House Committee: FBI Cut Side Deal To Limit Search Of Computers Of Key Clinton Aides And To Allow The Computers To Be Destroyed

146px-US-FBI-ShadedSeal.svg
The FBI investigation into the Clinton email scandal seems to grow more questionable by the day.  As I discussed earlier, the five immunity deals handed out by the Justice Department were, in my view, largely unnecessary and undermined the development of any criminal case.  Now, House investigators have learned  that Justice Department officials, in addition to their immunity deals, cut a “side agreement” with Cheryl Mills and Heather Samuelson for agents to destroy their laptops after searching their hard drives for evidence.  With Congress seeking the information, the side deal clearly would obstruct that investigation and the details of the side agreement make little sense if the FBI were pursuing any and all evidence of criminal conduct.

What is particularly bizarre is that the FBI agreed to limit their search to documents created before Jan. 2015.  That would exclude potential evidence of an ongoing conspiracy or efforts to obstruct the investigations.  The Mills computer, as I have already discussed, should have been handed over given ClintCongressional Sealon’s assurance that her staff would cooperate fully. Instead, Clinton and her staff refused to cooperate with the State Department investigation and then Mills refused to turn over her computer until she was given immunity from criminal charges.  Once again, that computer contained government communications and, more importantly, classified information. The FBI could have seized the computer with a court order without immunity.  Moreover, the contents of the computer contained property of the United States in the form of classified communications.  The FBI did not have to agree to even give back the computer.  Yet, the FBI first immunized Mill and then agreed to limit its search and to destroy the evidence before congressional investigators reviewed the computer.

In my view, the immunity deals and this side agreement raise very serious questions for investigation.  In cutting this deal, the Obama Administration played an active role in the destruction of evidence being sought by Congress.  Since there was no need for the side agreement, the actions of the Administration are now legitimately matters for congressional concern and investigation.

What do you think?

Here is the letter from the House Committee: House Letter

  1. In an effort to answer my own question regarding the USG’s ostensible justification for attempting to effect the overthrow of the democratically elected government of Syria, I’ve learned that Virginia Senator Richard Black went on a fact-finding trip to Syria, and his report in the video below paints a radically different picture of the situation there than we’ve gotten from the stenographic US Corporate Media and its sources in the US Government.

He points out, for example, that Saudi Arabia and Turkey, for reasons of their own, have been major players in the effort to bring down Assad’s government, in a country that was, before ISIS began driving out or killing Christians and Alawites, a very religiously tolerant society, a state of affairs very uncongenial to their extremist Islamism.

He also says that there ARE NO “moderate rebels” in Syria, and that the anti-Assad forces consist only of ISIS and affiliated terrorist groups, which Saudi Arabia, Turkey, Great Britain, France, and the US have heavily aided and abetted in their effort to bring down Assad.

He also points out that a US Defense Intelligence Agency (DIA) report predicts that if Assad’s government falls, so will the governments of Lebanon and Jordan, and that ISIS will then be in a position to launch major attacks in Europe through Turkey, which is supporting ISIS, as enemies of the Kurds, both financially and with arms.

It’s truly must-watch, highly educational video.

  2. Former CIA analyst Larry Johnson offers a decidedly negative assessment of former CIA Deputy Director Mike Morell’s intrepid foreign policy recommendation to kill Iranians and Russians in Syria, but Johnson doesn’t explicitly bring up the question that I’ve yet to hear or see asked, let alone answered, namely, how does the US Government justify its efforts to remove the democratically elected head of a sovereign state who has never initiated or even threatened to initiate hostilities against the US?

If anyone reading this has any explanation to offer regarding this, I’ll appreciate it.

    “Syrian Intervention
“With respect to Syria I will repeat a point I have made previously. Part of the blame for the bloody civil war there lies with Hillary Clinton and Barack Obama and has been made more deadly and bloody because Obama/Clinton helped provide weapons and training to radical Islamists. Come to think of it, Mike Morell was part of that process. Besides calling into question his judgment, let me add to the bill of particulars that he also is a war criminal.

