Democracy, Autocracy . . . or Hypocrisy? Biden Calls for Changing the Filibuster Rule

According to the Associated Press, President Joe Biden today will support changing the filibuster rule for voting rights legislation — a move widely viewed as effectively killing the rule. The report says that Biden will portray the choice starkly as one between democracy and autocracy. The AP, however, does not reference the third option of hypocrisy by failing to note that Biden vehemently opposed such moves for decades. He previously denounced killing the rule as “disastrous” for our democracy but now will declare the rule itself to be an existential threat to democracy. It is the latest example of President Biden’s embrace of “whatever it takes politics.

Biden will use a speech at Atlanta’s Ebenezer Baptist Church to complete his abandonment of his long-held position. AP quotes his expected address to include the following statement:

“The next few days, when these bills come to a vote, will mark a turning point in this nation. Will we choose democracy over autocracy, light over shadow, justice over injustice? I know where I stand. I will not yield. I will not flinch. I will defend your right to vote and our democracy against all enemies foreign and domestic. And so the question is where will the institution of United States Senate stand?”

Biden showed equal passion as a senator to denounce those who would find excuses for abandoning the filibuster rule. He called such efforts “disastrous” and proclaimed: “God save us from that fate … [it] would change this fundamental understanding and unbroken practice of what the Senate is all about.”

After six months of uncomfortable silence as president, Biden later said that, as president, he continued to support the rule. Putting aside certain factual and historical errors, Biden declared that killing the rule would “throw the entire Congress into chaos and nothing will get done. Nothing at all will get done. There’s a lot at stake. The most important one is the right to vote, that’s the single most important one.”

It appears now that, even if “God [might still] save us from that fate,” the President will not.

His colleagues, including then-Sen. Barack Obama (D-Ill.) and now-Majority Leader Chuck Schumer (D-N.Y.), gave equally full-throated endorsements of the rule being denounced today as a thoroughly racist relic.  Schumer, who is now also pushing for the change, previously said to abandon the rule would be “doomsday for Democracy” and reduce the United States to a “banana Republic.”

While President Biden may have found his natural resting place in the conflict between politics and principle, the move against the filibuster rule will only aggravate our deep divisions.

The Democrats would force through a sweeping federalization of state election laws for the first time in our history. It would federally preempt the laws in dozens of states and declare that Congress, not state legislatures, will now dictate how people vote in states like Georgia. It is notable that Georgian politicians like Sen. Raphael Warnock will be standing next to Biden in Atlanta as the President calls for setting aside Georgia’s own laws. (Stacey Abrams who is running for governor will not attend the event). Previously, Biden was criticized for misrepresenting the provisions of the Georgia law.

What is most striking is the inherent conflict in this logic. President Biden is going to a state where representatives passed voting rules as part of their democratic process. He is effectively saying that they must protect democracy from itself and support Washington dictating the rules in Georgia.

While denouncing the “Big Lie” of those who questioned the last election, Democrats in the same breath are arguing that the next election might be illegitimate or might be stolen under current election laws. Democratic leaders have insisted that Trump began that Big Lie by seeding doubts months in advance of the 2020 election due to the laws in blue states. Now those leaders are seeding the same doubts about the laws in red states before the 2022 election. (Indeed, despite recent denials, some of these same leaders who denounced the Big Lie are the same people who previously called the Trump election “illegitimate” and some supported challenges to electoral votes in Congress).

It is also worth noting that federal laws already protect against rules that inhibit or curtail the votes of minority citizens. Other laws are subject to judicial review if they curtail the right to vote generally. Indeed, many of these laws are being challenged by Democrats in court. The federal legislation is needed because these laws have been upheld by the courts as constitutional and nondiscriminatory.

For some voters in these states, the federal takeover of their election laws is not likely to resonate as a victory of democracy. Election laws have largely been left to the states in our constitutional system. If those laws are constitutional, the view was that each state could follow its own approach to issues like voter identification rules. While Congress can condition the receipt of federal funds on improving election administration (and reinforce constitutional protections for minority voters through laws like the Voting Rights Act), this is an unprecedented federalization of election laws to dictate how elections are administered.

In abandoning his long-held position, President Biden is choosing divisive politics over principle. This will further deepen the anger and divisions in our country. It will fuel claims that these laws are somehow illegitimate or laying the foundation for autocracy.

I previously wrote why the filibuster rule was designed for times like this:

Pushing through such controversial measures with bare majorities and on straight party lines will only deepen the divisions and increase the rage in this country. So this is precisely a time when the filibuster can play a positive role, by forcing legislation to pass with a modest level of bipartisan support. It requires consensus and compromise at a time of growing, violent division.

The filibuster has gone through historic controversies through the centuries, from opposing Caesar to opposing civil rights. But as a consensus-forcing rule, its time may have arrived, to the chagrin of many.

This move may also be soon regretted.

It is not likely to succeed but would put virtually all of the Democratic senators on record for calling for the demise of the rule. With the possible GOP takeover of both houses, the Democrats are sawing at the branch upon which their future may rest.

It was the Democrats who unwisely created the exception to the filibuster for judicial candidates in 2010. The Republicans later used that change as an excuse for an exception for Supreme Court nominees. Nevertheless, the GOP senators refused the demands of President Trump to abandon the rule for legislative matters when they were in the majority. Now, the Democrats would create an exception that could easily result in the total abandonment of the rule.

Since they are unlikely to succeed, it would be better to reaffirm support for the filibuster rule as a protection against losing the Senate in 2022.  However, short-term political interests seem to be prevailing. Biden is becoming unpopular with the left and he is now abandoning his prior principled stand for political convenience. It is a Faustian bargain that I expect that the Democrats could soon regret.

  1. The Democratic narative might be more convincing to us all if they didn’t include the idea that people should be able to vote without an ID. They try to say it’s about the black vote but we all know that they’re looking for the vote of the illegal immigrant. https://www.npr.org/2021/12/15/1064385999/new-york-city-will-allow-legal-non-citizens-to-vote-in-local-elections. But what the hey, they can use it to keep the black vote and make it a two fer by getting the illegal immigrant vote all in one fell swoop. You gotta give em credit, they know a sucker when they see one. Maybe you are just the sucker they are looking for. Some on this Blog have been sucked on for so long by the Democrats that they don’t even know that they have been slowly disappearing.

