The Curious Story of QAnon Shaman: Fox Footage Raises New Questions Over the Chansley Case

Below is my column in the New York Post on the recently disclosed videotapes from Jan. 6th. The tapes include images never seen before by the public of that day. However, my interest was drawn primarily to the images of “QAnon Shaman” Jacob Chansley being escorted through the Capitol. That footage raises serious questions about Chansley’s case in my view.

I am continuing to pursue the implications of the video today, but here is the column:

Fox’s Tucker Carson aired the long-awaited release of previously undisclosed footage from the Jan. 6 riot this week.

The first tranche of videotapes elicits major concerns over Jan. 6 committee members’ past claims.

Yet the most serious disclosures, in my view, relate to the case of “QAnon Shaman” Jacob Chansley.

I previously expressed reservations over the heavy sentence given to Chansley.

The new footage raises more questions about the Justice Department’s and the court’s handling of the case.

After the Republican Party boycotted the committee following the rejection of its proposed members, the committee could have strived to offer a balanced inquiry.

Instead, it hired a former ABC producer to put on a production for television, including tightly scripted statements and questions.

Witnesses were used as virtual props, and the committee consistently blocked any alternative views and evidence.

The members repeatedly used the hearing to make a pitch for the midterm and 2024 elections.

Even The New York Times admitted the narrative was meant to “recast the midterm message” and “give [Democrats] a platform for making a broader case about why they deserve to stay in power.”

I supported the committee’s creation, and I was highly critical of President Donald Trump’s remarks before the riot.

Indeed, I publicly condemned Trump’s speech while it was being given, and I called for a bipartisan vote of censure over his responsibility in the riots.

I also found much of the testimony to be highly disturbing from respected public servants opposed to the violence and the election denial.

The committee sacrificed its legitimacy by putting on hearings that often sounded more like a show trial than an objective congressional inquiry. It could have been so much more.

But the footage of Chansley was most disturbing.

I have supported the prosecution of those who rioted on Jan. 6. As I said immediately after the riot, it was a desecration of our constitutional process.

Yet many of us were surprised Chansley was given a 41-month sentence for “obstructing a federal proceeding.”

The sentence exceeded those handed down for violent offenses. Indeed, an Antifa member who took an axe to a member’s office in Fargo, ND, was later given probation … and his axe back.

I also objected to the Justice Department’s draconian treatment in holding figures like Chansley in prolonged solitary confinement without any apparent justification.

We knew Chansley was not shown engaging in violence or property destruction. The footage, however, showed Chansley walking through one of the doors with hundreds of others but escorted through the Capitol by a couple of officers.

The officials appear to be assisting him in gaining access to internal areas.

He walks past a dozen armed officers who do not try to stop him. He even appears to thank the officers for their assistance.

It’s not clear if the defense had access to all of these videotapes. Regardless, these tapes are in sharp contrast to what was presented in court.

The Justice Department portrayed Chansley as a violent offender. Prosecutor Kimberly Paschall played videos to show Chansley yelling along with the crowd. “That is not peaceful,” she insisted.

In his sentence, Judge Royce Lamberth noted, “He made himself the image of the riot, didn’t he? For good or bad, he made himself the very image of this whole event.”

I have great respect for Lamberth, but the sentence was hard to justify, particularly when compared with other defendants.

A Navy veteran, Chansley had no prior criminal record and pleaded guilty. He stood before Lamberth and implored that there was “a lot of bad juju that I never meant to create.”

Yet none of those mitigating factors seemed to count for much.

I agree with Lamberth that Chansley and others warrant longer than average sentences due to this attack on our constitutional process. However, Chansley seems to have a unique “aggravating factor” in his sentencing for “iconic costuming.”

An out-of-work actor, Chansley instantly became a sensation by appearing in his animal headdress, horns and red-white-and-blue face paint.

Had he merely worn a MAGA hat and chinos, he would likely have been given a fraction of this sentence.

Chansley did not appear to be a leader of any group that day as he wandered about the Capitol. The only people with him were often two attending and remarkably attentive Capitol police officers.

On the Senate floor, he is described as “chanting an unintelligible mantra” before leaving.

Chansley reaffirms the old expression among defense attorneys: “One day on the cover of Time, next day doing time.” That is a price that comes from being a celebrity shaman.

Once again, Chansley and any rioters deserve jail time. What occurred on Jan. 6 was a disgrace that has caused a lasting wound for this nation.

But making Chansley an example because he was the most visible is dangerously detached from his underlying conduct.

I have no particular sympathy for Chansley, but I do have concerns for the system that sentenced him.

In the end, justice has to remain blind. In this case, that means focusing on the crime rather than the costume.

