“Jim Eagle” Has Landed: A Federal Court Rejects Challenge to Georgia Election Law

Below is my expanded column in Fox.com on the recent decision finding the Georgia election law constitutional. That was the law widely denounced by President Joe Biden and other Democratic leaders as unconstitutional as a “new Jim Crow” law. The media repeated the claim despite some of us noting that the law fit well within existing precedent and even shared conditions with blue states like Delaware. Now that the challenge to election law changes denounced as voter suppression have been entirely rejected, there is little more than a shrug from some of the same figures and outlets.

Here is the column:

“Jim Eagle” has landed… with a thud. President Joe Biden famously (and somewhat bizarrely) used the name “Jim Eagle” to characterize the Georgia election law. Democrats have criticized Georgia rules enacted before and after the 2020 election as voter suppression. The provisions in this lawsuit concerned pre-2020 changes that allegedly made it “harder to register, harder to stay registered and ultimately harder to vote.” Both Stacey Abrams and Joe Biden denounced the Georgia laws in 2020 as voter suppression.

In the meantime, another court refused an injunction sought by the Biden Administration of additional provisions passed after 2020 concerning a ban on political parties supplying water, food, and gifts to people waiting in line to vote. Such injunctions are only secured when there is a substantial likelihood of prevailing on the merits. The provision was emphasized by critics, including President Biden, among the various other changes.

It was not enough to call it “Jim Crow on steroids” and “sick,” President Biden wanted the public to know that the law was flagrantly unconstitutional. Some of us disagreed, but the view that counted was that of U.S. District Judge Steve Jones, an Obama appointee who heard the challenge to the law. This week, Jones found the law to be entirely constitutional.  The case involves a challenge filed four years ago.

After being declared the “new confederacy” and subjected to a costly boycott, Georgians could be forgiven if they view Biden’s claim as more foul and fowl.

Given the exhausting media coverage and condemnations of the law, one would expect the legion of legal experts out in force on a judge upholding the allegedly “modern Jim Crow law.”  Instead, it has been crickets . . . almost as if the earlier coverage was knowingly exaggerated for public consumption.

After the post-2020 changes, Democrats denounced the Georgia election laws as flagrantly unconstitutional and abusive. Georgia Democratic candidate for governor Stacey Abrams tweeted  “It’s Jim Crow in a suit + tie.” Rep. Ro Khanna, D-Calif., called the laws “anti-American, racist, and a betrayal of our Constitution.” Democratic attorney Marc Elias (who allegedly hid the Clinton campaigns funding of the infamous Steele dossier) said in an interview that “democracy was assaulted with a pen” in the Georgia election law. Liberal publications like Vanity Fair called it “a broad, profoundly undemocratic assault on voting rights.”

Now that such claims were actually subjected to judicial review and rejected, there is little discussion of Jim Crow. The group that lost before the district court is closely associated with Abrams, who previously refused to concede the election of Gov. Brian Kemp in the last election.

President Biden once again has moved on. For weeks, Biden denounced Georgia as taking us back to the segregation period and even the Civil War. Yet, the ruling met with a shrug from the White House.

It is a familiar pattern.  The president has often made sweeping legal claims and then refused to address the rejection of those claims.

The Georgia ruling actually came on the anniversary of one of the most reprehensible examples. A year ago, President Biden rushed to condemn border agents falsely accused of whipping migrants from horses along the border. Not waiting for charges, let alone an investigation, Biden declared “It’s outrageous. I promise you, those people will pay.”

The same pattern followed. While some of us noted that there was no evidence to support the claim (and actually the photographer denied the allegation), the media went into the same frenzy. While promising a quick investigation, the Biden administration then slow walked the process and recently cleared the agents of the whipping allegation. They will, of course, still be punished just as the president promised that they would . . . for something.

The one thing that they will not receive is an apology from President Biden. The news cycle is over and they are no longer relevant. It is no longer important or worth mentioning that Biden openly misrepresented the law with a series of false statements. In today’s highly protective media, Biden can just move on without contradiction to his next sensational legal claim.

There is also silence from those who supported the boycott of Georgia over election laws that critics claimed would suppress voter turnout. Major League Baseball pulled the All-Star Game out of Atlanta and may have cost the state as much as $100 million.

The MLB is entirely silent in its decision to punish Georgia before any review of the courts of the pre-2020 or post-2020 changes. While some of us disagreed with Abrams and Biden, the MLB simply punished the whole state.

Georgia has noted that the alleged “voter suppression” under the law turned out to be a voter enhancement. According to the secretary of state’s office, 1.9 million eligible voters participated in the 2022 primary contest compared to 1.2 million in 2018. Moreover, African-American turnout was 22% higher than any other primary election except for the 2020 presidential primary.

Nevertheless, the Justice Department is continuing its own challenge of the post 2020 changes, which is further undermined by the analysis of Judge Jones on the pre 2020 provisions.  The Justice Department is challenging stricter voter ID requirementsdrop box regulations, shorter absentee ballot request deadlines and other provisions. However, it has not challenged similar or even more restrictive provisions in other states like Delaware.

