For weeks, critics of the J6 Committee have noted that the committee members promised to present compelling evidence to support criminal charges, but it has not yet presented that case after nine hearings. Even some Democratic figures, including former prosecutor and former Sen. Heidi Heitkamp (D-N.D.), do not believe a strong case has been made for an indictment. Now, Vice Chair Liz Cheney (R-WY) is making the same claim that there is “much more” undisclosed evidence but says that the Committee will not release the evidence (including possible criminal referrals) until the Fall — just before the midterm elections.
At the start of the hearings, committee members promised they had the long-sought smoking-gun evidence — new material that would close the circle on Trump. Committee member Rep. Adam Schiff (D-Calif.) indicated he thought there was now “credible evidence” to support a variety of criminal charges. His colleague, Rep. Jamie Raskin (D-Md.), said the committee would show that Trump organized a “coup” on Jan. 6, 2021.
No sooner had the hearings begun when many in the media declared that the criminal case had been conclusively proven — even though most of what was being presented was already generally known.
Looking objectively at the evidence, the committee never supplied “credible” proof of crimes. That is not to say the evidence is not shocking. Indeed, it is like a series of “jump scares” involving Trump and others raising unfounded or unconstitutional courses of conduct.
Now, on CNN’s “Anderson Cooper 360” Cheney said
“The committee has been, I think, very thorough and laying out much of what we know. There’s much more that we have not yet shared in hearings, and we anticipate we will share in the fall. We will also make decisions about criminal referrals, and ultimately the decision about prosecutions is up to the Justice Department, but I would anticipate the committee will have an opinion on that.”
CNN Chief national affairs analyst Kasie Hunt did not ask about why the Congress would wait to disclose the information. Instead, she responded “You obviously have a lot more information than the general public does in your head about what happened that day. But when you started these hearings earlier this year, did you have any idea how much you would know by this point?” Spoiler alert: Cheney said no.
In reality, some of us have written that the J6 Committee has released a great deal of new details and accounts, but that information has largely amplified known allegations rather than add new material evidence in a criminal case against Trump.
The obvious unasked question would raise the fact that the delay of any new releases would coincide with the midterm elections. Cheney has been criticized by critics for participating in a one-sided series of hearings devoid of alternative or dissenting views. Some have called it a “show trial” with members reading off teleprompters in tightly scripted and controlled hearings. As if to fulfill that show trial portrayal, Cheney ended the last hearing by calling for more officials to come forward and noting that Trump family members and former officials have now come forward with their own public “confessions.”
At the same time, Cheney and the Committee Chair have repeatedly stressed that voters cannot allow Trump to return to power and made repeated references to the upcoming election. The lack of any balance in the scope of examinations or presentation of evidence only magnifies the appearance of an investigation tailored to political rather than investigative priorities.
So now Cheney is saying “stay tuned” once again like a sequel that never quite ends. Of course, the members know that their control will end if the midterms result (as expected) in the GOP retaking the House. The Republicans have stated an intention to conduct their own investigation into why the House was unprepared for the riot despite warnings of possible violence.
The Jan. 6 committee has made a case against Trump personally and politically. It has not done so criminally. Timing further releases to coincide with the election will do little in establishing an interest in building a criminal rather than a political case.
Liz will submit some kind of credible evidence just before midterms that is if Adam can make some up just in time.
Turley is right!!! He may have moved the bar, but he’s right. The J6 Committee may have yet to prove specific crimes against Trump (emphasize the yet), but they have proven lots of crimes against the underlings and that Trump knew and participated in their direction. They haven’t been able to compel testimony from some of the participants but the Justice Department, which has finally been shamed into getting off its horse, won’t have those issues. I personally would like to see Meadows, McCarthy, Flynn, and Guiliani on the stand but that’s just me.
Is it a show trial? Yes, in many ways, but only because the Republicans, in a show of their own that backfired, chose not to participate if they couldn’t include Jordan (a witness and participant and Banks, whose only purpose would have been to gum up the works.
Turley pretends this is a rehash of old information with nothing new. He’s rehearsing here for what he’ll say on Fox News to placate the base. The Trump’s (including Donald) are testifying in New York about their civil fraud there. Georgia is closing in on his attempts to tamper with their election, and the Justice Department is calling in Pat Cipollone and top Trump cronies. Eastman is whining, Bannon is guilty, and as a side bonus, Alex Jones is bankrupt and out of millions for his lies. What Turley assures you of is basically nothing to see here.
I wish someone for once would characterize the “evidence” of alleged crimes by citing their elements and showing how the perpetrator completed the actions knowingly and intentionally to violate the law. Saying something is so has no meaning. Proving something is so does have meaning. All the rest is foderol, made not to convice the reader but, instead, to bolster the unlikely aspirations of the writer.

