Biden’s Red Queen Justice: The Border Agents Remain Under Investigation Six Months After Debunked Whipping Scandal

We have now reached the six-month anniversary of the investigation into border patrol agents that President Joe Biden declared guilty of whipping migrants at the border. Biden and the media spread a false story based on a misleading picture of mounted agents using a whip to guide his horse. While the Administration promised a conclusion to the investigation within days or weeks, it has continued to refuse to release any results and insists that it remains “under investigation.” The concern is that the Administration does not want to contradict the President who proclaimed the guilt of the agents and promised that they would be punished before they were investigated, let alone adjudicated. Six months ago, Homeland Security Secretary Alejandro Mayorkas promised that the investigation would be “completed in a matter of days, not weeks.”

The agents were responding to a large influx of undocumented migrants in Del Rio, Texas on Sept. 19. The media exploded with condemnations from politicians and pundits. Media stories presented the whipping as fact as the “Whipping (of) Haitian Asylum Seekers.”

Democratic politicians like Rep. Maxine Waters (D-Calif.) declared that the whipping was “worse than what we witnessed in slavery” and described “the cowboys who were running down Haitians and using their reins to whip them.”  Senate Majority Leader Chuck Schumer decried “images of inhumane treatment of Haitian migrants by Border Patrol—including the use of whips.” Rep. Ayanna Pressley (D-Mass.) called it simply “white supremacist behavior.” Many in the media went into high gear, denouncing what one outlet described as the “Whipping (of) Haitian Asylum Seekers.”

However, Biden’s behavior was the worst, due to his position as head of the Executive Branch: “It was horrible what — to see, as you saw — to see people treated like they did: horses nearly running them over and people being strapped. It’s outrageous. I promise you, those people will pay.”

By announcing that the agents were guilty and needed to be punished, Biden destroyed the credibility of the Department of Homeland Security’s ongoing investigation.

The problem is that the photographer himself quickly stated that it was false and “nobody saw a Border Patrol agent whipping.”

Once debunked, the White House and virtually all of the media went into a familiar radio silence.  It was sent to “investigation” and buried.

It is now six months later and the Biden Administration continues to maintain that the agents remain under investigation. Obviously, the falsity of President Biden’s declaration was established within days. It did not take days, let alone months, to determine if the agents did or did not “strap” or whip these migrants.

A classic response to such scandals is to bury them in investigation to wait for public attention to wane. You can do that by changing the question. For example, what began as an investigation into whether agents used reins to whip migrants might be converted into a long investigation into the use of horses in crowd control operations. That will take a lot of time and, when the report is issued, the actual whipping allegation can be buried in a broader policy debate. That will allow the media, as well as the Administration, to focus on the policy as opposed to the personnel involved.

Of course, President Biden was declaring the guilt of people who should have rights of due process and an expectation of a modicum of fairness. However, their innocence is now an inconvenient fact for both the Administration and many in the media. So they languish in legal purgatory.

JeffSilberman has no concern for a President who declares people guilty as a knee jerk reaction instead of waiting until all the facts are in. Most important to JeffSilberman is his Fox News Turley connection mania. Joe Biden is the top police officer in the nation but JeffSilberman doesn’t care about the present sheriff in town telling us that people are guilty before the investigation is complete. Not unlike Turley reminding the Democrats of the Hunter Biden laptop scandal which the MSM wrongly ignores. Turley and I have that in common.

You write of how Professor Turley overlooks subjects that you deem to be important but you overlook the leftwing media suppressing a story that would have had an effect on an election for President. In your lame attempt to seem fair you come out now once the MSM has admitted that the laptop is authentic to say that you agree with the Professor. Fox news has been saying for a year that the laptop is the real deal. The question then must be where has JeffSilberman been for the last year telling us that he has been agreeing with Fox News’ assessment of the veracity of the laptop? Not a wisper. JeffSilberman just thinks that it makes up for everything if he is very very late to the party. All the guests at the party know that he has arrived at the very last moment and acts like he’s been there all along.

            I think others here may bear witness that I agreed with Turley long before now that he was correct in criticizing the MSM for ignoring the Hunter laptop. I have always said that I don’t care if Hunter is found guilty of corruption as well as impeaching Joe if he was complicit. No one is above the law. No one.

            I will look at old posts by Turley about Hunter’s laptop to prove that I had posted my agreement with Turley long before now. I hope you will acknowledge your mistake when I do.

Was this after or before the left wing media finally admitted that the Hunter laptop was genuine. When did you admit that Fox News had it right all along? When did you tell us that you were outraged by the coverage of the laptop and the Dossier by CNN and MSNBC? When did you say that you were aghast at Hunter Biden receiving fifty thousand plus dollars per month from Burisma for doing nothing? When did you explain that when Joe Biden said he never met with any of the people his son was doing business with he was not being honest? I’ll tell you how many times you warned us of these things.                 This NYT article was published on July 30, 2021. I DID criticize MSM for ignoring the Hunter laptop long before now. I rest my case.

