Below is my column on Fox.com on the firing of former FBI General Counsel James Baker at Twitter. The move by Elon Musk is raising serious questions of whether he has faced a type of “deep state” problem within his own company obstructing his efforts to restore transparency and free speech values to Twitter.

On Tuesday, Elon Musk surprised many by firing former FBI General Counsel James Baker as legal counsel for Twitter. For many of us, the most surprising thing was that Baker was still at Twitter. I had assumed that Baker had left the company with Vijaya Gadde, Twitter’s former chief legal officer who was the key figure behind the company’s notorious censorship system. I cannot imagine a less compatible figure to remain at the company to implement the new transparency and free speech policies of Musk. What was equally surprising was to see one of my columns referenced in the story.
Yesterday, I was returning from a hearing in Richmond when my phone seemed to explode. It appears that Musk announced the firing as part of an exchange with journalist Matt Taibbi on my recent column, “Six Degrees from James Baker: A Familiar Figure Emerges With the Release of Twitter Files.”
Musk was responding to Matt Taibbi tweeting on the Sunday column. He posted “In light of concerns about Baker’s possible role in suppression of information important to the public dialogue, he was exited from Twitter today.”
Taibbi later added details that seemed to confirm the fears of figures like the New York Post’s Miranda Devine, who has played a major role in exposing the Hunter Biden scandal. Devine immediately noted on Fox News that the release strangely did not include emails on known meetings with the FBI on censoring information. She speculated that someone was holding back information. There was also a curious delay in the release of material that Musk said would be forthcoming.
Taibbi explained: “On Friday, the first installment of the Twitter files was published here. We expected to publish more over the weekend. Many wondered why there was a delay.”
Musk then removed any doubt about what “exited” meant for Baker: “On Tuesday, Twitter Deputy General Counsel (and former FBI General Counsel) Jim Baker was fired.. Among the reasons? Vetting the first batch of “Twitter Files” – without knowledge of new management.”
Musk added that Baker’s explanation for delaying the release of materials was “unconvincing.”
The tweets were an ironic twist given Baker’s controversial career. Conservatives often cite Baker as part of a “deep state” committed to opposing former President Donald Trump and working closely with Democratic interests. Now he is accused of essentially being part of a deep state at Twitter sabotaging or obstructing efforts of Musk to release information.
Taibbi added that journalist Bari Weiss (who like Taibbi is helping in the release and analysis of the material) was shocked by the conduct. Taibbi quoted Weiss as saying “My jaw hit the floor.”
As I discussed earlier, Baker was a controversial figure at the FBI and was forced out after James Comey was fired as director. Twitter seemed eager to hire him. Later few of us were surprised to learn that he then became an advocate for censoring the Hunter Biden story or that the cry of “Russians” seemed to justify extreme measures.
Twitter’s ex-safety chief, Yoel Roth, said the decision was a “mistake” but the story “set off every single one of my finely tuned APT28 hack and leak campaign alarm bells.” The reference to the APT28 Russian disinformation operation dovetailed with false claims of former U.S. intelligence officers that the laptop was “classic disinformation.”
The Russian disinformation claim was never particularly credible. The Biden campaign never denied the laptop was Hunter Biden’s; it left that to its media allies. Moreover, recipients of key emails could confirm those communications, and U.S. intelligence quickly rejected the Russian disinformation claim.
Still, there were a few Twitter executives who expressed unease with censoring the story, including former global communications VP Brandon Borrman, who asked, “Can we truthfully claim that this is part of the policy?” Baker jumped in to support censorship and said, “It’s reasonable for us to assume that they may have been [hacked] and that caution is warranted.”
There was no evidence the Post’s Hunter Biden material was hacked — none. Yet Baker found a basis for a “reasonable” assumption that Russians or hackers were behind it.
Now, there is a strong suggestion that Baker played a role in limiting or delaying the release of material. The question is whether some of that information deals with the earlier disclosures of the FBI communications. There are also curious deletions on some of the emails of dates and times.
Baker is likely to find himself a popular figure in the weeks to come. Putting aside the requisite media contract for such figures like Peter Strzok, he is likely to be one of the first to be subpoenaed to appear before a House committee.
In the meantime, Musk will now have to review any material redacted or removed by Baker. The release of that material could shed light on not just the cause for Baker’s termination but his role at Twitter in allegedly undermining Musk’s policies. More importantly, any material related to the FBI and other agencies would be key in determining if there was a system of “censorship by surrogate” at Twitter.
What is also clear is that, despite the full mobilization of Washington against Musk, the billionaire is undeterred. Once again, the normally unstoppable forces of Washington may have met their first immovable object.
I recall a few “old timers,” turn of the 20th century immigrants from Lithuania, used a description that is appropriate here: “good riddance to bad rubbish.” This was clearly a termination for cause by the corporation; I hope it resists any trumped up legal claims by Baker and all those like him.

