The Trump Indictment: Making History in the Worst Possible Way

Below is my column in Fox.com on the Trump indictment. There is a report of 34 counts against former President Donald Trump, which may be count stacking based on individual payments or documents. We will have to wait to see. In the meantime, the prosecution came about in the most overtly political way from Bragg campaigning on charging Trump to a public pressure campaign to indict from his former lead prosecutor.

Here is the column:

Manhattan District Attorney Alvin Bragg has finally made history. He has indicted former President Donald Trump as part of an investigation, possibly for hush money payments. We are all waiting to see the text of the indictment to confirm the basis for this unprecedented act. But history in this case — and in this country — is not on Bragg’s side.

The only crime that has been discussed in this case is an unprecedented attempt to revive a misdemeanor for falsifying business documents that expired years ago. If that is still the basis of Thursday’s indictment, Bragg could not have raised a weaker basis to prosecute a former president. If reports are accurate, he may attempt to “bootstrap” the misdemeanor into a felony (and longer statute of limitations) by alleging an effort to evade federal election charges.

While Trump will be the first former president indicted, he will not be the last if that is the standard for prosecution.

It is still hard to believe that Bragg would primarily proceed on such a basis. There have been no other crimes discussed over months, but we will have to wait to read the indictment to confirm the grounds.

What we do know is the checkered history leading to this moment.

The Justice Department itself declined to prosecute the federal election claim against Trump. There was ample reason to decline.

The Justice Department went down this road before and it did not go well. They tried to prosecute former Democratic presidential candidate John Edwards on stronger grounds (which I also criticized) and failed. In that case, campaign officials and donors were directly involved in covering up an affair that produced a child.

At the time, Edwards’ wife was suffering from cancer. The prosecution still collapsed. The reason is that you need to show the sole purpose for paying hush money in such a scandal. For any married man, let alone a celebrity, there are various reasons to want to bury a sexual scandal.

For Trump, there was an upcoming election but he was also a married man allegedly involved in an affair with a porn star. He was also a television celebrity who is subject to the standard “morals clause” that’s triggered by criminal conduct or conduct that brings “public disrepute, scandal, or embarrassment.” These clauses are written broadly to protect the news organizations and their “brand.”

Various presidents from Warren Harding to Bill Clinton have been involved in efforts to hush up affairs. They also had different reasons for burying such scandals, including politics. However, scandals are messy matters with a complex set of motivations. Showing that Trump only acted with the future election in mind — rather than his current marriage or television contracts — is implausible. That was likely the same calculus made by the Justice Department.

That is also why the use of the “bootstrapping” theory as the primary charge would be an indictment of the prosecution and its own conduct. The office has already been tarnished by the conduct of the prosecutors who pushed this theory.

When Bragg initially balked at this theory and stopped the investigation, two prosecutors, Carey R. Dunne and Mark F. Pomerantz, resigned from the Manhattan DA’s office. Pomerantz then did something that some of us view as a highly unprofessional and improper act. He published a book on the case against Trump — a person who was still under investigation and not charged, let alone convicted, of any crime.

It worked. Bragg ran on his pledge to bag Trump and Pomerantz ramped up the political base to demand an indictment for a crime. It really did not matter what that crime might be.

While other crimes have not been discussed in leaks or coverage for months, it is always possible that Bragg charged Trump on something other than the state/federal hybrid issue in his indictment. There could be other business or tax record charges linked to banks or taxes. Ironically, the bank and tax fraud issues were also a focus of the Justice Department, which again did not charge on those theories. Moreover, Bragg could face the same statute of limitation concerns on some of the issues previously investigated by the Justice Department.

Finally, Bragg could stack multiple falsification claims to ramp up the indictment. There are reports of 34 counts of business record falsification. But multiplying a flawed theory 34 times does not make it 34 times stronger. Serial repetition is no substitute for viable criminal charges.

Bragg could have something more than the anemic bootstrapping theory — and it would be more defensible. Conversely, if Bragg moves primarily on that theory, the Democrats are inviting a race to the bottom in political prosecutions. That is something that we have been able to largely avoid in this country.

Bragg had a choice to make. He cannot be the defender of the rule of law if he is using the legal process for political purposes. That is what would be involved in a formal accusation based largely on the bootstrap theory. The underlying misdemeanor could pale in comparison to the means being used to prosecute it.