  2. As a rider, I am deeply offended at the maligning of mounted Border Patrol. Those were split reins, not whips.

    They use mounted officers rather than sending them on foot because they are vastly outnumbered and could easily be overrun. A good horse is more effective than a single human in blocking people trying to get around. Some of the illegal aliens are hostile, and there have been a few on the terrorist watch list.

    A horse is also an advantage when the ground is too rough for a vehicle. The rider can also pack in water, a heat reflective blanket, and emergency supplies for hapless migrants who are abused, neglected, or abandoned by the violent cartel members they paid thousand of dollars to transport them.

    Gaslighting, misinformation, and targeting innocent people has been all too common in the Biden Administration. This investigation should have been wrapped up in 30 minutes.

    Here’s some virtual pets and carrots to the maligned grey and chestnut, and solidarity for the riders.

      Thanks for posting this decision. Do you think it will finally prompt Turley to pass judgment on the court’s tentative opinion of Eastman’s and Trump’s intent? Here is a damning summation:

      Corrupt intent

      “A person violates § 1512(c) when they obstruct an official proceeding with a corrupt mindset. The Ninth Circuit has not defined “corruptly” for purposes of this statute.222 However, the court has made clear that the threshold for acting “corruptly” is lower than “consciousness of wrongdoing,”223 meaning a person does not need to know their actions are wrong to break the law. Because President Trump likely knew that the plan to disrupt the electoral count was wrongful, his mindset exceeds the threshold for acting “corruptly” under § 1512(c).”

      “Dr. Eastman argues that the plan was legally justified as it “was grounded on a good faith interpretation of the Constitution.”236 But “ignorance of the law is no excuse,”237 and believing the Electoral Count Act was unconstitutional did not give President Trump license to violate it.”

      “Disagreeing with the law entitled President Trump to seek a remedy in court, not to disrupt a constitutionally-mandated process.238 And President Trump knew how to pursue election claims in court—after filing and losing more than sixty suits, this plan was a last-ditch attempt to secure the Presidency by any means.”

Our nation was founded on the peaceful transition of power, epitomized by George Washington laying down his sword to make way for democratic elections.239 Ignoring this history, President Trump vigorously campaigned for the Vice President to single-handedly determine the results of the 2020 election. As Vice President Pence stated, “no Vice President in American history has ever asserted such authority.”240 Every American—and certainly the President of the United States—knows that in a democracy, leaders are elected, not installed. With a plan this “BOLD,”241 President Trump knowingly tried to subvert this fundamental principle.”

      Turley, what is your legal analysis? It strikes me that Trump’s only defense is the George Constanza defense, that is, if Trump REALLY believed there was massive voter fraud then he had no corrupt intent. BUT, is he earnestly that blind and stupid? Or perhaps, he is a conman as Turley noted when he called him a “carnival snake charmer.”

        1. Well, I can’t find where Turley has said anything about Eastman’s role in the events of 1/6. Even if Turley is reluctant to criticize Eastman, he will be hard-pressed to claim that Eastman and Trump were acting without corrupt intent when Turley’s bestie Bill Barr said unequivocally that these election claims were utter “bullsh*t.”

          Turley’s in a tough spot to reconcile Trumpists’ and Fox’s contention that claims of massive voter fraud were made in good faith when a person whom he respects says they were total crap and impartial judges are also finding that they were- more likely than not- lies.

      2. I see that Eastman’s lawyers have released a response. In part: “He intends to comply with the court’s order. … [He] respectfully disagrees with the judge’s findings. Dr. Eastman asks all persons interested in this case to join him in calling upon the January 6tth committee to release all the evidence so the courts and the public can reach accurate conclusions about the matters involved.”

        I’d love for the Committee to release a lot more evidence, though I assume that some should not be publicly released for security reasons. They’ve said that they’re going to have more public hearings, and I look forward to watching them.

        I find it ironic that Eastman is asking that all evidence be released when he’s been withholding evidence and refused to answer over 100 questions.

  3. There will come a time when a publisher will come out with a coffee-table book titled ‘Biden’s Gaffes.’ There are already enough of them to fill a book, and the number seems to grow every week. When he was a Senator, none of his staff sought to ‘walk back’ his questionable comments. Even when he was Vice President, during those 8 years his staff didn’t find a compelling need to ‘walk back’ some of his more outrageous statements. But as the POTUS, and in his current condition, he requires ‘handlers’ and when he goes off script, his words circle the world and there are consequences to his utterances.
    He is the only US President in recent memory, and perhaps in US history, who needs to be under constant ‘damage control’ by his staff.

    This incident with the Border Agents on horseback will be in that coffee-table book and will be identified as a clear indication this President had mentally taken a turn for the worse. When you’re the POTUS, you do NOT do what Biden did, and you do not SAY out loud what Biden said.

    So is it any surprise that here we are, six months later, in March of 2022, and he is uttering words that Putin can now use in propaganda as evidence, as proof, the America wants regime change in Russia, and has wanted it for years!

