President Joe Biden on Wednesday repeated a claim about the Second Amendment that some of us have repeatedly challenged as untrue. In asserting that “the Second Amendment is not absolute,” President Biden repeated his claim that certain weapons were prohibited at the time that the Second Amendment was ratified. That is simply untrue.
The statement that the Second Amendment is not absolute is certainly true. There are laws that can be crafted within the confines set out under controlling Supreme Court precedent. However, as discussed in a column, President Biden continues to ignore those constitutional limitations in blaming the gun lobby and political opponents for these deaths.
President Biden also has repeated his claim that certain weapons were banned at the time of the ratification of the Second Amendment.
Previously, Biden declared:
“And I might add: The Second Amendment, from the day it was passed, limited the type of people who could own a gun and what type of weapon you could own. You couldn’t buy a cannon.”
This week, President Biden repeated a false claim that many of us have corrected in the past.
When he was announcing new rules for so-called “ghost guns” and other measures, President Biden renewed his false claim that early Americans could not buy a cannon.
“By the way — it’s going to sound bizarre — I support the Second Amendment. But from the very beginning the Second Amendment didn’t say you could own any gun you want, as big as you want. You couldn’t buy a cannon, when in fact the Second Amendment passed.”
It does sound bizarre because it is factually and legally untrue. I have received calls from media for years about this claim and it does not improve by repetition. Even the Washington Post has declared Biden’s understanding of the Second Amendment to be false.
Yet, this week, President Biden remained undeterred and uninformed: “The Second Amendment is not absolute. When it was passed you couldn’t own a cannon, you couldn’t own certain kinds of weapons. There’s just always been limitations.”
Once again, there were no federal laws barring cannon ownership when the Second Amendment was enacted. Gun laws remained local matters and I do not know of any bans on cannons or other gun types until much later in our history. Early local laws did control concealed weapons, though concealed cannons were not part of those ordinances.
Indeed, the Constitution itself supports private cannon ownership in the case of privateers. Article 1, Section 8, Clause 11 allows Congress to “grant Letters of Marque and Reprisal.” That allowed private parties to privateer on the high seas with . . . cannons. (Recently some members of Congress wanted to issues such letters of Marque again to enlist privateers in the fight against Russia).
As with the failure to acknowledge the limitations on the range of legislative options due to Second Amendment protections, President Biden is undermining efforts to reach common ground with this repeated false claim. If we are going to reach what the President calls “commonsense” responses to this massacre, we must start from a common understanding of the constitutional and historical foundations for such reforms.
To those that question the possession of an AR15 or any gun, I’ll quote in part from two cases by the Supreme Court.
The reversal of the lower Courts option in ‘United States v. Miller et. al’.
Adam Smith’s Wealth of Nations, Book V, Ch. 1, “Men of republican principles have been jealous of a standing army as dangerous to liberty.” “In a militia, the character of the labourer, artificer, or tradesman, predominates over that of the soldier: in a standing army, that of the soldier predominates over every other character; and in this distinction seems to consist the essential difference between those two different species of military force”.
And from: ‘Printz v. United States’, opinion of the Court written by Justice Scalia.
“Much of the Constitution is concerned with setting forth the form of our government, and the courts have traditionally invalidated measures deviating from that form. The result may appear ‘formalistic’ in a given case to partisans of the measure at issue, because such measures are typically the product to the ear’s perceived necessity. But the Constitution protects us from our own best intentions: It divides power among sovereigns and among branches of government precisely so that we may resist the temptation to concentrate power in one location as an expedient solution to the crisis of the day”.

But, some teacher with a handgun is supposed to prevent this from happening? Then, there’s the NRA intending to proceed with its convention in Texas, 300 miles away from the scene of the carnage, and the fat one you worship planning to attend. Plus, Trump lost his appeal and must sit for a deposition. But, Turley disagrees with something Biden said about the Second Amendment, claiming that “some of us” challenge as untrue. Well, Turley, that doesn’t MAKE it untrue, does it?.

The theme of Turley’s column is that NOTHING can be done to stop deranged losers from obtaining high power weapons. Because any attempt to ban guns like the AR 15 would muddy the Constitution. Besides, mass shootings are really a ‘mental health issue’ that Republicans hope to address with a huge expansion of mental health services. Though don’t expect such an expansion (by Republicans) at any point in this century.
The shooter passed a background check, bought legally at FFL dealer. Has any reporter asked how an umemployed high school dropout could find the money (probably in the thousands) to legally purchase his guns?

