Five Lingering Questions In the Wake of the Mar-a-Lago Raid

Former President Donald Trump has waived any objections to the release of the warrant and property receipt after the filing of a motion by the Justice Department. The motion, however, did not seek the release of the most important document in this controversy: the supporting FBI affidavit. That is the document that would reveal what the FBI told the magistrate about the prior communications with the Trump team and the specific allegations of the status of the documents in question.

There are reports that the documents involved material of the highest possible classification dealing with nuclear weapons. There is no question that the former President has no authority to retain classified material and that the government has a legitimate right to retrieve such material.

We should see the warrant and property list relatively soon in light of the DOJ motion and the Trump waiver. My greatest interest is the specificity of the information. Here are a few questions as we wait for the warrant and list:

  1. Attorney General Merrick Garland said that the DOJ would have used other less intrusive means if they were possible. Yet, it would seem that such options were not just possible but obvious, including the use of a second subpoena. Moreover, even if a raid was necessary, it is not clear why the DOJ would descend upon Mar-a-Lago with such a massive show of force rather than send a few agents over with the warrant.
  2. If the FBI believed that there was nuclear-related information in the resort, it certainly did not seem to move with dispatch. The last communication, according to the Trump team, was in June. Even after securing a warrant, there was reportedly a delay in executing the warrant. Why?
  3. If the FBI suspected that high-level material was retained at the resort, did they identify the material to the Trump team and demand its return? It is hard to imagine the Trump Team telling the FBI to pound sand if such a demand was made. Yet, such a denial would readily support a showing of probable cause. Moreover, adding a lock to the door of a storage room would not be viewed as sufficient for material at the apex of classification levels.
  4. Did the warrant specifically identify the material or the classification level? If the warrant sought the recovery of any possible classified evidence, it would again raise what was stated in the affidavit and the reason why such material was not acquired in the June subpoena despite the reported cooperation of the Trump team.
  5. There remains the role of the confidential informant and what the person shared with the DOJ. Was there evidence of active concealment of the material or merely a statement of additional documents being stored at the resort?

It is highly unlikely that all of this information will be contained in just the warrant and the list. Given the growing controversy over the necessity of the raid, this is one circumstance where the release of the affidavit is warranted. Rather than allow such questions to fester and grow, early and total transparency would seem in the public interest.

      It’s not a crime to release the copy of the warrant Trump got. He was perfectly capable of releasing it anytime. It was under seal to media and others who did NOT have a copy. Trump did.

    1. The FBI had informants in that group in Michigan, that talked about kidnapping the governor…The group was led by an FBI agent, but still the FBI was paying wild sums to the informants.

      1. No what is correct is there were a few non-FBI agents that were invited into what was essentially a Fake FBI militia group, that was pretty much run by the FBI.

  6. A “Warrant” without its Annex would seem to be about as informative as a cover letter without an appended contract. As a result, perhaps there are many more than the five questions posed, such as: should Trump not heave the gauntlet back by demanding that the complete document be released as well as the inventory of property; why doesn’t the subject of the warrant have a right to observe the process to insure both the nothing is taken but not inventoried, and nothing is left that was not there before the raid; how far can the scope of a search be expanded beyond the scope of the Affidavit before it becomes intrusive and plain illegal; and absent criminal activity, are there any bounds beyond which the treatment can descend, e.g., handcuffs, leg irons, orange suit, etc.? Without all of the relevant details being made available, one is left to pick away at the matter until frustration sets in.

  7. I’m focusing on #5: “There remains the role of the confidential informant and what the person shared with the DOJ”. Who is the snitch?

    At the top of this list is Trump’s son-in-law Jared Jushner.

    Trump’s troubles began with the military men in his administration whom he once referred to as “my generals.”

    At one point, Trump complained to his chief of staff, John F. Kelly, a former Marine general, asking why he and others couldn’t be “totally loyal” to him, like the “German generals in World War II.”

    “You do know that they tried to kill Hitler three times and almost pulled it off?” Kelly allegedly responded.

    So were Adolf Hitler’s generals yes men? Or did they really plot to assassinate him three times and get close once?

      We have people in govenrment, documents from government, people from MAL who have spoken of facts.
      Without putting them under oath that is the best evidence we have.

          It is unfortunately higher credibility because the FBI has been doing a fair amount of that as of late.
          AND because the agent heading the DC office that is running this Trump case is the same agent that was Running the office that engaged in entrappment in the Gretchen Whitmer kidnapping case.

          A random claim that evidence was planted has very little credibility.

          A claim that the FBI – with a reputation for planting evidence did so – is slightly more credible.
          A claim that the FBI office run by the same agent who ran a massive illegal entrappment scheme within the past two years panted evidence – is stronger still.

          It is not proof, it is not even close to proof, but it is a strong reason to be suspicious.

          If WaPo had a track recod of accuracy over the past decade of stories from anonymous sources,
          If they had properly done their job as journalists and vetted the anonymous source information.
          If they had done their jobs as journalists and ceased accepting information from sources that demanded anonimity that had lied to them in the past.

          Then an anonymous source story in WaPo would be more credible.
          But none of that is true.

          And why are these things that need to be explained to you ?

          God gave you a brain. Give it some exercise.
          It is possible to get better at critical thinking with practice.

          Neither is credible at this time.