    1. Thinkthrough, you link clearly says ‘local’ elections. So why should you care??

      1. Because it’s an illegal foot in our backdoor…

How politically literate and informed are people too stupid or lazy to locate a local DMV office and obtain a free or reduced cost ID? That’s your argument.

  2. Not right to change Senate filibuster rules. The earlier politicians created them for reason. The filibuster has been since 1806, that’s 225 years of precedent that has served the US. Other countries envy you. Our system here is broken, why would USA people want to break their system that has worked for centuries?

  3. So Biden changes his mind concerning the filibuster. Good old Joe would throw his own mother off the train if he thought it was good for the party. Party before country. So whats new. The said thing is that you knew who he is when you filled in the little circle on the ballot. He’s got a lot of nerve to say he is our friend. He just wants to be on the side thats winning.

  4. All of that is fine except you are a liar. We know you don’t care about your comments being deleted, but others care about their comments being deleted. However for a person who doesn’t care you have complained a lot about being deleted. Even on that score you lie.

  5. Karen S: Thank you for responding to a commenter with substantive information. If the facts upon which you rely are true, the effect is to make persons question other information, which is the real value of this blog.

    1. Lin,

      I agree.

  6. Republicans Know ‘Freedom To Vote’ Means Sharing The Vote With Non-Republicans

With a showdown on the Freedom to Vote Act and John R. Lewis Voting Rights Advancement Act coming this month, it has never been more urgent that Congress act. Just ask voters in North Carolina and Texas. Under the congressional map passed by North Carolina’s Republican-controlled legislature, Republicans could win 71 percent of the state’s congressional seats with only 48 percent of the statewide vote. Republicans in Texas have engineered similar advantages. Texas Democrats would have to win 58 percent of the vote to be favored to carry more than 37 percent of the state’s congressional seats. In other words, Texas could turn a dark shade of blue and Republicans would still have a two-to-one seat advantage. That hardly looks “not so bad” for Democrats.

    Edited from:
    https://www.washingtonpost.com/opinions/2022/01/10/no-republicans-arent-hammering-democrats-redistricting-theyre-doing-something-worse/
    ………………………………………………………

Gerrymandering is not limited to only Republican-controlled states. New York and Illinois are gerrymandered to favor Democrats. But nowhere is gerrymandering fair or desirable. Yet Republicans view gerrymandering as a survival mechanism. They know how easily Texas and North Carolina could be lost if congressional districts were drawn by non-partisan commissions.

    1. I live in North Carolina…and for a Democrat to accuse a Republican of Gerrymandering is just so much bovine fecal matter…..remember the Democrats ruled the State at the State Government level for just over a full Century.

These days….no matter who drew up the District Maps the Democrats have sued in Court and filed every challenge they can conjure up…..to include getting miffed over a District Map they themselves had drawn up.

Read up on the history of Gerrymandering in North Carolina if you want a good laugh.

What I propose is creating a State Electoral College for North Carolina and see the handful of high population Democrat strong holds lose their hold on State Elections.

Wake, Mecklenburg, Guilford, Forsyth, Orange,Durham and Buncombe Counties are all densely populated Counties and are all dark blue….well except maybe Buncombe and Orange…..which are only Blue.

    2. Idiot. Those examples are meaningless without the relevant information for the other 48 states.

    3. Idiot. Dems could carry more than 37 percent of the Congressional seats with less than 1% of the total state-wide votes.

  7. Voting Restrictions Necessary Because Blacks Won’t Vote Republican

All through Trump’s presidency we kept hearing this ridiculous narrative that Blacks were ‘trapped on the Democratic Plantation’. The idea seemed to be that Black Americans are too simple-minded to know that Democrats are only using them.

Another ridiculous narrative was the so-called ‘Walk-Away Movement’. In the 2018 midterm elections, Blacks were expected to ‘walk away’ from the Democrats in significantly big numbers. Candice Owens was employed to emphasize this message. But no Blacks walked away, of course. They somehow couldn’t discern all the ‘good’ Trump was doing for them.

So after Blacks helped to give Joseph Biden a winning lead of 7 million Popular Votes, Republicans were forced to get tough with Blacks by doubling down on voting restrictions. Republicans didn’t want to take these measures, of course. But Blacks were too simple minded to grasp the Democratic Plantation concept.

So now President Biden wants a federal law to nullify voting restrictions. How insulting to Blacks! They were perfectly free to vote Republican but they botched the opportunity.

    1. Anonymous:

Blacks support voter ID, as does 80% of the entire American population.

Voter ID laws are associated with an increase in turnout, not a decrease. Therefore, it is untruthful to call it suppression.

Joe Biden materially misrepresented the GA voter laws in order to generate a fake controversy.

It is racist to claim that out of all races and ethnicities, blacks are the only race too incompetent to get ID. Blacks have ID, and many who are interviewed find it insulting when Democrats claim they can’t manage. You need an ID to be a fully functioning citizen in the US. You need ID to open a bank account, cash a check, receive Welfare or Social Security checks, buy cough syrup, buy beer or cigarettes, get a document notarized, attend a Democrat convention or primary, go to Disneyland, or become a new patient at a doctor’s office. I was asked for my ID when I received my Covid vaccine.

States provide photo ID free to those who need it.

Democrats feel entitled to the black vote, and punish those who refuse to vote for them. Haven’t you noticed that racist slurs are normalized against black conservatives? “If you don’t vote for me, you ain’t black.” Remember when white Democrats attacked Candace Owens with Kirk at the restaurant? They threw water in her face, blew whistles, and men screamed in her face as loudly as they could. They were trying to frighten a black woman who dared to vote Republican.

Republicans do not assault black people in public for voting Democrat. Racist slurs against black Democrats is not normalized. They do not try to frighten blacks who vote Democrat to try to force them to vote Republican.

Democrats still have low expectations of blacks and try to coerce their voting. In some ways, the only thing that’s changed in Democrat behavior towards blacks is they don’t wear white hoods anymore. They may not burn crosses anymore, but they go after black conservatives something fierce. I don’t know why anyone would support such blatant racism.

      Your argument is spurious.

      1. Karen,

Trump’s election claims lost in every court. So why did Republican-led states pass a legislative wave of voting restrictions ‘after’ Trump’s defeat?? Whose vote are Republicans trying to restrict??

