President Joe Biden on Wednesday repeated a claim about the Second Amendment that some of us have repeatedly challenged as untrue. In asserting that “the Second Amendment is not absolute,” President Biden repeated his claim that certain weapons were prohibited at the time that the Second Amendment was ratified. That is simply untrue.
The statement that the Second Amendment is not absolute is certainly true. There are laws that can be crafted within the confines set out under controlling Supreme Court precedent. However, as discussed in a column, President Biden continues to ignore those constitutional limitations in blaming the gun lobby and political opponents for these deaths.
President Biden also has repeated his claim that certain weapons were banned at the time of the ratification of the Second Amendment.
Previously, Biden declared:
“And I might add: The Second Amendment, from the day it was passed, limited the type of people who could own a gun and what type of weapon you could own. You couldn’t buy a cannon.”
This week, President Biden repeated a false claim that many of us have corrected in the past.
When he was announcing new rules for so-called “ghost guns” and other measures, President Biden renewed his false claim that early Americans could not buy a cannon.
“By the way — it’s going to sound bizarre — I support the Second Amendment. But from the very beginning the Second Amendment didn’t say you could own any gun you want, as big as you want. You couldn’t buy a cannon, when in fact the Second Amendment passed.”
It does sound bizarre because it is factually and legally untrue. I have received calls from media for years about this claim and it does not improve by repetition. Even the Washington Post has declared Biden’s understanding of the Second Amendment to be false.
Yet, this week, President Biden remained undeterred and uninformed: “The Second Amendment is not absolute. When it was passed you couldn’t own a cannon, you couldn’t own certain kinds of weapons. There’s just always been limitations.”
Once again, there were no federal laws barring cannon ownership when the Second Amendment was enacted. Gun laws remained local matters and I do not know of any bans on cannons or other gun types until much later in our history. Early local laws did control concealed weapons, though concealed cannons were not part of those ordinances.
Indeed, the Constitution itself supports private cannon ownership in the case of privateers. Article 1, Section 8, Clause 11 allows Congress to “grant Letters of Marque and Reprisal.” That allowed private parties to privateer on the high seas with . . . cannons. (Recently some members of Congress wanted to issues such letters of Marque again to enlist privateers in the fight against Russia).
As with the failure to acknowledge the limitations on the range of legislative options due to Second Amendment protections, President Biden is undermining efforts to reach common ground with this repeated false claim. If we are going to reach what the President calls “commonsense” responses to this massacre, we must start from a common understanding of the constitutional and historical foundations for such reforms.
Consider a multi-pronged approach. A national advisory board could issue some security ideas — how many counties have instituted single points of entry at elementary schools, and limited points of entry at middle schools and high schools along with unobtrusive security that makes sure other points of entry remain locked? At least allow, in principle, that some guns are not protected by the 2nd amendment. Automatic guns have already been banned. But recognized the limits of this. And be prepared for reasonable people to disagree on what constitutes a weapon than can be considered purely an assault weapon in nature. Some people do not appreciate that some weapons are particularly valuable for self-defense because of limited recoil. There are some who wish to ban such weapons.
In addition, I would like to pull rank a little bit here. I have been in the back rooms where legislation is finalized. It is not a pretty sight. Under the best of circumstances, legislation is a hodge-podge of interests and will always have some unintended consequences.
Multiply that by a factor of 10 when you are crafting any type of possession law. Possession language by its very nature means you do not have to consider what the person you are criminalizing has actually done. There doesn’t need to be a victim, and there is no need to show that the citizen has actually done anything to anybody or has any intent to do so. Any number of situations that you never envisioned when writing the legislation can fall under its scope.
Finally, there isn’t a person I am friends with, regardless of party, who isn’t heartbroken by what has occurred. You say to yourself, well of course there isn’t. Is that really such a small irrelevant observation?
The thing is Miller v US has already said the 2nd specifically applies to weapons that have “military utility “.