What the J6 committee shows and what so much of the other activities of the Democrats show is that never before has a former president so intensly dominated the agenda of the opposing party in office. Recently, when Biden announced he had Covid (ist time), he had to crack that his predecessor was helicoptered to Walter Reed (I guess to inform us that he, Biden, instead, went to his room and watched TV). We have members of the press and congress speculating about an indictment of Trump without any proof or credible evidence that a crime occurred. Fortunately, the people see through this and are reminded of the calumny of the anti-Trumpsters whenever they fill up the family car, buy groceries at the supermarket or look for formula to feed their babies. This is what it’s all about, not that sily stuff of who said what to whom and when and why. The Balkanization of the Democrat Party is an unfortunate and dangerous thing to watch. This country needs two great parties to maintain an even keel in the ship of state. Right now it has only one as the other breaks up into civil war between progressives and what’s left of the “moderates.”
Possibly the best move right now, would be to invoke the 14th Amendment’s “Disqualification Clause” in Section 3. Reading the actual text, there appears to be a 2 part process:
By reading the actual clause, in part 1 of the process, it appears that Congress could invoke this clause with a simple 51% majority vote -or- that a citizen-plaintiff (ie: Capitol police officer on January 6 or any person harmed) could cite “14th Amendment injury” in a constitutional lawsuit with an ACLU type attorney. In constitutional lawsuits “injury” can also mean “violation” (ie: 1st Amendment injury, 2nd Amendment gun rights injury, 14th Amendment injury, etc). A Capitol police officer harmed has legitimate legal standing in court. Constitutional cases have a lower burden of proof and routinely use new precedents all of the time (ie: gain women’s voting rights, etc).
In part 2 of the process, it grants exclusive authority to Congress to forgive (or not) anyone previously disqualified with 2/3 of both houses of Congress.
This clause disqualifies anyone giving aid & comfort to the January 6 insurrectionists from ever holding governing authority ever again. Seems like it could be used against any government official from Arizona officials to Trump – they would basically be illegal candidates not eligible to run for office ever again.
Since the clause requires that an official has previously taken a constitutional Oath of Office and betrayed then their oath, it seems clear that “enemies of the U.S. Constitution” are clearly governed by this clause. It’s also clear that anyone without any remorse would never be forgiven by Congress.
Invoking the Disqualification Clause today wouldn’t prevent future civil and criminal suits.

Nothing says a search for truth like the strategic timing of accusations to coincide with a political event.
She’s sounding a lot of Adam Schiff and all that “Russian Collusion” evidence he claimed to have in his possession and the hearings are being run the same as Schiff’s on Russia with only harmful details to Trump being leaked or shown and anything that does not fit the narrative held back.
For Democrats, Cheney is a useful idiot who seems determined to help them avoid much-deserved electoral disaster in November. What’s more, her antics on the J6 committee ensure that she will be gone when the people of Wyoming vote this fall. It will be their verdict on her performance in the Democrat made-for-tv show trial. She effectively crossed the floor and sits as a Democrat now, so it’s time for a Republican to represent that state again.

No, the new information has largely corroborated known allegations. The J6 committee has provided a clearer picture of what was transpiring behind the Jan 6 insurrection and the attempted overturn of a valid election.
There’s a new matter of Alex Jones phone and it’s contents. He is well known to have extensive contacts with the proud boys and the oath keepers and Roger stone. After Jones got caught perjuring himself in court thanks to his incompetent lawyers there may be far more damaging information.
Then there’s the grand jury subpoena for Pat cipallone.
Just because there hasn’t been a lot information pointing to criminal conduct doesn’t mean they already have it. Trump’s lawyers are already preparing for criminal charges.

The DOJ determines criminality. The committee just gathers information to pass on to the DOJ. We don’t know what else has the committee passed on to the DOJ that the public doesn’t know.