“What, under other circumstances would be a funny incident, is listening to Mike Morell desperately try to smear Donald Trump as dangerous, ignorant and reckless while he, Morell, is calling for killing Russians in Syria who are there at the express and legal invitation of a recognized state. That, boys and girls, is called an act of war.

“It is the kind of provocation that would fully entitle Russia to retaliate militarily against the United States. So let me get this straight, Morell wants us to think he is the voice of reason and moderation, like Hillary Clinton, and he wants to start a fight with a nuclear power? Yeah, that’s brilliant judgment.

“Morell was not finished with his display as the King of all Cretins. Morell also proposed that U.S. forces begin bombing Syrian government installations, including government offices, aircraft and presidential guard positions. The former acting CIA director said that he wanted to ‘scare Assad.’

“Let’s review the reality in Syria. Russia has helped Syria obtain air superiority. Russia has installed an anti-aircraft defense system capable of shooting down U.S. aircraft. And Morell’s prescription? Launch airstrikes on a sovereign nation (again, an act of war on our part), but with only one objective – ‘scare Assad.’

“Let’s ignore for a moment his wildly reckless proposal to risk a military confrontation with the Russians. Focus instead on what he sees as the ultimate goal for using military force and having your sons put their lives on the line – he wants to ‘scare Assad.’ …

“I suppose there is one bit of good news with respect to Morell – he resigned from CBS as a talking head and we won’t have to listen to his bullsh!t as much (I hope). Let’s put the former Director of the CIA up against Trump and what Trump is saying. Morell favors actions that could provoke a war with a nuclear-armed Russia and Trump wants to have a better relationship with Russia. So you tell me: Who is the real reckless, dangerous moron?” [My emphasis]

“I have the same fear Ken. Our political class is clamoring for another war and if this senseless antagonism against Russia continues, I suspect an eventuality will mean a form of war.”

For the benefit of anyone who doesn’t yet share our anxiety in this regard, here’s some strong wake-up medicine:

    Mike Morell’s Kill-Russians Advice
    “By Ray McGovern*

“Perhaps former CIA acting director Michael Morell’s shamefully provocative rhetoric toward Russia and Iran will prove too unhinged even for Hillary Clinton. It appears equally likely that it will succeed in earning him a senior job in a possible Clinton administration, so it behooves us to have a closer look at Morell’s record.

“My initial reaction of disbelief and anger was the same as that of my VIPS colleague, Larry Johnson, and the points Larry made about Morell’s behavior in the Benghazi caper, Iran, Syria, needlessly baiting nuclear-armed Russia, and how to put a ‘scare”’ into Bashar al-Assad give ample support to Larry’s characterization of Morell’s comments as ‘reckless and vapid.’ What follows is an attempt to round out the picture on the ambitious 57-year-old Morell.

“I suppose we need to start with Morell telling PBS/CBS interviewer Charlie Rose on Aug. 8 that he (Morell) wanted to ‘make the Iranians pay a price in Syria. … make the Russians pay a price in Syria.’

Rose: ‘We make them pay the price by killing Russians?
    Morell: ‘Yeah.’
    Rose: ‘And killing Iranians?’
Morell: ‘Yes … You don’t tell the world about it. … But you make sure they know it in Moscow and Tehran.’

“You might ask what excellent adventure earned Morell his latest appearance with Charlie Rose? It was a highly unusual Aug. 5 New York Times op-ed titled ‘I ran the C.I.A. Now I’m Endorsing Hillary Clinton.’

“Peabody award winner Rose — having made no secret of how much he admires the glib, smooth-talking Morell — performed true to form. Indeed, he has interviewed him every other month, on average, over the past two years, while Morell has been a national security analyst for CBS.

“This interview, though, is a must for those interested in gauging the caliber of bureaucrats who have bubbled to the top of the CIA since the disastrous tenure of George Tenet (sorry, the interview goes on and on for 46 minutes).
    https://consortiumnews.com/2016/08/12/mike-morells-kill-russians-advice/

Although I highly recommend watching the whole interview, to start with what this Clinton supporter who is reportedly on her short list of top presidential advisers has to say regarding murder as a foreign policy tool, go to 29:50. The interview makes painfully clear the intellectual and moral caliber of “bureaucrats who have bubbled to the top of the CIA” and of Deep State- enabling Corporate Media slugs like Charlie Rose.

