No, Omar Cannot be Denaturalized on the Basis of her “Somalians First” Speech

Florida Gov. Ron DeSantis (R) yesterday called for the denaturalization of Rep. Ilhan Omar (D-MN) after a controversial speech was uncovered in which she pledged to put Somalia first in Congress and her work. While I have been a long critic of Omar, her views expressed in this speech are not only protected speech, but they are not a basis for denaturalization.

In the video, Rep. Omar is shown declaring that “We as Somalians we love each other. There are areas of friction that led us to kill each other, but in reality, we are an organized society — brother and sisters, people of the same blood.”

She then goes further into where their loyalties lie:  “People who know they are Somalians first, Muslims second, who protect one another, come to each other’s aid and to the aid of other Muslims too.” She assures the audience that the U.S. government will “only do what Somalians in the U.S. tell them to do…They will do what we want and nothing else. They must follow our orders and that is how we will safeguard the interests of Somalia,” she said.

She further declares that “For as long as I am in the U.S. Congress, Somalia will never be in danger,” she said, telling Somalians to “sleep in comfort, knowing I am here to protect the interests of Somalia from inside the U.S. system.”

The speech has led to calls for expulsion from Congress and denaturalization. Neither would be appropriate, in my view.

The speech is clearly protected under the First Amendment. Omar is not advocating imminent violent or criminal conduct. She is expressing her personal priorities and loyalties. The omission of an expression of loyalty to the United States has left many irate and insulted. However, it is still protected speech. Indeed, burning an American flag and condemning America are protected forms of free expression.

Omar was born in Mogadishu, Somalia in 1982 and her family fled the country during the Somali Civil War. After living in refuge camps, the family was given asylum in the United States. The family would eventually move to Minnesota where Omar achieved the extraordinary distinction of becoming the first Somali-American legislator elected to Congress in 2017.

She has remained a controversial figure due to her statements on Israel and other subjects.

The growing calls for denaturalization are disconnected from governing constitutional and statutory standards.

The authority to denaturalize is implied in the language of Article I, Section 8, Clause 4:

“[The Congress shall have Power . . . ] To establish an uniform Rule of Naturalization, and uniform Laws on the subject of Bankruptcies throughout the United States…”

Denaturalization is largely based on the granting of citizenship based on fraudulent or false representations. In Johannessen v. United States, 225 U.S. 227, 241 (1912), the Court held that  “[a]n alien has no moral nor constitutional right to retain the privileges of citizenship if, by false evidence or the like, an imposition has been practiced upon the court, without which the certificate of citizenship could not and would not have been issued.” A failure “to comply with any of these conditions renders the certification of citizenship  ‘illegally procured,’ and naturalization that is unlawfully procured can be set aside.”

Others can condemn Rep. Omar’s comment, but they cannot strip away her citizenship due to her exercise of free speech.

The greatest disconnect in these calls is that Omar would be stripped of her citizenship for exercising the very right that defines us as citizens.

We are loyal Americans because we are bound by a type of covenant of faith in our Constitution, the commitment to each other that we will fight for the rights of our neighbors regardless of whether we agree with their values or views.

This country is not endangered by a lack of patriotism or even a lack of loyalty in others. It is threatened by allowing our anger to blind us to the denial of the very thing that defines us.

      Tinfoil hat me thinks Biden might present himself as Lincoln, grant amnesty by referencing slavery, and 30 mil people could easily become 150 mil overnight with our reunification laws; replete with repeated Civil War reference from the media, and try to take control of the government by fiat. He did ask Congress for unilateral power (emergency power) if they want to address the border. This election is going to be a sheet storm. And it will reverberate for a good while afterward. We should all prepare ourselves. Riots are inevitable. if you live in a blue city, get ready to reap what you voted for, because it’s coming in a very undeniable way.

  2. I don’t disagree, her speech is protected, and there is no such thing as ‘de-naturalization’, that was sheer stupidity on the part of DeSantis.

    But –

    As a member of Congress, I personally am not comfortable with what she represents. This is going to sound absolutely awful, but: we have gotten to the point where these immigrant enclaves are basically large communities of people who have come here with no desire whatsoever to assimilate, and are working by proxy to deal with things in the countries they presumably left behind when they came to America hoping for something better. These communities have zero interest in ever becoming American – they hope they can change their home countries utilizing the freedom we have her. It’s cognizant dissonance for me too, why wouldn’t someone do that? Except that they have no intention of ever returning, they employ our benefits and resources, and do f*** all for this country itself. And to me, that is not ok. This would all be very different if she were not an elected official to our American government, and I have just about had it with the democratic party. They are irredeemable flotsam, and likely the biggest threat to actual human prosperity on earth.

    The fact of the matter is that she is being by a Somalian community large enough in America that this all seems perfectly plausible and reasonable to her. She is part of the Justice Dems, and let us pray that they are the next to bankrupt, they have been a cancer on our system. They positively LIVE to find loopholes they can exploit for their own selfish aims at the expense of everyone else that is just trying to live.   3. We must defend her natural right to free speech, protected by our constitution as a citizen of this country. That is 100% an American principle. That being said, for far too long, we’ve ignorantly allowed hostile actors to overtake every vital institution in our country by stealthy actions, which we did not recognize.     1. Is there a process to revoke citizenship when someone displays intent to destroy their new country from within? Yes, there is. Return them to their home country via parachute with nothing but the clothes on their back. Then, let them explain at the US Consulate or Embassy in their home country – remember, they’ll claim to be US citizens – why they need protection from their ‘brothers and sisters’ and a ride back.