        1. Are you the ignorant racist that recently posted that blacks weren’t smart enough to get valid ID’s?

        2. Anonymous:

It’s not voting restrictions. The only people restricted from voting are those not legally allowed to vote. No legal voters are restricted from voting. Verifying who you are is not a restriction or voter suppression.

          Why are there voting reforms?

          1. Democrats are trying to send mail in ballots to 100% of people on the voter rolls, nationwide, even though many of those are duplicates, deceased, have dementia, moved, or otherwise unavailable. Mail in voting is globally considered at high risk of fraud.
          2. In PA, the case revolved around applying a different legal standard for ballots in each district. This was in violation of the equal protections clause in the 14th Amendment. This affected every single one of the millions of ballots in PA, and it was the same premise that won in Bush v Gore. Many of the initial attorneys had to withdraw due to death threats from Democrats. The attorney who remained withdrew when Rudy Giuliani strong armed his way onto the case. Giuliani proceeded to then drive the case off the rails, ignored the foundational case with the unequal legal standards, and instead focused on issues that only affected a small percentage of votes, such as deceased votes, or unsubstantiated claims, rather than the easily provable crux of the case. The merits of the original case in PA was never decided, therefore, the claims were never disproven. In fact, they could not be disproven because districts DID impose different legal standards.
          3. 80% of Americans support voter ID. Hence why there are more voter ID laws.
          4. Democrats in far Left cities such as NY are moving to allow illegal aliens and legal residents to vote in local elections. This means that non citizens voting in national elections is on the horizon. This is another motivation to verify voter eligibility.
          5. The Left fights tooth and nail against auditing voter rolls, which means they are currently inaccurate.
          6. Vote harvesting is blatantly ripe for fraud. There is nothing keeping activists from throwing out or filling out ballots in opposing districts but their own conscience, which is rare in politics.
          7. Voter fraud against elders is well documented. Caregivers or vote harvesters fill out ballots against the wishes of the elderly residents. There have been many cases where old folks tell their children they wanted to vote Republican, but the nurse said they had to vote Democrat, as well as ballots filled out for people with dementia.
          8. I have received ballots for the previous owners of my house for over a decade. At least one of them is dead. I’ve tried to no avail to get the rolls updated. Not everyone has a moral compass like me.
          9. In most other nations, in order to get a mail in ballot, you have to personally request it, and verify your identity. This is to prevent fraud.

Why don’t you want to prevent fraud? Al Gore lost his suits, but FL still improved its hanging chad issues for future elections.

        3. His claims didn’t lose in ANY court. What is wrong with you? We are not nearly as stupid as you are.

          1. Anonymous the Stupid deceives and lies. If a person committed homicide and admitted to it, but there was a Miranda violation Anonymous the Stupid would say he wasn’t guilty of murder.

Then he would say, show me the evidence. He would claim that the admission of guilt didn’t count because it didn’t meet judicial rules like the election cases brought to court. Then he would say the evidence didn’t exist because it was tampered with or removed from lock-up. Then he would say your sources are no good, and the murder wasn’t published in the Washington Post. This liar will continue to lie until suddenly, a year or two later, more facts arise and the man is put in jail for murder.

By then, everyone forgot about the homicide, and Anonymous the Stupid pretends it never happened and he was never wrong.

The problem is that Anonymous the Stupid has been wrong on almost every major question brought to this blog. When shown his own words, he claims another anonymous poster wrote that.

He is almost always that other anonymous poster, whether green anonymous gray anonymous, whether yellow anonymous that has gone under Sammy, Molly G. and Edison. HE is or has been other anonymous fixtures as well. Most exist only for a short time, and then instead of admitting he is wrong, he dumps the name and moves on.

            He is a liar.

          2. William: why don’t you look up and read the disciplinary complaint against Giuliani. It details all of the lies and baseless claims that he made in various forums, and that’s the reason his law license was summarily suspended. He had no facts whatsoever to back up the lies about Trump’s “stolen victory”.

        4. We should take the vote away from anyone who would use the vote to do something morally or legally wrong. When people vote to confiscate the wealth of others for themselves, voting isn’t a right.

          It’s a wrong.

    2. The anonymous person above is accusing blacks of being too ignorant to get a valid ID. We all know that isn’t true except for him and a few morons on this blog. Blacks disagree with this type of racism and laugh at the foolishness provided by the above person. He should be known as the Ignorant Racist.

      1. Anonymous, name ‘1’ prosecutor in the U.S. who has uncovered a major case of voting fraud.

          1. KAREN:

Who do you think you’re fooling with those ultra obscure links??

Not only are those NOT major fraud cases, but those sources are pathetic! If that’s all you can come up with, as a rebuttal, then my point is proven.

Surely if there were major cases of voting fraud you wouldn’t be scraping the bottom of the barrel like this.

              1. The above icon sounds like the ignorant racist. He thinks black people are incapable of getting ID. He is the one that is incapable.

        1. Prosecutors? What in the world?

There are major cases of voting fraud in Wisconsin and Fulton County, Georgia (56,000 illegal ballots). The illegal votes in Fulton County gave the state to Biden. I haven’t seen a tally of the illegal votes from the illegal vote-harvesting in Wisconsin.

  8. (I smile every time I read certain commenters engaging in [pseudo]-condescension of other commenters-and pretensions of intellectual superiority…) The good professor created this blog for us to engage each other indebate and discussion, not silly name-calling and dismissal of opposing views.

    1. You talking to me? If so, say it.

I am not calling Turley a name. I am criticizing his statements and condemning his silence about certain matters. Doesn’t Turley do the same- pointing out MSM silence on newsworthy matters and criticizing the hypocrisy of Democrats as well as Republicans?

I absolutely have no doubt that Turley would be the first to deny that he is above the same criticism he levels at others. The problem is that he won’t defend himself or his employer Fox News from such accusations because he knows all too well that it would be preposterous to deny that Fox does not engage in the same *advocacy journalism” which he rightly denounces at CNN and MSNBC.

      1. Jeff:

Don’t tempt me to link to all your comments calling Turley names and bashing his character. Your trolling against our host has been unrelenting and egregious. It is a testament to his commitment to the First Amendment that you can come here and trash him all day every day.

        1. Apparently you did not see my response to your accusing me of calling Turley names. So I am reposting it here so that you can respond to it. If you don’t answer my question at the end of this post, I will assume that you not deny that Turley is guilty of that which you accuse me.

