Below is my column in the New York Post on the ruling against Nina Jankowicz in her defamation case. It turns out that calling opposing views defamation is no better than calling them disinformation.Here is the column:
For free speech advocates, there are few images more chilling than that of Nina Jankowicz singing her now-infamous tune as “the Mary Poppins of Disinformation.”
The woman who would become known as the “Disinformation Czar” sang a cheerful TikTok parody of “Supercalifragilisticexpialidocious” to rally people to the cause of censorship.
When the press caught wind of President Biden’s plan to appoint Jankowicz as head of the Department of Homeland Security’s new “disinformation board,” Fox News said she “intended to censor Americans’ speech.”
The backlash was swift. Plans for the board were suspended, and Jankowicz resigned in 2022. She then sued Fox News for defamation.
On Monday, the case was dismissed. But Chief Judge Colm Connolly didn’t just say it was legally unfounded — he demolished the claims of figures like Jankowicz that they are really not engaged in censorship.
I was one of Jankowicz’s earliest and most vocal critics and she is discussed in my new book, “The Indispensable Right: Free Speech in an Age of Rage,” as part of the current growing anti-free speech movement in the United States.
The Biden administration has coordinated with social media and targeted the revenue of conservative, libertarian and other sites.
These figures gleefully worked to silence others with the support of millions in public dollars for years. Yet, when exposed to criticism, they often portrayed themselves as victims with an obliging and supportive media.
They all took a page from Mary Poppins, who “taught us the most wonderful word!” In this case, the word is “disinformation” and it is certainly not connected to “censorship.” Rather you are supposed to call the barring, blacklisting and throttling of opposing views “content moderation.”
Jankowicz took that not-so-noble lie to a new level. After losing her job, she launched a campaign soliciting funds to sue those who called her a censor.
I was highly critical of these efforts as trying to use defamation as another tool to chill critics and shut down criticism.
It was a telling lawsuit, as Jankowicz simply labeled criticism of her as “defamation” — just as she labeled opposing views “disinformation.”
The objections to her work were called false and she insisted that she was really not seeking to censor people with her work.
Connolly made fast work of that effort. After holding that people are allowed to criticize Jankowicz as protected opinion, the court added:
“I agree that Jankowicz has not pleaded facts from which it could plausibly be inferred that the challenged statements regarding intended censorship by Jankowicz are not substantially true. On the contrary … censorship is commonly understood to encompass efforts to scrutinize and examine speech in order to suppress certain communications.
“The Disinformation Governance Board was formed precisely to examine citizens’ speech and, in coordination with the private sector, identify ‘misinformation,’ ‘disinformation,’ and ‘malinformation.’ … that objective is fairly characterized as a form of censorship.”
Of course, in America’s burgeoning censorship infrastructure, the entire decision is likely to be viewed as some form of disinformation, misinformation or malinformation.
After all, even true facts can be deemed censorable by the Biden-Harris administration.
I testified previously before Congress on how Jen Easterly, who heads the Cybersecurity and Infrastructure Security Agency, extended her agency’s mandate over critical infrastructure to include “our cognitive infrastructure.”
The resulting censorship efforts included combating “malinformation” — described as information “based on fact, but used out of context to mislead, harm, or manipulate.”
Thus, referring to Jankowicz as engaged in censorship on this defunct board may be true, but could still be treated as “malinformation.”
As I discuss in my book, these setbacks are unlikely to deter the corporate, academic and government figures aligned in our current anti-free speech movement. Millions of government and private dollars are flowing to universities and organizations engaged in targeting or blacklisting individuals and groups.
It is now a growing industry unto itself.
The new censors have gone corporate and mainstream. Silencing others is now a calling, a profession. They have literally made free speech into a commodity that can be packaged and controlled for profit.
Yet Confucius once said that “the beginning of wisdom is the ability to call things by their right names.” This opinion takes a large step toward such wisdom.
If figures like Jankowicz want to continue to make money silencing others, we can at least call them for what we believe they are: censors.

