According to the police report reproduced by The Smoking Gun, Campos was “writing on a piece of paper, which caused it to bleed over onto the desk.” Smoking Gun reports “Woodside’s Facebook page reveals that her “likes and interests” include the official “Sharpie Permanent Markers” page on Facebook.”
The boy was taken to a juvenile detention center and the police “booked the marker into the property room.”
Here is what appears to be the operative law under section 35-202:
No person may possess an aerosol spray paint container or broad-tipped indelible marker on any private property unless the owner, agent, manager, or other person having control of the property consented to the presence of the aerosol spray paint container or broad-tipped indelible marker.
This is standard language in other states for graffiti ordinances. Of course, this is public property and a school.
Now before all of the civil libertarians on this site get their constitutions in a knot, let me remind you that markers are well known entry instruments to paint brushes and sketching pencils. The stain left on many a good student by these insidious devices is found in prison art classes around the country.
