FEC Fines the Clinton Campaign and DNC for Conduct Related to Steele Dossier

We have previously discussed allegations that Marc Elias, the former general counsel for the Clinton Campaign and partner at the firm Perkins Coie, lied to conceal the campaign’s funding of the infamous Steele Dossier. The Federal Election Commission (FEC) has now fined the Democratic National Committee and Hillary Clinton’s 2016 campaign for violating election rules in hiding that funding. Elias has previously been sanctioned for his conduct in litigation and recently lost an effort to gerrymander the Maryland voting districts.  The alleged Elias’ lies would ordinarily seem a professional liability for any attorney but they seem an actual professional attraction for Elias.

On March 29, the FEC imposed a relatively small fine of $8,000 for Clinton and $105,000 for the DNC. However, it is the basis rather than the size of the fine that is so notable.

The FEC found that Clinton campaign and DNC payments to Fusion GPS were funneled through Perkins Coie and Elias. As the campaign denied funding the dossier, these payments were concealed as “legal advice and services.” The FEC said the law firm, Perkins Coie, paid Fusion $1,024,407.97 for the dossier in 2016.

Elias has featured prominently in the filings of Special Counsel John Durham. The key to many of these operations is someone referred to by Durham as “Campaign Lawyer-1,” who is now known to be Elias. Elias was called before the grand jury.

It was Elias who made the key funding available to Fusion GPS, which in turn enlisted Steele to produce his now discredited dossier on Trump and his campaign.

During the campaign, a few reporters did ask about the possible connection to the campaign, but Clinton campaign officials denied any involvement. It was only weeks after the election that journalists discovered that the Clinton campaign hid payments for the Steele dossier as “legal fees” among the $5.6 million paid to Perkins Coie.

New York Times reporter Ken Vogel said at the time that Elias denied involvement in the anti-Trump dossier. When Vogel tried to report the story, he said, Elias “pushed back vigorously, saying ‘You (or your sources) are wrong.’” Times reporter Maggie Haberman declared, “Folks involved in funding this lied about it, and with sanctimony, for a year.”

“It was not just reporters who asked the Clinton campaign about its role in the Steele dossier. John Podesta, Clinton’s campaign chairman, was questioned by Congress and denied categorically any contractual agreement with Fusion GPS. Sitting beside him was Elias, who reportedly said nothing to correct the misleading information given to Congress.”

Elias’ former partner, Michael Sussmann, has been indicted by Durham.

It is not known if Elias is a target for possible indictment.

Democrats continue to hire Elias despite his checkered past. Elias has unsuccessfully led efforts to challenge Democratic losses.  Elias has been sanctioned in past litigation.

Elias also was the subject of intense criticism after a tweet that some have called inherently racist. Democrats used the recent Georgia election law as a rallying cry for federalizing elections by labelling the law, as described by President Biden, “Jim Crow on steroids.” Biden has been repeatedly called out for demonstrably false statements about the law.  Elias argued that Georgia voters could not be expected to be able to read their driver’s licenses correctly — a statement that seemed to refer to minority voters who would be disproportionately impacted by such a requirement.

Elias was back in the news on another defeat in court last week. He filed in support of an abusive gerrymandering of the election districts in Maryland that a court found violated not only violated Maryland law but the state constitution’s equal protection, free speech and free elections clauses. The court found that the map pushed by Elias “subverts the will of those governed.”

Elias has been accused of making millions from gerrymandering and challenging election victories by Republicans (while condemning such actions by Republicans as “anti-Democratic”). He was involved in the New York redistricting that was ridiculed as not only ignoring the express will of the voters to end such gerrymandering but effectively negating the votes of Republican voters.

It is clear that none of these controversies will alter Elias’ conduct or such tactics. Indeed, they appear to be a draw from some Democrats and the media. CNN recently asked Elias “what should we be doing differently” in covering elections. He chastised the media for not having enough of a a “pro-democracy slant,” which appears to mean a more Democratic slant.

After the FEC fine, DNC spokesman Daniel Wessel called the complaints over their hiding the funding of the dossier (and public denials before the election) are “silly.”

It has been a bad week for Elias, but these headlines only seem a draw for some in Democrats that Elias is the precisely the type of attorney that they want in case pursuing gerrymandering and election challenges.