          —————

          Karen,

I appreciate your reading my comments as I do yours. And I thank you for taking the time in replying to me. I have acknowledged before that Turley is probably oblivious to all the commentary on his blog, yours and mine being no exception. Still he welcomes and encourages our contributions. His only stipulation is that we conduct ourselves civilly. And though he may not read our comments, some people do, and with any luck, someone may who can approach Turley and ask him about something said on this blog. So, I cannot be certain my efforts are in vain; neither can you.

However, Turley is not above criticizing a person’s character. Let me give you an example of Turley assassinating Trump’s:

“NewsMax CEO Christopher Ruddy’s cynical and sensational selection of Donald Trump to moderate the next presidential debate has backfired. Ruddy united conservative and liberal commentators and candidates in denouncing him and NewsMax for the obscene idea — with Ron Paul and Jon Hunstman leading the way in immediately refusing to participate in such a circus. Perry, and Romney were the next (rather belatedly) to refuse to participate. Bachmann has now also declined to participate on a program with look of The Apprentice and the dignity of the Jersey Wives. That leaves Santorum and Gingrich who have confirmed that they will appear with a carnival snake charmer to get on TV.”

          https://jonathanturley.org/2011/12/09/newsmax-flames-out-trump-debate-down-to-gingrich-and-santorum/

I have never called Turley a “carnival snake charmer.” Turley was not finished debasing Trump:

“Perry yesterday respectfully declined the invitation due to other campaign commitments. It was less than honest as the basis for the rejection and certainly less redeeming than the condemnations of Paul and Huntsman for Ruddy’s effort to degrade American politics even more with the use of such an absurd reality television star.”

Turley was outspoken about his contempt for Trump. Do you think he was rude?

      2. No one has ever come up with an example of Fox lying the way NBC does routinely. Fox quite simply is much more scrupulous than all the left-wing outlets.

        1. William_JD,

I could not disagree more. You and I are implacably at odds on this point. Fox is being sued for billions of dollars by Smartmatic and Dominion election companies for defaming these companies by broadcasting intentionally or recklessly false statements. Upon being served papers, Fox banned those Trumpist lawyers who made the allegations against these 2 companies. They no longer appear on Fox. The lawsuits proceed, however.

You will be forgiven for being ignorant of these lawsuits because Turley has mentioned them but once and the subject is scrupulously avoided on Fox.

          1. The keywords are ‘being sued,’ not lost the case. Jeff is unable to provide a suit Fox lost and why. But we saw the Washington Post get sued, and they lost. Same for the NYTimes that lost. They still have a Pulitzer they refuse to give up that was a total fabrication created by Stalin. That Pulitzer goes along with its leftism and Jeff, who lacks knowledge regarding today and yesterday.

Take note, Jeff’s dialogue is 80% Trump lied, but he can’t produce the lie, Turley is a hypocrite because Jeff, the attorney, doesn’t understand legal analysis, Fox News is bad because it is being sued, not that it lost the case.

Everything else is that he is not well informed enough to make a decision. The guy is an insufferable as$.

  9. Karen whitewashes 1/6:

“But when one group of Trump supporters barged into the Capitol building, took selfies, broke some windows, illegally paraded, and interrupted the proceeding, that was sedition, a Constitutional Crisis, an insurrection. Republicans rightly condemned the trespassers, but most did not inflate their crimes.”

Turley does not characterize the vandalizing of our Capitol as an “insurrection;” instead, he calls it a “desecration.” Indeed, I would respect an insurrection *if* I believed that an election had been stolen (which Turley has NEVER contended). On the other hand, a desecration, that is, to treat something that is sacred with disrespect, is utterly disgraceful as well as inexcusable.

I agree with Turley that the Trumpists did not commit an act of insurrection against our Capitol but, rather, a desecration which is worse.

    1. Professor Turley was outraged that the Jan 6 participants barged into the Capital, trespassed, and interrupted the proceeding. The Capitol building is symbolic of the entire country.

That said, he has expressly stated that Jan 6 was NOT an insurrection or sedition.

Similarly, tearing down statues because someone despises the subject is a desecration of public property.

Burning down a police precinct was a desecration of public property that should have been treated with respect.

Seizing entire city blocks as an autonomous zone was a desecration of our country.

I agree with Professor Turley that the behavior of those who trespassed on Jan 6 was outrageous. They did not kill anyone, not like BLM protestors did. They did not burn down any building or cause millions of dollars of property damage. Democrats did that.

Getting thrown into solitary for 9 months while awaiting trial for trespassing, illegally parading, and interrupting an official proceeding is outrageous. Meanwhile, the BLM rioters who terrorized the country for a year were not even charged, for the most part. Of those who were charged, many were diverted to counseling.

That’s not whitewashing. That’s an accurate description of most of the charges, their time in solitary, and that it was not an insurrection.

Yet which group of people are Democrats in Congress investigating? The ones who trespassed and illegally paraded on one afternoon, or the many thousands who looted, committed arson, assaults, murder, and destruction of property across America for a year?

Stop lying about January 6 while ignoring the Leftist terror and destruction that burned the country for a year.

      1. Karen,

I agree with you that the Antifa thugs and BLM protesters who vandalized businesses and government buildings over the summer were just as malevolent as the Trumpists who desecrated our sacred Capitol.

        1. Jeffy ///Really ?. Those antifa and BLM upstanding citizens burned , looted and destroyed millions of dollars of goods , businesses and all but destroyed the local economies they has so much of the dear old fun in and with. Not to mention the many people slain and maimed in their mandatory radical fun time(s) . Yet only one person died in DC on 6 jan. It was a woman , a veteran…shot dead by a coward officer with a history of bad judgement while being a capitol officer. No capitol officer died directly or of injuries on that day 6 jan. But your heros and liars would demand you believe their alternate facts which are by any definition lies. And yet here you and your ilk are.

          1. Phergus,

Thanks for telling me what I already know. I don’t whitewash nor excuse the violence over the summer. All I said was the Trumpists who desecrated our Capitol were as malevolent as BLM thugs and Antifa. They might have killed some Congressmen but for the intervention of the Capitol police. Who knows.

