“Kidnapping is a Thing”: MSNBC Continues False Claim that DeSantis is Kidnapping Migrants

I have been writing about the claim of Hillary Clinton and others that the transportation of migrants to places like Martha’s Vineyard is “literally human trafficking” and other crimes. Despite the utter lack of legal basis for these allegations, major media has continued to air such claims. This weekend, MSNBC’s Tiffany Cross and MSNBC regular (and past writer for Above the Law and the Nation) Elie Mystal repeated the false claim that the trips constitute kidnapping.Mystal responded to Cross’ claim that the trip constitute “kidnapping” with a diatribe against “Republican fascists.” He then added

“What I believe is happening here is kidnapping…kidnapping is a thing. Kidnapping by trick is a thing. Telling people that you are going to take them one place and sending them someplace else is a form of kidnapping.”

Indeed, kidnapping “is a thing,” just not this thing.

As noted in a column this weekend, this claim was also made by Gov. Gavin Newsom.  It is legally absurd. Kidnapping requires that the culprit “unlawfully seizes, confines, inveigles, decoys, kidnaps, abducts, or carries away and holds for ransom or reward or otherwise any person.” There is nothing unlawful in conveying individuals who are lawfully in the country pending their immigration hearings; the trips are voluntary, and most migrants appear eager to accept free passage to cities like New York or Chicago.

Mystal also analogized the migrants to teenagers: “Imagine Ron DeSantis goes up to a group of white teenagers, offers them some candy and says, ‘Hey, I’m gonna take you to Disney World if you get in my van.’ And then Ron DeSantis drives them to Bush Gardens.”  Such analogies are insulting to adults who elect to accept free transport to cities like Chicago or New York. These are vulnerable individuals but these trips are only being offered to adults to decide if they want to take advantage of the free transportation.

It is reminiscent of the recently deleted tweet by NBC analogizing migrants to “trash.” The trash analogy seems far worse but the suggestion that these migrants are like minors or teens being lured by candy is pretty insulting. These are adults who are clearly in desperate situations but they are not like children or teenagers unable to decide whether to remain near the border or accept a flight to another city.  Would Mystal make the same claim of being “lured” to the country to cross illegally? While there have been alleged misrepresentations, those allegations have not been proven and there has not been evidence of any systemic misrepresentations. Thus far, these transfers appear consensual, including signed or express acceptance of the free transportation. There are rational reasons why migrants would prefer to go to cities like New York rather than remain along the border given the huge influx of migrations.

Mystal has previously caused uproars for controversial claims from accusing a senator of wanting to murder Justice Ketanji Brown Jackson to his continued attacks on a high school student even after he was cleared of a false race-based story. He has called the Constitution “trash” and previously stated that white, non-college-educated voters supported Republicans because they care about “using their guns on Black people and getting away with it.” He has also lashed out at “white society” and explained how he strived to maintain a “whiteness free” life in the pandemic. He also called all Republicans “white supremacists.”

However, it is the misrepresentation of the criminal law that is most concerning.  There are good-faith reasons to oppose these trips as a political stunt. That does not make them federal crimes.  The effort to bend and twist the criminal code for such political purposes is a dangerous trend. You can denounce these transfers without trying to criminalize such policies.

In legal analysis, accuracy is also “a thing.” We do not always get it right but it requires a modicum of objectivity. It is not that our personal views are not expressed in what we wish might happen. However, calling these trips “kidnapping” is to take a flight from one’s legal senses.

The compassionate Governor of Massachusetts and liberals of Martha’s Vineyard have now shown governors and burghers throughout the U.S. the most humane way to bestow kindness and tender loving care on all the migrants the Biden administration is quietly airlifting to towns all across the U.S.: Have the National Guard round them up and gently persuade them to live on U.S. military bases until their cases can be heard in court and a decision made on their asylum claims.
    It is so much more humanitarian than the previous administrations Remain-in-Mexico cruelty!
    Much easier to distribute the free iPhones and debit cards too.

We’ve gone from enforcing the Remain in Mexico immigration policy, to not just a remain in the United States immigration policy, but how American taxpayers should accommodate the travel desires of these illegal immigrants.

    What’s next? Use eminent domain to raze the suburbs and build multi-family housing for these people?

    1. First of all, no one is “illegal.” Second, these people had completed a significant part of the asylum process such that they were released into this country by DHS.

  5. I’m surprised by the comments of Concerned Citizen and Anonymous (the “holy” one). Why aren’t they celebrating the vacation awarded to the illegal aliens by Governor DeSantis? Every single illegal alien was delighted to be in the prestigious, luxurious, and sumptuous Martha’s Vineyard. I would think that they would be urging the fine residents of Martha’s Vineyard to build the illegal aliens free housing and to give them free food, free medical care, free education, and free transportation.

