There were a couple of eye-raising moments this weekend during an interview of President Joe Biden on CBS’ “60 Minutes.” One was his continued blanket denial that his son Hunter had done anything that had any impact on him or the country. However, it was the President’s sudden announcement that the pandemic “is over” that may have taken some people by surprise, including Administration lawyers still using the pandemic as a basis for policies and programs. This includes a major appellate case this week.
The Administration relied on the pandemic to justify the massive loan forgiveness program at a cost of as much as $1 trillion. The move will be the subject of challenges and defended under the HEROES Act of 2003 as tied to a national emergency, ”when significant actions with potentially far-reaching consequences are often required.”
The pandemic is also being used by states continued crackdowns on those who refuse to get vaccines. New York is moving to fire hundreds of teachers and school administrators.
Private companies like T-Mobile are also moving this month to fire unvaccinated workers.
The President also heralded the removal of masks recently despite the continued requirement for some schools and other locations under pandemic rules (including at my own George Washington University). While at the Detroit Auto Show, Biden declared “If you notice, no one’s wearing a mask, everybody seems to be in pretty good shape.”
Biden’s statement on the end of the pandemic is likely to be cited in a variety of briefs in cases challenging emergency powers and policies used by the Administration. It was just a year ago, in September 2021, that the President imposed such rules to “ensur[e] the health and safety of the Federal workforce and the efficiency of the civil service.” President Biden announced a similar requirement for federal civilian employees. Exec. Order No. 14,043, 86 Fed. Reg. 50,989 (Sept. 14, 2021).
One such example could be the appeal now being considered by the United States Court of Appeals for the Fifth Circuit. The issue of the sweeping pandemic authority being claimed by the Biden Administration is now going before the full court in an en banc rehearing.
U.S. District Judge Jeffrey Brown previously issued a nationwide injunction against the vaccination mandate in January. That was stayed and has resulted in a series of conflicted moves on appeal.
Yet, the Justice Department is still citing the pandemic authority and insisting that “if an employee chooses not to receive a COVID-19 vaccine (and is ineligible for an exception), he simply may no longer be permitted to continue in federal employment, just as an employee would be subject to termination if she chose to stop performing her job or chose to violate workplace policies.”

Now the President is declaring that the pandemic is over as the Justice Department is defending pandemic policies in various courts. Even if one were to argue that the policy should be reviewed as supported at the time, the continued viability of the policy can now be questioned in light of the President’s own statements. The President’s comments also highlight the fluidity of pandemic policies. While we often look to the CDC on such status statements, it is the President who ultimately decides federal policies on pandemic measures.
If the pandemic “is over,” some may question the continued uncertain status of military personnel and federal employees on vaccine status as well as lingering mask mandates being used in some states and by certain businesses.
So I’m guessing the Administration lawyers will cite the tough policies are the reason Biden can declare the pandemic over, therefore if the tough policies fail in court the pandemic will not be over. Is that their game plan?

The ineffectiveness of surgical or cloth masks to reduce transmission of an aerosolised virus the size of Covid 19 has been known for decades, and no proof of the effectiveness of these masks against the spread of Covid 19 has emerged; the studies purporting to show this have been comprehensively debunked.
The WHO has reported over 14m excess deaths worldwide from Jan 2020 to Dec 2021 yet only about 5m reported Covid 19 deaths. Given the confusion of dying with compared to dying from, and other reporting uncertainties, these reported Covid 19 deaths are in my view as likely to be overstated as understated.
The “draconian” measures you celebrate likely did far more harm than good. And the best independent public health specialists were warning that this would be the case from day 1.

They were still too late, they were not sufficiently effective against a highly contagious virus, and they were rendered even more ineffective by the rate of mutation of the virus. And finally the adverse effects were sufficient that they never should have been universally used.