            1. Trespassing and illegally parading are not, actually, equivalent to murder, arson, looting, destroying businesses, seizing city blocks for an autonomous zone that denies entry to police and EMT, burning an apartment building, burning a police precinct, flipping police cars, hurling firebombs at federal buildings, and driving jobs out of minority neighborhoods during a pandemic. I’m not guessing what BLM and Antifa wanted to do; I’m judging them by what they did do.

If you can’t admit that, then you are not being honest.

              1. Karen,

I DON’T deny a single accusation you make against SOME crazed Antifa and BLM protestors. Had some of the crazed Trumpists gotten their hands on Progressives and especially the so-called “Squad,” they would have been no less bloodthirsty than their Antifa and BLM counterparts.

One thing is for certain, Pence was a dead man…..

        2. Someone who busted up a window or two, trespassed, and interrupted an official proceeding would be nearly equivalent to the Jan 6 protestors. I would say that it was especially rude since the Capitol is symbolic of our entire country.

However, torching a business or apartment building, with people inside, is not “just as malevolent” as the Jan 6 protestors. In fact, most of them were not malevolent at all.

Most Americans polled view Jan 6 as a protest that just went too far.

BLM and Antifa rioters who destroyed businesses, police precinct, police vehicles, burned apartment buildings with people inside, assaulted people, caused millions in property damages, destroyed minority owned businesses, drove jobs out of minority neighborhoods for generations, destroyed badly needed jobs and sources for critical goods like groceries during a pandemic, and contributed to the defund the police movement which caused an enormous increase in murder, rape, theft, and other crimes, are orders of magnitude worse than simple trespass and illegally parading.

You are to recall how many times Democrats impeded Congress with their sit ins, or interrupted or trespassed in handmaid cloaks, genitalia hats, or other hallmarks of SJW.

I try to be careful to be fair to the Jan 6 protestors. What they did was wrong. The law should apply to them, but it should be fair. Solitary confinement for 9 months for trespassing is not just, especially since the Democrat protestors that terrorized the nation for a year for the most part weren’t even charged.

          1. Karen continues to gaslight:

“Someone who busted up a window or two, trespassed, and interrupted an official proceeding would be nearly equivalent to the Jan 6 protestors.”

140 officers were injured on 1/6. That you deliberately ignore that fact demonstrates that you are a damnable liar.

By the grace of God (some would say), the Trumpists did not get their hands on Pence. Had they, they would have made a spectacle of hanging him by the neck until he was dead.

I have conceded time and again that the Trumpists were not engaged in an insurrection. They were a lynching party.

            1. The gaslighting is by Jeff who has enough gas to power a city.

”Thousands of cops were injured, over $2 billion in damage during Floyd riots. Where are the “congressional hearings”?

              1. Have these hearings when the Republicans take over Congress. I don’t give a damn as long as the Republican majority does not quash the 1/6 committee investigation.

                1. I think most conservatives would want the Jan 6 investigation to continue and be expanded so that all of Jan 6 can be investigated starting at the top with Nancy Pelosi. I think most would agree that all the data should be made public. Maybe we will find out more about how Pelosi orchestrated Jan 6 starting at the very beginning along with all those people like Epps that are known to be involved but never arrested.

                  1. And perhaps we will find out whether Trump was derelict in his duty to protect the Capitol. Can’t wait to see where the chips will fall!

          2. You’ve been corrected many, many times about how and why someone is held without bail and not allowed contact with the general jail population, so I’m beginning to think you are either uneducable or intentionally deceitful. Here goes one more time: a JUDGE decides whether or not someone qualifies for bail, not the Democratic party, not any politician. There are various reasons someone may not qualify for bail, such as an outstanding arrest warrant or warrant for failing to appear in a pending case, or a probation or parole violation (which is the case with several members of the Trump Army), can’t afford the bail, they are a flight risk, having previously skipped out on bail, plus other reasons. The Constitution does not REQUIRE pretrial release on bail. The Constitution merely says that if someone is eligible for bail, the amount must be reasonable.

Whomever is responsible for the operation of a jail facility, be it the warden or a sheriff, is responsible for the safety and security of all of those incarcerated. The person running the jail decides whether a prisoner should be held away from the general population, based on the risk of the prisoner harming others or vice-versa. No Democrat, politician or even a law enforcement officer makes this decision. And it is not used for punitive purposes, either.

No Democrat ever told any protesters to burn down a building or engage in rioting. Trump told his army of supporters to storm the Capitol, after losing dozens of frivolous lawsuits, being unable to bully state election officials and after Pence refused to violate the law, all to keep him in office. Everyone who went past the police barricades outside the Capitol was in the wrong. Some of them helped batter police officers. Some urinated and defecated on walls and floors, defaced the John Lewis memorial, entered offices and stole papers and laptops. This is all the fault of Trump and his massive ego. Your comparison to BLM and Antifa is disingenuous.

  10. “While denouncing the “Big Lie” of those who questioned the last election, Democrats in the same breath are arguing that the next election might be illegitimate or might be stolen under current election laws.”

The Big Lie is a genuine lie. Democrats suggesting that the next election might be illegiimate is not a lie. It is possible, It can become a lie if after the next election it is clear that the election is not illegitimate but Democrats begin claiming it is. Until then suggesting this possibility is not a lie. Turley mentioning the two in the same sentence in the way he has here reveals intellectual dishonesty.

    1. Randy,

While Turley has never contended, unlike lying Trumpists, that the election was stolen, he has NEVER condemned the Big Lie to his great shame. In fact, this is the first time that Turley has even mentioned the Big Lie!

      Turley went on to say:

“Democratic leaders have insisted that Trump began that Big Lie by seeding doubts months in advance of the 2020 election due to the laws in blue states. Now those leaders are seeding the same doubts about the laws in red states before the 2022 election. (Indeed, despite recent denials, some of these same leaders who denounced the Big Lie are the same people who previously called the Trump election “illegitimate” and some supported challenges to electoral votes in Congress).”

Stating that Democratic leaders “insisted that Trump began the Big Lie” is to suggest that the Big Lie may not be a fact but, rather, some sort of Democratic conspiracy theory. Trump did, IN FACT, seed doubts about the legitimacy of the 2020 election despite Turley’s insinuation otherwise. Adding to Turley’s intellectual dishonesty, he makes a moral equivalence between Democrats raising legitimate objections to Red State legislators attempting to pass voter laws which may intentionally or unintentionally disenfranchise Democratic voters with Trump’s bald-faced lie that he could only lose the 2020 election if it was rigged.

