It does seem that the rampant sexism and abuse of women by extremists in the Middle East has finally yielded one positive dividend. In April, Al-Zawahiri was recorded answering a question on the role of women and stated that they cannot work outside of the their homes and families . . . and presumably cannot plant IEDs around the home. It seems that God wants only males to kills dozens of innocent people, including children, in markets — but would be aghast to see a woman doing the carnage.
Feminist terrorists have not accepted the news without a fight. One women (calling herself Rabeebat al-Silah, Arabic for “Companion of Weapons”) wrote a 2000-word essay expressing disappointment at the unbroken glass ceiling for women bombers: “How many times have I wished I were a man … When Sheikh Ayman al-Zawahiri said there are no women in Al Qaeda, he saddened and hurt me. I felt that my heart was about to explode in my chest…I am powerless.”
Presumably, her exploding heart was a figure of speech since that is man’s work in Al Qaeda.
If Al-Zawahiri is serious about branching out the franchise into the United States, he needs to get right with the law and read Title VII of the Civil Rights Act of 1964 (Pub. L. 88-352) (Title VII), as amended, as it appears in volume 42 of the United States Code, beginning at section 2000e. A quick trip to the EEOC website at here might help.
First, “-t]he term “employer” means a person engaged in an industry affecting
commerce who has fifteen or more employees for each working day in each of
twenty or more calendar weeks in the current or preceding calendar year,
and any agent of such a person.”
Second, he will need to file out a lot of paperwork on why gender is a bona fide occupational qualification. The EEOC has written that
Title VII permits gender based assignment if gender is a “bona fide occupational qualification reasonably necessary to the normal operation of that particular business or enterprise.” 42 U.S.C. § 2000e-2(e). However, the BFOQ exception is very narrow and applies only in limited circumstances. 29 C.F.R. § 1604.2; EEOC Compliance Manual Section 625: Bona Fide Occupational Qualifications, at § 625.1. Under this standard, an individual cannot be excluded because of sex unless that individual’s sex prevents him or her from being able to safely or efficiently perform job-related activities that fall within the “essence” of the employer’s business. Int’l Union, United Auto. Aerospace & Agric. Implement Workers of Am., UAW v. Johnson Controls, Inc., 499 U.S. 187 (1991).
I suppose that he can argue that gender discrimination “fall[s] within the ‘essence’ of” his business, but he will have to contest with the many other terrorist organizations that openly recruit and explode women. This could lead not only to serious legal vulnerability, but injunctive relief. His only hope is the continuation of President Bush’s pledge not to allow his fight against Al Qaeda being treated as a legal rather than a military matter.
He will also have to deal with pesky feminist suicide bombers who continue to fight for their rights.