There are many opinions as there are people. What has changed in the past fifty to sixty years? I can think of a few. I am sure there are many more.
I grew up in a rural community and attended high school in the mid 1970s. and a good number of farm kids drove to high school in their pickups and displayed their guns in the window rack. We had no shootings and very few hunting accidents.
We didn’t lock our front door and often left the car window open while shopping.
I know we didn’t have video games. They were not around back then. The first ones in the late 1970s were Pong, Asteroids and Space Invaders. I guess Pac-Man was violent. Three quarters of kids now play or have played violent games. Lots of shooting.
We didn’t have the internet and if we watched a PG-13 movie, especially on a military base, an adult had to accompany the child. My cousin and I had to have his dad sit behind us to watch a Bruce Lee film.
We attended church and catechism every week.
We had a healthy respect for police.
We got into deep trouble at home if we got in trouble at school.
We ate at the dinner at the table as a family.
We only had one TV.
We had one phone.
These are just a few things I can think of off the top of my head. My point is this, who is addressing what is going into the minds and hearts of youth? How does one reach this point to commit such an evil thing? Has anyone seen a Hollywood action movie where they don’t shoot at least ten people? John Wick?
We weren’t perfect by any means. Not even close. Bad things happened back then.
There is something much deeper than just a few new laws can mend. Everything should be on the table for an honest debate. The operative word is honest.

I have noted a number of mental health studies showing Americans are more stressed, depressed since the lockdowns.
Lots of us had a similar childhoods in suburbs of major cities. We never locked our back door. We took off on our bikes (no helmets) and played outside until it got dark. No one was on Ritalin or Adderal or antidepressants the way so many kids are today.
Over medicating, needlessly medicating, is a big part of the behavioral issue as well studies showing frequent cannabis use can cause psychosis. All of this contributes to a complex societal problem.
1-Clearly defined procedures for red flag laws as to who can trigger them, time limit on adjudication, clear cut process for returning firearms if adjudication clears the individual,
2-raise the age for autoloader rifles and handguns to 21 unless an individual is in the military.
3-consider bolt action firearms with max caliber of 22 with no magnum varieties ammunition for those 18-21 in age (not military)
4-open juvenile records to the firearms database. People don’t turn 18 and just suddenly appear as a serial killer. Already there are many reported stories of the Uvalde shooter showing some aberrant and violent behavior.
5-more support for school protection and limited access to schools
6-restrict district attorneys ability to drop weapons charges, in negotiation

On guns, a perhaps helpful change might be to increase to 21 the age at which gun purchases and ownership are permitted. Young men of today appear to be at risk of doing significant harm with their guns, Even in Texas, you have to be 21 to buy a handgun; raising the long gun age from 18 to 21 would not be a radical change and might do something to reduce risks.
Then raise the service age and the legal adult and voting age as well. No double and triple standards.
The ‘service age’ puts young men age 18 under the management and control of Military Officers and NCOs, their movements very regimented and regulated. School and mass shootings haven’t been associated with 18 year olds in Basic Training on a US Military Base leaving the base with weapons (they’re not allowed to subject to severe penalties) and shooting up citizenry at random. One is continually pressed by this President to decide whether he is just not smart or if there is some sort of plan. Although I did not vote for him, I tried hard to see his point of view because he is, after all, our only President. I’ve used up all of my understanding. Whether he is simply dumb or evil, he is not good for the USA. I like the idea of the Congress changing hands but I have serious doubts that any good will come of that. The GOP may investigate with a vengance but that won’t give it anything to run on in 2024. I remember the 1948 Presidential campaign when Harry Truman ran on the singular idea of the “do-nothing (GOP) Congress.” That produced four more years of Harry.
Many posters suggest all schools should have a single entry point. The problem with that is many of the shooters are students. You then have to search every person entering the school? Add a metal detector? Include preschool, private schools, after school education? What about churches, after school sporting events, the list goes on. Unfortunately, there are mentally deranged people in society and they will find a way to cause destruction if so inclined.
