling for the demise of the rule. With the possible GOP takeover of both houses, the Democrats are sawing at the branch upon which their future may rest.
It was the Democrats who unwisely created the exception to the filibuster for judicial candidates in 2010. The Republicans later used that change as an excuse for an exception for Supreme Court nominees. Nevertheless, the GOP senators refused the demands of President Trump to abandon the rule for legislative matters when they were in the majority. Now, the Democrats would create an exception that could easily result in the total abandonment of the rule.
Since they are unlikely to succeed, it would be better to reaffirm support for the filibuster rule as a protection against losing the Senate in 2022. However, short-term political interests seem to be prevailing. Biden is becoming unpopular with the left and he is now abandoning his prior principled stand for political convenience. It is a Faustian bargain that I expect that the Democrats could soon regret.

With a showdown on the Freedom to Vote Act and John R. Lewis Voting Rights Advancement Act coming this month, it has never been more urgent that Congress act. Just ask voters in North Carolina and Texas. Under the congressional map passed by North Carolina’s Republican-controlled legislature, Republicans could win 71 percent of the state’s congressional seats with only 48 percent of the statewide vote. Republicans in Texas have engineered similar advantages. Texas Democrats would have to win 58 percent of the vote to be favored to carry more than 37 percent of the state’s congressional seats. In other words, Texas could turn a dark shade of blue and Republicans would still have a two-to-one seat advantage. That hardly looks “not so bad” for Democrats.

Gerrymandering is not limited to only Republican-controlled states. New York and Illinois are gerrymandered to favor Democrats. But nowhere is gerrymandering fair or desirable. Yet Republicans view gerrymandering as a survival mechanism. They know how easily Texas and North Carolina could be lost if congressional districts were drawn by non-partisan commissions.

Voting Restrictions Necessary Because Blacks Won’t Vote Republican
All through Trump’s presidency we kept hearing this ridiculous narrative that Blacks were ‘trapped on the Democratic Plantation’. The idea seemed to be that Black Americans are too simple-minded to know that Democrats are only using them.
Another ridiculous narrative was the so-called ‘Walk-Away Movement’. In the 2018 midterm elections, Blacks were expected to ‘walk away’ from the Democrats in significantly big numbers. Candice Owens was employed to emphasize this message. But no Blacks walked away, of course. They somehow couldn’t discern all the ‘good’ Trump was doing for them.
So after Blacks helped to give Joseph Biden a winning lead of 7 million Popular Votes, Republicans were forced to get tough with Blacks by doubling down on voting restrictions. Republicans didn’t want to take these measures, of course. But Blacks were too simple minded to grasp the Democratic Plantation concept.
So now President Biden wants a federal law to nullify voting restrictions. How insulting to Blacks! They were perfectly free to vote Republican but they botched the opportunity.

It’s not voting restrictions. The only people restricted from voting are those not legally allowed to vote. No legal voters are restricted from voting. Verifying who you are is not a restriction or voter suppression.
Why are there voting reforms?
1. Democrats are trying to send mail in ballots to 100% of people on the voter rolls, nationwide, even though many of those are duplicates, deceased, have dementia, moved, or otherwise unavailable. Mail in voting is globally considered at high risk of fraud.
2. In PA, the case revolved around applying a different legal standard for ballots in each district. This was in violation of the equal protections clause in the 14th Amendment. This affected every single one of the millions of ballots in PA, and it was the same premise that won in Bush v Gore. Many of the initial attorneys had to withdraw due to death threats from Democrats. The attorney who remained withdrew when Rudy Giuliani strong armed his way onto the case. Giuliani proceeded to then drive the case off the rails, ignored the foundational case with the unequal legal standards, and instead focused on issues that only affected a small percentage of votes, such as deceased votes, or unsubstantiated claims, rather than the easily provable crux of the case. The merits of the original case in PA was never decided, therefore, the claims were never disproven. In fact, they could not be disproven because districts DID impose different legal standards.
3. 80% of Americans support voter ID. Hence why there are more voter ID laws.
4. Democrats in far Left cities such as NY are moving to allow illegal aliens and legal residents to vote in local elections. This means that non citizens voting in national elections is on the horizon. This is another motivation to verify voter eligibility.
5. The Left fights tooth and nail against auditing voter rolls, which means they are currently inaccurate.
6. Vote harvesting is blatantly ripe for fraud. There is nothing keeping activists from throwing out or filling out ballots in opposing districts but their own conscience, which is rare in politics.
7. Voter fraud against elders is well documented. Caregivers or vote harvesters fill out ballots against the wishes of the elderly residents. There have been many cases where old folks tell their children they wanted to vote Republican, but the nurse said they had to vote Democrat, as well as ballots filled out for people with dementia.
8. I have received ballots for the previous owners of my house for over a decade. At least one of them is dead. I’ve tried to no avail to get the rolls updated. Not everyone has a moral compass like me.
9. In most other nations, in order to get a mail in ballot, you have to personally request it, and verify your identity. This is to prevent fraud.
Why don’t you want to prevent fraud? Al Gore lost his suits, but FL still improved its hanging chad issues for future elections.

