Ninth Circuit Rules Against Seattle in Using “Heckler’s Veto” in Arrest of Pro-Life Protester

We have often discussed how cities and universities will use the threat of protests to block or shutdown free speech, particularly of conservative speakers or groups. We now have a major decision out of the United States Court of Appeals for the Ninth Circuit that could prove an important precedent in resisting the growing anti-free speech movement in the United States. In Meinecke v. City of Seattle, the court ruled against Seattle in a case involving the arrest of a pro-life protester. Matthew Meinecke was harassed by Antifa and other counterprotesters, but police arrested Meineche when he refused to yield in exercising his right to free speech.

In his decision, Judge Jay Bybee (who was joined by Judges Margaret McKeown and Daniel Bress) described how Meinecke went to an abortion rally and LGBTQ event to read Bible passages. He was abused and assaulted by the protesters, including some identified as Antifa. The group has regularly engaged in violence against those with opposing views, including pro-life advocates. Yet, rather than protect him and arrest Antifa members, the police demanded that Meinecke stop speaking.

The court described the encounters:

Protestors surrounded Meinecke after about an hour. One protestor seized Meinecke’s Bible. Meinecke retrieved another Bible from his bag and continued reading aloud. Another protestor grabbed hold of—and ripped pages from—the new Bible. The altercation soon escalated. As protestors, some of whom Seattle police characterized in their written reports as Antifa, encroached, Meinecke took hold of an orange-and-white traffic sawhorse. Five protestors, some clad in all black and wearing body armor, picked up Meinecke and the sawhorse, moved him across the street, and dropped him on the pavement. One law enforcement officer who observed this interaction reported that “‘Antifa’ members … began to fight/assault” Meinecke.

Undeterred, Meinecke walked back to his original location by the federal building and resumed reading and held up a sign. While people gathered on the street, however, some approached Meinecke, knocked him down, and took one of his shoes.

Seattle police finally intervened. Although the officers acknowledged that the protestors had assaulted Meinecke, they took no action against the perpetrators. They instead ordered Meinecke to leave the area. The precise dictates of the officers’ order are in dispute. Meinecke maintains that the officers instructed him “to go where no one could hear [his] message or read [his] sign.” The City disagrees, claiming that Seattle police simply directed Meinecke to the other side of the street and that they told Meincke that he “could still display his banner and exercise his [F]irst [A]mendment rights.”

Regardless, Meinecke declined to go to a different location. The officers then arrested Meinecke for obstruction under Seattle Municipal Code Ordinance § 12A.16.010(A)(3), which provides, “A person is guilty of obstructing a police officer if, with knowledge that the person obstructed is a police officer, he or she … [i]ntentionally refuses to cease an activity or behavior that creates a risk of injury to any person when ordered to do so by a police officer.” The officers took Meinecke to the police precinct and kept him there for about two hours; they did not book him. Meinecke was released after the abortion protest ended….

Seattle’s annual PrideFest took place on June 26, 2022, two days after the Dobbs rally. The event was held at the Seattle Center, a public park. Meinecke, again dressed in a shirt and tie, entered the park around noon and began to read from the Bible in a conversational tone.

Eventually, PrideFest attendees noticed Meinecke’s presence. As the district court found, they began “dancing near him, holding up a flag to keep people from seeing him,” and making “loud noises so he could not be heard.” According to his complaint, “a couple of attendees stood close to Meinecke and howled and barked like dogs, and mocked Meinecke, while he read passages from the Bible. Meinecke did not engage with them.” Another individual poured water on Meinecke’s Bible. Meinecke kept reading aloud.

After a couple of hours, more PrideFest attendees gathered around Meinecke and began yelling. This attracted the attention of about ten law enforcement officers, who asked Meinecke “to move to a public area located outside the park.” Meinecke declined and continued to read from his Bible. A PrideFest attendee shouted at the officers, demanding Meinecke’s removal. The officers then told Meinecke “that they were imposing a ‘time, place, and manner’ restriction on him and ordered him to leave the park.” Again, Meinecke declined to leave. The officers told Meinecke “that he was posing a risk to public safety,” and they again demanded he leave the park. Meinecke told the officers that he was not in any danger. The officers then arrested Meinecke for obstruction.

Meinecke again was taken to the precinct. This time, though, the officers booked him. He was later released on bond. At his hearing a few days later, the City informed Meinecke that it was not pursuing the charges against him at that time, but it warned Meinecke that “it could bring up charges for this incident at a later time.” …

Note the protesters stole his bible and assaulted him. Yet, the police threatened Meinecke with arrest and then took him into custody for failing to be silenced by the mob.