One can make a good case that the first justification leading to the current US proxy war in Ukraine against Russia (risking nuclear winter for planet earth) was HRC’s original lie blaming Russia for her loss to the likely all-time most loathsome candidate Trump. Russia spent like about $75k @ Facebook etc. in a race where the total expenditures were in the billions. So maybe .001% of the money spent caused HRC to lose.

  4. The Federal Code for “lying to the FBI” doesn’t begin to capture the brazenness of spoofing the FBI into investigating one’s political adversary. Congress needs to get down to some basic lawmaking about false-flag misinformation ops that are corrupt and/or endanger public safety.

    It’s shameful that the FBI has to reach for “technicality” crimes to indict broad, corrupt, ambitious deceptions such as Sussmann and Elias “lying to the FBI, or Hunter Biden for a FARA. As things stand, it is not illegal under Federal Law to plan to ignite a race war. Many have tried to foment one (Charles Manson, Timothy McVeigh, a few involved in Jan 6th, and Steven Carillo), yet none will be charged specifically with their apex intent.

    As Putin has shown, big lies can be used to great evil. We need to keep our laws up-to-date with the threat posed by organized untruths as an avenue for fomenting mayhem. We need some red lines that rope off deceitful infowarfare from 1st Amendment protection.

    A former White House staffer who served in the Obama administration told CNN that if then-President Barrack Obama wanted to make a call to someone from the Oval Office, he would normally ask an aide seated nearby to dial the person. The aide would then call the number and hit transfer to connect the caller to the President.

      Of course this will quietly go away, no one will fess up to it, or print a retraction/correction for days if at all.
      That is the level of professionalism in journalism nowadays.

    2. The PRA requires that all presidential call be logged, regardless of whether they’re logged automatically (like the ones that go through the switchboard) or not. The issue is that some calls that were supposed to have been logged were not logged.

      Your CNN article says “the seven-hour gap is likely explained by use of White House landlines, White House cell phones and personal cell phones that do not go through the switchboard.” That only explains why the calls weren’t logged *automatically*. It does not explain why the calls were not *manually* logged, consistent with the requirements of the PRA.

      Your articles says as much: “Calls also should have been documented in the Presidential Daily Diary, which is compiled by an Archives employee detailed to the White House. … No explanation has been given so far why calls known to have been made in the hours Trump was in the Oval Office are not documented in the presidential diary,” as required by law.

Then after the election they worked to undermine the administration of President Trump with the same document and by extension smear all Republicans. Now when even The New York Times and The Washington Post have admitted that the Steele Dossier was a pack of lies and a court has found the liars guilty the Democrats try to continue the charade. The use of the Dossier was an attempt to steal an election. Then after the election they tried to destroy the President who had been elected using the same piece of made up vomit. This was not only an attempt to steal an election but to also formulate a coup. You want to talk about a “Big Steal.” The Jan 6 riot lasted only part of one day but the coup attempt by The Democratic Party continued for five years.   13. I agree. No one is above the law. Let’s hope all wrongdoers are prosecuted whichever their political party. But I will note in Elias’ case, Turley spoke more like a prosecutor than his usual bent as a defense counsel. We know there is bad blood between the two.

        Michael Cohen was convicted of 2016 campaign finance law violations that included paying $130K hush money to Stormy Daniels, a campaign loan for which Cohen was repaid — plus a huge bonus — over the course of 2017, including via checks signed by Trump himself. Trump’s lawyer Giuliani admitted to Trump reimbursing Cohen for Cohen’s illegal campaign loan. Trump’s failure to report the loan (from Cohen to the campaign) and failure to report the loan repayments are themselves campaign finance violations. Trump also lied about his liability to Cohen by omitting the required declaration of liability from Trump’s 2017 financial disclosure form (OGE form 278e) and then after being caught in that illegal omission, Trump made a false declaration on his 2018 financial disclosure form about the total amount of the liability, in both cases certifying that the forms were accurate when they were not. Knowingly and willfully omitting or falsifying information that’s required to be reported on form 278 is also illegal.

        But you will never admit to Trump having broken the law, because you’re a Trumpist.
