The Trump short list for vice presidential candidates is reportedly down to Ohio Senator, J.D. Vance, Florida Sen. Marco Rubio, South Carolina Sen. Tim Scott and North Dakota Gov. Doug Burgum. Rubio is a favorite for many due to his record in the Senate and his appeal to hispanic voters (where the GOP is hoping to make gains in the coming election). The problem is not Rubio or his record, but his residence.
The Twelfth Amendment contains a habitation or “favorite sons” provision: “The Electors shall meet in their respective states and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves.”
The risk is that Florida’s electoral votes could be challenged in any election since both Trump and Rubio reside in the state. That is a chunk of 30 votes in a close election. In addition other states which sought to block Trump from the ballot like Colorado could try this new tack to derail his campaign.
The most obvious option is for either Trump or Rubio to move. The easiest would be for Trump to move since Rubio represents Florida. That could include either New York or New Jersey ( where his Bedminster property is located).
That option would be costly for Trump in terms of taxes. Moreover, Trump is desperately trying to get out of New York where he is effectively shackled to the defense table as his opponent, President Joe Biden, campaigns around the country.
The funny thing is that Trump has been campaigning in New York and drawing some large crowds. It would be the height of irony if Trump ends up making New York competitive with a mix of the time forced to be in the state and a change of residency.
Alternatively, Rubio could resign from the Senate and focus on running with a residence in a different state. He could also attempt a more creative approach and just change residency for the election.
Under Article I, Section 3, Clause 3:
No Person shall be a Senator who shall not have attained to the Age of thirty Years, and been nine Years a Citizen of the United States, and who shall not, when elected, be an Inhabitant of that State for which he shall be chosen.
Rubio can argue that he was “an Inhabitant” of Florida “when elected.” Given the recent controversy over the appointment of Democratic Senator Laphonza Butler, it could be hard for some Democrats to object.
Yet, there will be some who will no doubt try. In 2000, Dick Cheney was challenged by three Texas residents when he moved back to Wyoming. They failed.
Ultimately, it could also be challenged in Congress under the Electoral Count Reform Act.
Despite declaring the challenge to the Biden election was an attack on democracy, Democratic members previously challenged Republican presidents in Congress, including Jan. 6th committee head Bennie Thompson (D-Miss.) and Rep. Jamie Raskin (D-Md.)
In other words, it could be done but it would likely draw challenges. Then again, why should this part of the election be any different from every other part?
Picking a career politician for VP is the one thing that will cause me to stay home.
Yep please stay home!
That’s just stupid. So you won’t vote because Rubio is a career politician and yet your non-vote may assist Biden-Harris?? Real deep thinking there.
When this whole Veepstakes thing started the word was that Trump was going to pick a woman. There were several names mentioned.
Truth is, Trump cannot really work with women and does not respect them. It is not surprising that his list is now exclusively male.
That’s a talking point proven wrong by 5 decades in business, working along side women Rumor has that he married one, and he may have even created one or two. Compare him to Biden.
Trump married three women, and KNEW several others in the biblical sense while married, then paying them to say it never happened. Then there’s the one he assaulted in a department store, along with being photographed feeling up his oldest daughter that he says is “hot.”
There is a tiny possibility that you are right – beyond that Trump married 3 women.
Trump was fairly open about being a playboy when he was younger.
But the MacDougal and Clifford stories are far from established truths.
I do not personally care if they are true. It does not change anything if they are.
Neither are alleging the bizzare fetish behavior of Biden. None are alleging anything non-consensual.
Aside from These women now saying something happened having previously denied it, as well as having said other things of dubious credibility, and Trump denying it – we really have no actual evidence.
Further, Trump paid his doorman 30,000 to kill an absolutely false hearsay story about a love child with a hispanic maid.
I think a First hand false account probably is worth 130,000 to him. One of the strongest indications that the Daniels and MacDougal stories are false, is the tiny amount of money they were paid.
YOU beleive those stories would have tipped the election. So why didn’t Trump pay more – much more for them ?
Why didn’t Daniels and MacDougal and their lawyers shop the story to Hillary ? She paid over a million for the Steele Dossier Hoax.
Do you honestly think she would not have paid big bucks for these stories – If they could be proven true ?
The same BTW is true of the E Jean Carrol nonsense.
All that proves is that in NYC with a biased judge and biased juries you can almost get what you want from a jury.
You will notice the Carrol Verdict had zero effect on the polls.
If you had a cluen that would NOT be because Trump voters – including independents do not care if Trump sexually assaulted E, Jean Carrol, it is because the majority of people understand lawfare when they see it, and they do not beleive Carroll.
My Daughter is “Hot” – but I did not take showers with her.
We are 10 days into the Bragg Trial and so far the prosecutions case is being won by the defense.