We have already watched the unseemly display of Bragg’s former lead prosecutor in publishing a book and publicly calling for charges during an ongoing investigation. Proceeding solely on the bootstrap theory would be a singularly ignoble moment for the Manhattan District Attorney.

What is clear is that whatever comes out of that gate next week, it will not just be Trump who will face the judgment of history.

  1. What’s even more sickening is the rabid reaction of the Democratic base screaming for Trump’s blood. This pack of jackels has no clue about law or justice, yet it claims to be the “justice” czars for all those “oppressed” minorities who are now demanding multi-million dollar “reparations.” The Democrats have deliberately sent this country over the cliff to hold on to their power, but now we’re seeing exactly what their “power” is being reduced to: China and Russia, together with most of South America, Asia and Africa, are re-positioning power away from the US, UK and EU bullies, and forcing the rapid decline of their rotting empires. Can’t happen fast enough.

  2. Yet another example: the political decline in America? We’ve seen this political tyranny in other countries and the continued movement towards stricter State control, our host most recently wrote of religious persecution in England, State speech denial in America, all coming from the left in their quest for control of the levers of government and society in particular.

I do feel empathy for President Trump, but he was and is a cog in support of independence of the citizens in contrast to what now exists. What’s happening to President Trump is “POLICTICAL RAILROADING” of the highest order: (Tyranny)!

  3. We are going to have to change our conversation; we’re going to have to change our traditions, our history; we’re going to have to move into a different place as a nation.” — Michelle Obama, May 14, 2008

We are five days away from fundamentally transforming the United States of America.” — Barack Obama, October 30, 2008

Think about those two statements for a moment. In 2008, I was a registered Republican. I had until that election never truly considered crossing party lines. I was a Republican for selfish reasons only. Since I was first eligible to vote in the 1980 election, I was in the military and Reagan promised to build up our Navy and give me a much needed pay raise. I hadn’t ever read the constitution, Declaration of Independence, or any other original source document from our founding, to actually understand the history of this great nation. And then in 2007 I began reading as many original source historical documents as I could. The constitution, DoI, Federalist Papers, etc. I even took a deep dive into Vattel’s The Law of Nations.

Along comes this young, charismatic man who got my attention. Early on, he actually had me considering crossing party lines. I don’t recall hearing or reading Michelle Obama’s statement at the time. Maybe I did, but she was merely a candidates wife. But based on my studies, something seemed afoot and I really started to question what Barack Obama was telling us. And when he made that statement, I recall yelling out loud at the television: TRANSFORM US INTO WHAT!? I pleaded for some journalist to ask him what was his vision for America when we’ve been fundamentally transformed.

We wake up today having reached Obama’s vision for this now once great nation. Take a look around, do you even recognize it anymore? We are on the verge of total collapse; economically, militarily and culturally. If ever our country resembled the full force of the Executive branch of government, today it should be crystal clear. We are well passed the need for
just Joe Biden to take a cognitive test. This entire country needs one. I believe Mattias Desmet when he posits that we can carve out 30% of our citizens that are consumed in a mass formation psychosis. They are a lost cause. But from this moment forward, how the remaining 70% respond will tell us if we can ever climb out of this hole that Obama gave us shovel ready jobs to dig.

    1. Thank you Olly for this thoughtful posting. You show how knowledge is required to recognize the difference between style and substance.

      1. Thank you Seth. JT’s blog attracts more people that are concerned about the direction of this country than that 70/30 split I previously mentioned. Desmet estimates that of that 70%, only 5% are truly active against the rise of a totalitarian regime. More will get engaged, but the question is whether it’s too late. I did a quick count and we’ve had approximately 45 unique contributors that oppose this insanity and 5 that are defending it. That’s an 89/11 split. I believe this indictment has been the wake up call we needed.

    2. Well said, Olly. History says only 15% of the population participated in the war for Independence from Britain. If the same 15% of the current 70 percent who aren’t completely lost to the cause participate again to throw off the shackles of an unjust government, we’re probably in pretty good shape. Unless massive, unchecked election fraud happens again in 2024, we should follow Bragg’s lead and start arresting the likes of the Bidens, Clintons, Pelosi’s, Newsoms, Watters, Schumers and their like-minded RINOs for their less than ethical financial transactions; clean out the career-minded, yet unaccountable types in DC and start down the path of Liberty again.

