We have now reached the six-month anniversary of the investigation into border patrol agents that President Joe Biden declared guilty of whipping migrants at the border. Biden and the media spread a false story based on a misleading picture of mounted agents using a whip to guide his horse. While the Administration promised a conclusion to the investigation within days or weeks, it has continued to refuse to release any results and insists that it remains “under investigation.” The concern is that the Administration does not want to contradict the President who proclaimed the guilt of the agents and promised that they would be punished before they were investigated, let alone adjudicated. Six months ago, Homeland Security Secretary Alejandro Mayorkas promised that the investigation would be “completed in a matter of days, not weeks.”

The agents were responding to a large influx of undocumented migrants in Del Rio, Texas on Sept. 19. The media exploded with condemnations from politicians and pundits. Media stories presented the whipping as fact as the “Whipping (of) Haitian Asylum Seekers.”
Democratic politicians like Rep. Maxine Waters (D-Calif.) declared that the whipping was “worse than what we witnessed in slavery” and described “the cowboys who were running down Haitians and using their reins to whip them.” Senate Majority Leader Chuck Schumer decried “images of inhumane treatment of Haitian migrants by Border Patrol—including the use of whips.” Rep. Ayanna Pressley (D-Mass.) called it simply “white supremacist behavior.” Many in the media went into high gear, denouncing what one outlet described as the “Whipping (of) Haitian Asylum Seekers.”
However, Biden’s behavior was the worst, due to his position as head of the Executive Branch: “It was horrible what — to see, as you saw — to see people treated like they did: horses nearly running them over and people being strapped. It’s outrageous. I promise you, those people will pay.”
By announcing that the agents were guilty and needed to be punished, Biden destroyed the credibility of the Department of Homeland Security’s ongoing investigation.
The problem is that the photographer himself quickly stated that it was false and “nobody saw a Border Patrol agent whipping.”
Once debunked, the White House and virtually all of the media went into a familiar radio silence. It was sent to “investigation” and buried.
It is now six months later and the Biden Administration continues to maintain that the agents remain under investigation. Obviously, the falsity of President Biden’s declaration was established within days. It did not take days, let alone months, to determine if the agents did or did not “strap” or whip these migrants.
A classic response to such scandals is to bury them in investigation to wait for public attention to wane. You can do that by changing the question. For example, what began as an investigation into whether agents used reins to whip migrants might be converted into a long investigation into the use of horses in crowd control operations. That will take a lot of time and, when the report is issued, the actual whipping allegation can be buried in a broader policy debate. That will allow the media, as well as the Administration, to focus on the policy as opposed to the personnel involved.
Of course, President Biden was declaring the guilt of people who should have rights of due process and an expectation of a modicum of fairness. However, their innocence is now an inconvenient fact for both the Administration and many in the media. So they languish in legal purgatory.

I have always said that I don’t care if Hunter is found guilty of corruption as well as impeaching Joe if he was complicit. No one is above the law. No one.

As a rider, I am deeply offended at the maligning of mounted Border Patrol. Those were split reins, not whips.
They use mounted officers rather than sending them on foot because they are vastly outnumbered and could easily be overrun. A good horse is more effective than a single human in blocking people trying to get around. Some of the illegal aliens are hostile, and there have been a few on the terrorist watch list.
A horse is also an advantage when the ground is too rough for a vehicle. The rider can also pack in water, a heat reflective blanket, and emergency supplies for hapless migrants who are abused, neglected, or abandoned by the violent cartel members they paid thousand of dollars to transport them.
Gaslighting, misinformation, and targeting innocent people has been all too common in the Biden Administration. This investigation should have been wrapped up in 30 minutes.