    1. I am not seeing much of this in the MSM or even Fox, but there is a Mess in the Proud Boys case

      After the DOJ’s star witness admitted thqat he lied under oath to the J6 committee and to DOJ and completely undermined DOJ’s case, more recently the DOJ sent a spread sheet to the defense as part of discovery, and the rocket scientiests at DOJ – instead of deleting the content that was purportedly unrelated or highly classified – they merely hid the rows with that data in and the defense attorney’s unhid it and found all kinds of exculpatory information that DOJ was hiding – including admissions by DOJ attorney’s that they had no case and were persuing it soley on orders from above, and that attorney’s were directed to destroy evidence, and to alter records removing the names of superiors who attended meetings so no one could call them to testify.

      The BP case should be dismissed, but I doubt that will happen.

      There should be serious sanctions – including disbarment and even possibly criminal charges for some involved.
      But that is not going to happen.

      This is shades of the FISA warrant and falsifiying and destroying evidence – except that not even the slap on the wrist that occured there is going to happen.

In his book “The Nightmare Years: 1930-1935” the author and journalist William Shirer described an incident that occurred in Afghanistan when he had snuck into the country against the advice of the British military. He was with his guide and joking with a crowd of boys and old men. Then something happened, within a moment, the crowd turned from friendly into a mob that were hurling stones at he and his guide. Just that quick.

    There are strange group dynamics, especially when a crowd is spooked that can turn a peaceful protest into a mob. This wasn’t an insurrection. It was a huge crowd and those closest to the Capitol turned mob. There was insufficient security. In some cases, the discipline of the Capitol Police broke down, which further escalated into pandemonium. There were crimes by a subset of the crowd and I don’t think there are many who think that these should go unpunished. But fairly judged. What is bizarre is how this has been blown up in the media and how they have taken the stance, “I’ve made up my mind, don’t confuse me with the facts!”

    Here is the excerpt from William Shirer’s account of the crowd turning in an instant. It serves as an example of why being near huge crowds is not a good idea. “The crowd, mostly boys and old men, was friendly enough as Bosshard (my guide) started snapping pictures with his Leica. He would stop and give the youngsters some silver foil from his film packs and joke with them in Pushtu. The old men grinned toothlessly.

    Suddenly, a couple of young mullahs appeared and started angrily to harangue the crowd. In an instant the amiable crowd was transformed into an angry, threatening mob…..

    The youngsters, who a moment before had been laughing with us, started to pick up loose stones and hurl them at us. I had never been stoned before—It was something I read about in the Bible. I looked back at our car, some hundred yards down the street and turned to run for it.

    “Don’t!” Bosshard said sternly. “Don’t run!”

    Again he took his revolver out and held it up. “Keep facing them. And step back slowly,” he said calmly. Once or twice we had to jerk our arms up to our faces to ward off a missile. We kept treading backward toward the car. The crowd kept edging closer. Their aim was getting better. The damned street seemed to be loaded with stones. Finally Bosshard brandished his gun and fired a couple of shots in the air. The crowd stopped. By this time, we had nearly reached our car. We back-treaded the last thirty feet as fast as we could, Bosshard covering our retreat.

    “Jump in fast!” On the other side. Don’t turn your back!” He was calm but decisive. He put his gun down, threw himself in the car behind the wheel, and turned the starter. In a second we were off, a few parting stones falling harmlessly on the roof of the car.”

    There were many mistakes made. There were crimes committed. It is time to review ALL the facts and dispel emotion.

On his 3/6 show Carlson falsely claimed “these were not insurrectionists, they were sightseers”. The part Carlson didn’t show was the insurrectionists breaking in doors and windows to get into the Capitol–and beating up Capitol police who stood in their way. Minor details.

    When it comes to QAnon Shaman Jacob Chansley, Carlson falsely claimed Capitol police “helped” him and “acted as his tour guides”. No. They repeatedly asked him to leave the building. Remember the Capitol police were outnumbered 1000 to one. Their tactic was to try to de-escalate, not to try to use force to get the insurrectionists to leave the Capitol. And remember Chansley pleaded guilty to a serious felony–unlawfully entering the Capitol to try to overturn an election. But you claim Chansley’s 41 months was too harsh. Frankly, I think he got off easy.

    Outside the loyal MAGA supporters who watch Fox, everyone has denounced Carlson’s attempt to sanitize what happened on Jan. 6. Even GOP Minority leader Mitch McConnel and other Republican senators have called Carlson’s version of the events absurd and misleading. The only thing Fox got right is when they called Arizona for Biden. But since then Fox has back peddled and has perpetuated all the lies about the election and Jan. 6. It appears Carlson now rules the roost at Fox and you know your role–to provide an echo chamber for the chief host at Fox.

    So when you put that disclaimer at the end of your 3/5 column that: “I appear on Fox as a legal analyst and my views on this blog are neither connected to nor approved by Fox…”. I only smile. Of course, you don’t need “approval” from Rupert Murdock for everything you write because you clearly understand what is expected of you. You are a paid propagandist–you know like Joseph Goebbels. I would imagine Goebbels didn’t need Hitler’s “approval” for everyone of his speeches. He also knew what was expected of him.

      Carlson is not government he has no duty to show everything. We have all seen the half hour or so of video you reference – over and over and over. A half hour or so out of 41,000 total hours. Pretty much proves that what occured was fundimentally a peaceful protest.