This comes from a guy who has turned “political posturing” into an art form. Not to be outdone the right-wing extremist GOP Rep. from Arizona, Paul Gosar, said Salvadore Ramos was a “transsexual leftist illegal alien”. How does Gosar know? Because he a supporter of the white nationalist movement that has put out this bizarre theory. GOP politicians in Texas believe Ramos was suffering from some “mental disorder” despite the police authorities saying there was no such evidence in Ramos’ background.
Right-wing media pundits have also weighed in on the shooting–like Fox’s Tucker Carlson. He blames the Covid pandemic lockdowns for recent mass shootings: “Oh, so the lockdowns dramatically increase the incidence of mental illness among young people…Could there be a connection?”. Carlson doesn’t explain how Australia, that had a mass shooting in 1996 and has had very restrictive Covid restrictions, banned all semi-automatic rifles and has not had a similar mass shooting since then. New Zealand also had a mass shooting in 2019. They implemented a gun buy-back program and there hasn’t been a mass shooting since the program was put in place. Minor details not worthy of comment on Fox.
Donald Trump has also reacted to the mass shooting. While other GOP have cancelled Trump plans to address the NRA convention in Texas tomorrow. The maker of the DDM4 V7 rife Ramos used is “Daniel Defense”. They say their product is “a perfect rifle for everybody”. Indeed. DD had a booth at the NRA convention. But they have decided to back out. The optics were obviously terrible. DD issued the rhetorical “thoughts and prayers” after the shooting.
And what is the Supreme Court doing to prevent future mass shootings? The conservative majority is poised to strike down a New York gun safety law and probably expand the right of Americans to carry guns in public. Justices Alito and Kavanaugh are leading the charge to expand the proliferation of guns .Makes perfect sense. What is ironic is that GOP lawmakers in Texas are stripping women’s access to abortion but they have no time to protect children when they are in school. Strange world we live in.

Agreed..in theory yes, they are. Just pointing out there are no exceptions listed in the ‘protections’ the US Constitution affords to everyone and that I’m not referring to specific laws themselves. Individual states and politicians are claiming otherwise, though, like Brandon’s statements about cannon ownership by citizens, and California’s ban on magazine capacity of 11 rounds or more, being against the 2nd’s principle and purpose. The Founders did not place limits on “arms” ownership or their use on anyone, including citizens, as they knew equal or superior firepower in the hands of citizens is the only way to defend against a government that wishes to harm its people. Only after it’s ratification did limits on the 2nd become the ‘exceptions’ to the same Amendment. I had weapons since I was 14 years of age for hunting as well as my high school friends. We were required to take a hunter safety course before we were able to obtain a hunting license because of our age. During hunting season we would meet have a breakfast and go pheasant hunting. In all those years non of us or kids we knew took our weapons outside our homes to brandish them in any way. We respected and feared any criminal contact with police, we even knew some by their first names and would often chat with them.
What I don’t understand is why the youth of today are so bold that they will take a weapon on the street’s like it was the OK Coral? It seems they don’t fear the consequences but of course there’s not many consequences today. The Democrats have demonized police so we can’t blame the police so where’s the problem?
My generation had easy access to weapons but had no malintent while this generation isn’t adult enough to own a BB gun. Could it be the computer games and/or social media because it’s not the gun walking into buildings firing off rounds.

My uncle , pretty much the whole extended family and friends of my father/family. Most of them were veterans of wars , many had been there and done that so to speak. They all understood and cherished the 2nd Amendment as they had been in places not so fortunate as Americans.
From an early age I collected trophies these veterans brought home from their wars/service. This was once a common thing in America, and stories and heirlooms often passed hands to sons , daughters ..family.

The President of the United States makes a declarative statement that is demonstrably false. The statement is a direct assault on the Constitution. A subject our host has an unchallenged grasp of the facts and history.

The hypocrisy is mind boggling. Steve Kerr has a public temper tantrum every time a mass murder takes place that fits his liberal narrative. But there are shootings and murders in big cities every day and he is silent. The media is complicit. They should has him: “Hey Steve, 31 people were gunned down last weekend in Chicago. Why didn’t you comment about it?”
Of course there is not one mainstream reporter who would question the veracity of anything the Plotted Plant President says.

have them formatted to a narrower width. Respected studies have shown that the
human eye functions better when certain type sizes are scaled to relative widths.

Both the Buffalo and the Texas shooters were clearly deranged. Maybe a better background check would have picked that up, maybe not. But also, maybe better mental health services, better educational oversight, and better parenting could have made a difference. But those are issues the Dems don’t want to touch — easier to blame the gun.
Not locking away the country in front of an Xbox for essentially two years effectively driving half of the population mad may have helped.
