Below is my column in Fox.com on the Trump indictment. There is a report of 34 counts against former President Donald Trump, which may be count stacking based on individual payments or documents. We will have to wait to see. In the meantime, the prosecution came about in the most overtly political way from Bragg campaigning on charging Trump to a public pressure campaign to indict from his former lead prosecutor.

Manhattan District Attorney Alvin Bragg has finally made history. He has indicted former President Donald Trump as part of an investigation, possibly for hush money payments. We are all waiting to see the text of the indictment to confirm the basis for this unprecedented act. But history in this case — and in this country — is not on Bragg’s side.
The only crime that has been discussed in this case is an unprecedented attempt to revive a misdemeanor for falsifying business documents that expired years ago. If that is still the basis of Thursday’s indictment, Bragg could not have raised a weaker basis to prosecute a former president. If reports are accurate, he may attempt to “bootstrap” the misdemeanor into a felony (and longer statute of limitations) by alleging an effort to evade federal election charges.
While Trump will be the first former president indicted, he will not be the last if that is the standard for prosecution.
It is still hard to believe that Bragg would primarily proceed on such a basis. There have been no other crimes discussed over months, but we will have to wait to read the indictment to confirm the grounds.
What we do know is the checkered history leading to this moment.
The Justice Department itself declined to prosecute the federal election claim against Trump. There was ample reason to decline.
The Justice Department went down this road before and it did not go well. They tried to prosecute former Democratic presidential candidate John Edwards on stronger grounds (which I also criticized) and failed. In that case, campaign officials and donors were directly involved in covering up an affair that produced a child.
At the time, Edwards’ wife was suffering from cancer. The prosecution still collapsed. The reason is that you need to show the sole purpose for paying hush money in such a scandal. For any married man, let alone a celebrity, there are various reasons to want to bury a sexual scandal.
For Trump, there was an upcoming election but he was also a married man allegedly involved in an affair with a porn star. He was also a television celebrity who is subject to the standard “morals clause” that’s triggered by criminal conduct or conduct that brings “public disrepute, scandal, or embarrassment.” These clauses are written broadly to protect the news organizations and their “brand.”
Various presidents from Warren Harding to Bill Clinton have been involved in efforts to hush up affairs. They also had different reasons for burying such scandals, including politics. However, scandals are messy matters with a complex set of motivations. Showing that Trump only acted with the future election in mind — rather than his current marriage or television contracts — is implausible. That was likely the same calculus made by the Justice Department.
That is also why the use of the “bootstrapping” theory as the primary charge would be an indictment of the prosecution and its own conduct. The office has already been tarnished by the conduct of the prosecutors who pushed this theory.
When Bragg initially balked at this theory and stopped the investigation, two prosecutors, Carey R. Dunne and Mark F. Pomerantz, resigned from the Manhattan DA’s office. Pomerantz then did something that some of us view as a highly unprofessional and improper act. He published a book on the case against Trump — a person who was still under investigation and not charged, let alone convicted, of any crime.
It worked. Bragg ran on his pledge to bag Trump and Pomerantz ramped up the political base to demand an indictment for a crime. It really did not matter what that crime might be.
While other crimes have not been discussed in leaks or coverage for months, it is always possible that Bragg charged Trump on something other than the state/federal hybrid issue in his indictment. There could be other business or tax record charges linked to banks or taxes. Ironically, the bank and tax fraud issues were also a focus of the Justice Department, which again did not charge on those theories. Moreover, Bragg could face the same statute of limitation concerns on some of the issues previously investigated by the Justice Department.
Finally, Bragg could stack multiple falsification claims to ramp up the indictment. There are reports of 34 counts of business record falsification. But multiplying a flawed theory 34 times does not make it 34 times stronger. Serial repetition is no substitute for viable criminal charges.
Bragg could have something more than the anemic bootstrapping theory — and it would be more defensible. Conversely, if Bragg moves primarily on that theory, the Democrats are inviting a race to the bottom in political prosecutions. That is something that we have been able to largely avoid in this country.
Bragg had a choice to make. He cannot be the defender of the rule of law if he is using the legal process for political purposes. That is what would be involved in a formal accusation based largely on the bootstrap theory. The underlying misdemeanor could pale in comparison to the means being used to prosecute it.
We have already watched the unseemly display of Bragg’s former lead prosecutor in publishing a book and publicly calling for charges during an ongoing investigation. Proceeding solely on the bootstrap theory would be a singularly ignoble moment for the Manhattan District Attorney.
What is clear is that whatever comes out of that gate next week, it will not just be Trump who will face the judgment of history.
What’s even more sickening is the rabid reaction of the Democratic base screaming for Trump’s blood. This pack of jackels has no clue about law or justice, yet it claims to be the “justice” czars for all those “oppressed” minorities who are now demanding multi-million dollar “reparations.” The Democrats have deliberately sent this country over the cliff to hold on to their power, but now we’re seeing exactly what their “power” is being reduced to: China and Russia, together with most of South America, Asia and Africa, are re-positioning power away from the US, UK and EU bullies, and forcing the rapid decline of their rotting empires. Can’t happen fast enough.
Yet another example: the political decline in America? We’ve seen this political tyranny in other countries and the continued movement towards stricter State control, our host most recently wrote of religious persecution in England, State speech denial in America, all coming from the left in their quest for control of the levers of government and society in particular.
I do feel empathy for President Trump, but he was and is a cog in support of independence of the citizens in contrast to what now exists. What’s happening to President Trump is “POLICTICAL RAILROADING” of the highest order: (Tyranny)!