The transmission rate for the original variant was too high to have any hope of stopping. And each successful mutation was more contagious than the next.
The effectiveness of measures needed to contain a virus must increase essentially exponentially as the transmission rate increases.
I don’t know what alt-right source you get your information from, but it is WRONG. Yes, kids and their mental health suffered because schools were forced to resort to online learning, but would it be better to have MORE dead children or MORE family members and teachers of children who transmitted the virus to these adults? I know of no reliable public health department or offiical who has ever said that schools should not have closed based on the information available at the time. COVID was a novel virus, and our public health officials did their level best to give good advice about the best way to save lives and prevent serious illness as they acquired information about the virus and its transmission.
And, please stop claiming that Trump did anything deserving “credit” for the vaccine. All he did was divert taxpayer money to vaccine makers and guarantee payment even if they didn’t come up with an effective vaccine. That’s it. He deserves NO credit for the science behind the vaccine. There were things he could and should have done if he had anything resembling leadership skills, such as locate the necessary ultra-cold freezers and/or arrange to secure more of them, make logistic plans for vaccine distribution, secure stockpiles of sufficient quantities of PPE and recruit people qualified to administer the vaccine, and plans for rapid deployment to people and places who should be given priority. He did NONE of these things–Biden did. Management of a novel, virulent virus does not rely on “simple mathematics”. Public health professionals acquired information on an ongoing basis, and hindsight is 20-20.
Natacha, you are ignorant. Sweden never closed its primary or middle schools. The other Northern European countries opened them very quickly in the Spring. All of the rest of Europe and some of our Red states had them open from the beginning of the fall. There were no waves of sickness and death in these schools.

I would further not – this is not about hindsight – for multiple reasons.
First we KNEW what would and would not work in may 2020 – more than 2 years ago.

I was wrong about several things related to Covid. Current estimates are 70%+ of the country has had it.
I would have bet money that it never was going over 30%. Very very very few diseases ever infect more than 1/3 of the population.
Past that I intuitively understood the math – or atleast that it falsified pretty much everything the “experts” said.
But I still underestimate the extent to which Covid would swirl arround the world.
More attention tot he math and more attention to past history would have fixed that.
But I can not be too hard on myself because I was far closer to correct that all the experts you worship.
Lets start with easy. We have NEVER been able to stop a respiratory virus with a 1.4R0 – NEVER.
Doing so requires atleast a 41% reduction in the transmission rate. There is not a single covid policiy that would have been more than a speed bump to the Flu.
Wuhan covid had an R0 or 2.5-3.5 That requires a 400% reduction in the spread just to reduce infections by 1/2.
Actually stopping it would require a 500%+ reduction in the spread rate.
That was NEVER EVER happening. Anyone knowing elementary math could figure that out in March 2020.
The Transmission rate along meant that there was no public policy that was going to work PERIOD.
That was absolutely knowable
The next huge error on all of YOUR part is demonstrate by your 20-20 hindsight claim.

Trump deserves as much credit for the vaccine as FDR does for the manhattan project or JFK for getting man to the moon.
No that was not “all he did” he used executive power to kick the ass of FDA/CDC and get them past their inability to take risks or approve anything quickly. We do not know all of what happened behind the scenes But Trump was likely threatening federal bureaucrat on a daily basis.
Further your hindsight sucks. The Vaccine was pushed through FDA so fast that democrats all over the country were claiming to not trust it, until Biden won the election and suddenly owned the vaccine and had to go from pissing on it to selling it.
You want to piss about the logistics – but the FACT is the logistics was incredible. Biden had longer to figure out how to get the US out of Afghanistan and he BOTCHED it. I would further note that the super refrigerators like massive numbers of ventalators turned out not to be necescary.
Next Vaccines were distributed as fast as they were produced. Which initially was slow.
In the US the federal government has no general police power – and therefore no real public health authority – which should have told people that Biden was smoking wacky weed when he claimed he was going to do better.
Presidents do not have that power. The vaccine was provided to the states. Each state finding its own way to distribute it. Some doing badly and other better.
There was a shortage of PPE for about five minutes in the US – primarily because Obama/Biden favored buying lots of vaccines for things that might be necescary and then used up all the ppe against swine flu and never replaced it.
Just to be clear I am not sure that the Obama/Biden decision was not the right one. It takes much longer to gear up to produce vaccines than to produce PPE. The PPE shortage in the US was never serious and only lasted weeks.
You shoudl learn to trust free markets. Covid should teach you – that free markets deliver. Government through the pandemic failed. But despite getting kicked in the balls repeatedly – free markets delivered again and again.
And no Biden did not do any of those things, because that is outside the power of a US president.
I would further note that while Trump was president during Covid about 30K people died per month.
While Biden was president right up through today with a vaccine about 30K people died per month.
Obviously Biden did no better. 700K people died while Biden was president – yet he said when only 200K had died under Trump that he should resign. Why hasn’t Biden resigned ?
Democrats are very good at expressing faux moral outrage – but they never apply to themselves the standards they impose on others.