Speaking of disinformation, there is a curious similarity in many media outlets suddenly claiming that Kamala Harris was never a “border tzar”. The very same outlets that reported that President Biden appointed Kamala Harris border tzar, in charge of the border crisis, are all now asserting it never happened. When called on their previous reporting calling her exactly that, they are updating previous articles to “correct” or remove that title, or adding a note that the title was erroneously attributed to her.
We are all told that President Biden never told us, on camera, many times, that he’d put Kamala Harris in charge of the border, or that Jen Psaki and Karine Jean-Pierre ever had to field questions from reporters on why Harris wouldn’t visit the border or improve the crisis. We are all told to forget Kamala Harris telling us she was working on the “root causes” of the migration crisis, as part of being in charge of the border.
The phenomenon is across many media sources. Mainstream media is either denying she ever was given any responsibility about the border at all, or claiming that she had no real power to do anything about it, and so had no connection at all to the crisis.
She resisted visiting the border where migrants surged through. She solicited pledges of billions of dollars from corporations and private individuals, yet over 10 million illegal aliens got through the border, where BP became concierge services to illegal immigrants. Her “root causes” plan was to somehow improve the conditions in countries that send illegal immigrants. Afghanistan should have already taught us that nation building doesn’t work. As long as the conditions are better in the US than another country, then people will want to migrate here. The only way to stop illegal immigration from the “root causes” standpoint is to make the conditions in the US worse than the source countries.
There seems to be such marked similarly and timing of these articles denying Kamala Harris position of border tzar that one wonders if, once again, the Biden Administration is colluding with the mainstream media to spread propaganda and disinformation to the public, to interfere in the upcoming election.

This rotten regime is always colluding with someone or some entity to accomplish something evil. “Doing good” at anything worthwhile to U.S. Citizens is not in its scope of vision. And as far as “Mainstream Media”, as you call it, goes, Joseph Goebbles would be gleeful, down right proud, were he here to witness them in action. So you use that to segue into you frequent but unsupported claim there is a “burgeoning censorship infrastructure” put in place by the Biden administration. Only one problem. You have been unable to cite one person or group who has actually been “censored”. In fact, the last time that claim was made by conservatives in Missouri v. Biden, Justice Barrett ruled in a 6-3 decision that the plaintiffs couldn’t show they were “censored” by any action taken by the Biden administration.
Jankowicz is not the only one to lose a defamation lawsuit. DJT has frequently sued publications because he didn’t like their coverage of him. He lost EVERY one. In the last one in England he lost a defamation suit against Christopher Steele–and big time. He was ordered to pay $382,000 in court costs! That was back in March and there is no indication DJT has paid that civil judgment. Funny you don’t mention any of that in your rant against Jankowicz.

For most rational American adults, the judicial rejection of this feeble claim of being defamed in the context of this Birthing Person’s personal online history would seem to be the only rational outcome.

Who knows – they are no longer up where they can be reviewed and they’ve been scrubbed from the Way Back Machine archives.
As background and context to both the failed Disinformation Queen, Douglass Mackey’s prosecution and imprisonment for a meme, and the DoJ that imprisoned Mackey just seizing and shutting down two websites as “Russian election disinformation”, this website is still very much up and pops right up on a Google search for Trump Project 2025:

That website was created by the Biden/Harris election campaign. It is crafted to give the impression that Project 2025 is the creation of and part of Trump and his election campaign. The contents are every single lie and misrepresentation of Project 2025 we have seen proclaimed by both Biden and Harris as well as right here by Dennis McIntyre and Gigi. The talking point lies they post here could have been copied from that website and then posted here.
The website can still be seen – unlike the “Russian disinformation websites” taken down by Merrick Garland. The Soviet Democrats who created and published that fraudulent website aren’t worried that police state fascist Merrick Garland and his STASI minions are going to prosecute them and throw them in a cell with Douglas Mackey.
The Disinformation Queen failing in her feeble lawsuit is nice, but minor. We still have Soviet Democrats who will silence free speech by imprisoning Douglass Mackey for a mocking satirical meme, shut down websites they claim (trust them, they’re the DoJ) are Russian disinformation – and allow Biden/Harris to create and publish a fraudulent website that appears to be from Trump and his campaign.

Go to the home page of the Heritage Foundation (a conservative think tank organization founded in 1973): heritage.org. In the middle of that page is a link to “Project 2025: Presidential Transition Project”. That link navigates to (guess where) project2025.org. By the way, quite a few parts of the home page for the latter site have upload stamps from February, 2024, so this isn’t something that was “recently” created, no matter what the authorship might be. I’m beginning to suspect that yo and Dennis McIntyre are the same poster, just engaging yourself in puerile debate for your own feeble-minded amusement.