      Further – The left, democrats, the media, DOJ have all been hiding all of this from us for 2 years.

      That hiding is itself evidence.

      Specifically in the case of DOJ it is malfeasance – Prosecutors have a duty to provide exculpatory evidence to the defense.

      Regardless, no one is argument that those who broke in doors and windows – so far the evidence is that occurred only in the West Tunnel, to gain entrance, and those who initiated violent attacks on the police – again that is why we need ALL the video – we have ALL seen the West Tunnel Video’s.       Some of this video has audio. You are incorrect. Regardless, the video shows him following them – not the other way arround – and them opening locked doors for him.

      That is NOT asking him to leave repeatedly.

      What we are now learning is that neither did those inside the capitol.

      Far and away the largest number entered through open doors, walked through peacefully, were courteous with the CP who were courteous back
      nearly all even stayed between the ropes.

      In otherwords this was nothing like the ACTUALLY VIOLENT Kavanaugh protests.

      There is no crime of trying to overturn an election. Unlawfull entry – if he actually committed that is a summary offence – not jailable.

    There was evidence intentionally withheld from the public. There was no scrutiny. There was no cross examination.

    It was a sham. It was a Soviet show trial. And the public did not buy it.

    Oh in sane, just world you’re exactly right but what do you tell Chansley when the rioters in Portland (who torched a federal courthouse) and any scuzzy member of the BLM/Antifa (not just an idea we find) rioters who really killed people (mostly black)ON THAT DAY and still no prosecutions by the federales? Well, you talk selective prosecution – a topic the Left has forgotten about since they run the persecution … er … prosecution services.     Oh and I truly can’t wait for Chansley’s Brady v. Maryland motion based on withheld surveillance tapes showing our Norseman being led around (escorted even) around the Capitol with Capitol Police jiggling the locks to the Senate chamber to show him around. Four years in prison for saying crazy shinola in the Great Well of the Senate? If that’s the rule, then Maj Leader Schmuckmer deserves 30 years in the pokey!

      I think what JT is saying is that regardless of how the officers treated him… he was guilty of being part of the ‘mob’ protesting outside the capitol which forced the joint session of Congress to pause their required duties.

      That’s the felony.

      The issue of how a group of protesters outside the capitol forced Congress to vacate is another story and goes beyond the scope of this individual.

      But the issue is… was he given a fair trial? Was exculpatory evidence withheld? In light of this evidence would he even had gotten jail time?
      Not to mention the mistreatment and abuse in pretrial detention.

        The defense of selective prosecution presumes you committed the felony. It just says the government who prosecutes you can’t be ethically worse than you are. Wanna argue the govenment is a paragon of virtue with its two-tiered “justice for just-us” system?

          I think everyone notices the selective prosecution and the selective sentencing being given.
          But the point I was making was that the fact that Congress had to vacate the building meant that a felony had occurred.

          There’s clearly more to this… and my other point/question was that regardless of the underlying felony, a Brady violation had occurred. I know that JT made comments where the prosecution could claim that the videos were in the hands of the legislative branch thus not available to them… but even that falls flat.

          The prosecution had videos which meant that the videos were available to them. Then there’s the question of who had the videos. Not the legislative branch but the Capitol Police and the building’s security. Those videos are not a single item. They are digital and can easily be copied and distributed. While there may be security concerns it doesn’t matter. The fact that some videos were released to the prosecution meant that they had access to all.

        Congress was not FORCED to do anything – they chose to leave.
        A significant part of What Tucker is providing is the evidence that those inside the capitol were peaceful – Far more peaceful than Kavanaugh protestors.

        Yet, while Kavanaugh protestors were actively running arround trying to disrupt – congress continued to do their job.

        Those of you on the left constantly abuse the meaning of words.

        It is self evident from the video of people peacefully moving through the capital that all congress had to fear from these people was the political consequences of ignoring them.

  6. “Stop the Steal” is a self-incriminating mantra and statement of purpose to interfere with the Constitutional transfer of Presidential power. I’m still waiting for the instigators and organizers to be indicted. What kind of elitist justice system prosecutes the lowest-level offenders while letting the ringleaders slide?     1. Investigations are ongoing. It’s common for investigations to work their way up.

    2. I consider these Jan 6th folks like the Women Marchers on Versailles circa 1789. If you believe the system is totally corrupt (and it surely is), then you have a moral imperative to act. You may or may not not like the way they acted, but I appreciate the sentiment. If BLM can burn down inner cities over mythical systemic racism, you ought to be able to break a window or two over a corporation-media-communist coup. Liberty, Equality, and Freedom from Facebook for all! Oh and to correct the record, the only person killed during the Jan 6th “riot-surection'” was some poor unarmed, 110 lb, female air force vet with the temerity to climb through a broken window in front of a wussy cop with a firearm. Rename her “George Floyd” and we’ve got a martydom. As it is we’ve got … well … nothing.