You are correct management of Covid does not rely on simple mathematics.
Simple Mathematics told anyone with a brain from the very start that attempts to manage covid would FAIL.
And they did. The US did no better under Biden than Trump – self evidently. I have pissed over Biden for doing as badly as Trump despite having a vaccine. But honestly that is not Biden’s fault. The vaccine did not work, and again simple math would tell anyone that from the start.
Initially we were told the vaccine was 97% effective. The math actually tells us that is not going to be good enough.
But fairly quickly we realized that within 6 months effectiveness declined to 50%. At that point it was obvious the vaccine would not work. To have the slightest chance of actually working – we would have to vaccinate 8B people in one week. That was never happening. The global rate of vaccination was slower than the rate of decline in the efficacy of the vaccine.
It is highly likely that the Vaccine actually made things worse – by keeping covid arround longer.
This is another one of the stupid ideas of the covid experts. The purpose of “flattening the curve” is to protect the healthcare system. In every single other way flattening the curve is a BAD idea, not a good one.
Ultimately we would have been far better if Covid had burned through the world FASTER.
If would have killed people much faster, but it would have killed fewer and we would have likely reached natural immunity. We may have a very serious problem now as a consequence of flattening the curve.
There is reason to believe that COVID is now endemic. It is possible we will never get rid of it. Or atleast not soon. It is a modern aids. That probably would not have happened but for relying on the vaccine after we knew it was not going to work. Worse still – we know that the adverse reactions to the vaccine for most people are more likely to kill them then covid. And it appears that repeated boosters are having diminishing returns. So each new booster is a greater risk of dying from the booster, but less effective against Covid.
We caused this. This is not would would have happened had we done nothing.
Not only did we destroy the economy and mental health and education, and …. but it is probable that in the end we have made it worse.
It is actually time for a new manhattan project for a Covid vaccine that works.
There are several mistakes we have made – some where foreseable some were not.
Using the spike protein as our target was a MISTAKE – one that scientists should have grasped early.
You do not target the most virulent part of the virus. Filling the body of a vaccinated person with lots of spike protein is incredibly dangerous – and that appears to have been the case. The core idea behind both the DNA and mRNA vaccines are excellent. But the inital implimentation is poor.
We need to find some part of covid to target that is not highly changeable and not highly toxic. or better still develop a vaccine that targets MULTIPLE parts of Covid. Old style vaccines expose us to the entire virus. That is likely why in MOST instance immunity lasts much longer.
We do not need to rush this time because the goal is different. We are looking to eradicate an endemic virus that is no longer killing 30K per month. but is still killing people and will continue. We need a vaccine that is better tolerated, has few adverse reactions, and has a long half life. That is going to be harder to develop.
But we have the tools.
There are other problems we should fix with the mRNA vaccines. But those are technical – and they are fixable.
JBS, I agree. And the worst of the official response was directed at children. That is continuing, with boosters now being recommended for children without ANY human testing. Since healthy children bear virtually no risk of a serious outcomes from Covid 19, this is incomprehensible.