It seems we are seeing a number of comments from commenters whom we have never seen before, all trying to spin the narrative of policies and in house lawyers, but ignore the fact Baker was key person in pushing the Russia hoax while at the FBI.
Do not fall for their spin. I think it was JJC whom said that the people will know the truth when they see it. Or something like that.
The lawyer was expressly working against his clients wishes. It was not his place to decide. This was malpractice at the very least.

I mean, it would be interesting to see the Musk policies mentioned here. I think Musk’s policies, though, are whatever Musk says at the moment which might be different tomorrow. Hard for people to work under him.
You would think Musk, who is being paid $50 billion – more than anyone in history – to run a completely other company; should not have the time to be rehashing something that happened two years ago at a company before he owned it. The lengths people will go to to run interference for Trump and try to feed his narrative even two years after he is out of office is astounding.

I wonder what twitter’s policy is now on releasing documents to the press. Does all the press get access to whatever internal emails they want? I would think it would be more interesting to see the emails behind Musk’s tweet a couple of weeks ago that said he was going to create a panel with diverse views to review any decisions regarding bans or reinstatements. Then that just disappeared and Musk seems to be making these decisions on his own.
Was there an internal discussion about this decision? It would be nice is an independent journalist (i.e., not Tiabbi, Greenwald or Weiss) could take a look at internal twitter emails to see what happened with that decision and whether there are any sort of written policies behind what seem like arbitrary and meandering decisions by Musk..
Musk, the owner and the person that pays the lawyer fees, said he wanted to release the documents. How is this anything other than malpractice? If baker thought it was bad, he should tell Musk and if Musk persists resign.

It’s a revealing conclusion these three alone are not “independent”. What fact makes these three not independent which would not effect any journalist? Is it that Musk picked them? That would also be true of anyone. Is it that they are among the very few open liberals (distinguished from left wingers) in journalism today? If so this amounts to the expectation no information is valid unless it is approved by the left wing.
I don’t doubt this is how left wingers think. It’s a consequence of spending every moment of their lives in left-activist institutions. But it’s helpful for outsiders to understand the principles underlying left wing criticism so we can reject it as politically biased.
The journalists I trust the most By Far are those that have remained consistent to their values over very long periods of time.
Glenn Greenwald is at the top of that list. It is unlikely that he and I agree on many things – though we do on some – especially those in his prime area of expertise – national security issues.
Greenwald attacked, Bush, Obama, Trump, and Biden for exactly the same things.
He also specifically noted for all his other problems with Trump that in the areas of jounralism that he reported on – though far from Perfect, that Trump remains the least problematic of the 4.
I have enourmous respect for Greenwald.
Barri Weis is younger. But she stood up for principles at NYT and ended up leaving. She has an excellent podcast “Honestly” which I highey recomend. She and here guests are frequently wrong on issues, but they are HONEST, and prepared to look at controversial topics without spouting the corporate line. Regardless, even if you disagree with them – her guests are intelligent argue their points, are toughly questioned by Weis.
I like Taibbi, I think he is a good journalist, without being critical – I like his work, but he is not the same stature as Weis and Greenwald – atleast not so far. Taibbi is starting to take flak for stepping into the Twitter files., but Weis and Greenwald have paid real costs for their work
Glenn was blating the Russian dissinformation story was nonsense and that the Laptop was obviously authentica and attacking the media for memory holing the story in Oct 2020 – just after it came out.
No one was ahead of Glenn in reporting the banning of the story and that the laptop was authentic.
He also provided the best bullet proof explanation as to why it was trustworthy.

This mere sounds like Musk (and Tiabbi, Weiss and quite frankly Turley) do not know what the job of an in house lawyer is. No one should be shocked that an in house lawyer is reviewing documents before they are sent to the press. Musk says “without knowledge of new management” but Musk did not say he asked that these documents not be vetted in the normal course.
Musk clearly does things on his own without going through lawyers and that is a problem for a company such as this. Perhaps if he asked his lawyer before doing things like tweeting conspiracy theories about Paul Pelosi, before firing people responsible for complying with governmental consent decrees his company would not be on such a downward spiral right now.

It is irrelevant what the job of an inhouse lawyer is.

It is important to understand that it may make us all feel good to get all of this information out into the public domain but Democrats will not suffer one single time as a result of these findings. Evil is more clever than good and the American people have given up and no longer care about this or any other scandal in government because they have lost the power of the vote.

This country is in for a great deal of pain as a result of the last two elections.