      1. If the same 15% of the current 70 percent who aren’t completely lost to the cause participate again…

That’s a good point JAFO. And a big IF. While I don’t believe the 30% will grow in numbers, they will very likely increase their violent rhetoric and action (think Brown Shirts) in an attempt to keep that 70% passive. Desmet argues that Totalitarianism, fueled by this mass formation psychosis, is a phenomenon that first appeared in the 20th century. There wasn’t anything similar to it in history and so it succeeded. There is no such excuse today. All the symptoms of a rising totalitarian regime are present. We know how it begins, thrives and ends, IF, that 70%, Republicans, Democrats, Independents, etc. believe this will all be resolved with the next election. As you so correctly pointed out, totalitarians are not about to risk their stranglehold on their instruments of power, by allowing the very people they are terrorizing to vote them out it.

    3. 1. When the dust settles, you will notice that nothing fundamental has changed between yesterday and today!
      2. Obamas “Vision for America” was a main topic during ’08 election cycle (In 2007, supporters of then Rep Ron Paul (R-TX) organized fundraisers to push his (failed) Presidential bid, The “Tea Party Grass-Roots Movement” was born and a substantial number of Republican Candidates won seats in 2010 midterm elections.)
      3. In 2013, “Tea Party” groups believed they where targeted by IRS under the leadership of Louis Lerner (D). After multiple investigations no bias was found.
      4. In 8/15, Presidential candidate Donald J Trump praised tea party people in Nashville, TN: “These are people who work hard and love the country and they get beat up all the time by the media.” Without these (anti-establishment) grass-roots supporters, Trump wouldn’t be elected.
      5. In the meantime, this casualty has been resolved and provision has been made to ensure that Obama’s legacy will remain permanent.

      1. Dealing with #3. WAs ” no bias was found”?

“The order stated that Lerner, as director of the Exempt Organization Division, first became aware of applications from tea party groups in April or May 2010.

It stated, “For the next two years, Lerner failed to adequately manage the EO division employees who processed these applications.”

It stated, “Moreover, Lerner failed to inform upper level IRS management of the serious delays in processing applications for tax exempt status from tea party and other politically sensitive groups.”

It stated, “Consequently, it was a year before the IRS office of chief counsel became involved, and nearly two years before superiors in the IRS management chain were aware of the mismanagement of tea party and other sensitive advocacy application …

The IRS admitted its treatment of the plaintiffs was wrong.

“For such treatment, the IRS expresses its sincere apology,” the order says. …

The consent order ended with declaratory judgment that it is wrong to apply U. S. tax laws to any entity based on its name, any lawful positions it espouses on any issues, or its associations or perceived associations with a particular viewpoint.”

Some people need to review the facts before rendering their opinions.

        1. On 10/23/15, Assistent AG Peter J Kadzik informed Congress in a letter (eight pages) that DoJ didn’t find evidence that the IRS targeted conservative groups for political reasons:

“We found no evidence that any IRS official acted based on political, discriminatory, corrupt, or other inappropriate motives that would support a criminal prosecution. We also found no evidence that any official involved in the handling of tax-exempt applications or IRS leadership attempted to obstruct justice. Based on the evidence developed in this investigation and the recommendation of experienced career prosecutors and supervising attorneys at the Department, we are closing our investigation and will not seek any criminal charges.”

          1. The judge felt differently. These things are adjudicated in court.

Lerner apparently felt differently as well and held her correspondence from public view.

            1. As DoJ closed the investigation & didn’t seek any criminal prosecution, why was a criminal court involved and a judge felt differently?
As the link you provided (“$100M Magic: Why Bruno Mars And Other Stars Are Ditching Their Managers”) is a mishit, you can check at
https://danfromsquirrelhill.wordpress.com/2020/06/14/obamas-irs-scandal/ if criminal charges were filed.
Lois Lerner’s opinion is irrelevant. After 30 years in civil service she is eligible for a pension after she retired in 9/13.

              1. No one provided Lois Lerner’s opinion. She refused to turn over the emails and a favorable President ended the investigation because she was doing his bidding. She went home.

      2. When the dust settles, you will notice that nothing fundamental has changed between yesterday and today!

If only we could look back in history and find out what happens when people ignorantly wait for the dust to settle to discover they were deceived. Oh wait, a world war happened and millions died as a result.

        1. Maybe it helps to find out why Republicans underperformed up and down the ballot in ’22 midterms: A wave-style environment, President Joe Biden’s, approval ratings were significantly under water, and historical pattern that party who controls WH loses a sizable number of seats in both chambers. Does this prompt self-reflection why VOTERS sent a different message?