There is the tiniest fig leaf of a possibility that the Covid vaccines are a valid choice for those over 50.
The data we have right now should result in recommendations AGAINST vaccinating any healthy person under 50.
The younger the more strong the counter.
Further we are very close to the point at which the mRNA vaccines should likely be withdrawn from the market.
It increasingly appears that those who have taken the mRNA vaccine are times more likely to die from SOMETHING than those who have not are likely to die from Covid.
I beleive the DNA vaccines are less effective against Covid. But they do not have the high excess deaths of the mRNA vaccines – there are still complications – the AZ vaccine appears to have problems. The isreali on has problems. the chinese one is worthless. I am not sure what that leaves J&J ?
I want to be clear about something else.
I did not and do not oppose the development of the mRNA vaccines or anything else that was tried and failed.
I would have personally taken the mRNA vaccine in June 2020 if it had been avialable – without widespread human testing.
AS A CHOICE.
The problem is when government tries to change something from a choice to a requirement.
Or a prohibition.
CDC and FDA can piss over HCQ if they wish. But they should never have interfered with doctors providing that as a choice.
I strongly suspect this is the first time ever that a matter of public health was imposed on us all top down by force.
The left likes to rant that abortion is a medical choice between a woman and her doctor.
Of that I am not sure.
But Vaccination, HCQ, Ivarmectin, Masks, …. Those all ARE.
We had an organized “deep state” effort to impose specific treatment and ONLY that treatment by FORCE,

Vaccination has been proven to prevent SERIOUS illness and deaths, not necessarily transmission. Preventing deaths and serious illnesses is a definite beneift. Just ask anyone who has recovered from being on a ventilator or someone who has lost a loved one to COVID. I know of NO reliable public heath authority that takes the position that masks do not help prevent the spread. You cannot deny that social distancing does help, which included closing schools.
I just finished Bob Woodward’s excellent book on Trump, entitled “Rage”, in which he details Trump’s intentional efforts to mislead America about how serious COVID is–something he was told about from the get-go and decided to lie about mostly because he had no clue about what to do and refused to yield to knowledeable public health professionals. All he knew was that COVID was making him look bad, so the parade of lies about “15 cases will soon be 0 cases…it’ll be over when the weather warms up….you’ll be back in church by Easter…etc.. Woodward’s book reminded me about Dr. Nancy Messionier of the CDC, who publicly stated right at the outset of the pandemic that schools should immediately take steps to make certain that children had access to WiFi and working computers from their homes because schools were going to need to shut down. Trump demanded that she be fired. I don’t think she was fired, but she was never heard from publicly again. Her advice was eventually implemented, but the acute phase of the pandemic could probably have ended sooner if schools had shut down sooner. It is estimated that not less than 130,000 Americans died unnecessarily due just to believing Trump’s lies.

Please cite the Constitution for “emergency powers.”
The do not exist; they are artificial and fabricated.
The closest the Constitution comes is suspension of habeas corpus which requires rebellion or invasion (note: Southern States constitutionally seceded; they did not rebel).
What America lacks is a Supreme Court that executes “Judicial Review,” regardless of the presence of a “case” being brought, and fulfills its duties per its sworn oath to support the clear and evident meaning and intent of the words of the Constitution.
No Supreme Court will ever find “emergency powers” in the Constitution; a liberal court might make some up, but they are not there.

The mask requirements in some states are because individual school districts have more control of local policies. That has nothing to do with whether Biden “declared” the pandemic over.
The vaccination requirements should be treated just as and other vaccination requirements. There are still requirements for vaccination from measles, rubella, chickin pox, etc. obviously there’s no pandemic of either disease but vaccination is still required.
As for the student loan forgiveness program it doesn’t stop simply because the pandemic is “declared” over. It still applies because it took so long to implement and it still helps those who need the relief.
Is Biden’s declaration sufficient, or is there a statutory process that has to be followed to declare both an emergency and the end of the emergency? If the former, would his saying ‘never mind’ sufficient to reverse his comment from last night? And would he have to say it himself, or could a White House official say it on his behalf?
Coherence is not a progressive strength
The pandemic has become endemic. The vaxxxines are now unquestionably riskier than the disease itself, according to official data from around the world.
Shocking how politicians manipulated citizens by “following the science”.
People were frightened, punished, coerced, and manipulated by regulators and politicians.
Count the children injured and deprived of education.
People lost their jobs, were fined, and ostracized.
The phrase “Covid denier” became both an insult and a cudgel to damage people.
And now it is over; with a casual comment on “60 Minutes”.