Turley is slowly becoming a partisan hack before our very eyes. Still I am not accusing him of being a Trumpist though he is doing his utmost to pander to them not unlike his Fox colleagues with whom he has become a collaborator in their efforts to discredit their media rivals.

      1. Jeff: Your smug arse opinion is only one that matters, Right? “Turley is slowly becoming a partisan hack before our very eyes. Still I am not accusing him of being a Trumpist though he is doing his utmost to pander to them not unlike his Fox colleagues with whom he has become a collaborator in their efforts to discredit their media rivals.” Let this chap your arse. I voted for DT, and will do so in 2024 barring any health issue of his, denying that. I watch Fox but not obsessed with it. The country was a hell of a lot better off with DT in. If you believe Joe Biden is up right, (not corrupt) and copmpetent, then you are delusional. Your DT hating channel locked tunnel visioned mind and opinions will soon encounter some disclosures. A big wind of disclosures will soon come that will shake and rattel the hades out of you Dems including Joe Biden and Kam Harris this year. Meanwhile, you retain your elitest smugness attitude and prepare for a Big Crow eating Buffett coming soon.

        1. Bring it, Baby! It suits me just fine to lock up Biden next to the jail cell in which they throw Trump. If Biden is a crook, so be it.

Trump is a pathological liar, but it does remain to be seen whether he has broken any criminal laws. I DO know 2 things though:

          1. Trump will call his prosecutions “witch-hunts.”
          2. Trumpists will echo Trump’s calls.
          3. Turley most definitely will NOT.

          Check that- 3 things!

      2. Jeff:

If I cut and pasted every comment you made trolling Turley on his own blog, assassinating his character, it should shame you. The sheer quantity of time you devote to your hatred of Turley and Trump is staggering.

You are incredibly rude to our host. It’s crass. He doesn’t read the comments section, so not only are you trolling him, but you’re wasting your time. He has no idea what you write or think.

    2. The thing about the next election being illegitimate isn’t a lie.

      It’s a promise.

The whole point of HR 1 is to make the next election as illegitimate as possible.

  11. The Congress is not supposed to be a slippery slope, a place where any legislative idea is just forced through “just because it looks good”. And it is not a place where rules should be changed for the benefit of expediency of the majority.

I will be satisfied to see a two-year period pass where Congress doesn’t pass any legislation other than the budget.

    1. Yup. Would be great, but think of all the lobbyists who would go hungry. Oh wait, the regulatory trough is still where the pigs can be fed.

  12. More red meat for the disciples who don’t know any better, plus Turley gets in some digs at Democrats, which is part of the agenda he is paid to promote. The filibuster is not sacrosanct, as Turley would imply. Here are the facts (from MSNBC): “There’s no shortage of members, including a handful of Democrats, who routinely argue that in the interest of protecting democracy, bipartisan comity, and the integrity of Senate as an institution, the filibuster must remain intact. To abandon the 60-vote threshold, they claim, is to invite political ruin.

What this argument tends to overlook is the fact that the Senate already makes all kinds of exceptions to the filibuster rule. The 60-vote threshold doesn’t apply, for example, to budget bills. Or judicial nominees. Or executive branch nominees. Or the War Powers Resolution. Or the Congressional Review Act. Or trade promotion authority. Or the latest bipartisan debt-ceiling fix. Or last week’s continuing resolution amendment that GOP senators liked. (which was to roll back funding for vaccine mandates)”

And, Turley, you are wrong to claim that the voter protection act proposed by is somehow “dictating” how elections are run. Rather, the John Lewis Act would prevent mostly Republican states from intentionally erecting barriers to voting, especially for minorities. For example, in Georgia, Republicans eliminated all but one polling place for one county–choking the number down from polling places 7 to 1, thus guaranteeing long lines. Then, there’s the gerrymandering to dilute the effect of Democrats by lumping them all into a few districts. In several states, Republicans have harassed or simply kicked Democrats off of local election boards, to make it easier to cheat in the manner Trump demanded of Raffensberger–by “finding votes” that aren’t there. Without Democrats to stop them, that’s exactly what they would do. In fact, that’s what they already tried to do. Yesterday, it was revealed that election officials from 3 states sent fake vote certifications to the National Archives declaring that Trump won, when he had in fact, lost in those states. These records were turned over to the Jan. 6 Commission and may be referred for criminal prosecution for not only falsifying documents, but placing the state seal on forged documents. In Minnesota, Republicans also eliminated all but one ballot drop box in one of the largest cities. They also are busily working to eliminate voting on weekends and other times working people might find it convenient to vote–all to cheat their way into power by creating barriers to probable Democrat voters. Yes, federal protection is needed to stop these abuses. And if dumping the filibuster is the way to get this done, then it should be done. Protecting the right to vote is at least as important as “trade promotion authority”, executive branch and judicial nominees, and raising the debt ceiling.

Turley falsely accuses Biden of hypocrisy and “whatever it takes” politics. That is EXACTLY what Republicans are doing, beginning with refusing to speak against the Big Lie, and including flatly opposing almost everything Democrats propose, while Trump cheers them on instead of shutting up and going away in view of the fact that he was voted out of office. Republicans are setting the stage to try to cheat to get power in the midterms, because that’s they only way they can “win”.

    1. “More red meat for the disciples who don’t know any better ….”
      **********************************
Well, then thankfully we have you to educate we poor ignorant savages so embedded in our cargo cult. Oh, and double thanks for putting this line early in the screed so I don’t have to wade through the “Trash Turley” sewer you typically create in your comments.

      1. Just for the record, I do harshly criticize Turley for selling out to Fox News, but then again, I am alone in praising him for not stooping to the level of jumping on the Trumpist bandwagon. In fact, I have long predicted that Trumpists here will soon discover how wrong they have been thinking that Turley is allied with them. They will realize that when the long arm of the law finally catches up to Trump and his Organization and family. We know that the Trumpists will stand by Trump regardless of the prosecutions and jury verdicts. Turley will stand on the law.

        That will tear it.

    2. NATACHA Name that county in Ga., that eliminated the voting pricincts. All This BS about systemic racisim in USA, is absurd. You had a 1/2 black muslim communist Saul Alinsky myrmiadon POTUS for 8 years. You had black DOJ AGs for 8 years, most evry large city in America has a black Dem mayor mostly female black mays, black, chief of police, black DA, black County Chairman and black commissioners, and the litnany could cointinue. So why haven’t those blacks purged the system?