Even the lame stream media is ceding that the case has not only not been made – it is weaker than it was at the start, they have NOT connected Trump to these deals or to these women – except in the most tangential ways.
Multiple prosecution witnesses have established that Trump did not deal with them, or Deniels of MacDougal. that they have no evidence tht Trump had anything to do with any of this, that it was all being done by Cohen.
And several witnesses confirming that Trump was very deeply concerned about Melania finding out about this – going so far as to stop newspaper delivery to his NYC residence.
Then we have witnesses saying the Campaign put alot of time into figuring out how to deal with the Access Hollywood tape – but Daniels and MacDougal did not come up.
And Prosecution witnesses who are Lawyers within the entertainment industry have testified that the money paid for NDA’s is “legal fees”
It would be nice if the actual trial was televised. Everyone is only hearing what one side or the other decides is worth reporting. I watched a bit of Fox coverage which avoided almost all the facts to tell the audience why in their opinion there should be no coverage at all.
I don’t doubt Trump had some concern about Melania finding out. Thinking stopping delivery of the newspaper would keep her unaware is ridiculous but that’s another thing. It only matters that he was partially movitated by the election which has been more than proven by multiple witnesses.
Isn’t there a tape with Trump discussing making the payments you say he isn’t tied to in cash? McDougal was happy not to have her story published and preferred the Enquire kill it rather than Hillary publish it. Pecker says he was aware at the time he was guilty of violating election finance laws. Believe if you want that the defense is winning. If Trump loses you’ll blame it on something else because you can’t acknowledge who Trump is. Forgetting about McDougal and Stormy, he cheated on Ivana with Marla Maples and on Marla with Melania. Why does he have the names and numbers of women he doesn’t know in his records? Almost all of the witnesses are former Trump employees or friends. We haven’t even gotten much to the falsified records but the election fraud is clear.
Biden’s 2024 Ere-election campaign has devolved to the increasingly distant hope that Trump will be convicted and voters will care.
Your trying to rig another election – and failing miserably.
John Say,
“Your trying to rig another election – and failing miserably.”
That right there.
Rig “another election,” how sad.
You like rapists.
Biden has worked so well with Harris – Oh and Reade.
Two Florida men on the ballot is two too many.
Hold my beer…
RFK Jr. and Shanahan are both from California. Not sure if they just don’t care because they are not planning to win anyway.
Cue: the comments from trolls that do not address much of anything but their own hyperbole. Again, if these trolls aren’t paid (and I think they are, every last one of them; I have experience in that realm), then wow are they sad to show up here everyday and spew their idiocy. It doesn’t work on people that actually think, gang, and that is 99% of the people that follow this particular blog in the first place. Just yawn, go away already. You are convincing no one, your efforts and dollars are better spent on the likes of Tik-Tok. The kids their will lap it up; we know better. Far too much better. The pixels you monopolize here still don’t scroll far enough; you are ridiculous. more and more with each passing day. Thank your handlers for the check, and maybe think about actually helping another human on this earth instead of posting your vile boosheet here.
*there
Rubio is the favourite be cause he is the choice of that Singer Jew guy. And because he, Rubio is into the lifestyle.
The precursor to Moshiachian rule is homosexual rule, because the Moshiach is the biggest most flamboyant fancyassed Jew ever. We are getting there.
I like Tim Scott and would have no problem with him as a vice president or even president some day but I would reserve judgement on the presidency part until I first see him elected to the vice presidency and then see how he performs. JD Vance is good but he is better to stay in the senate for now and I would not care for the present governor of Ohio getting to pick his replacement. Tim Scott could be picked because his replacement in the senate would likely be a good pick with their present governor. I don’t think the ND governor adds that much. I would prefer the Virginia governor and he would be replaced by a rising star lieutenant governor. Marco Rubio is fine from my perspective but Trump, would have to move. I would suggest he move to Texas but avoid Travis, Bexar, Harris, Tarrant, and Dallas counties. Those counties are inhabited by too many democratic covens.
as if anyone gives a fvck about your opinion. physician or not you esteem yourself more than anyone else does you douche
GEB said: “I would prefer the Virginia governor and he would be replaced by a rising star lieutenant governor. ”
Agree with you about Youngkin. I have mostly been following his vetoes of 2A attacking bills from the Democrat VA legislature (I own some acreage there and am a VCDL member) but I’m confident his other actions mirror those. I have not heard much from here about the Lt. Governor but will take your word that she is doing well. Her public speaking seemed to exhibit some lack of coherency during her and Youngkin’s campaign, but perhaps she has worked on that. Virginia is a state-level battleground state; I wouldn’t want the Dems to get the governor’s chair as well as the state houses.
He is a senile old man suffering from dementia, at the very least. Obama and Clinton are running the country, into the ground, on purpose (Saul Alinsky).
