Stay Tuned: Cheney Declares J6 Holding “Much More” Evidence of Possible Crimes

For weeks, critics of the J6 Committee have noted that the committee members promised to present compelling evidence to support criminal charges, but it has not yet presented that case after nine hearings. Even some Democratic figures, including former prosecutor and former Sen. Heidi Heitkamp (D-N.D.), do not believe a strong case has been made for an indictment.  Now, Vice Chair Liz Cheney (R-WY) is making the same claim that there is “much more” undisclosed evidence but says that the Committee will not release the evidence (including possible criminal referrals) until the Fall — just before the midterm elections.

At the start of the hearings, committee members promised they had the long-sought smoking-gun evidence — new material that would close the circle on Trump. Committee member Rep. Adam Schiff (D-Calif.) indicated he thought there was now “credible evidence” to support a variety of criminal charges. His colleague, Rep. Jamie Raskin (D-Md.), said the committee would show that Trump organized a “coup” on Jan. 6, 2021.

No sooner had the hearings begun when many in the media declared that the criminal case had been conclusively proven — even though most of what was being presented was already generally known.

Looking objectively at the evidence, the committee never supplied “credible” proof of crimes. That is not to say the evidence is not shocking. Indeed, it is like a series of “jump scares” involving Trump and others raising unfounded or unconstitutional courses of conduct.

Now, on CNN’s “Anderson Cooper 360” Cheney said

“The committee has been, I think, very thorough and laying out much of what we know. There’s much more that we have not yet shared in hearings, and we anticipate we will share in the fall. We will also make decisions about criminal referrals, and ultimately the decision about prosecutions is up to the Justice Department, but I would anticipate the committee will have an opinion on that.”

CNN Chief national affairs analyst Kasie Hunt did not ask about why the Congress would wait to disclose the information. Instead, she responded “You obviously have a lot more information than the general public does in your head about what happened that day. But when you started these hearings earlier this year, did you have any idea how much you would know by this point?” Spoiler alert: Cheney said no.

In reality, some of us have written that the J6 Committee has released a great deal of new details and accounts, but that information has largely amplified known allegations rather than add new material evidence in a criminal case against Trump.

The obvious unasked question would raise the fact that the delay of any new releases would coincide with the midterm elections. Cheney has been criticized by critics for participating in a one-sided series of hearings devoid of alternative or dissenting views. Some have called it a “show trial” with members reading off teleprompters in tightly scripted and controlled hearings. As if to fulfill that show trial portrayal, Cheney ended the last hearing by calling for more officials to come forward and noting that Trump family members and former officials have now come forward with their own public “confessions.”

At the same time, Cheney and the Committee Chair have repeatedly stressed that voters cannot allow Trump to return to power and made repeated references to the upcoming election. The lack of any balance in the scope of examinations or presentation of evidence only magnifies the appearance of an investigation tailored to political rather than investigative priorities.

So now Cheney is saying “stay tuned” once again like a sequel that never quite ends. Of course, the members know that their control will end if the midterms result (as expected) in the GOP retaking the House. The Republicans have stated an intention to conduct their own investigation into why the House was unprepared for the riot despite warnings of possible violence.

The Jan. 6 committee has made a case against Trump personally and politically. It has not done so criminally. Timing further releases to coincide with the election will do little in establishing an interest in building a criminal rather than a political case.

Absurd! If the Democrats, and especially the NeverTrump RINOs, knew the level of contempt and repugnance so many Americans feel towards them, they would seek refuge in China. The anger is real, and bringing former VP Cheney, an architect of the Patriot Act, the never-ending War of Terror, the failed invasion of Iraq, and the WMD hoax, adds fuel to the fire.

Were any lawyers for Communists subpoenaed by grand juries during the McCarthy-HUAC Red Scare Era when the US was actually at war with Communists in Korea? I can guarantee it never happened to the lawyers for the Chicago Seven.

      Garland isn’t going to indict Trump unless he has a strong case. Learn to be more patient.

The possibility arises that if the J6 committee waits till just before the election to drop it’s “bombshell” or the Justice Dept does the same, it is entirely possible that this will piss off most Trump supporters and could drive voting even more. Especially if the “bombshell” comes through with a whimper. Trump is not running for anything. What the democrats and the mainstream media do not realize is that Trump, in 2016, listened to the discontent and rode it the White House. He also had lower chances of winning the election than many of the other Republicans except for Jeb Bush. He did not make this change but rode the Wave. Ron Desantis and other Republicans of a similar view wait in the wings and came step easily into the role no matter what happens to Trump. I think that people like Desantis, Nikki Haley, Kristi Noem, Mike Pompeo and others will present an existential threat to the Democratic plans and none carry the baggage of Trump. Taking out Trump only releases others who can use his format yet get better results and are less likely to self destruct like Trump. Be careful what you wish for because you may get it and the unintended and unforeseen consequences.