          I would agree IF the House Republicans had the stomach and time to fight a “fair” fight and started removing self-declared, foreign fighters from within Congressional walls. However, I don’t think they would have enough votes to get the job done today, tomorrow or anytime before the next election; that’s a non-starter with this group. Remember this too, Team Red *also*, as much as their Blue Brothers, wanted nothing to do with The People’s Constitutionally-elected ‘choice’ seven years ago when the House had a much larger majority, including the gains by riding on Trump’s coattail promises to roll back, if not outright undo, ACA. But just as in many times past, the ‘reds’ couldn’t be bothered with fulfilling their own campaign promises, let alone The People’s directive by adding to their numbers in the House. They *still*, as a Party, do NOT want his voice heard in their alleged, sacred halls, the halls The People themselves dare not enter.

          With that in mind, my second thought. I’m on the record for being a big believer that people should practice what they preach, lead by example, ‘do onto others…’, etc., etc. So when anyone believes the proverbial grass is greener ‘over there’, then I encourage that person, every time, to go ‘there’ and be happy living with their own kind and other like-minded people. Refusniks not need worry about being extinguished, disappeared, imprisoned or litigated into financial ruin (turning them into martyrs), they can just be ‘helped’ in achieving their Dreams by being relocated, albeit involuntarily, to their Promised Land(s) where they’ll be among no one but friends, nodding with smiling faces.

Do we really need to have WWIII? Wouldn’t it be easier to just acknowledge, even if one wants something that isn;t necessarily ‘Right wing’, that our modern left, across the globe, are basically the old aristocracy and don’t know any better than you what is best for your life? do we really have to go back to feudalism (again – 15 minute cities are basically serfdoms, dictated to you by people that you did not elect)?       Very much agreed, but at least 50% of us, and nearly 100% of the under-40 are working for the exact. Opposite. Talking sense to them means precisely zero.               I would also not prioritize immigration enforcement against people who are diligently working an honest job. No ICE raids of workplaces. Concentrate on those who are committing crimes, or who are managing to sponge off the public. Enforce the border strictly, don’t let anyone in without the proper documents, because there’s no way to know who they are or what they intend. But once someone has successfully entered and is now working hard and showing that they are exactly the sort of person we want to immigrate, leave them alone.

    This all assumes Omar’s unabashed cultural/historical affinity with her Somalian kinfolk is somehow uniquely in conflict with U.S. national interests there.

    As the Most American ™, if we continue going down the rabbit hole of accusing fellow U.S. citizens of displaced ‘American loyalties’, I have a whole host of people we can throw on that funeral pyre.

    First, and foremost, at the beginning of Russia’s invasion of Ukraine (after a decade of Joe Biden’s personal involvement there) one would have been hard pressed to find any members of Congress without duel U.S./Ukraine flag pins on their lapel, if not draped in the Ukraine flag. Throughout most of 2022, whole cites would light up the night sky with Ukraine’s colors in unquestioned solidarity.
    Quite frankly, I’m still in heated disagreement with family members and close friends over the conflict and how to resolve it – although far less now. It’s a festering, bleeding existential threat to U.S. national security imo.

    Next, of course, is fast-expanding catastrophe unfolding in Gaza, Israel and the broader Mid East. Except, perhaps, for Omar and few other malcontents, there is no doubt where congress’ sympathy lies. For reasons beyond my understanding, Israel seems to be the only country in the world where there is no distinction at all with U.S. national security interests – where you are as likely to find Sen. Fetterman draped in an Israel flag singing hosannahs as you are Sen. Graham.

  7. Speech is a protected right that cuts both ways. However, if there is concern about false statements or questionable circumstances, then this should exclude the individual from holding office, especially one where national secrets are discussed.

      Omar does not need a security clearance to be a representative.
      She would need one to serve on the Intelligence committee.

    3. The constitution says otherwise. She’s over 25, she’s been a US citizen for over 7 years, and on the date of the last election she lived in Minnesota. That makes her eligible, and neither congress nor any state can add any further requirements.

      Immigration is a massive issue in this election. But it is a multifaceted issue – not only is there the problem of something like 8M people in 3 years, but it ties back to the broad theme of far left lawlessness.

      Trump is spending his life in court over nonsense. Most of the cases are failing spectacularly. Sometimes they fail spectacularly and STILL the left pulls it off.

      Trump has said he is one indictment away from a landslide – and increasingly that appears correct.

      Currently Trump will win the popular vote by 4M and the electoral college by 100pts.
      Trump is over 50% in half of major polls. While Biden is dropping faster than Trump is rising.

      While I keep mentioning Trump – this is only about Trump to the extent that Trump has chosen to put himself into the position of Marytr.

  9. No, she cannot be denaturalized for her speech. She also lied on a federal form in connection with her fraudulent marriage to her bother. She could have been prosecuted for that, but not denaturalized. Her “parents” lied on their asylum papers when she first came to this country (she was not their daughter). Not sure if a child fraudulently brought into this country should be punished for something done by adults when she was a child, but it does render her presence in this country a fraud. At a minimum her asylum claim should be reconsidered given her actual parentage. (Was her father a war criminal?)

    Either way, the real issue is that unchecked legal and illegal immigration should not be permitted to allow the creation of congressional districts where the majority are anti-American and have primary loyalty to a foreign state. Her presence should be Exhibit A in the failure of our current system. This cannot help but result in balkanization or worse yet tribalization. That is not the American melting pot I remember from School House Rock.

That is not her fault; she was a minor and thus would not have been asked any questions, nor filled any forms, so she didn’t lie. And once she was naturalized her immigration status became irrelevant.

    1. Yes, it is. How is that relevant? You can’t cancel someone’s citizenship, let alone deport them, just because they committed a crime. You can’t even disqualify someone from Congress for it. If the statute is still running, you can prosecute them; if two thirds of the House thinks fit, they can vote to expel them. That is all.

      And Congress has for well over a century taken the view that it can’t expel a member for any offense committed before the last election.