There are major cases of voting fraud in Wisconsin and Fulton County, Georgia (56,000 illegal ballots). The illegal votes in Fulton County gave the state to Biden. I haven’t seen a tally of the illegal votes from the illegal vote-harvesting in Wisconsin.

Fox is being sued for billions of dollars by Smartmatic and Dominion election companies for defaming these companies by broadcasting intentionally or recklessly false statements. Upon being served papers, Fox banned those Trumpist lawyers who made the allegations against these 2 companies. They no longer appear on Fox. The lawsuits proceed, however.

You’ve been corrected many, many times about how and why someone is held without bail and not allowed contact with the general jail population, so I’m beginning to think you are either uneducable or intentionally deceitful. Here goes one more time: a JUDGE decides whether or not someone qualifies for bail, not the Democratic party, not any politician. There are various reasons someone may not qualify for bail, such as an outstanding arrest warrant or warrant for failing to appear in a pending case, or a probation or parole violation (which is the case with several members of the Trump Army), can’t afford the bail, they are a flight risk, having previously skipped out on bail, plus other reasons. The Constitution does not REQUIRE pretrial release on bail. The Constitution merely says that if someone is eligible for bail, the amount must be reasonable.
Whomever is responsible for the operation of a jail facility, be it the warden or a sheriff, is responsible for the safety and security of all of those incarcerated. The person running the jail decides whether a prisoner should be held away from the general population, based on the risk of the prisoner harming others or vice-versa. No Democrat, politician or even a law enforcement officer makes this decision. And it is not used for punitive purposes, either.
No Democrat ever told any protesters to burn down a building or engage in rioting. Trump told his army of supporters to storm the Capitol, after losing dozens of frivolous lawsuits, being unable to bully state election officials and after Pence refused to violate the law, all to keep him in office. Everyone who went past the police barricades outside the Capitol was in the wrong. Some of them helped batter police officers. Some urinated and defecated on walls and floors, defaced the John Lewis memorial, entered offices and stole papers and laptops. This is all the fault of Trump and his massive ego. Your comparison to BLM and Antifa is disingenuous.