The democrat claim that demographics is destiny has flipped.
All demographic changes favor republicans.
Minorities are slowly turning red.
Republicans are going to lose a couple of red states, but the entire rust belt, as well as NV, OR and WA are either turning red or atleast purple from deep blue. Even NY is no longer blue but purple.
Republicans won every demographic except under 30 and single women.
If abortion is on the ballot it will not be in 2024.
Mailin voting, ballot harvesting, and fraud are giving Democrats a boost. But that is a one time increase, not a trend.
I suspect all of these in combination have added about 1% to democrat vote totals.
Republicans are starved for money and will be. But democrats require massive amounts of money over and over and over to win.
Overcoming this 1% increase in democrat votes will be hard work, but it is inevitable. Every place that democrats won by a fraction of a percent will soon enough be a place they loose by a fraction of a percent.
But the biggest advantage republicans have is democrat policies and governance.
Joe Biden took office with the wind at his back.
He could have done nothing and still appeared to be a great president.
Instead in 22 short months he has wreaked havoc on everything.
Unfortunately for all of us – this is not going to improve anytime soon.
It is appearing that Musk is turning a corner with Twitter – that Twitter under Musk is no longer vulnerable to being canceled.
That is huge, it will in the long run reshape all of social media and even regular media.
Public companies MUST follow Musk if he succeeds – whether they want to or not.

It’s certainly a steep uphill climb to reach those who don’t want to hear, but one has to take a first step to show transparency, especially when it involves their own government. Perhaps, if nothing else, is to ask the question out loud, in public, “If they’ve been hiding this from you, fellow citizen, what else are they not telling you while at the same time raking in far more dollars than their government salary while you can barely make ends meet?”

That is not true. They have lost a critical weapon of censorship: Twitter.
I have no idea why Baker was not removed earlier. That concerns me regarding Musk.
Someone suggested this might have been a setup to get rid of baker for cause, as apparently Baker has a big parachute.
There are complications here. MOSTLY there are no privacy issues regarding this content.
But it is still possible that SOME of this information needs redacted.
Twitter should not provide it directly to Weis or Taibbi without redacting what little might be truly private.
My suggestion would be to have an outside lawyer review and redact everything before sending it to weis and Taibbi.
But to provide them with Everything – with minor privacy redactions.
And let them choose what to print.
Or alternately just put the redacted copies on the cloud for everyone.

The “media app” that runs to left on every new android phone is far left wing phony junk. So every android phone is compromised.

Baker was in line for a life altering severance package.
Now he has presumably been fired for cause. No package.

We are in an existential fight for the country against a rich, powerful, and amoral adversary.
We were in the same fight in the latter half of the 18th century, too. While only 10-15% of the population participated, the end result stopped the most powerful adversary on the planet at that time (bonus points: they still hate that we decided to keep our guns). Which they will. The left controls essentially the entire education budget in America, along with more NGOs, media, entertainment, and large businesses. They’ve always used these funds to support political spending, for example both Bill Ayers and Bernadine Dorhn were given sinecures in the education system for their service to the political left. Now we see indirect support by contracting with political consultants like DIE and CRT.
If we’re serious about fighting the left step one is retaking the education systems from the left so they can’t repurpose those funds to reward political activiy.
The most discouraging part of this entire story is that the contents of Hunter Biden’s laptop have been known to law enforcement since before the 2020 election. When recently told that the Republican congress will be investigating the suppression and lack of investigation of the laptop Biden responded ‘good luck with that’. Why should he fear his administration suddenly caring about his corruption when it has been known since he announced he was running for president? That video of him at the CFR talking about threatening Ukraine by withholding loans unless they fire the prosecutor who was investigating the company that Hunter was being paid by was public during Trump’s impeachment for trying to influence Ukraine in a phone call. We live in a world of contradictions and there appears to be no resolution to the cognitive dissonance we live with everyday now. It makes me extremely sad because I love this country.

As Taibbi just revealed and Musk confirmed
Baker was canned for cause for interferance in releasing “the twitter files”.
Barri Weis, who is the other journalist Musk is working with discovered that the communications she received from Twitters archived were being reviewed by Baker – who was not supposed to be part of the filtering team – given his role in the supression of the NY Post story.
Turned out Baker was filtering the information being provided to Taibbi and Weis and when caught was fired.
That is why Baker was fired.
That also likely means that part of the reason we see only small involvement by Baker and his alma mater the FBI is because Baker was filtering it.
I honestly do think they have met their first immovable object, and thank goodness money just doesn’t matter in this fight. Sadly, whittling down to dollar signs is what it took for these shucksters to concede a single inch. If they aren’t prepared to assassinate Elon, they had best learn to play nice, because, his NOT going away. It is beyond reprehensible that money is the only language they will take seriously. Current dem voters that read this blog: bear that in mind. You are voting for the aristocracy, period (and indeed, many of you in the modern left are members of that class, so this might be moot), and all of your counter culture past amounts to a teenage indulgence because your refuse to examine the evidence and change your minds for the *actual* betterment of everyone. 50% of modern liberals are elitist hypocrites, the other 50% are very much willfully ignorant, particularly in the connected age.

Well, unless there is a 6th floor window someplace from which Musk will fall . . . I understand from recent Russian history that 6th floor windows are more dangerous than guns.
The core point being missed is that people like James Baker and Yoel Roth, to name a few, join corporations and governments but never built anything and add nothing of value to society while pretentiously forcing their utter stupidity on others. They’re nothing more than parasites.