  4. So here’s the plot:
Obama and coterie know Republicans will gut the Dem’s accomplishments and reset the Supreme Court.
Obama doesn’t trust HRC but her health issues mean she’ll die a martyr in the WH which sets up the VP as untouchable.
Parallel development: Establish a covert movement which moves Trump to ascendency, thinking that the Donald couldn’t possibly win….but the race is close. But the plan was for a runaway for. HRC
If it looks like HRC will go down legally before inauguration, Obama pardons her as she resigns for health reasons. Obama’s man takes over. Sympathy vote carries the DEMs.
Better yet, Biden’s crew finds a way to outflank Obama’s grab.

  5. I ususally find Alex Jones hard to watch and listen to because of his hyper-intense demeanor and delivery, but the segment he did regarding the US, Russia, and Syria, which I’ve provided the link to below, is outstandingly good:

    1. I have the same fear Ken. Our political class is clamoring for another war and if this senseless antagonism against Russia continues, I suspect an eventuality will mean a form of war.

9 trillion dollars in additional debt since he took office, greater instability in the world, rampant division in American society, a failed health care initiative, attacks against journalists and whistleblowers, corruption, sleaze, abuses of office and the American public is in a more vulnerable position both geopolitically and personally.

      Mission accomplished Barack Obama.

You’ve succeeded in your goal better than you could have expected. Because as surely as you envision yourself in being a person of vast intellect and wisdom, you could not possibly have allowed this to happen by default, due to sheer incompetence. It was by design certainly. And foolish more than half of us were as voters to take a hack from the frat boys of the political class and to bleat “Thank you sir, may I have another?”

I’ve said since the beginning of his initial presidential candidacy, that Barack Obama was untrustworthy and later I opined he would damage the country far more than any good, altruistic deeds he might serve us as table scraps. Nearly eight years later, we are in however in that same situation. Worse off than before.

And now we should even be expected to believe that more of the same damage will not occur in the future if we don’t reign in our politicians before they cause an even more catastrophic damage to our society? We are going to pay a price if we continue to surrender our liberty over to our own failed leaders.

  6. This piece regarding Clinton’s health and its political significance has also just come to my attention:

“Marlow said he thought the most important of the [Ed Klein’s Guilty as Sin] book’s many detailed chapters concerned ‘the palace intrigue’ between the Obamas and Clintons, including the revelation that the Obamas ‘were well aware of Hillary Clinton’s health issues.’

“As Marlow put it, Guilty as Sin suggests Clinton’s shaky health was one of the reasons the Obamas supported her because ‘they think they could perhaps have another shadow presidency.’ “
“He explained how Obama has taken steps to guarantee his influence within a Clinton White House:

“It’s either Hillary wins or Donald Trump wins, and if Donald Trump wins, obviously, Obama’s legacy is gonna get wiped out, including Obamacare and a lot of other things. So he’s thrown in his lot now with Hillary, but he’s aware of the fact – keenly aware of the fact – that Hillary’s health is very frail. [My emphasis]

“He, in fact, offered her the use of the Walter Reed National Medical Center to have a checkup. He said he’d let her get in there secretly and nobody would know about it, but she said, ‘No, thank you’ because she has her own doctors in New York City, where she goes periodically for checkups, for what I’m told is a leaky heart valve.

“He, Obama, was very instrumental in persuading Hillary to tap Tim Kaine as her running mate. And the reason for that is that Tim Kaine, who used to be a Clinton loyalist many years ago when he was governor of Virginia, backed Obama in 2008 against Hillary during the primaries. So he is an Obama man, Tim Kaine, not a Clinton man. And so if Hillary should falter because of her health in the White House, if she’s elected, the Obamas have what you might call a mole, or a Manchurian candidate, or whatever you want to call Tim Kaine, there so that they can have huge influence over the course of this country and the Democratic Party. [Emphasis added]

“Klein noted that Obama is ‘renting this huge home in the Kalorama section of Washington,’ which he thinks has ‘eight bedrooms, and there’s room for Valerie Jarrett there. It has room for ten cars, and that’s very unusual in Washington. This is kind of a second White House in Washington, with Obama, with clear intention of continuing his influence over the course of this country in the next presidency,’ Klein said.