Think about those two statements for a moment. In 2008, I was a registered Republican. I had until that election never truly considered crossing party lines. I was a Republican for selfish reasons only. Since I was first eligible to vote in the 1980 election, I was in the military and Reagan promised to build up our Navy and give me a much needed pay raise. I hadn’t ever read the constitution, Declaration of Independence, or any other original source document from our founding, to actually understand the history of this great nation. And then in 2007 I began reading as many original source historical documents as I could. The constitution, DoI, Federalist Papers, etc. I even took a deep dive into Vattel’s The Law of Nations.
Along comes this young, charismatic man who got my attention. Early on, he actually had me considering crossing party lines. I don’t recall hearing or reading Michelle Obama’s statement at the time. Maybe I did, but she was merely a candidates wife. But based on my studies, something seemed afoot and I really started to question what Barack Obama was telling us. And when he made that statement, I recall yelling out loud at the television: TRANSFORM US INTO WHAT!? I pleaded for some journalist to ask him what was his vision for America when we’ve been fundamentally transformed.
We wake up today having reached Obama’s vision for this now once great nation. Take a look around, do you even recognize it anymore? We are on the verge of total collapse; economically, militarily and culturally. If ever our country resembled the full force of the Executive branch of government, today it should be crystal clear. We are well passed the need for
just Joe Biden to take a cognitive test. This entire country needs one. I believe Mattias Desmet when he posits that we can carve out 30% of our citizens that are consumed in a mass formation psychosis. They are a lost cause. But from this moment forward, how the remaining 70% respond will tell us if we can ever climb out of this hole that Obama gave us shovel ready jobs to dig.

Thank you Seth. JT’s blog attracts more people that are concerned about the direction of this country than that 70/30 split I previously mentioned. Desmet estimates that of that 70%, only 5% are truly active against the rise of a totalitarian regime. More will get engaged, but the question is whether it’s too late. I did a quick count and we’ve had approximately 45 unique contributors that oppose this insanity and 5 that are defending it. That’s an 89/11 split. I believe this indictment has been the wake up call we needed.

If the same 15% of the current 70 percent who aren’t completely lost to the cause participate again to throw off the shackles of an unjust government, we’re probably in pretty good shape. Unless massive, unchecked election fraud happens again in 2024, we should follow Bragg’s lead and start arresting the likes of the Bidens, Clintons, Pelosi’s, Newsoms, Watters, Schumers and their like-minded RINOs for their less than ethical financial transactions; clean out the career-minded, yet unaccountable types in DC and start down the path of Liberty again.

While I don’t believe the 30% will grow in numbers, they will very likely increase their violent rhetoric and action (think Brown Shirts) in an attempt to keep that 70% passive. Desmet argues that Totalitarianism, fueled by this mass formation psychosis, is a phenomenon that first appeared in the 20th century. There wasn’t anything similar to it in history and so it succeeded. There is no such excuse today. All the symptoms of a rising totalitarian regime are present. We know how it begins, thrives and ends, IF, that 70%, Republicans, Democrats, Independents, etc. believe this will all be resolved with the next election. 5. In the meantime, this casualty has been resolved and provision has been made to ensure that Obama’s legacy will remain permanent.

On 10/23/15, Assistent AG Peter J Kadzik informed Congress in a letter (eight pages) that DoJ didn’t find evidence that the IRS targeted conservative groups for political reasons:
“We found no evidence that any IRS official acted based on political, discriminatory, corrupt, or other inappropriate motives that would support a criminal prosecution. We also found no evidence that any official involved in the handling of tax-exempt applications or IRS leadership attempted to obstruct justice. Based on the evidence developed in this investigation and the recommendation of experienced career prosecutors and supervising attorneys at the Department, we are closing our investigation and will not seek any criminal charges.”

The judge felt differently. These things are adjudicated in court.