          1. Maybe it helps to find out why Republicans underperformed up and down the ballot in ’22 midterms:

The mere fact the historical pattern was defied, especially in light of the direction of the country, would prompt any objective observer to figure out what happened. In that same vein, one would also look at the results in Florida and ask if that is what the wave should have looked like. If so, then what was it that Florida did differently?

            1. Bills SB 90 & 524 adding numerous restrictions to the voting process with the stated goal of making state and local elections more secure, like voting by mail, new identification requirements, ban on ballot harvesting, creating an Office of Election Crime & Security.

    4. +1 million Olly. Obama, the great divider wanted this with his ungrateful, America hating wife.

      1. Thank you Wen Bars. It’s astonishing to me that no one that I am aware of ever asked Obama what he believed the United States would look like after being fundamentally transformed. I don’t know if they thought the constitution had some magical force field that would stop him from doing real, lasting damage, but it wasn’t called a parchment barrier for nothing.

The fact is Obama was thinking strategically, while everyone else was thinking tactically. The country was not yet ready for the full blown Marxist takeover. Instead, Obama used Cass Sunstein’s Nudge theory to move us in that direction. At the same time, the Marxists that were already at work in and out of government were growing the “mass formation” using Cloward & Pivens’, Rules for Radicals.

The Tea Party rose up against the plan and Obama made a tactical error by pushing too hard in his 2nd term. I believe his ego made him miscalculate how far along we were and when Clinton was nominated, America had had enough. Then when Trump was nominated, the curtain was pulled back and we saw just where we were in Obama’s strategic plan. The mythical deep state was real and they were (are) deeper and wider than anyone imagined. The Trump era was the beginning of Obama’s strategy coming out party. By the 2020 election, we saw the full effect of what his transformation of government looked like. Now, the Biden era has exposed the full effect of what the mass formation psychoses has done to the culture.

Our future now rests in the hands of the 65% that have passively allowed this to happen.

  6. Turley is engaging in a lot of speculation and political innuendo. We don’t know the charges or what exactly was used for evidence. As usual Turley leaves out a lot of things. He speaks of political motives but he doesn’t explain exactly what they are. Even indicting on misdemeanors is important because it shows that nobody is above the law. It’s still about holding Trump accountable when he thinks he’s not accountable to anyone.

Turley left out the Republicans in congress trying to interfere by demanding Bragg testify before Jim Jordan’s committee and present evidence against Trump. That’s literally a direct violation of separation of powers. Which makes Turley’s “analysis” merely a poor attempt at deflection from the fact that he, like everyone else, does not know what the charges are. He’s just feeding the rage while waiting for the charges to be announced. He’s doing exactly what the always complains about, engaging in the “age of rage” mentality. Turley’s hypocrisy is as predictable as day and night.

    1. @Svelaz,
      Speculation?
Yes. That’s because the indictment is still sealed and the rumors are flooding out.

Why Bragg withheld releasing the indictment is a bit of a mystery to the legal pundits.

      Yet it doesn’t matter.
Turley’s point, which many of the legal pundits agree upon is that if you have a piece of dog poop and you cut it up 10 times, you still have poop.

Bragg may have tried to bring in the McDougal payoff made by the National Inquirer.
Here… it was legal. They paid for an exclusive and decided not to run with it.
Happens. (e.g they check out her story and it doesn’t pan out or leaves them open to legal liability.)

Sure the guy is a friend of Trump and hence the term (catch and kill) comes to play.

This will not end well for Bragg.
      He’s playing with fire.

And to have Bragg try to accuse the GOP in Congress of political interference is laughable.
To make matters worse for Bragg. He’s soft on crime unless your name is Trump.
(That won’t play well with the locals)

      -G

      1. It’s amazing that no matter what someone Trump perceives to be an enemy does, it’s always wrong. Bragg has kept his mouth shut — no bragging, no grandstanding, no predictions that Trump would go down, and his office doesn’t leak, either. The indictment will be presented when Trump gets arraigned on Tuesday. David Pecker, publisher of the Enquirer, engaged in “catch and kill” for Trump–the Enquirer didn’t kill stories because they didn’t pan out–it was hush money payouts to benefit Trump.