“Marlow offered some parting thoughts about the importance of Guilty as Sin, building from Klein’s point about the inter-connectedness of the Clinton and Obama power structures in Washington:

“One of the highlights for me was talking about how Hillary is too big to fail, too big to jail. Going into just the detail of how many people would suffer if Hillary Clinton was indicted [see my post re the DOJ’s dropping of charges against State Department beneficiary Marc Turi] , and you realize it’s all the cronyism; it’s all the corporatism. She got out of getting more scrutiny because the more scrutiny she’s under, the more it hurts the Obamas, the more it hurts the other people in power. That’s the math.“ [Emphasis added]

  7. Up-thread, I wrote, “The bottom line for me, is, regrettably, that this presidential election (even if Trump were to be elected, which I see as a quite unlikely prospect) will in no way loosen the stranglehold on the American political process of the Oligarchy, the Power Elite, the Deep State, or the Military-Industrial-Intelligence Complex, whichever term you prefer to use to describe the real agents of pathological power in the world, whose bellicosity, [power lust, and greed, I could add] literally threatens a majority of the human race.”

Since writing that, the following report on the testimony of former British ambassador Craig Murray, based on his first-hand experience with the activities of members of the Global Elite, has come to my attention:

“Under Comey, the FBI has become unprecedentedly politicized at the top levels, and this rank partisanship is ruining the Bureau.”

    It’s not just the FBI:

“DoJ drops charges against arms dealer who could implicate Clinton

“The Department of Justice is dropping charges against an arms dealer who says he can expose Hillary Clinton’s role in illegally arming terrorists in Libya.

“American Marc Turi had been charged with selling weapons to Libyan rebels at a time when it was illegal to do so. An associate of Turi claims that the DoJ was dropping the charges because the revelations about Clinton’s Libya policies would sink her campaign.

    “Politico:
“The deal averts a trial that threatened to cast additional scrutiny on Hillary Clinton’s private emails as Secretary of State, and to expose reported Central Intelligence Agency attempts to arm rebels fighting Libyan leader Moammar Qadhafi.”

  9. I must have ventured into a parallel universe!

In my (former) universe, the FBI and DOJ would never, EVER make such an agreement.

“Under Comey, the FBI has become unprecedentedly politicized at the top levels, and this rank partisanship is ruining the Bureau. J. Edgar Hoover—who, whatever his many faults was an almost comically scrupulous public servant who kept his FBI out of partisan politics for five decades—would not like any of this. And he’d be absolutely right.

For the sake of our democracy, we need our secret police force to be non-partisan and willing to investigate corrupt politicians regardless of party affiliation. Whoever the next director is, that person will need to clean partisan hacks out of the FBI with vigor while restoring a sense of mission that does not kowtow to the ruling party in Washington. Here a bit of Hoover’s annoying obsession with minute details would be a godsend.

Part of the reason things have gotten so bad is that the media has been derelict. Out of a desire to not speak ill of Barack Obama and Hillary Clinton, while covering for Democrats generally, the mainstream media has shied away from serious investigation to what’s happened to the FBI since 2009. As a result, the public is learning only near the end of Obama’s second term what a politicized mess the Bureau has actually become. None of this bodes well for our democracy or the rule of law.”

    “Ken,
“Thanks for referencing this analysis. This is such a sad and scary state of affairs. It is obvious that the oligarchy wants Clinton as president and they will do whatever it takes to achieve this aim.
“I wonder why Clinton. She is a skilled stooge but there are others. They seem very specifically to want her. I am not certain why she is so important to them but I know they have awful plans in store for our nation and this world and she will complete those plans.”

    Glad to do it.

As the US oligarchy, (C. Wright Mills’ “Power Elite”) financially and otherwise controls both the Republican and Democrat wings of the American Political Party, their selection of a president is obviously less concerned with which wing of the Party is represented in the White House than it is with shutting out any third party president who doesn’t share the Party’s domestic and foreign policy agenda.