    But rather than do those things, Concerned Citizen and Anonymous (the “hold” one) were happy to see the illegal aliens kicked out of Martha’s Vineyard. And then they want to imprison Governor DeSantis for giving Martha’s Vineyard’s residents the blessed gift of illegal aliens. If I did not know any better, I’d say that Concerned Citizen and Anonymous (the “holy” one) are elitist, racist, hateful, and hypocritical scoundrels, instead of the warm, loving, compassionate, and humanitarian people that they have claimed to be at every opportunity.

Jonathan: You say what Govs Abbott and DeSantis did was not “kidnapping” but just offering “free transportation to cities like Chicago and New York” and “these transfers appear consensual, including signed or express acceptance of the free transportation” and only “adults” were involved. There are several problems with your analysis.

    First, there were children among those transported to northern cities. How could a child expressly consent to such transfers? Second, the migrants were deceived and lied to to get them on the busses and planes. They were told they would get their immigration status expedited and jobs when they arrived. And they were even lied to as to where they were going. One group of migrants was told they were going to Boston but they ended up in Martha’s Vineyard. In order to be “consensual” there must be “informed consent”. You should know that. Any waivers signed by the migrants would be void under these circumstances. Migrants were also given the wrong agency to change their addresses–probably to ensure the migrants were removed when they failed to change their addresses with the proper agency. Third, you cite a definition of “kidnapping” but don’t cite your source. There may be other statues involved relating to transporting asylum seekers across state lines using fraud and deceit. It’s too early to tell what ligation may be pursued.

    Finally, you lightly dismiss what was was a cynical political stunt and using migrants as a pawn by Abbott and DeSantis. Using other innocent human beings seeking asylum for such purposes is the part you missed and that’s the despicable part!

The term eludes me at the moment, for this type of racism.   15. I would be happy to keep the migrants on Martha’s Vineyard and expropriate the mansions for emergency housing since the summer population has likely left. I would also love to send the summer population of Martha’s Vineyard to northern Mexico with only the clothes on their backs and with no access to their assets which also have been seized to pay for the mass migration. After all they should be willing to pay the ultimate sacrifice (financially) to support their sanctuary state. I thought that was what liberalism was all about. I would bet the migrants are far less insufferable than the usual Vineyard inhabitants.

No legislation to affect classification or declassification of material of the executive branch is constitutional. The legislative branch has no power to usurp the power of the executive branch. Power of the executive branch may be transferred to the legislative branch solely through amendment. The legislative branch may attempt to impeach a sitting president for “…Treason, Bribery, or other high Crimes and Misdemeanors.” Eccentric ideations do not bear.

      They were as free at the end as at the start if not more so.
      Further those at the end were not in a joint criminal venture with those at the start.

      DeSantis did not go to venezeula to pick these people up from kidnappers, he did not transport them to Martha’s Vineyard to be held by Brothel owners. They came to the US freely, they traveled freely, and they were free when they arrived in Martha’s vineyard. DeSantis did not sell them or receive anything from Martha’s Vineyard in return for providing them.
      Indeed MV did not want them.

      Greyhound and Delta are not guilty of human trafficing, Neither is DeSantis.

How would we know whether a Venezuelan birth certificate was forged, or whether someone is using another’s identification? What, exactly, do you expect our government to do? Those seeking asylum are having a legal case number assigned and will have a trial to determine whether they are entitled to asylum under US law. What else would you expect Joe Biden or his administration do? How do you stop people from coming here?         I stand to my assumption: During President Biden’s tenure 4.9 million people, the equivalent of the entire population of Ireland, improper entering.US:”

        !. All persons arriving at a port-of-entry to the US are subject to inspection by U.S. Customs and Border Protection (CBP) officers.
        2.All persons who don’t use a port-of-enty to the US (eg sneaking accross the border) or entering through immigration inspection under false pretenses are violating federal immigration laws as they entered US unlawfully.
        3. Improper entering the US is a federal misdemeanor and is punishable by law.
        4. According to 8 U.S. Code § 1325 he punishment for improper entering the U.S. as a first-time offender is either a fine from between $50 up to $250 or a prison sentence of up to 6 months. Repeat offenders are likely to be fined twice as much as the first attempt and may face a new prision sentence of up to 2 years.
        5.President Trump established a zero-tolerance for ilmproper entering US. President Biden’ DoJ instructed prosecutors to act on the merits of individual cases.
        6. Within 1 year of last arrival in the US applicants should file Form I-589 with USCIS. Refugee status depends on 101(a)(42) of INA. A decision should be made within 180 days.
        7. In 10/21, President Biden set the annual refugee cap at 125K. According to RPC, in fiscal year ’22 arrived 20K refugees in US.