You are wrong about for whom the story will not end well–Trump is going down, if not for the Stormy Daniels matter, then for other pending matters, and for those who have followed his career, it’s about time. By “locals” if you mean the people of NYC, you don’t know what you’re talking about. Trump has been a pariah there for years, and for good reasons, including destroying the art pieces from the historic Bon Wit Teller Building, after promising to donate them to the MOMA as a condition for tearing down the historic building to construct his gold tower. Then there’s the housing discrimination case. Bragg is correct about political interference, too–the Manhattan DA’s office is not subject to Congress, and it has no power to compel him to appear, much less testify, about prosecutorial decisions or evidence it has adduced in investigating Trump. What is laughable is Jim Jordan pretending he has such power and/or that he could use it to intimidate the Manhattan DA.

    2. Svelaz…if you are so unimpressed with Turley, why are you here? I appreciate his forum, this place he offers for us to exercise free speech, a sacred thing that is dying now in America, the only country to ever guarantee it in its constitution. We are on the road to totalitarian control. The Bill of Rights is soon to be a historical relic.

    3. “We don’t know the charges or what exactly was used for evidence”

The 6th amendment is below. which part of ” to be informed of the nature and cause of the accusation;”
is difficult for you to understand.

      Amendment VI
In all criminal prosecutions, the accused shall enjoy the right to a speedy and public trial, by an impartial jury of the state and district wherein the crime shall have been committed, which district shall have been previously ascertained by law, and to be informed of the nature and cause of the accusation; to be confronted with the witnesses against him; to have compulsory process for obtaining witnesses in his favor, and to have the assistance of counsel for his defense.

    4. “Even indicting on misdemeanors is important because it shows that nobody is above the law. ”
Good, then lets indict Biden. AOC, You.

All for the purpose of showing that no one is above the law.

Then lets refuse to tell anyone what the underlying crime is.

If your purpose is to show that no one is above the law – then indicting any president or former president will do.

Actually adhering to the rule of law REQUIRES that you do not act for Show. but for cause.

So far you have not provided cause.
79% of americans according to a cnn poll think this is a meritless political prosecution.

I thought you beleived in democracy.

  7. “Although there is evidence of potential violations of the statutes regarding the handling of classified information, our judgment is that no reasonable prosecutor would bring such a case.”

    – James Comey, Director FBI, Investigating Hillary Clinton’s Blatant Crimes, 2016

  8. Meanwhile, the Biden crime family has not a single charge, and the Big Guy even sits in the White House and muses about ice cream after children are murdered.

Compare and contrast justice under the Democrat Party.

  9. This political prosecution feels like a biological imperative for the zealots on the left. They cannot resist the idea of indicting Trump because it feels so emotionally satisfying to them. It is TDS in its most extreme stage.

  10. I’m no fan of Trump. I think he’s an awful politician who takes his allies for granted, constantly tries to please his enemies, thinks cheering crowds equates to winning elections and when he was POTUS, he pretty much did exactly what the establishment wanted even while claiming he didn’t. He trashes his own party allies and then expects them to be loyal to him (for what?). But given all that, his getting indicted is an absolute travesty of Justice and basically is the crossing the Rubicon moment where the US is now a full blown banana republic. Nancy Pelosi proudly announced on Twitter that “No one is above the law!” and the “Trump has an opportunity to prove his innocence.” PROVE HIS INNOCENCE? A multi-term House Speaker doesn’t seem to understand the basic tenet of US criminal justice, which is the presumption of innocence. Trump doesn’t have to prove jack. DA Bragg does. By that standard, Pelosi will have a tough time proving she didn’t commit insider trading fraud, and Biden will have a tough time proving he didn’t get millions in bribes from China.

Anyone cheering on what’s happening to Trump just because Trump is a jerk really needs to pull their heads from their rears. Because corruption comes from the top down. And if the democrats can railroad Trump, then any democrat DA can railroad anyone for anything, especially those who lack Trump’s considerable monetary and legal resources. At this point, the Republican AGs and DAs across the country would be fools not to prosecute democrats on any charge they think they can make stick. This behavior simply cannot be allowed to only go one way, because the democrats will learn no lesson unless there are severe consequences.

Be careful what kind of country you want to live in, because you may just get it.

    1. “PROVE HIS INNOCENCE? A multi-term House Speaker doesn’t seem to understand the basic tenet of US criminal justice, which is the presumption of innocence. ”

      _______________________________

Not a mistake. It is deliberate spreading of disinformation. Pelosi knows exactly what she’s doing.