Thank you Wen Bars. It’s astonishing to me that no one that I am aware of ever asked Obama what he believed the United States would look like after being fundamentally transformed. I don’t know if they thought the constitution had some magical force field that would stop him from doing real, lasting damage, but it wasn’t called a parchment barrier for nothing.
The fact is Obama was thinking strategically, while everyone else was thinking tactically. The country was not yet ready for the full blown Marxist takeover. Instead, Obama used Cass Sunstein’s Nudge theory to move us in that direction. The Tea Party rose up against the plan and Obama made a tactical error by pushing too hard in his 2nd term. Turley is engaging in a lot of speculation and political innuendo. We don’t know the charges or what exactly was used for evidence. As usual Turley leaves out a lot of things. He speaks of political motives but he doesn’t explain exactly what they are. Even indicting on misdemeanors is important because it shows that nobody is above the law. It’s still about holding Trump accountable when he thinks he’s not accountable to anyone.
Turley left out the Republicans in congress trying to interfere by demanding Bragg testify before Jim Jordan’s committee and present evidence against Trump. That’s literally a direct violation of separation of powers. Which makes Turley’s “analysis” merely a poor attempt at deflection from the fact that he, like everyone else, does not know what the charges are. He’s just feeding the rage while waiting for the charges to be announced. He’s doing exactly what the always complains about, engaging in the “age of rage” mentality. Turley’s hypocrisy is as predictable as day and night.

Yes. That’s because the indictment is still sealed and the rumors are flooding out.
Why Bragg withheld releasing the indictment is a bit of a mystery to the legal pundits.
Yet it doesn’t matter.
Turley’s point, which many of the legal pundits agree upon is that if you have a piece of dog poop and you cut it up 10 times, you still have poop.
Bragg may have tried to bring in the McDougal payoff made by the National Inquirer.
Here… it was legal. They paid for an exclusive and decided not to run with it.

Bragg has kept his mouth shut — no bragging, no grandstanding, no predictions that Trump would go down, and his office doesn’t leak, either. The indictment will be presented when Trump gets arraigned on Tuesday. David Pecker, publisher of the Enquirer, engaged in “catch and kill” for Trump–the Enquirer didn’t kill stories because they didn’t pan out–it was hush money payouts to benefit Trump.
You are wrong about for whom the story will not end well–Trump is going down, if not for the Stormy Daniels matter, then for other pending matters, and for those who have followed his career, it’s about time. A multi-term House Speaker doesn’t seem to understand the basic tenet of US criminal justice, which is the presumption of innocence. Trump doesn’t have to prove jack. DA Bragg does. By that standard, Pelosi will have a tough time proving she didn’t commit insider trading fraud, and Biden will have a tough time proving he didn’t get millions in bribes from China.
Anyone cheering on what’s happening to Trump just because Trump is a jerk really needs to pull their heads from their rears. Because corruption comes from the top down. And if the democrats can railroad Trump, then any democrat DA can railroad anyone for anything, especially those who lack Trump’s considerable monetary and legal resources. It’s not just the indictment of a former president that is so bad, but frightening that it is the indictment of a declared presidential candidate against whom the opposing party has been fighting for years. If there’s sufficient evidence that someone who is a candidate has broken the law, simply being a candidate does not and should not prevent indictment.

Pretty clear to me, given the false news about the grand jury waiting until after Easter etc., that Bragg is going to pull a sneak indictment which will include things other than the Daniels and McDougal payments. I expect he will add some or all of New York AG James’ alleged “crimes.”

Don’t bet on the hush-money charge being the only one. We know from experience that the communists throw every lie against the wall to see what sticks, but I’d be willing to bet a steak dinner all charges wind up on appeal like Russian collusion or high-school rape gangs: a baseless fraud.
I strongly suspect the motivation is to further Bragg’s political career in NYC. I also suspect the effort is to “martyr” Trump and undercut DeSantis, so national Democrats are just as thrilled as the mob in NYC.
It’s a little worrisome that our justice system is now a political football. Messrs. McConnell, DeSantis, Cruz, Hawley, Paul, McCarthy, et al, are the next likely targets, so unless they want to be murdered in a prison shower someday, they need to go to the mat right now over this ever-widening abuse of the justice system.

The ratings for cable news entertainment stations is dropping rapidly to the point that all three networks cannot generate 4 million viewers (combined) during prime time. They are losing the younger audience at the fasted rate. Walter Cronkite could draw 20 million back when the country was half the population.
So, “news” comes from many more sources than cable “news” networks. What to do? Politicians and attention seekers must throw fire bombs (figuratively speaking) so that their “story” will go viral and more people will watch it. Gosh, who wants to hear a news program that reports facts? This makes the point of the Eagles song, “Give us Dirty Laundry.”