“A person violates § 1512(c) when they obstruct an official proceeding with a corrupt mindset. The Ninth Circuit has not defined “corruptly” for purposes of this statute.222 However, the court has made clear that the threshold for acting “corruptly” is lower than “consciousness of wrongdoing,”223 meaning a person does not need to know their actions are wrong to break the law. Turley, what is your legal analysis? It strikes me that Trump’s only defense is the George Constanza defense, that is, if Trump REALLY believed there was massive voter fraud then he had no corrupt intent. Well, I can’t find where Turley has said anything about Eastman’s role in the events of 1/6. Even if Turley is reluctant to criticize Eastman, he will be hard-pressed to claim that Eastman and Trump were acting without corrupt intent when Turley’s bestie Bill Barr said unequivocally that these election claims were utter “bullsh*t.”
Turley’s in a tough spot to reconcile Trumpists’ and Fox’s contention that claims of massive voter fraud were made in good faith when a person whom he respects says they were total crap and impartial judges are also finding that they were- more likely than not- lies.
I see that Eastman’s lawyers have released a response. In part: “He intends to comply with the court’s order. … [He] respectfully disagrees with the judge’s findings. Dr. Eastman asks all persons interested in this case to join him in calling upon the January 6tth committee to release all the evidence so the courts and the public can reach accurate conclusions about the matters involved.”
I’d love for the Committee to release a lot more evidence, though I assume that some should not be publicly released for security reasons. They’ve said that they’re going to have more public hearings, and I look forward to watching them.
I find it ironic that Eastman is asking that all evidence be released when he’s been withholding evidence and refused to answer over 100 questions.

She was in the midst of breaking into a highly secure location, the Speaker’s Lobby, which opens directly onto the House floor, while there were still members of Congress and staff in the House chamber. She was shot by a Capitol Police officer whose job it was to protect those members of Congress and staff, and after an investigation that lasted at least a couple of weeks, it was determined to be a justified shooting. DHS should announce that these border agents did nothing wrong. It doesn’t serve the country to protect Biden and others from a finding that they jumped to the wrong conclusions. You should know by now that on the day that Babbitt was shot, hundreds of people broke into the Capitol buildings, avoided screening, and brought in weapons (e.g., bear spray, bats).
In addition, prior to Babbitt being shot, the Capitol Police attempted to evacuate members of Congress from the House and Senate Chambers (but been unable to evacuate some House members) and the Secret Service had taken the VP to highly secure location; nothing happened on the days you’re referring to that led to anyone having to be evacuated from the chambers.
In addition, neither the Senate gallery nor the elevator is a highly restricted area like the Speaker’s Lobby (you don’t say what “Senators private areas” you’re referring to — name them and we can check whether they are highly restricted; for all I know, your claim isn’t even accurate). There are rules that severely restrict who can enter the Speaker’s Lobby: “§ 4.1 Persons who are not entitled to floor privileges under Rule XXXII may not be admitted to the ‘Hall of the House or rooms leading thereto, which include the cloakroom and the Speaker’s lobby.”

As far as the state of affairs in the U.S., I can’t lay all the blame on Biden after just one year or so in office. I don’t lay the blame of Covid on Trump though I do blame him for his denial of the severity of the pandemic. It’s too facile to hold the President accountable for all the problems in the country. The Governors and Mayors have to take some if not much of the blame. It’s a big country.

As for Biden, I am indifferent to his presidency. I’m just grateful that a conman is not President. I wish Obama was still in office. Strong, liberal and intelligent. I don’t like to speak about something like the pullout of Afghanistan and the mayhem that occurred without being privy to everything that Biden and his commanders knew at that time including all the secret intelligence and back room deals with the Taliban. Then I could fairly judge his decision or rather his reliance on his Lieutenant Generals in the field. There is just too much unknown to me and you to pass judgment.

I told you that I volunteer for a non profit that helps resettle refugees in the Chicago area. Just last week I had an Afghani helicopter pilot in my car. He was one of the last to leave. His parents are still there. From a man who has first hand knowledge, not a news organization, not our State Department,I know that all of the Americans who WANTED to leave did NOT GET OUT. Yesterday I met with a former Commander in the Afghani army. He confirmed the helicopter pilot’s story. Two people on the ground. I think that meets journalistic standards. And many SIV holders who should have been prioritized to leave are also still there.