Iowa had Senator Tom Harkin. He rarely came to the state of Iowa, but that was never a problem for the Dems.
Harkin owned a home on the Bahama’s 35% of his time, 64% time in DC, and 1% time in Iowa.
I dont think radical leftist a chance to question the EC votes is enough to push Little Marco
Let’s see if I read this right–Turley says: “He could also attempt a more creative approach and just change residency for the election.” So, Turley is suggesting that Rubio deliberately be deceitful by playing games with his residency in order to circumvent the requirement that a POTUS and VP can’t both be residents of the same state, all of which is being done to court Hispanic voters? So, Turley, is that what George Washington University teaches law students–how to cheat to circumvent the Constitution, calling it a “creative approach”? And, you wonder why some of us, especially experienced attorneys like me and Dennis, do not respect you.
How utterly predictable: A Far-Left partisan attorney saying that “circumventing” the law is “cheating” and not worthy of respect. Wow. They always accuse you of what they are doing themselves. What else do you call the repeat efforts of Biden to give away trillions of public assets to buy votes from student debtors after being told his prior efforts were unlawful? And Gigi and Dennis, I guarantee you, practice the same tax “circumvention” every year, just like we all do. Otherwise known as tax avoidance, or tax planning. What hypocrites.
Gigi, thank goodness the Dems never cheat, bend rules, are deceitful, play games, etc.
If you and Dennis are/were actual lawyers, no wonder the rule of law is so twisted now.
How many innocent people did you put in jail? How many who were guilty did you let go free?
In what state does California Dem US Senator Adam Schiff have his primary residence? Where is Maxine Waters primary residence located? I’m sure you’re quite worried about the fact that neither reside where they were elected to represent.
When RFK Sr and Hillary Clinton each in turn moved to NY in order to represent it in the senate, were they each being “deceitful by playing games with their residency in order to circumvent the requirement” that a senator live in his state on election day?! (And that actually is a requirement, unlike your claim, which is not.)
In the old days I thought the VP selection, was largely based on delivering the EC for their home State. I need convincing about Gabbards transformation. She sounds good in interviews, though stiff in her delivery. Very metered, modulated, and enunciated, It sometimes feels like English is her second language.
Scott is a marketing creation.
Burgum is real. A businessman. All successful businessmen, take decisive actions towards goals. He would be very good at the cabinet level, except he has zero DC support structure. He would be froze out, what ever agency he led would make his life hell, and slow walk all his reforms. At the cabinet level, I think the only way to make things happen is clean out the top level of civil servants at an agency. Send the hither to the offices at the state level No cut in pay. My bet, very few will accept the move and quit.
Dubya and Lord Cheney were both listed as Texas residents, Cheney changed it to Wyoming. But Cheney lived and worked in Texas for Halliburton. Didn’t matter, no one paid any attention until it was to late.
Was also an issue in 1980 IIRC. There was a move to have Jerry Ford run as Reagan’s VP, but since both were living in CA at the time., it sort of died out
One of the biggest problems is
the two top candidates are Trump and Biden.
Those are really the best we can do???
@Anonymous
I hear you, but even though Trump is the blowhard that he is, there’s no arguing with his policy. It’s pretty clear that the Bidens play fast and loose with international policy, if nothing else (the rest of the time they are carrying water for the party, IMO. Likely, but unconfirmed, Obama’s party. And hoo boy do they interpret the law into their own, esoteric, unknown to any other living person, language. They might as well be interpreting the law as that made up language from Game of Thrones. I used to compare them to Al Capone, but the modern DNC is much, much stupider than that, the mob at the least had a soupçon of subtlety in their daily dealings; they don’t deserve the credibility of the reference).
I am A-OK with trump’s policy. I have zero doubt the reason the dems started in with the quid pro quo nonsense in the Ukraine years ago, based on one phone call, no less; along with everything else, because they were terrified at what an outsider might discover (even though in years prior, Trump was a lifelong dem) and where that person might take it. I’ll take Trump’s mean tweets over a single thing that the DNC has wrought for nigh on 20 years. 🤷🏻♂️ Trump can’t control his mouth, to be sure, but he did a lot of good. Why do you think the dems undid it all with a record-breaking number of executive orders on virtually the first day of Joe’s inauguration? At some point you gotta call a spade, a spade. There is nothing redeeming about the modern, lockstep, American democratic party. Zero.
James,
I agree.
I was surprised at how aggressively the DNC went to shut out any other possible candidates and run with such a weak choice. Are they trying to lose?
Then DeSantis campaign seemed to shoot themselves in the foot over and over again.
Given their track records, and the woke crazy the leftists have highjacked the Democrat party, I have to vote for Trump.
Dear President Roosevelt,
While we know that Gen. Patton is a good general, we simply can not support him leading our troops because of his foul language!