The Democrat party is possessed by lawless, unethical, unhinged, seize-power-by-any-means, sociopathic liars and America-hating communist Marxists intent on destroying the country from within.
Which is why half the country is being deliberately lied to, misinformed, propagandized, brainwashed and radicalized — BY the Democrat party and their media accomplices.

  11. It’s not just the indictment of a former president that is so bad, but frightening that it is the indictment of a declared presidential candidate against whom the opposing party has been fighting for years. I’m no Trump supporter (unless I am forced to choose him against any one of the potential Dem candidates in the general election), but IMHO this all but makes his case about election interference.

    1. If there’s sufficient evidence that someone who is a candidate has broken the law, simply being a candidate does not and should not prevent indictment.

      1. Are you dense or do you just play dense when you want to? This indictment is political. The history of the indictment proves it, as does all the other charges levied against Trump that failed. At least be honest.

Such stretching of truth mixed with intentional density makes you have little to no value.

  12. Pretty clear to me, given the false news about the grand jury waiting until after Easter etc., that Bragg is going to pull a sneak indictment which will include things other than the Daniels and McDougal payments. I expect he will add some or all of New York AG James’ alleged “crimes.”

  13. Professor Turley: “There is a report of 34 counts against former President Donald Trump…”

Don’t bet on the hush-money charge being the only one. We know from experience that the communists throw every lie against the wall to see what sticks, but I’d be willing to bet a steak dinner all charges wind up on appeal like Russian collusion or high-school rape gangs: a baseless fraud.

I strongly suspect the motivation is to further Bragg’s political career in NYC. I also suspect the effort is to “martyr” Trump and undercut DeSantis, so national Democrats are just as thrilled as the mob in NYC.

It’s a little worrisome that our justice system is now a political football. Messrs. McConnell, DeSantis, Cruz, Hawley, Paul, McCarthy, et al, are the next likely targets, so unless they want to be murdered in a prison shower someday, they need to go to the mat right now over this ever-widening abuse of the justice system.

Stanford’s law school strongly suggests there is no bottom here.

  14. The ratings for cable news entertainment stations is dropping rapidly to the point that all three networks cannot generate 4 million viewers (combined) during prime time. They are losing the younger audience at the fasted rate. Walter Cronkite could draw 20 million back when the country was half the population.

So, “news” comes from many more sources than cable “news” networks. What to do? Politicians and attention seekers must throw fire bombs (figuratively speaking) so that their “story” will go viral and more people will watch it. Gosh, who wants to hear a news program that reports facts? This makes the point of the Eagles song, “Give us Dirty Laundry.”

Phil Donahue, Geraldo and Jerry Springer step aside and hold my beer. The world is hurting. People are hurting. Problems are mounting and crying for leaders to roll up their sleeves and quit acting like babies. The present occupant of the White House is clueless and is more interested in taking your gas stove away than tackling real problems or building things.

    1. Upstate, it’s not enough for Trump to win the Presidency. He needs both houses to win big with Republicans who have courage. To correct the problems, Trump has to go against the deep state.

That means he has to pass laws so that all government officials can be quickly fired and prevent individual bureaucracies from passing rules not set forth by Congress.

      1. “He needs both houses to win big with Republicans who have courage.”

Trump needs to get into office and declare a “Crazy Abe” Lincoln “Reign of Terror,” under martial law with habeas corpus suspended, and retroactively correct “decisions” by the Supreme Court, as was the case with Dobbs when the totally corrupt and criminal SCOTUS “decision” of 1973 was thrown out, and take America back to freedom and back to the Constitution of 1860, after enforcing the law, the Naturalization Act of 1802, in full force and effect on January 1, 1863, under which ineligible individuals must have been deported and compassionately repatriated, in the name of the Constitution and freedom. America needs to be taken back to the law. No more one man, one vote democrazy (i.e. the “dictatorship of the proletariat”). Only the severely restricted-vote republic of Ben Franklin which assures adherence to, and the dominion of, the literal, clear and evident, meaning and intent of the Constitution.

The singular American failure has been the Supreme Court which has presided over the abrogation of the dominion of the Constitution and implemented the dominion of the Communist Manifesto in America.

        It is long past time.

        1. ” Chief Justice Taney told him he was a criminal and he ignored it.”

Where did Justice Taney call Lincoln a criminal?

George there is no reason for your missive to rewrite history. All you have to do is provide your opinion and the facts.