Hillary has made it abundantly clear as Secretary of State that ideologically and temperamentally she’s fully on board with the neocon Project for a New American Century’s imperialist agenda, calling for US “full-spectrum dominance” by the US throughout the world, and is therefore eminently qualified to represent the Power Elite, as POTUS.

Regarding the Republican wing of the Party, as the son of former president and CIA Director George Bush, Sr., I imagine that Jeb Bush was the oligarchy’s first reliable choice in 2016, just as his younger brother was in 2000, but as we all know, Jeb! didn’t comport himself so well.

With his anti-globalist and anti-imperialist pronouncements coupled with his successfully tapping into the seething and widespread resentment of white Americans, however, Donald Trump threw a large monkey wrench into the Bush-option for hedging the Party’s bets, which is why the howls of the Party’s Republican Establishment would drown out those of a contemporaneous full-moon werewolf convention.

Trump’s reliably periodical bizarre behavior, however, has demonstrated fairly spectacularly that he’s his own worst political enemy, and together with his being constantly pilloried in the Power Elite’s Corporate Media, it will probably be unnecessary to throw the election to Hillary as it was to Junior in 2000 and 2004.

On the other hand, Trump has apparently garnered new support from some neocon intellectuals, which, if Trump accepts it, Trump supporter and libertarian Paul Gottfried finds, of course, greatly worrisome:

“Finally, I should note that if those presented on the Amgreatnes website as Trump’s intellectual shock troops are what they claim to be, I’ll have to reconsider my enthusiasm for the GOP presidential candidate. One reason [libertarian] Walter [Block]and I backed Trump is that he seemed less surrounded by neocon ‘policy advisors’ than Hillary. This may no longer be the case. That said, I shall pull the lever for Trump in the voting booth because I wish to prevent the Cultural Marxist dictatorship that might descend on this country if Mrs. Clinton is elected. But I have no illusion after seeing some of the Amgreatness signatories that a Trump victory will bless us with a neocon-free administration. That’s unlikely to arrive, no matter which nominee wins the presidential sweepstakes.”

As the Obama Administration has circled the wagons around her with the tragi-comic DOJ investigation of her self-serving tenure in the State Department, and in view of its active promotion of her candidacy as a dependably ruthless national security statist and imperialist, her being the first female major-party candidate for president, her being the wife of the “first black president,” combined with the low-information voting habits of tribalistic Democrats and other maladies afflicting the American body politic, the only potentially serious obstacle to Hillary’s swearing-in that I can see is her physical health. (In addition to the many recorded incidents indicating her physical debility, and for what they’re worth, see the videos of Dr. Ted Noel and http://www.wnd.com/2016/09/friends-of-hillary-say-she-has-parkinsons/)

The bottom line for me, is, regrettably, that this presidential election (even if Trump were to be elected, which I see as a quite unlikely prospect) will in no way loosen the stranglehold on the American political process of the Oligarchy, the Power Elite, the Deep State, or the Military-Industrial-Intelligence Complex, whichever term you prefer to use to describe the real agents of pathological power in the world, whose bellicosity literally threatens a majority of the human race.

With many more compelling reasons than he had, alongside Thomas Jefferson, “I tremble for my country when I think upon the fact that God is just, that his justice cannot sleep forever.”

  11. If anyone is interested the NYT just presented a story about an NSA contractor, Harold T. Martin III, who apparently has been charged with ‘unauthorized removal or retention of classified documents’ among other charges.

The usually detailed coverage of the NYT fails to mention that the laws only apply to working stiffs and provide only for three ‘tut-tut’s and a smack on the wrist for high administration officials.

  12. Maybe it’s just me, but I just can’t believe that this woman will be our next president.

I just don’t believe that my people are that far gone.

Go Trump. But I’m still voting Stein.

    1. It is unbelievable in so many ways. Her last ditch scenario is voting machine fraud and they are all set to go with that at DHS. It may not be that she wins, any more than she won the primary with Sanders. But the oligarchy seems to want her very badly and they will do whatever it takes to get her in. That’s what I see happening at this point. Or, we could get Obama for life!