The panel ruled that Meinecke was likely to prevail in his constitutional challenge in granting a preliminary injunction “from enforcing § 12A.16.010(A)(3) against Meinecke in public parks and streets based on the anticipated hostile reaction of an audience.”

The panel expressly denounced the enforcement of  “content-based heckler’s vetoes”:

Our precedent on this point is clear: “The prototypical heckler’s veto case is one in which the government silences particular speech or a particular speaker ‘due to an anticipated disorderly or violent reaction of the audience.'” As such, it “is a form of content discrimination, generally forbidden in a traditional or designated public forum.” The Supreme Court has emphasized as “firmly settled” that “the public expression of ideas may not be prohibited merely because the ideas are themselves offensive to some of their hearers, or simply because bystanders object to peaceful and orderly demonstrations.” … “Listeners’ reaction to speech is not a content-neutral basis for regulation.” …. It is apparent from the facts, including the video available from police body cameras, that the Seattle police directed Meinecke to leave the area because of the reaction his Bible-reading provoked at the Dobbs and PrideFest protests….

[T]he City maintains that the police officers merely sought to relocate Meinecke’s speech rather than ban it outright…. But the government cannot escape First Amendment scrutiny simply because its actions “can somehow be described as a burden rather than outright suppression.” …

Even assuming that the officers simply instructed Meinecke to cross the street, their directions burdened Meinecke’s speech. Meinecke had a right, just as those participating in the anti-Dobbs rally or the celebration of PrideFest, to use public sidewalks and streets for the peaceful dissemination of his views….

“If speech provokes wrongful acts on the part of hecklers, the government must deal with those wrongful acts directly; it may not avoid doing so by suppressing the speech.” … The officers could have required the protestors to take a step back from Meinecke. They could have called for more officers—as they did after Meinecke was arrested. They could have erected a free speech barricade. They could have warned the protestors that any sort of physical altercation would result in the perpetrators’ arrests. And they could have arrested the individuals who ultimately assaulted Meinecke.

The City did none of those things. Instead, the police report on Meinecke’s arrest simply recites that “[w]hen resources allowed in the past[,] SPD would try and keep the two opposing groups separated.” That is hardly the sort of concrete proof necessary to establish that restricting Meinecke’s speech was the only way to avoid violence….

The opinion is a major win for free speech at a time when this “indispensable right” is under attack by an array of government, corporate, and academic interests.  We have seen Democratic politicians use the threat of violence from the left as an excuse to bar pro-life and conservative speakers. Likewise, this has become a regular practice at universities in barring conservative speakers due to security concerns while liberal speakers are free to speak on campuses.

      Rudy Gulliani was asked about the over whelming arrests of blacks in one precinct. The city ran an analysis on the 911 calls, and found >80% originated from blacks. What are the police to do? Ignore black on black crime? All you have proved is black are predisposed to criminal activities. Not a big surprise with the decimation of the black family, and too many boys raised without a male authority figure in the home. Govt “safety nets” removed fathers from the home, because the $ safety net, required as single head of household. Two nights ago, I began to watch a documentary film, “Confessions of a Serial Killer”, which is about Samuel Little, a serial killer who was active for 25 years, largely (but not exclusively) in Southern California, and who “specialized” in strangling black female sex workers who were typically also drug addicts. After Little was extradited, convicted, and imprisoned for three murders in the Los Angeles area, he confessed, with credible substantiating evidence, to the murders of 90 women in total, across the country. The film theme was tilted heavily toward speculation about how Little managed to run free for so long. Little himself was interviewed, and clearly stated that it was mostly because he was murdering women that no one cared about: sex workers with drug habits whose line of work and lifestyle put them in risky situations in dangerous environs. The narrator then interviewed a retired white Los Angeles detective who had investigated several of the murders in that jurisdiction. The detective explained the failure to solve those crimes in pretty much the same terns that Little used – the victims were pursuing a lifestyle that alienated them from most of “ordinary society”, including relatives and former friends. None of that stopped the narrator from claiming that the reason the crimes weren’t solved was racial prejudice because the victims were black. There then were interviews with some smarmy social workers, who had no connections to, or serious detailed knowledge, about the crimes. but who had absolutely no problem confirming that it was nothing but racial prejudice on the part of the police and prosecutors that allowed Little to operate for so long without being arrested. That clearly was going to be the theme of the rest of the film. I had to stop watching at that point: despicable opportunism that takes advantage of actual victims of violent crime turns my stomach. Near where I grew up in Southern Jersey, in the early 2000s, there were four female, drug-addicted, prostitutes murdered behind a seedy motel on a highway just outside of Atlantic City. The bodies weren’t found for weeks after the murders took place. While those murders have been investigated off and on ever since, and occasionally a newspaper story about some lead or other is published, they remain unsolved. Speculation for the last few years has been that the murderer was also responsible for 11 deaths of sex workers in similar circumstances that occured in Gilgo Beach, Long Island, NY in the same approximate time frame. None of those murders has been solved either. And, guess what? All 15 victims of those crimes were white.