  15. We don’t need a divorce. We just need Downstate New York (the city) to be detached from the rest of the country and ruled as a federal enclave . I don’t think we need to detach California since it pretty much is self destructing right now with a government run amok, floods, blizzards, mudslides, fires, droughts and the BIG ONE (earthquake) ready to happen. John Carpenter was so advanced in his thinking (Escape from New York, Escape from LA).
New York is losing it’s luster as the financial capitol as banks and finance flee the city to Florida and other bustling states like Georgia, Tennessee, Texas, North and South Carolina. My God those 2 liberal progressive states are so bad they have started making Alabama and Mississippi (old #49 and #50) look good and that is an accomplishment. Arkansas (Arkansas!!!) is bustling. The Midwest like Michigan and Minnesota are sinking but the Red states are doing better. Illinois could be doing so much better and has vast potential but Chicago/Springfield is such a drag it’s going to kill a once proud state.
The point is that I don’t really care what personally happens to Mister Trump other than he is a martyr for the Right to use and inflame the righteous anger of the people. The deplorables that Hilary hated so much. He’ll be the focus and there are many that will be recruited to the cause because of these political persecutions.
Increasingly the meaningful decisions in this country will be made in Cities and electorates across these Southern states, as well as the Midwest and Mountains. LA, DC, and NYC will become less relevant to the Country and will need to straighten out or be shoved aside or simply ignored.
Who is truly forcing the action in the US? Congress and the President or the Red State Governors and their Attorneys General?
I am for the law, that is blind to political affiliation and wealth but if push comes to shove, remember it’s We The People who are the ultimate arbiter of the law.

    1. Is there something about ocean water that living near it subconsciously drives people to Leftism? (Jeff Spicoli, ‘surfer-dude’-types excepted, of course.)

    2. Irreconcilable differences, no?

      They want the Communist Manifesto.

We want the U.S. Constitution and Bill of Rights (original).

  16. I would have to disagree that Trump won’t be the last. They will never do this against a left politician, and there is not another right politician like DJT, so he is first and last. Those who can bring this indictment and carry it through have all the people in place to enforce this farce. They all suffer from TDS, and when that is in effect, they focus on nothing else. They have been trying to manufacture anything to get Trump since he became a candidate, and he will always be treated differently then anybody else. This is a political show and because conservatives have no voice or anybody in place to block this type of nonsense it will go through, and the tyrannical, fascist state will be in full force. They don’t care about the illegal influx at the border leading to child trafficking, sexual trafficking, drug cartel freedom, fentanyl killing so many, rape, energy independence, going against anything China and their communist regime, crime in the major cities, …but let’s get Trump, is a biggie.
Why? Because. That is all they have.

    1. and there is not another right politician like DJT, so he is first and last.
You haven’t been paying attention. EVERY Republican is as bad or worse then Trump. Go back and look at what the Dem establishment said about Liz Cheney, until she caught the TDS virus. (in all fairness, the most strident TDS players are the most at risk of loosing their percentage of the DC $$Grift$$ Cheney checks that box)
Trump was pulling back that curtain, and lots of Republicans are at threat to being exposed. That’s what set off the DC elite.

        1. “Made Man” DeSanctimonious thinks he’s “clean” and above the fray. He doesn’t support the Constitution and America when he doesn’t support Real President Donald J. Trump, in fact, he fails to support the Constitution and America when he disparages Real President Donald J. Trump by challenging him. “Made Man” DeSanctimonious should have taken the vice presidency, waited his turn and worked for a three-term dynasty for the benefit of America and Americans. Perhaps he’s not concerned with working for the benefit of America. Actual Americans who are conservative, as the very Constitution is conservative, are up against the global, Deep Deep State “Swamp” and it will rip “Made Man” DeSanctimonious to shreds as he takes it on all alone, unless, on the other hand, “Made Man” DeSanctimonious is part and parcel of the global Deep Deep State “Swamp,” which is a distinct possibility. It’s very interesting that “Made Man” DeSanctimonious hasn’t even been given a dirty look yet.

  17. The Left is nothing if not improvident. Everything they do blows up in their faces, to their continuing surprise. Ending the filibuster on judicial nominations, rejecting the other party’s committee appointments, they’re always so eager to make power plays and then so outraged when the tables are turned, as they always will be. You would think that with a current President of their own party so obviously compromised by his past and more likely than not to have engaged in criminal as well as ethical violations, they would not want to set precedent for indicting former presidents. They see that the documents debacle is unlikely to pay off now that Biden’s similar actions have muddied the waters, so they are hanging their hats on this laughable accusation that is more likely than not to be dismissed out of hand, if it happens to fall to a judge with a remaining shred of integrity. But by then the precedent will be set. Their short-term gain will result in long term pain for themselves. I’m sure they’ll be outraged when the day comes.