I have acknowledged before that Turley is probably oblivious to all the commentary on his blog, yours and mine being no exception. Still he welcomes and encourages our contributions. His only stipulation is that we conduct ourselves civilly. And though he may not read our comments, some people do, and with any luck, someone may who can approach Turley and ask him about something said on this blog. And, Turley, you are wrong to claim that the voter protection act proposed by is somehow “dictating” how elections are run. Rather, the John Lewis Act would prevent mostly Republican states from intentionally erecting barriers to voting, especially for minorities. For example, in Georgia, Republicans eliminated all but one polling place for one county–choking the number down from polling places 7 to 1, thus guaranteeing long lines. Then, there’s the gerrymandering to dilute the effect of Democrats by lumping them all into a few districts. In several states, Republicans have harassed or simply kicked Democrats off of local election boards, to make it easier to cheat in the manner Trump demanded of Raffensberger–by “finding votes” that aren’t there. Without Democrats to stop them, that’s exactly what they would do. In fact, that’s what they already tried to do. Yesterday, it was revealed that election officials from 3 states sent fake vote certifications to the National Archives declaring that Trump won, when he had in fact, lost in those states. These records were turned over to the Jan. 6 Commission and may be referred for criminal prosecution for not only falsifying documents, but placing the state seal on forged documents. In Minnesota, Republicans also eliminated all but one ballot drop box in one of the largest cities. They also are busily working to eliminate voting on weekends and other times working people might find it convenient to vote–all to cheat their way into power by creating barriers to probable Democrat voters. Yes, federal protection is needed to stop these abuses. And if dumping the filibuster is the way to get this done, then it should be done. Protecting the right to vote is at least as important as “trade promotion authority”, executive branch and judicial nominees, and raising the debt ceiling.
Turley falsely accuses Biden of hypocrisy and “whatever it takes” politics. One of the most egregious parts of the restrictive new voting law passed in Georgia last year was a provision allowing the state Legislature to replace members of local elections boards the Lege considered to be “underperforming,” although what that means isn’t very well defined.
The Georgia Lege quickly got to business making such replacements in six counties, with the effect of removing Black Democrats and installing Republicans instead, to make the boards better. Now one of the boards that got reorganized, in Lincoln County, is planning to eliminate all seven polling places in the rural county and replace them with one big central voting location in the county seat, which is imaginatively named “Lincolnton.” That means some residents will have to walk or drive at least 15 miles to vote, and others even farther, the Atlanta Journal-Constitution reports.
Oh yes, there’s also no public transportation in Lincoln County, as well as no taxis or Uber or Lyft. Not even a place to rent a Lincoln; the major rental places are all in Augusta.
In the legislation reorganizing Lincoln County’s elections board, the county commission was given the power to choose the majority of elections board members. Surprise, surprise, over the summer, the GOP-majority commissioners replaced one Democrat, giving the elections board a Republican majority too.
But don’t you worry about how this will affect the ability of Lincoln County voters to get to the polls! The new, consolidated voting site will be much bigger and better, Lincoln County Elections Director Lilvender Bolton explained, and also much safer, you see:
“We really don’t have room in some of our facilities to do social distancing and to do the things that we need to do to keep my poll workers safe,” Bolton said. “We will be able to set up 30 or 40 voting machines, whatever we need.”
If a Georgia Republican worrying about “social distancing” and the safety of poll workers sounds a little weird to you, it might be because previous efforts to reduce the number of polling places were also pursued under a similar pretext. In 2018, the Republican-dominated elections board in Georgia’s Randolph County wanted to close three-quarters of the polling places in that mostly Black county prior to the general election. The board insisted the locations weren’t in compliance with the Americans with Disabilities Act, even though the locations had been used in the primary elections that year. After a national outcry, the Journal-Constitution notes, the county ended up only closing three polling places, in mostly white areas, even!
This year, in Lincoln County, Bolton claimed nobody would be inconvenienced at all, because a bit over half of county residents vote during early voting, although we’d point out to him that they did that in seven locations that may be a lot closer to them than the proposed consolidated site.
Now, there is a significant difference between Lincoln County and Randolph County as the AJC explains: Unlike Randolph, Lincoln County is already a Republican-majority place, where only 28 percent of voters are Black. Donald Trump got 68 percent of the vote in Lincoln County in 2020.
Still, even if the county’s population is mostly white and Republican, those who aren’t white and Republican have votes that matter in statewide elections too; Georgia may have noticed that recently. And who in that county is more likely to be run off from voting because they don’t have a car?
Anyone who wants to vote would have to drive or walk to a polling place, or return an absentee ballot. Turnout decreases when voters have to travel farther to cast a ballot, according to a statistical analysis by The Atlanta Journal-Constitution.
And of course the new Georgia voting law makes voting absentee more difficult than in 2020, by limiting the availability of ballot drop boxes, requiring new voter ID requirements, implementing shorter deadlines to request an absentee ballot, and sharply restricting the mass mailing of ballot request forms.
As you’d expect, voting rights people are plenty pissed about this, because why not just let people vote? Denise Freeman, a voting rights activist and former Lincoln County school board member, told the Augusta Chronicle,
Lincoln County is a very rural county. Some people live as far as 23 miles from the city of Lincolnton. […] This is not about convenience for the citizens. This is about control. This is about the good old boys wanting to do what they’ve always done, which is power and control.
Gosh, she sure sounds cynical about a really great idea to make voting more efficient for Republicans who can manage to travel much farther to the polls. Besides, doesn’t she care about the pandemic?
The Lincoln County elections board could vote as early as January 19 on the proposal.