EVERY county that touches Atlanta Fulton County Georgia.and Fulton County, Ga., has a black mayor, black Chairman, and black County commissioners, black Chief of police, and are the largest populations county wise in Ga. In other words they are run by blacks. Fulton, Clayton, Cobb, Dekalb, Gwinnett, Douglas. Those voting precincts are run, and managed by blacks. DT is correct. Joe Biden is a huge demented, noncoginative, old hypocrite fossil. He will not be in office on 121-31-2022 Voting laws were arbitrarily ignored. abated, and abused in the 2020 election in those counties. You believe the fat lady hs sang on the 2020 election, but that will yet be proven to be erroneous. Selah

      1. From “The Wonkette”:

One of the most egregious parts of the restrictive new voting law passed in Georgia last year was a provision allowing the state Legislature to replace members of local elections boards the Lege considered to be “underperforming,” although what that means isn’t very well defined.

The Georgia Lege quickly got to business making such replacements in six counties, with the effect of removing Black Democrats and installing Republicans instead, to make the boards better. Now one of the boards that got reorganized, in Lincoln County, is planning to eliminate all seven polling places in the rural county and replace them with one big central voting location in the county seat, which is imaginatively named “Lincolnton.” That means some residents will have to walk or drive at least 15 miles to vote, and others even farther, the Atlanta Journal-Constitution reports.

Oh yes, there’s also no public transportation in Lincoln County, as well as no taxis or Uber or Lyft. Not even a place to rent a Lincoln; the major rental places are all in Augusta.

In the legislation reorganizing Lincoln County’s elections board, the county commission was given the power to choose the majority of elections board members. Surprise, surprise, over the summer, the GOP-majority commissioners replaced one Democrat, giving the elections board a Republican majority too.

But don’t you worry about how this will affect the ability of Lincoln County voters to get to the polls! The new, consolidated voting site will be much bigger and better, Lincoln County Elections Director Lilvender Bolton explained, and also much safer, you see:

“We really don’t have room in some of our facilities to do social distancing and to do the things that we need to do to keep my poll workers safe,” Bolton said. “We will be able to set up 30 or 40 voting machines, whatever we need.”
If a Georgia Republican worrying about “social distancing” and the safety of poll workers sounds a little weird to you, it might be because previous efforts to reduce the number of polling places were also pursued under a similar pretext. In 2018, the Republican-dominated elections board in Georgia’s Randolph County wanted to close three-quarters of the polling places in that mostly Black county prior to the general election. The board insisted the locations weren’t in compliance with the Americans with Disabilities Act, even though the locations had been used in the primary elections that year. After a national outcry, the Journal-Constitution notes, the county ended up only closing three polling places, in mostly white areas, even!

This year, in Lincoln County, Bolton claimed nobody would be inconvenienced at all, because a bit over half of county residents vote during early voting, although we’d point out to him that they did that in seven locations that may be a lot closer to them than the proposed consolidated site.

Now, there is a significant difference between Lincoln County and Randolph County as the AJC explains: Unlike Randolph, Lincoln County is already a Republican-majority place, where only 28 percent of voters are Black. Donald Trump got 68 percent of the vote in Lincoln County in 2020.

Still, even if the county’s population is mostly white and Republican, those who aren’t white and Republican have votes that matter in statewide elections too; Georgia may have noticed that recently. And who in that county is more likely to be run off from voting because they don’t have a car?

Anyone who wants to vote would have to drive or walk to a polling place, or return an absentee ballot. Turnout decreases when voters have to travel farther to cast a ballot, according to a statistical analysis by The Atlanta Journal-Constitution.
And of course the new Georgia voting law makes voting absentee more difficult than in 2020, by limiting the availability of ballot drop boxes, requiring new voter ID requirements, implementing shorter deadlines to request an absentee ballot, and sharply restricting the mass mailing of ballot request forms.

As you’d expect, voting rights people are plenty pissed about this, because why not just let people vote? Denise Freeman, a voting rights activist and former Lincoln County school board member, told the Augusta Chronicle,

Lincoln County is a very rural county. Some people live as far as 23 miles from the city of Lincolnton. […] This is not about convenience for the citizens. This is about control. This is about the good old boys wanting to do what they’ve always done, which is power and control.
Gosh, she sure sounds cynical about a really great idea to make voting more efficient for Republicans who can manage to travel much farther to the polls. Besides, doesn’t she care about the pandemic?

The Lincoln County elections board could vote as early as January 19 on the proposal.

        1. Oh, and one other thing, Lighteredknot, don’t you know that it is blasphemous to use “Selah” from Psalms in conjunction with your false accusations and lies?

  13. OT

“MSNBC host: Stacey Abrams ‘obviously’ doesn’t want to appear with unpopular Biden in Georgia”

‘Politicians don’t show up with presidents when their approval ratings may be in the 30s in the state where they want to be elected governor,’ Joe Scarborough said.

MSNBC’s Joe Scarborough said Stacey Abrams is skipping President Biden’s voting rights speech in Georgia on Tuesday because the gubernatorial candidate doesn’t want to be seen with the unpopular president in the state. “This is an event custom-made for Stacy Abrams, she obviously doesn’t want to be on the same stage as Joe Biden,” Scarborough said on “Morning Joe.” Joe Scarborough said Stacey Abrams is “obviously” skipping President Biden’s important voting rights speech in Georgia on Tuesday because the gubernatorial candidate doesn’t want to be seen with the unpopular president. “I am not criticizing Stacey Abrams here. I am making a comment about the political standing of Joe Biden as seen from a woman who’s running for governor of Georgia and wants to win that election,” Scarborough continued. “Politicians show up with presidents when they have 52% approval ratings. Politicians don’t show up with presidents when their approval ratings may be in the 30s in the state where they want to be elected governor.”

    1. George Joe plagerized from Erick Erickson. “They’re coming down here today. They’re going to tie up traffic as everybody is getting back from Indianapolis, and they won’t have their star with them. This is the really telling and damning part.