Sincerely,
Mrs. Edna Prigg,
Chairman of the Christian Ladies Association
Just gonna leave this here in agreement https://torrancestephensphd.substack.com/p/dirty-deeds-done-dirt-cheap
Be careful what you ask for. Distaste for RINO is valid but they do have a voting block. Sometimes concessions win elections.
Trump/Gabbard 2024!
Gabbard 2028!
I gotta buy her new book.
2 Democrats on the top of the ticket? Last D to run with a Republican as VEEP was Andrew Johnson. We all saw how that worked out.
Technically, they did not run as Republicans – they were the National Union Party
Why is Turley spending his time writing and posting multiple pieces of garbage every day, often in the middle of the day?
He is a professor at a major law school.
It is finals time, the busiest time of the academic year.
He should be offering review sessions for his students before finals.
He should be holding extended office hours for students.
He should be grading papers in a thoughtful and constructive manner.
Do you notice that he never posts in the evening on his own time at home?
The answer to this conundrum, of course, is that he doesn’t write this garbage. It is fed to him by his handlers at Fox.
Reading for comprehension is what held you back in school, and why you get everything wrong. Even as an adult you can get remediation. Or just finish out your life stupid.
My, my, my.
What a thoughtful and insightful comment.
And yet, 100% accurate.
Iowan2,
Well said.
You’re just angry because you lost.
Why is it your business ?
Why do you presume that Turley is not doing all of the above – to the extent that is what Law professors do.
I do not know specifically about GWU, but I was a TA at GA Tech in the 70’s and I graded papers – not the professor.
I also had extended office hours so that students could get remedial assistance before finals.
Good for you. Glad to hear that you helped the students.
But were you also at the same time, writing political propaganda every day?
Were you travelling to NY to appear on the Fox Fantasy Channel?
Even when not travelling to NY, were you constantly making remote appearances on Fox?
To quote John Say,
“Why is it your business ?”
Oh, no!
The good professor is not writing about what you want him to write on his own blog!
Cry harder!
And maybe it is the good professor has better time management skills than you do. He could of written this in between appointments. He could of written it while eating lunch at his desk.
But this is the problem with leftists. They always think they know better. They always want to tell everyone what to do and how to do it. It is the fascist side in them that is showing.
Why is it that posts from left wing nuts NEVER address actual issues and always become attacks on character.
Do you have anything substanative to say ?
John Say,
As they demonstrate daily, no, no they do not have anything substantive to say.
Trump has been indicted for serious crimes and you look the other way. There, I said something critical of Trump. In your view, that makes me a left wing nut. That fact that you think this way…
This is a constitutional and legal blog. Turley wrote about the legal and constitutional issues regarding Trump’s potential VP candidates.
Pretty much on point.
Why does this have your panties in a bunch ?
I am not especially happy with any of the Choices that Turley listed and hope that Trump is picking from an entirely different list.
But Turley’s post was about the constitutional and legal issues associated with picking Rubio.
Whether Trump pick’s Rubio or not since Trump is aparently considering Rubio, The constitutional issues are a legitimate topic for this blog.
Barring a miracle – Biden is stuck with Harris. So we will not see posts about that dicision.
Separately, Turley is correctly noting that Trump is trying – as any rational person would, to extricate himself from the $hithold that NYC has become. Aparently many on Wall Street are leaving NYC posing a serious threat to the role of NYC as the financial capital of the world.
Though Wallstreet firms are rehoming many places – a significant number are being attracted to Florida.
Regardless, the left has behaved idiotically and made their conduct the appropriate topic of legal and constitutional blogs.
When you behave lawlessly and unconstitutionally – you should expect that Turley will cover it.
In this instance Turley is discussing the constitutional and legal problems associated with one of Trump’s choices as VP.
I do not dislike Rubio, But I hope he is Not Trump’s choice.
But Turley did not discuss the merits of Rubio or others as candidates, but the constitutional and legal issues.
How is that Fox Fodder ?
John Say,
Well said and spot on.
does Doug promise to bring in the North Dakota vote? North Dakota is the 19th largest state, but with a population of less than 780,000, it is the 4th least populated.
Rubio is a joke…and Scott is a media creation
for the LOVE OF GOD…those are HORRIBLE RINO selections!
Absolutely, I want MTG on the ticket.
So you want the D’s to win?
Vivek the only one that would stand up to media and other countries with truth and great ideas to make America great again. If he doesn’t make him vp then put him in your administration, you won’t regret that pick
try and win without them. GOP is a minority party, and you and your cult master really can’t afford to throw this 15% under the bus. And that’s just a guess as to how many Republicans won;t vote for Trump under any circumstance.
MAGA is RINO. If Reagan were alive he would have denounced Trump as he descended on the escalator.
