Wisconsin Man Arrested After Leaving Cellphone at Bar Containing Child Pornography

aaron_kleinAaron R. Klein, 24, of Brookfield, Wisconsin may spend a number of years in prison for what began as an unpaid bar bill. Klein was unable to pay his bar tab and agreed to leave his cellphone as security at the bar. When the bartender opened the phone to find Klein’s telephone number, he discovered child pornography.

The bartender called police and Klein was arrested when he came back to the bar to pay his bill and collect his phone. What is interesting is that the private search falls outside of the fourth amendment, allowing the bartender to review the internal contents of the cellphone and then reveal that information to the police.

Klein now faces 7 counts of possessing child pornography; each count carries a maximum sentence of 25 years, a fine of up to $100,000, or both.

Putting aside the grotesque need to have child porn on a phone, I remain mystified generally about the use of cellphone to hold explicit pictures, as in this case.