  10. Most of the witnesses against Trump were the most loyal Trump Republicans – very few Democrats! Today’s GOP would likely kick out Lincoln, Eisenhower and even Ronald Reagan. Reagan would wouldn’t be extreme enough to survive in today’s Republican Party. We have real conservatives like George Will repulsed by the devolution of today’s Republican Party.

    These were Trump cabinet officials that loved Trump but then considered invoking the 25th Amendment when Trump betrayed his constitutional Oath of Office.

  13. The DOJ has subpoenaed Pat Cipollone to testify before a grand jury focused on its January 6 investigation. We only know this because Cipollone’s lawyers chose to make it public — the DOJ itself does not announce the names of its grand jury witnesses.

    As Cheney said, “ultimately the decision about prosecutions is up to the Justice Department.” I care what information is shared in the J6 Committee hearings, which already make clear that Trump was derelict in responding to the Capitol riot, but I don’t really care whether the J6 Committee makes a criminal case, because that responsibility is the DOJ’s.

Watching or reading Trump’s Ellipse speech, which is plainly self-incriminating about the plan to interfere with the EC vote count — boldly stating both motive (“and I’ll be President”) and means (“if Mike Pence does the right thing”), and tagging his two co-conspirators Giuliani and Eastman. That’s a slam dunk for conspiracy to impede an official proceeding of Congress. The name “Stop the Steal” given to the rally is an implicit admission of intent to impede the peaceful transfer of Presidential power.

    But, what could this undisclosed evidence point to? A group was meeting at the Willard Hotel right up to the night of Jan 5th. This group was presumably led by Steve Bannon. If there was planning with militant groups to seize the EC ballot boxes and remove them from the House Chamber, then this widens the conspiracy and aggravates the brazenness of stopping Congress from performing its duty under the Constitution.

    If an attempt to hold onto the Presidency after electoral defeat is not somehow a serious crime, then what is our form of government except a game favoring the unsavory, dirty-dealing power-monger?

    1. This is badly informed. The election is not over until Congress certifies the electors. The Vice President/President of the Senate is critical to the process. He can send back the electors and initiate an investigation if he so chooses. That is what Trump was asking for. He’s entitled to believe an investigation could prove him right and he’s well within his rights to request one. The notion that Trump ordered Pence to declare him the winner, and when he didn’t Trump set out to kill him is propaganda that only works on badly informed people.

        No, he can’t do that. Pence had no constitutional authority to “send back the electors”. All Pence is required to do is count the votes and certify the winner. He has no other duty besides that. That’s why Pence wouldn’t do what Trump wanted, because it’s illegal and unconstitutional.

        The plot entailed pressuring Pence to reject (or send back) enough EC votes to bring Biden’s total under the 270 required for a win. You think it’s a matter of opinion whether the Presiding Officer of the Joint Session has such power, but Eastman admitted to the other WH lawyers around Jan 4th that such an expansive interpretation of his role (enough power to overturn the voters in the states) would lose 0-9 under Supreme Court review.

        Then, based on nobody getting 270 EC votes by 1:00 pm on Jan 6th, per the Constitution, the election would be resolved in the House of Representatives, each state delegation casting 1 vote. That would guarantee Trump a “Constitutional” win 26-24.

        The political crime was fabricating and amplifying a misinformation campaign about having “won by a landslide” — basically refusing to accept electoral defeat. This is an unparalleled affront to state-by-state elections and the EC being the way we chose a President. It is an attempted nullification of democracy.

        If there is no crime or punishment for such brazen power-mongering, then it will be tried again and again until successful.
        And that risks a Civil War, which only simple-minded fantasizers think ends well and clean. Total dominance/submission of political opponents is the stuff of petty autocrats, of which we seem to have too many in our country at this juncture — on both sides.

          Thank you. That tells me the technical process that would be required. It’s not unlike Schiff’s parody of the Trump’s Zelensky phone call. Democrats have conjured up a Trump master criminal plan to overthrow the government, but they have provided no evidence to suggest how such a plot was even feasible. I have no doubt Trump wanted a new (favorable) slate of electors. Hell, I wanted a new slate. But believing rioters at the capitol were going to prevent the transfer of power is not even a B movie storyline that would sell.

            The fact they resumed the session and proceeded with the certification of the election a few hours later, tells me exactly how little of a threat the mob was.
            However, the committee has to push that narrative as if it was some truly awesome threat to democracy, and they have the bombshell evidence to prove Trump was the mastermind behind it all.
            And yet all we have are duds.
            Pop-culture reference, reports have it the new Bat Girl movie, despite being completed, after pre-screening reviews were so bad, the studio decided to cancel the release of this $70m . . . “dud.”
            Perhaps the Jan5 committee should follow suit in their own “dud.”