  13. “What difference at this point does it make?” The most corrupt candidate to ever run for president is having the way cleared for her by not only DOJ, FBI, Obama himself, most of the media, and of course, the stupidity of the American people as manipulated by the media which has in turn been masterfully manipulated by Obama and his administration. God bless America.

“I wonder, Professor, what you think they are looking for ?”

Although it’s a little dated, maybe this will help:

(Charles Lipson is the Peter B. Ritzma Professor of Political Science and the founder and director of the Program on International Politics, Economics and Security at the University of Chicago)

“To understand the gravity of these issues, it is important to recognize that this is not just an ’email scandal.’ It is an ’email + server + foundation’ scandal. Secretary Clinton didn’t just send sensitive (and now-classified) emails over open lines, she stored them on private servers that didn’t meet the government’s cyber-security standards for sensitive documents.

“On its face, retaining classified materials in such vulnerable settings is a criminal violation. Senior intelligence officials have been charged for less – far less. Storing some 1,300 classified documents on a personal server, and doing it for years, poses a special problem because it shows the mishandling was not inadvertent. It was Clinton’s standard operating procedure.

“The State Department has done everything it can to protect its former boss. When it finally received her documents, it flatly refused to comply with long-standing Freedom of Information Act requests by releasing them. It took several court orders for the agency to begin trickling out small batches with large sections blacked out. The redactions only underscore why the documents should never have been held on private, unsecured servers in the first place. [Emphasis added]

“The latest document dump shows why the State Department is so skittish. One reveals the secretary of state telling a senior department official, Jake Sullivan, to strip all the security markings off one document and send it to her on an insecure connection. We don’t yet know if Sullivan actually complied, but, if he did, both he and Clinton face serious legal jeopardy.

“Beside these national-security matters, the emails reveal obvious conflict-of-interest issues pertaining to the significant overlap between Clinton’s official duties and her family foundation’s operations.

“Major donors to the foundation often had business before the State Department, and they sometimes received help. After the devastating 2010 earthquake in Haiti, for instance, Bill Clinton was named co-chairman of the Interim Haiti Recovery Commission, and, according to the Wall Street Journal, ‘the State Department began directing parties interested in competing for Haiti contracts to the Clinton Foundation.’ Not surprisingly, many contractors became foundation donors, or were already. The FBI now has to decide if any of this was a “pay to play” arrangement. Proving a quid pro quo is notoriously difficult, but Fox News reported Monday that public corruption is now a second track in the FBI investigation.” [Emphasis added]

    1. Ken,

Thanks for referencing this analysis. This is such a sad and scary state of affairs. It is obvious that the oligarchy wants Clinton as president and they will do whatever it takes to achieve this aim.

I wonder why Clinton. She is a skilled stooge but there are others. They seem very specifically to want her. I am not certain why she is so important to them but I know they have awful plans in store for our nation and this world and she will complete those plans.

It’s very sad to see how willing people are to ignore or justify what is happening. I realize we have many paid people on this site but I also know from direct personal experience that the talking points presented by the paid shills in the media have had their desired effect and most ordinary Democrats believe them.

We truly need people who will think, see through things and act with an inner sense of ethics.

      1. Jill – the group that meets at Bohemian Grove every year get to decide who is President. Trump was not on their list. Usually the candidate is invited to join the organization first. However, it is a male only group. Still, the fix was in for Hillary, as we have seen from the emails from the DNC. The fly in the ointment was Trump, who was never expected to place, much less win the nomination on the Republican side.
Hillary is having trouble getting audiences, however yesterday Trump was in Prescott, Arizona and pulled over 10,000 on a week day. The NYT has 33 reporters looking for dirt on Trump, 0 reporters looking for dirt on Hillary. It is the same for most of the major papers.

The fix is in. Homeland Security wants to run the elections in all states. Do you think that is going to end well?

        1. Paul,

This won’t end well for our nation unless people start acting like real citizens and rise up, peacefully, to bring back the rule of law, protect our earth and help each other live good lives.

      2. Yes, Ken, thank you for the pithy clarification. It’s really good, IMO.
Jill, I agree that we truly need people who will think, see through things and act with an inner sense of ethics. But where do you now find people like this?