    1. Nope. I’m on the left, and if Biden broke the law, then I want him charged TOO.
Former presidents should not be above the law. The rich and powerful should not be above the law.

      1. Nope. I’m on the left, and if Biden broke the law, then I want him charged TOO.

But you demand rule of law, and due process. Something you ignore for Trump.

        1. Nope. I call for the rule of law and due process for Trump too. Don’t lie.

          1. Rule of law to ATS is charging a man repeatedly, losing and then charging him again. We have had 7 years of non-stop charges against Trump where all failed, yet the so-called “rule of law” man says there is a lot of room for more charges that are manipulated just to get them in court.

You are a liar and a cheat.

            1. Anonymous, Trump faces multiple investigations for multiple events, all criminal in nature. Given how much Trump lies and manipulates he’s dug that hole himself. Trump’s corruption and incompetence are catching up to him fast. It’s only a matter of time when one of them will land him in prison or worse make him file for bankruptcy. I would much prefer Trump lose his money than go to prison. There’s nothing more frightening to a billionaire than being broke and poor.

              1. If after seven years of continuous prosecutions, impeachments, improper and probably illegal investigations all leading nowhere you haven’t learned what is going on, you are stupid.

                “all criminal in nature. “

Name the crimes and give reasonable proof. Stupid people can’t provide reasonable answers to this question, so you will decide, whether or not, you are stupid.

                “Trump lies”

What significant lies? Do not confuse error and opinion with lies. Let’s hear your answers which will decide whether you are stupid or not.

                “Trump’s corruption”

What corruption. Let’s hear your answers which will decide whether you are stupid or not.

“It’s only a matter of time when one of them will land him in prison or worse make him file for bankruptcy.”

Tell us how that will occur and provide proof. Let’s hear your answers which will decide whether you are stupid or not.

              2. You keep saying things like “all criminal in nature” yet that is NOT true.

                You keep making up Crimes.

Here is Derschowitz Challenging Bragg to come up with a SINGLE case in which anyone has ever been charged for failure disclose the reasons for payments of money’s for non-disclosure.
AS Derschowitz notes – this happens EVERYDAY in NYC.

The FACT is Trump’s cponduct is NOT Criminal in nature – it just gets your goat.

You are pissed as H311 that Trump continues to accuse those of you on the left of rigging elections – something that is OBVIOUSLY True – even if we can not agree on the specifics of how.

This ludictrous “influence elections” nonsense of yours is unbelievably dangerous.
Everything everyone in politics does is to “influence elections”.
The only group bartred from “influencing elections” is government.

Just recently CNN blurred out the Trump text to donate message on his podium.
But a few days before they did not blurr the same message on Biden’s.

That is obviously influencing elections – is that a crime ?
Democrats the media, the Biden campaign supressed true stories about Hunter Biden – that influenced the election – is that a crime ?

The only efforts to influence elections you seem to think are crimes – are the LEGAL acts of republicans.

                https://youtu.be/K5Stu8QoKnI

Do not do stupid things – payback is a b**ch.
It is idiocy like you are engaged in that corrupts the country.
This nonsense does not end well for any of us.

It ends badly in the unlikely even you get what you want.
And it can end even worse for you if you don’t

              3. It is extremely unwise when you are accused of acting like Levanti Beria to be talking like Stalin.

Can you read your own posts ?

You make it clear what your goal is – The Destruction of Trump – or anyone else that dares to point out how much of a petty tyrant you are.
Jail – great, Better still – you want those who oppose you to die homeless and in poverty.

Facts be damned. Law be damned.

      2. How’s about no one should be above the law? It seems that way with NYC’s criminal element. But I guess throwing dog poop against the wall until something sticks is more important that protecting NYC’s citizens and millions of visitors.

        1. If that were the case, Hillary would have been prosecuted in 2016 for her mishandling of classified docs. Clearly some people are above the law. How about Hunter Biden and his gun crime that the secret service covered up. The list is long so be realistic when you spew comments like nobody is above the law.

      3. 18 U.S.C. § 201, a politician or former politician receiving, accepting, or agrees to receive or accept anything of value personally for or because of any official act performed or to be performed by such official or person shall be fined or imprisoned for not more than two years, or both.
