For years, former CNN Anchor Lynne Russell was the familiar face of Headline News for the country. She may soon be making headlines again as the lead plaintiff in what could prove a major Second Amendment challenge in Washington, D.C. Russell is challenging the city’s prohibition on “off-body” carrying of weapons, including keeping a handgun in a purse. That type of off-body carry is precisely what may have saved Russell’s life in a shootout with an armed assailant in 2015. Russell’s nightmare began when the armed assailant grabbed her outside of their motel in Albuquerque, New Mexico and forced her into her room. He then threw her across the room on to the bed as her husband, Chuck De Caro, a former CNN correspondent, was coming out of the shower.
Russell then had the amazing calmness and control to suggest to her husband that there might be something in her purse that the man would want. Inside was her gun and De Caro pulled it out and exchanged fire with the man. He was shot three times but survived. The assailant did not.
Both Russell and De Caro showed amazing courage. The fact that De Caro could come out of a shower naked and immediately engage a gunman in a shootout is worthy of a Die Hard sequel.
Russell is now leading the fight for others, particularly women, who use off-body carry for self-protection. For many women, a holster is not a convenient option with dresses and other outfits. Indeed, there are guns and purses specifically designed for women to blend into clothing styles.
Under D.C. Municipal Regulation § 24-2344.1 and § 24-2344.2, citizens are instructed:
2344.1A licensee shall carry any pistol in a manner that it is entirely hidden from view of the public when carried on or about a person, or when in a vehicle in such a way as it is entirely hidden from view of the public.
2344.2A licensee shall carry any pistol in a holster on their person in a firmly secure manner that is reasonably designed to prevent loss, theft, or accidental discharge of the pistol.
It is not just a matter of style. A holster on a dress outfit is more likely to stand out and could serve as an attraction for felons who are seeking to steal a weapon.
The Russell challenge seems quite strong to me. Under the post-Bruen jurisprudence, it will be difficult for the District to show historical support for limiting gun rights to on-body-carry situations.
While the District is citing a contemporary New Jersey law, that is not quite the historical support that the Court has previously demanded.
The Court held that “when the Second Amendment’s plain text covers an individual’s conduct, the Constitution presumptively protects that conduct.” To overcome that presumption “the government must demonstrate that the regulation is consistent with this Nation’s historical tradition of firearm regulation.”
It is doubtful that any early gun laws barred carrying weapons off body. Indeed, the most common weapons like muskets necessarily were carried on horseback or kept at arm’s reach.
I have previously written how New York, D.C., and Chicago are examples of Democratic cities that routinely commit lasting self-inflicted wounds to gun control efforts with poorly conceived and poorly drafted measures.
In 2008, the District of Columbia brought us District of Columbia v. Heller, the watershed decision declaring that the Second Amendment protects the individual right of gun possession.
In 2010, Chicago brought us McDonald v. City of Chicago, in which the Court declared that that right is incorporated against state and local government.
These cities are the gifts that keep on giving for gun rights advocates. Politically, local officials are heralded for any gun control legislation and they are rarely blamed for major losses that come later in the courts — losses that often expand the reach of prior cases.
The case is Russell et.al. v. District of Columbia et.al. Case number 2024-cv-1820.

Harris is not qualified. That has nothing to do with being a women or being Black(ish) – she has been an elite all her life – she shares very very little with most black people in this country.

I expect that poll on being ready for a female president has much more to do with the quality of the contenders for the honor of being first than anything.

Harris MIGHT have given Democrats a long shot at retaking the House – though the generic ballot is more GOP favorable than in 2022.
And she likely diminished the scale of the republican sweep in the Senate.
But she has not changed the presidential election.

There is no indication that the delegates to the Philadelphia convention, or to the thirteen ratifying conventions, were familiar with Vattel’s work, or paid it any regard; there is every indication that they were familiar with Blackstone, and held him in far higher regard than he was held in the UK. All we know is that there was a copy of Vattel in the Boston public library, and another at Harvard University, and apparently several members of the Massachusetts Provincial Congress read it in 1775. It may be that some of those members ended up being delegates to Philadelphia in 1787 and/or to the MA ratifying convention in 1788; or it may not. If so they may have been influenced by it, or not. There’s no indication that anyone else had even read it.
However, Old Airborne Dog’s argument that the notes from the Philadelphia convention show no reference to Vattel in discussions on the “natural born citizen” clause is a half-truth: the truth is that the notes contain no such discussions. It would seem that the phrase was incorporated without any discussion at all, because everyone thought they understood it and the reasons for it and agreed it should go in. Which doesn’t give us any guidance on whether they understood it according to Vattel or to Blackstone.

He only wants to debate Kamala Harris on Fox where he thinks he will face a more friendly audience and softball Qs from the hosts.
The DJT campaign doesn’t know what to do with Harris so they are resorting to the old standby–personal racist attacks on the first Black woman who will likely be the Dem candidate. The DJT MAGA mantra now is that Harris is a “DEI hire”, “she slept her way to the top”, she is a “childless cat lady”–all sorts of nonsense.
There is a lot of speculation as to whether there will be a debate between DJT and Harris. I think there will be at least one debate in September. DJT has little choice. If DJT were to refuse the optics would be horrible–the accusations he is a “coward”, etc. So there will be a debate and the media headlines will probably be “Convicted felon agrees to a debate against a former criminal prosecutor”.
As an experienced debater I have a suggestion for Harris in the debate. When DJT says “the Democrats are destroying America” Harris should laugh out loud. That’s right. We know DJT hates to be mocked or laughed at. That’s why he never attended a DC Correspondent’s Dinner during his 4 years in the WH. Not being treated seriously is DJT’s worst fear and if Harris first laughs at his demonstrably false statements it will drive him up the the wall. Laughter is the best antidote for all of DJT’s lies.
But I’m sure Kamala Harris doesn’t need my debate advice. As an experienced tough criminal prosecutor she knows how to handle con artists who have defrauded investors, those judged rapists and a convicted felon in another case. Unlike Biden in the first debate who stumbled in answering many questions, Harris will be will be well prepared. Her opening will be something like: “I am the only candidate on this stage who has not been convicted on 34 counts of business and election fraud. I am the only candidate who was not found liable for rape. I am the only candidate who did not try to violently overturn an election to try to stay in power. I am the only candidate who did not steal national defense information and then try to hide those documents from the FBI. I am the only candidate who does not admire dictators like Putin and Victor Orban”.
Whatever happens in the DJT/ Harris debate it will not be a fair fight. The public has long tired of DJT’s bombastic performances–short on facts but long on lies and conspiracy theories. Harris knows how to handle narcissistic bullies and she will not be intimidated by the Trumpster!