          A named source, or a copy of the afadavit, or a detailed list of the documents taken (which we are not getting) might change that.
          Just as the CCTV video from MAL or other information might change the weight I give to clkaims that the FBI planted evidence.

  8. Turley is a lawyer. He knows perfectly well that the FBI cannot by law release the affidavit. It’s not legally possible for them to do so.

    The “excessive” presence of the FBI would be necessary if classified nuclear weapons material was involved. If the White House did in fact notice such information missing they could have had an “informant” who may, and I emphasize may, have been an Department of energy agent sent there to confirm that indeed such documents were there. That’s just pure speculation on my part.

    Now Turley still neglected to mention that Trump was capable of releasing HIS copy of the warrant and receipt any time. But he continued to refuse. Most likely so he could take advantage of the situation and cry victim.

    Either way Trump is still in serious trouble if it turns out that highly classified nuclear weapons information was in his possession. The question will be, why? Things like that aren’t just “misplaced”.

      That is correct – They are tracked. Every classified nuclear document has a special binder on it of a unique color and a special batch number on the outside and everywhere it goes it must be signed in and out. So the government has complete records of where it is at at all times. The ONLY scenario you have that has the slightest chance of getting Trump in actual trouble is that the last recorded location for the document was the oval office on J19, 2021. And even then you will have to contend with the Constitutional argument that if Trump left with it under his arm – it is declassified.

      In your mythical nuclear scenario – which has a snowballs chance of being true, but humoring you, the most likely way such a document gets to MAL is if it was in Some Trump WH staffers desk on J19 and GSA inadvertently transfered it to MAL.
      Or alternately it was actually at MAL on J19, and no one ever came to retrieve it.

      MY point – which is obvious to people with noraml IQ’s but somehow opaque to you, is that there are very few ways for any STILL classified document to get at MAL – and the only one that is a problem for Trump is if he went to the WH – or somewhere else AFTER he was president and stole it.

      It is highly unlikely that Trump even legitimately personally removed a nuclear document from the WH.
      Classified material is normally transfered by FSO’s especially highly classified material.
      Remember that part about Colored jackets and specail batch numbers and signing it in and out – that is not done by consumers of classified materials – like the President. It is done by those whose job is to manage, track, secure classified materials.

      FSO stands for Fascility Security Officer – and my guess is the WH has a whole army of them.
      When I have my TS/SCI clearance I was at a defense contractor with a staff of 55 and we had our own SCIF and FSO, There are thousands of people who work at the WH – there are likely dozens of FSO’s.

      So in your impossible hypothetical there MUST be an FSO that lost track of this nuclear material.

      Returning to reality – the most likely scenario is that this is Trump’s personal copy of the Material Trump declassified regarding XFH.

      And DOJ is going to try to claim that Trump did not declassified it, he just issued an Executive order to declassify it, and it is still classified unto the Biden admin completes that process – which they are never going to do.

  9. The public perception is, “The Boy Who Cried Wolf.” If there is not compelling and earth shattering findings, then the reputation of the DOJ and FBI will be permanently and irreparably marred. Then there would be cause for the citizens of this country to be concerned about who is next.

    How many tax payer dollars have been spent so far investigating and trying the former President of the United States? A billion dollars? More? Who will be held accountable for the misuse of hard earned tax dollars?

    I know that the rank and file officers and FBI agents are professionals with integrity. It only takes a few bad apples to spoil the barrel.

    If they are going to break precedent then they should have dotted every I and crossed every T and chosen judges and officers with unimpeachable credibility and with absolutely conflicts of interest.

    They have not handled this huge story very well.

    Here is a suggestion. Perhaps the DOJ could concentrate more effort on convicting drug dealers, gang related gun crimes, rampant theft, human traffickers and the criminals running freely through our streets and across our southern border.

  11. With all the classified information every President has seen, it seems a bit ridiculous to raid his home over documents he may or may not have in his possession. Unless they ever intend to bleachbit his brain, this does not seem to have been necessary.

    Since the DOJ/FBI is in Trump’s future America First action plan, what a great way for them to gather intelligence on his strategy.

      Much of it sounds highly questionable as to why the government would want it.

      Purportedly there were 11 classified documents – which is a tiny fraction of what Clinton had. 4 classified TS – I beleive Clinton had over 300TS. and purportedly 1 TS/SCI Clinton had several TS Code Word only – which is even higher.

      That is according to press leaks.

      I have not heard this directly but some of the press has reported that these are all documents that Trump declassified as president.

      Which likely means these are the Russia Collusion documents that Trump declassified.
      If that is the case this flips the narative – Why was anything associated with the collusion delusion EVER classified TS or TS/SCI.
      As the press keeps blurting – that is supposed to be the near highest level of classification of national security information.

      It is starting to sound as if the entire purpose of this was to keep Trump from releasing the documents he ordered declassified.

      Some of this is speculation – though it is likely we will find out soon enough.

Trump could release the subpoenas and the warrant related to this controversy if he wants them made public but he didn’t. He snubbed the subpoena issued months ago.         A reasonable person would conclude that an even application of the law would apply to former President Trump in the exact same way it was applied to former SoS Clinton. Disparate treatment on the other hand would prove the claim this is purely a political attack on Trump and that Garland and his DOJ have released unreasonable prosecutors towards their political ends.