      Correct – the rates of violence for blacks – not just in the US but throughout the world are about double that of whites.
      The rates of hispanics are a bit more than 50% higher. Conversely asian rates of violence are much lower than whites.

    Bill Maher wouldnt be caught dead reading Bible passages anywhere but like these Judges, Maher is now swinging mightily against the alphabet people (aka “Lesbian, Gay, Bisexual, Transgender, Queer, Questioning, Intersex, Asexual, Nonbinary, + Plus (The ‘plus’ is used to signify all of the gender identities and sexual orientations that letters and words cannot yet fully describe”). Maher even defends Governor Ron DeSantis in his judgment that the Left are indoctrinating kids in schools by sexualizing them. Not sure what to make of Seattle police turning their backs on the law, but maybe they decided “if you cant beat them, join them” or are tired of being hated by the people of Seattle. Thus it is surprising and encouraging that both the 9th Circuit and Bill Maher are sticking up for societal norms even if Seattle’s “finest” do not.

        The ‘plus’ is actually a stand in for a wide variety of behaviors that aren’t easily categorized (in most cases, in my experience, because they are pathologies, not orientations, that is somewhat true for the ‘Q’, too, it’s a catchall). The abbreviation used to just be ‘LGB’, even the ‘T’ wasn’t in the mix.

        I believe you are partially correct in your presumption, but it isn’t limited to pedos. Think furries, trans-humanism, or even things like (blech) coprophilia. Someone of that mentality once told me standing in line at a dance club, ‘I’d **** anything! I’d **** a plant!’. They were not gay, just damaged.

        There are legitimately unwell people throwing shade by association on those with integrity in LGB circles, just like every other area of life the unwell have infiltrated.

  7. It appears that the reading of bible passages did not interfere with hearing the speakers at the rally (if there were any). Therefore, the officers were not justified in asking Meinecke to move. The shutting down of a speakers merely because someone else threatens to assault him opens the door to an immediate privilege of censorhsip by anyone who does not like what the speaker says. It is like academics who shut down conservative speakers at colleges by saying that they or their students are “triggered” by the words of a speaker. By implication, their emotional tranquilty trumps the legal right of the speaker.

  8. The arrest and charges took place in June 2022, and the case had to work its way to the appeals court for final relief.
    The process is the punishment for the victim. Until there are severe civil and criminal penalties for the perpetrators, including the officers and city managers, this fascist behavior by ANTIFA will keep happening.

    All this goes on yet the FBI cannot seem to figure out how to deal with Antifa. Local police in local communities all across this country have arrested and unmasked Antifa members.
    Yet with all our internal security apparatus the FBI cannot seem to connect the dots with friends and adherents and build a coherent network of these thugs. Either they don’t know how to draw lines or dots or they simply have forgotten how to reconstruct and expose a terrorist organization or more likely they have been ordered not to.
    Seems our intelligence agencies have every other organization in the country and outside penetrated with agents yet Antifa runs amok with no apparent idea who is in charge. That to me suggests they are at the beck and call of individuals or political parties inside this country. To have all that organization at a riot with armour and shields and objects to throw, you, by definition, have to have an organization and any organization can be penetrated.

  11. This decision also directs City/State Governments that they have an inherent duty to arrest violent perpetrators that suppress others. This should be the wake up needed to stop ANTIFA and other violent protesters that attack others with differing views. I wonder what that means to any of the cases that have been ignored on this issue?

  12. I find it unbelievable that “Antifa” has become a household word and has been intimidating people and committing terrorist acts with impunity for at least the past six years. There appears to be no FBI, DOJ, IRS interest in their activities. The seems to be able to recognize them. They have a uniform, websites, wear patches, they aren’t even hiding, and yet there is still no interest in investigating a radical, leftist, terrorist group. I realize that the FBI is slow to react to these things, even denying that the “mafia” existed during prohibition, but this group has been active for years with no high profile arrests. Their members seem to drift to every radical leftist protest/riot across the country. BLM rallies, terrorist environmental groups, occupy wall street, etc. Where do they receive their funding? When they’re arrested, nothing seems to come of it. They’re usually under 25, no job, no means of support, they’re often armed, and are arrested at a protest/riot hundreds of miles from where they live. Doesn’t that seem unusual? Isn’t this what the FBI is supposed to be investigating?