    And in the news this week, a survey of Biden voters suggests that if they had known various facts about Biden that the mainstream media suppressed or buried they would not have voted for him, sufficient to have given Trump a 2nd term, it may be time for regime change in America.

    Silberman’s injection of the Wallace story is actually an appropriate example of how the Left doesn’t tolerate questioning their narrative. Just like with this whipping story, their “truth” was debunked early by FoxNews because they did what journalists are supposed to do…question the narrative. Wallace isn’t comfortable working for an organization that does that. He’s a media carpetbagger that saw an opportunity in the ruins of CNN to be their #1. All he’s doing now is selling his new show.

I can tell you one thing- Turley has a higher opinion of a professional journalist like Wallace than the “absurd reality television star” which he called Trump. Boom!

    I don’t believe it is impeachable because he has his opinions and is soft in the head, but why not impeach him anyway since that has more validity than the two impeachments of Trump.

    This is like the Capitol incident. Continued investigations when the information is available but not utilized by the left for political reasons.

I suspect many of the critics who jumped to scream at the injustice of the pictures 1- never rode a horse and used reins, 2-heard that it was in Texas and any proper progressive knows that Texas is the gates of hell 3- never have been on a real river bank or been in country where even a military Hummer or other off road vehicle cannot go, 4-never tried to control a large crowd while standing by themselves in a large and uncooperative crowd, 5- progressive critics who believe that accusation is followed by hanging (figuratively) with out that slight little step called due process 6-never heard of the statement “well why don’t we wait and see what the investigation shows because there may be facts here that we are unaware of.” 7-you are like Jeff and have a 1 trick pony with no reins or direction.

  12. The President of the United States is cognitively impaired. In his younger days, he was not the brightest bulb in the pack, though he manage to figure out how to leverage his power to enrich himself. If their is any doubt, let him take a physician administered cognitive test.

    So here we are. His administration is a disaster and his polling is disastrous. Nearly everyone knows it. Americans are fed up with the smug elites who “know best” who don’t give a care about the truth, only raw power.     1/6 unarmed white woman shot dead by capital police for exercising here citizens rights to protest. That investigation took about a 24 hour’s???

      Babbitt wasn’t exercising her right to protest. She was in the midst of breaking into a highly secure location, the Speaker’s Lobby, which opens directly onto the House floor, while there were still members of Congress and staff in the House chamber. She was shot by a Capitol Police officer whose job it was to protect those members of Congress and staff, and after an investigation that lasted at least a couple of weeks, it was determined to be a justified shooting.       DHS should announce that these border agents did nothing wrong. It doesn’t serve the country to protect Biden and others from a finding that they jumped to the wrong conclusions. Even better if Biden and others act like adults and admit they were wrong. Just like it would be good for Margot to admit that she’s wrong about Babbitt having been shot “for exercising here citizens rights to protest.”

You should know by now that on the day that Babbitt was shot, hundreds of people broke into the Capitol buildings, avoided screening, and brought in weapons (e.g., bear spray, bats).

              In addition, prior to Babbitt being shot, the Capitol Police attempted to evacuate members of Congress from the House and Senate Chambers (but been unable to evacuate some House members) and the Secret Service had taken the VP to highly secure location; nothing happened on the days you’re referring to that led to anyone having to be evacuated from the chambers.

              In addition, neither the Senate gallery nor the elevator is a highly restricted area like the Speaker’s Lobby (you don’t say what “Senators private areas” you’re referring to — name them and we can check whether they are highly restricted; for all I know, your claim isn’t even accurate). There are rules that severely restrict who can enter the Speaker’s Lobby: “§ 4.1 Persons who are not entitled to floor privileges under Rule XXXII may not be admitted to the ‘Hall of the House or rooms leading thereto, which include the cloakroom and the Speaker’s lobby.”

              In addition, in the events you refer to, no one was attempting to breach a locked door.

              In addition, on the day of the events you refer to, no one had physically attacked any Capitol Police and no one had damaged the building.

The Governors and Mayors have to take some if not much of the blame. It’s a big country.

                    As for Biden, I am indifferent to his presidency. I’m just grateful that a conman is not President. I wish Obama was still in office. Strong, liberal and intelligent. THAT is an impeachable offense. He also subsequently said he was not given intelligence that the generals said he was given. Somebody is lying.
                      I told you that I volunteer for a non profit that helps resettle refugees in the Chicago area. Just last week I had an Afghani helicopter pilot in my car. He was one of the last to leave. His parents are still there. From a man who has first hand knowledge, not a news organization, not our State Department,I know that all of the Americans who WANTED to leave did NOT GET OUT. Yesterday I met with a former Commander in the Afghani army. He confirmed the helicopter pilot’s story. Two people on the ground. I think that meets journalistic standards. And many SIV holders who should have been prioritized to leave are also still there.
                      Biden just wanted to fill the planes. So I am going to pass judgement.
                      As far as ” can’t wait”. I have a ” can’t wait” also.
                      I can’t wait until next year. When the Democrats can’t run a sitting President, something that has only happened 9 times. Twice because the sitting President was assassinated.