As I understand it, the law in Georgia is clear that if the number of illegal votes exceeds the margin of victory, the election is invalid. Margot Cleveland has reported on sound evidence that the number of people who voted in one county even though they had moved permanently out of that county more than 30 days before election day almost certainly exceeded the margin. These votes were illegal. This was among the allegations made in the legal claim filed in Georgia but never heard. It was in reference to this that Trump said the illegal votes should be found. He was right.

There is plenty of indications of fraud in Georgia. For one, 37 counties could not produce the required chain of custody documents until months later (no doubt constructed after the fact). Second there is video of Fulton County Election officials telling the observers that vote counting was over because of a water main break (false on its face as it turns out). He then pulls out his phone and makes a call once the observers had left – who was he calling. The staff then continues for several hours counting votes. Contrary to federal law requiring all records be kept for 22 months, Fulton County cannot produce any ballot images for those who voted in person. Where did they go? Post election, the warehouse where the ballots were kept was broken into. Video surveillance of absentee drop off boxes has suddenly vanished – most conveniently of the most populous – and Democrat controlled – counties in Georgia. The local officials claim the State Board of Elections ordered them to do so. Being part of the election record, this also violates federal election law. Our SOS who a) should have been out and about visiting the most populous counties and ensuring their procedures were in accordance with state and federal laws and b) should be all over these improprieties and bringing charges has been conspicuously AWOL until his reelection chances became clearly dimming with the consequences of his inaction. At the very least blatant incompetence reigns at all levels of Georgia elections. And this is just Georgia. Voter fraud in the 2020 election? Nah there is no voter fraud! Conservatives can’t (yet) prove there was but you can’t prove there wasn’t either considering all the shenanigans that went on.

The Dems haven’t appeared to regret any of their foolishness over the past number of years – i don’t know why they’d start now. The entire party seems to have had a psychotic break from reality. Their fracturing can’t come soon enough, and it is plain to see to anyone that has paid attention, they have wrought this upon themselves. History will not look back kindly on them as they are currently constituted, it has been and is utter madness. If ‘moderate’ Dems would like Independents such as myself to ever vote for them or their policy again, they had better divorce themselves from this absolute toxicity.
I am pretty sure there are no moderate dems. Even those who may have more moderate values are seeing the writing on the wall for 2022…cram through some inane unconstitutional orders or bills right away or get thrashed in the next election. What they fail to realize is that they will get thrashed at some point anyway, and then their fake-as$ impeachment crap and lack of the filibuster will get turned upon them…I can’t wait. Meanwhile, I plan to vote only for those who promise to undo this crap going forward. This cannot be allowed to stand.

I think the Dems were so certain of a 2016 win, when Clinton lost, all their plans evaporated, they had some kind of break down. They seem to be trying by force of will to bend reality to their perception. It is not working, which is why they seem more and more disconnected with reality.
As an Independent, I am looking for some degree of sanity, finding it with Manchin, Sinema and some others questioning changing the filibuster. But that only seems to drive the other Dems more off the deep end.
Some people who have protested or made demands of Manchin or Sinema (e.g. disrupting a wedding) highlights the madness.

Moderate, or should I say “moderate” Democrats like Kelly, Shaheen and Testa want to skate under the umbrella of Manchin and Sinema but selfish pigs like Schumer are demanding they go on the record with a vote, a vote that Schumer knows will fail. Selfish pig Schumer is just doing this to establish his leftist credentials to protect him against AOC in a primary battle. Ask yourself what Mark Kelly thinks about Schumer.
PS. It is also disgusting that Kelly et al are not asked by our incurious media how they feel about the filibuster. If this were Republicans duking it out the media would be playing up “the party is in disarray” angle every night.