  13. This 9th circut ruling, re-establishes Enumerated Rights, above Government official actions.

    Now transfer this Rights first, Appeals Court decision, to the overtly anti constitutional gag order against President Trump.
    The Judge cannot strip a defendant of his constitutional rights. The judge also limited what reporter can report about the Jury. A direct violation of the freedom of the Press. The judge also has determined the prosecution will NOT provide the defense with a list of witnesses.

    Judge Merchen will get the conviction that will be free of facts of any crime. Then the Judge will have to explain why he will not put Trump in jail. No sane person believes you can put a President behind bars for non-crimes
    Of course this case like the previous two will ultimately be overturned by SCOTUS, of the lower appeals courts ignore the lack of due process.

In the last three days I have now seen this story out of Seattle, a story out of NYC where an Israeli beauty queen and soldier was punched in the face by a Hamas supporter and the police did nothing to the guy and a case out of London where the police told a Jewish man to stay out of a certain area not because he was doing something wrong but because he was too outwardly Jewish and it would rile up the Muslims in the street at that time.

    We also have stories out of Columbia University where Jewish students are being harassed by Hamas lovers without being protected by the school.

    Jewish people need to wake up and they need to wake up soon. Some notable lefty Jews have started to speak sense, people like liberal Debra Messing, liberal Michael Rappaport, liberal Amy Schumer and other lefty Jews that have a voice. Wake up, they are coming after the Jews and they aren’t hiding it any more.

    As an aside, does anyone think that it would have been ok for the Antifa goons in Seattle to steal a Koran off of a guy praying, rip up pages of a Koran, pour water on a Koran that a Muslim guy was reading? It is open season on Jews and it is fine to attack Catholics or even Christians to a lesser degree, but say anything about Mohammed or Islam and you are done. These chicken (you know whats) would never attack Islam or Muslims the way they attack Jews or Christians. That is why we need to fight back.

      Given enough room, the left always start eating their own. Leftist revel in the diversity of their collation. Lacking historical knowledge that many segements hate each other. Blacks and Hispanic dont like each other and have wildly conflicting cultures. Jews are heavily Dem, but we can see the elite colleges have been cultivating antisemitism for decades. This riots did not sprout like wild flowers. The seeds have been planted and nourished for decades.

      But, these protestor self identify as Hamas. That means attacking Jews and Christians, is attacking the enemy. These rioters thing attacking Jews, is a daily chore to be completed, like taking out the trash.

    1. Why do the police have to get it right? Immunity means they are protected from any sort of responsibility. You can bet the command level in Seattle, are busy constructing work a rounds to the court ruling. A way to do the same thing differently. It is the culture of the radical leftists.

      Unfortunately, there seems to be an ever-increasing tendency on the part of police to take the course that comprises the least work and least risk, rather than the course that the law seems to demand. Whether this is simply another symptom of the disintegration of our society, or if there is more involved, I do not know.

    3. As Bobby Hull alluded to, the police surely would not have arrested the speaker if he had been a Muslim reading from a Koran. They took the easy way out knowing they will never be held personally responsible, and any final court judgement is many years in the future, at which time they will likely have moved on to another job.

    A 16-year-old High School student in North Carolina was suspended for three days after using the term “illegal alien” – a legal term of art, during a vocabulary assignment in his English class.

    Leah McGhee, the boy’s mother, says her son was assigned vocabulary words during class last Tuesday, which included the word ‘alien,’ the Carolina Journal reports. When her son asked; “Like space aliens or illegal aliens without green cards?” – another student in the class took offense and threatened to kick his ass, prompting the teacher to call in the assistant principal.

    School administrators at Central Davidson High School in Lexington deemed his words ‘offensive and disrespectful to classmates who are hispanic,’ according to the report.

    “I didn’t make a statement directed towards anyone; I asked a question,” the suspended boy said in response to his suspension. “I wasn’t speaking of hispanics because everyone from other countries needs green cards, and the term “illegal alien” is an actual term that I hear on the news and can find in the dictionary.”

    According to the report, the boy’s record could now be damaged as he aims to secure an academic scholarship for collage. He currently participates in school clubs, track, and cross country.

    “Because of his question, our son was disciplined and given THREE days OUT of school suspension for ‘racism,’” his mother wrote in an email shared with the Journal. “He is devastated and concerned that the racism label on his school record will harm his future goal of receiving a track scholarship. We are concerned that he will fall behind in his classes due to being absent for three consecutive days.”