Stacey Abrams is a no-show. She’s got her haircut scheduled and given staffing issues and cancelations, she can’t get out of her appointment. Actually, we don’t really know why, but it does not matter. Despite all the insistent excuse-making from Democrats, when the President of the United States and his Vice President show up in your state to talk about your signature, core issue and you can’t alter your schedule to be there and they didn’t check the schedule to accommodate you, that’s a pretty big tell that even Abrams knows Biden is radioactive.

  14. Anonymous the Stupid, put the comment in context. He wasn’t asking for anyone to do anything illegal. There was lawlessness and appropriate assessment and recounting of the ballots was needed.

Eatonville Mayor Anthony Grant, Two Others, Charged with Election Fraud

Following witness testimonies from Eatonville residents and current and past officials, a grand jury moved to indict Grant, James Randolph, and Mia Antoinette Nowells on 25 counts having to do with who filled out absentee ballots and how they did it in the municipal race. The counts range from voter ballot solicitation to corruptly influencing voting.

(A Democrat mayor in a different state… Lawlessness exists so it is necessary to assess and recount ballots to maintain our democratic republic.

    1. Anonymous the Stupid, knowing that when I respond to your comments, my replies are deleted as well, when you choose to use a specific address, I’ll respond to you under my own comments or someone else’s.

Excellent commenters’ substantive replies to you are being deleted along with your Stupidity. You are like a terrorist that explodes a bomb to kill others despite killing yourself.

You also write: “His [Trump’s] comment was completely in context. Exactly in context. He wanted votes just enough votes stricken in Fulton County for him to win the state.”

He wanted an audit and hoped to find at least that many votes. His point was that with all the lawlessness that occurred, his loss was very narrow and could easily have been due to Democrat lawlessness.

I don’t doubt that Republicans have acted lawlessly as well, but not to the extent we saw in this last election. However, I note that your statement didn’t have any proof, and we all know that you lie or take things out of context.

      1. ATS, along with a few others here, is the personification of the Militantly Stupid…

    2. As I understand it, the law in Georgia is clear that if the number of illegal votes exceeds the margin of victory, the election is invalid. Margot Cleveland has reported on sound evidence that the number of people who voted in one county even though they had moved permanently out of that county more than 30 days before election day almost certainly exceeded the margin. These votes were illegal. This was among the allegations made in the legal claim filed in Georgia but never heard. It was in reference to this that Trump said the illegal votes should be found. He was right.

      1. Brian Wilson also replied to the comments about Democrat election lawlessness, but his comment was deleted as well because of Anonymous the Stupid’s duplicity. I have taken the liberty of copying it so Anonymous the Stupid can read it.

There is plenty of indications of fraud in Georgia. For one, 37 counties could not produce the required chain of custody documents until months later (no doubt constructed after the fact). Second there is video of Fulton County Election officials telling the observers that vote counting was over because of a water main break (false on its face as it turns out). He then pulls out his phone and makes a call once the observers had left – who was he calling. The staff then continues for several hours counting votes. Contrary to federal law requiring all records be kept for 22 months, Fulton County cannot produce any ballot images for those who voted in person. Where did they go? Post election, the warehouse where the ballots were kept was broken into. Video surveillance of absentee drop off boxes has suddenly vanished – most conveniently of the most populous – and Democrat controlled – counties in Georgia. The local officials claim the State Board of Elections ordered them to do so. Being part of the election record, this also violates federal election law. Our SOS who a) should have been out and about visiting the most populous counties and ensuring their procedures were in accordance with state and federal laws and b) should be all over these improprieties and bringing charges has been conspicuously AWOL until his reelection chances became clearly dimming with the consequences of his inaction. At the very least blatant incompetence reigns at all levels of Georgia elections. And this is just Georgia. Voter fraud in the 2020 election? Nah there is no voter fraud! Conservatives can’t (yet) prove there was but you can’t prove there wasn’t either considering all the shenanigans that went on.

    3. Since the above comment was made Anonymous the Stupid has made comments that questions the many questions that have arisen from the 2020 election. We keep posting evidence of lawlessness but Anonymous the Stupid chooses to start from scratch every time he responds. …And then he is deleted.

I’ll repeat just one recent example noting that Democrats have gotten rid of election data they were supposed to keep. Democrats know they are guilty.

Georgia ballot harvesting probe casts fresh light on past Democrat efforts to make tactic legal

Top Democrat election lawyer Marc Elias called third-party ballot gathering one of “four pillars” to success.

  15. The Dems haven’t appeared to regret any of their foolishness over the past number of years – i don’t know why they’d start now. The entire party seems to have had a psychotic break from reality. Their fracturing can’t come soon enough, and it is plain to see to anyone that has paid attention, they have wrought this upon themselves. History will not look back kindly on them as they are currently constituted, it has been and is utter madness. If ‘moderate’ Dems would like Independents such as myself to ever vote for them or their policy again, they had better divorce themselves from this absolute toxicity.

    1. I am pretty sure there are no moderate dems. Even those who may have more moderate values are seeing the writing on the wall for 2022…cram through some inane unconstitutional orders or bills right away or get thrashed in the next election. What they fail to realize is that they will get thrashed at some point anyway, and then their fake-as$ impeachment crap and lack of the filibuster will get turned upon them…I can’t wait. Meanwhile, I plan to vote only for those who promise to undo this crap going forward. This cannot be allowed to stand.

      1. I think there might be, e.g. Tulsi. But you see – (not Tulsi) they are also cowards.

    2. James,
I think the Dems were so certain of a 2016 win, when Clinton lost, all their plans evaporated, they had some kind of break down. They seem to be trying by force of will to bend reality to their perception. It is not working, which is why they seem more and more disconnected with reality.
As an Independent, I am looking for some degree of sanity, finding it with Manchin, Sinema and some others questioning changing the filibuster. But that only seems to drive the other Dems more off the deep end.
Some people who have protested or made demands of Manchin or Sinema (e.g. disrupting a wedding) highlights the madness.

  16. Moderate, or should I say “moderate” Democrats like Kelly, Shaheen and Testa want to skate under the umbrella of Manchin and Sinema but selfish pigs like Schumer are demanding they go on the record with a vote, a vote that Schumer knows will fail. Selfish pig Schumer is just doing this to establish his leftist credentials to protect him against AOC in a primary battle. Ask yourself what Mark Kelly thinks about Schumer.

PS. It is also disgusting that Kelly et al are not asked by our incurious media how they feel about the filibuster. If this were Republicans duking it out the media would be playing up “the party is in disarray” angle every night.