Given the reasoning and precedent in the Jones opinion, such objections seem even less compelling particularly given the record turnout in the last election cycle despite both the pre-2020 and post-2020 changes.

Much like the border agent controversy at Homeland Security, the Justice Department seems driven to prove the president right. However, thus far, no one can get the “Jim Eagle” claim off the ground in challenging the Georgia election law.

Judge Jones wrote: “the burden on voters is relatively low…  plaintiffs have not provided direct evidence of a voter who was unable to vote, experienced longer wait times, was confused about voter registration status.” That seems a bit odd for a state widely denounced as engaging in voter suppression before and after 2020.

So much for “Jim Eagle.” Yet, these baseless claims will only increase with the approaching midterm elections. Our politics have now come to resemble the “bad” days described in William Shakespeare’s “Richard III” when “wrens make prey where eagles dare not perch.”

  1. Challenges from the left to common sense election reforms enacted by states around the nation are highly beneficial. As the challenges are defeated in case after case, a shield of precedence against future challenges is being constructed.

    For starters, do not call us “elders.” Elderly people are very frail humans typically in their 90s. (Although Chief Attack the Covington Kids did call himself an “elder” even though he was under 65.)

    No one alive today unless over 120 years old (born during the 19th century) “milked” Medicare; that group never paid anything into it. People started paying Medicare taxes in 1965. People now between 78 and 120 (born between 1901 and about 1945) got a very good deal but they did not milk Medicare because they did pay into it; the closer to 1945 the less a good deal it was (and of course that is a rapidly shrinking age cohort). Born between 1946 and 1962, you will about break even. Born after about 1962? Sorry, you will never break even on average compared to what you paid into the Medicare Parts A and B Trust Funds via Payroll and Income taxes respectively over your lifetimes (and if the people that spout the Alex Jones malarkey dominate, they’ll cut your benefits too). All of this math applies to SS too except move everything back in time 30 years because SS started in 1935 and no one got any benefits unless they paid in no matter how old they were (benefits started in 1941 or so rather than immediately as with Medicare)

    As for benefits, no idea what the Alex Jones fan is talking about. The benefits are not that great (99% of the people on original LBJ Medicare Parts A and B buy additional private insurance or add a public health plan called Part C and another one called Part D) but you never exhaust your benefits after “two hospitalizations of 3 days.” There is some weird lifetime limit if you use your 90 day per-incident limit over and over again (but as noted above, everyone makes other arrangements that make that lifetime limit irrelevant). In fact, Original LBJ Medicare has this weird rule where you have to get them to keep you in the hospital over three days in order to get skilled nursing when you get out.

    Re; Georgia: DeKalb County and a few others recently contracted with Konnech, an American election software company that develops software used in managing election poll workers. Today, just today, Konnech’s CEO, Eugene Yu, was arrested in Michigan “as part of an investigation into the possible theft of personal identifying information of those workers.” This arrest was tied to poll workers in Los Angeles County. Quite literally all that has come from our dems is rhetoric, the destruction of civility and norms of law, and histrionics, and it’s been six years, not two. One could even argue it extends back through Obama’s second term. We no longer have an American Democratic party and haven’t for some time. The elitists and Marxists were always there, sure, but now they are all that are left. Pun intended.

        I agree with you James. I served 20 years in the Navy, with my first 12 during the Cold War. I was 100% confident that my military chain-of-command and the political leadership, regardless of party, acted for the most part in the best interest of our country. Yes, they made questionable tactical decisions, but strategically they weren’t trying to undermine our national security. Foreign and domestic policy had the usual ebb and flow, but I don’t recall ever being concerned that any problems we faced due to bad policy decisions couldn’t be resolved in the next election cycle. Those days are long gone. We are in another cold war and this time our enemy exists within our country and has taken over the Democratic party.

Upon qualifying for Medicare, Americans on average consume what they contributed to Medicare after 2 hospitalizations, with each hospitalization averaging 3 days. I had this debate with Mespo a few years ago on here and provided all of the pertinent links. Since youre a wiz at finding comments by people on this blog regardless of the date, perhaps you can locate them.

                To most people, that would mean a patient covered by Medicare would have to pay out of pocket afterward. That would be the most literal interpretation, which, of course, is false. Whether your argument with Mespo is correct is debatable, and without what each person said and the links, what can anyone say? Either person can prevail based on the arrangement of the numbers.

                No, I don’t intend to waste my time searching for links. If you want to push your argument again provide the links.

Joe didn’t talk so loud when his best friend in the Senate was a KKK leader by the name of Robert Byrd. Joe never turns down a man who needs to be a victim if he thinks it will get his vote. If it would have been a Trump appointed judge who made the ruling it would be in the news every third minute from now until the election. When the ruling is made by a Judge appointed by Obama they just slink back under a rock. I don’t have to put it as graciously as Professor Turley.

    1. If you followed the docket, you would see that several claims in the original lawsuit were dismissed along the way, or plaintiffs conceded failure to state a claim. ONly a few of the remaining claims went forward over the months, and now those were dismissed as well.

        2. Those of several plaintiffs’ claims that were rendered moot by the 2021 law were dismissed in the may 19 motion hearing on same. The remaining claims went forward, -only one remained against the state election board, and the final September opinion also added as moot the claim regarding Training on Absentee ballots ( see p.143)

  13. Of course there’s no response when their allegations were proven false. Did we see an outpouring of remorse when the Trump dossier turned out to be a Russian Hoax paid for by the DNC and Hillary Clinton?     When BLM’s Defund the Police movement led to cities burning, cops being assaulted or murdered, and skyrocketing violent crime, politicians, activists, and your friends and family just quietly removed the solidarity slogans from their social media, and “cough cough” denied they ever supported defunding the police.

    The same thing will happen within the next decade with the transgender movement. Boys who were encouraged to “become” girls and girls who were enabled to have their breasts removed and take hormones with permanent effects are eventually realizing they were irreparably mutilated. Many were just trying to find their tribe, but what they found instead was mutilation and the ruination of their bodies and in some cases, their fertility. Ideas and choices they had as 6 years old put them on the path to sterilization. There are so many heartbreaking stories coming out, and the lawsuits are just beginning.

    Right now, parents are losing custody of their children if they oppose puberty blockers, which are used to chemically castrate pedophiles, hormone therapy which has permanent effects and serious health risks, or, worst of all, surgery to castrate boys, remove healthy breasts from girls, and that create an approximation of the opposite sex’s genitalia. Those boys grow up getting all this attention, applause, and getting called brave. Then they find themselves as 6 foot tall transgender, and realize, no, men do not view them as “real” women in every sense of the word. That vaginoplasty, created from the hairy skin of their lost genitals, is not, actually, real women’s genitalia, and will require specialized care…forever. This is one of the reasons why gender “reassignment” surgery does not stop the suicides of transgender.

    Right now, transgenderism is a craze. Giving boys puberty blockers, estrogen, and eventually castration surgery is a modern day eunuch fad. When the boys are thoroughly ruined, miserable, and all grown up, these same people so fervent in pushing the idea that one can actually, really change their gender, and not just their appearance or behavior, are going to deny they actually supported transgenderism. They’ll start deleting social media posts.

    Transgender people can change their appearance through the use of dress, drugs, and in extreme cases, surgery. They can change their behavior to stereotypically opposite sex behavior. All of this is superficial. It’s done to approximate the appearance and mannerisms of the opposite sex, like playing a role. It does not, actually, change their sex, and relies upon stereotypes. I have a dictionary that’s only 6 years old, that listed sex and gender as synonyms. The Left simply appropriated both terms, and for a while, declared they were different. Now, they claim even one’s sex can be changed, and that madmen masquerading as doctors and nurses are “assigning” sex at birth, with the implication it’s somewhat arbitrary and unfair. This is a crazy, harmful, abusive fad, and what’s actually brave is not going along with it while it’s popular.

    Women can be ultra feminine, wearing dresses, heels, and makeup, or they can enjoy pumping iron, doing martial arts, working on cars, hanging out with guy friends, getting tattoos, and having a brusque, authoritative demeanor. They can bake cookies or hunt a moose. Get married and have a family or be single. Date men or women. Being a woman encompasses all of these. My gender is not a state of mind.

    The total irrationality of the transgender movement was exposed when “woman” became indefinable. Literally. You’re a woman if you think you are, and there are no requirements or criteria or even a definition. Matt Walsh’s movie, “What is a Woman” was heartbreaking to watch.

      Clinton did not just “pay for” the Steele Dossier and the other separate set of lies concerning a Trump marketing server. In the case of the dossier, multiple long time Clinton political operatives made up stuff and then fed it to a Russian living in the U.S. (under investigation of being a Russian spy) who fed it Steele who fed it to a PR firm who fed it to Clinton’s law firm allegedly to give to the FBI but actually to give to the Clinton News Network. Same sort of tinkers to evers to chance for the server story except that started with a guy who had already been promised a job in the Clinton administration who fed it to Georgia Tech who fed it a Clinton campaign lawyer who fed it to the FBI and the press.

  14. There was record voter turnout, including among minorities, after the Georgia election laws were passed. It didn’t prevent black people from voting, so to call it Jim Crow on steroids or Jim Eagle is demonstrably false.

    Democrats just say these terrible things about Republicans because it gets them votes, not because it’s true. That’s the MO. Call Republicans racist, xenophobic, misogynistic, fascist bigots who hate the poor often enough, and people become conditioned to believe it. Those voters will then continue to vote for Democrat politicians, in spite of out of control crime, high cost of living, and unaffordable gas, because at least they’re not fascist bigots. When you can’t honestly debate policy, then assassinate the critics’ character.

    The propaganda works, even in the face of glaring racism among prominent Democrats, like Joe Biden proclaiming if you don’t vote for him, “you ain’t black.”

    The Democrat Party fights every attempt to prevent cheating, whether it’s auditing the voter rolls, requiring ID, or preventing activists from filling out ballots for elderly patients with dementia.
